RE: Approval of Cedar Creek Center Site Development Plan
Dear Mrs. Lewis:
The Frederick County Planning Department administratively approved Site Plan 9025-96 for the
above referenced site plan on August 5, 1997. This site plan, for the change of use to a 4,375
square foot visitor center, museum and office for the Cedar Creek Battlefield Foundation, meets all
County requirements for development within the BI (Neighborhood Business) zoning district. The
site plan calls for the provision of seventeen parking spaces, parking lot landscaping, landscape
screening, handicap accessibility, and entrance improvements onto Route I I -Valley Pike.
I have provided you with three copies of the approved site plan for your use. Please keep an
approved copy for your files and maintain an approved copy on the construction site. Once the site
development has been completed, you should contact this office to schedule an on -site inspection.

RE: Secondary Review of Cedar Creek Center Site Development Plan
Dear Mr. Andreae:
I have had the opportunity to review the above referenced site plan resubmitted to our department
on June 25, 1996. The following are comments that need to be addressed during the final revision
of this site plan:
1) Please correct the magisterial district.
✓ 2) Please indicate the correct location and dimensions of all required setbacks and yard
areas.
3) Please revise the number of perimeter shade trees required and provided to reflect the
perimeter of the parking area (Point A to Point B). This is the minimum perimeter that
can be allowed on this site.
1 4) Whenever land that is zoned B1 (Neighborhood Business) is to be developed adjacent to
residentially used RA (Rural Area) zoned land, a "B" category buffer is required on the
land that is being developed. The requirements for a "B" category buffer are shown on
the original marked site plan. The required buffer would be impossible to implement on
this site due to the proximity of the existing building (and overflow parking area) to the
adjacent property. However, some form of screening must be provided to reduce the
impact of the development on the adjoining residential property. This may be provided in
the form of a landscaped screen as defined in the Frederick County Zoning Ordinance.
The approximate location of the required screening is shown on your marked copy of the
site plan.
Please revise your site plan to reflect the comments specified in this letter and resubmit one copy
for my review. Once I have verified the information contained on the revised site plan. I will
need all approved review agency comment sheets and five copies of the final site plan for
approval. Comment sheets are required from the following agencies: the Virginia Department of
Transportation. the Frederick County Health Department, the Inspections Department, the
Frederick Countv Fnuineer. and the Frederick County Fire Marshal.

Please identify the proposed use of each area of the building. This information should be
shown on the site plan and must include the floor area, in square feet, of each proposed
use (museum, administration, and retail). Please be aware that an accessory dwelling is
not permitted with a business unless it is occupied by the owner of the business, an
� employee, or an individual employed as a watchman.
1,) Please provide the Floor -to -Area Ratio calculations for this property.
Please show the posted speed limit of Route 11 adjacent to the property.
P6S Please indicate the dimensions of the entrance and exit points to and from Route 11.
Please include the location of any entrances on Route 11 within 200 feet of the
existing entrances. This includes the opposite side of adjoining roads.
106 Please show the location and size of any utility lines associated with the septic system and
well.
Please show the location of any easements on the property. This includes the extent
of the drainfield.
2V The location and nature of all facilities necessary to meet Fire Code requirements shall be
approved by the Fire Marshall.
Please revise the calculations describing the required number of parking spaces. As the
number of parking spaces is based on area of usage, figures consistent with those from
comment thirteen need to be shown in the calculations.
Visitation to the center will exceed the projections shown on the site plan. In order to
accommodate for this and future increased visitation to the center, additional parking
should be provided at this time. In addition to the automobile parking need, tour buses are
expected on site. As the center becomes more established, visitation from tour buses can
be expected to rise. V.D.O.T. will not permit parking within the Route 11 right-of-way.
Therefore, provisions should be made now to accommodate numerous tour buses on site
at the same time. Fortunately, space is available at the rear of the building to redesign the
parking layout and accommodate additional parking. /
Within the B 1 (Neighborhood Business) zoning district, parking lots shall be paved with
concrete or bituminous concrete. Concrete curbing and gutters shall be installed around '
1Wthe perimeter of the parking lot. Please revise your site plan to reflect these requirements.
Please show the dimensions of all disabled parking spaces and ramps.
25) Please improve the landscaping plan by describing the types and size of plants to be
used. The number of perimeter and interior trees required and provided needs to be
revised to reflect the perimeter of the parking area (Point A to Point B). Also, a three-
foot -high evergreen hedge shall be provided along the perimeter of the parking lot as
shown on the marked plan.
Please calculate the percentage of the site that is landscaped and show this on the site
plan. A minimum landscaped area of thirty-five (35) percent is required within the BI
(Neighborhood Business) zoning district.

27) Whenever land that is zoned Bl (Neighborhood Business) is to be developed adjacent to

Dear Mr. Longerbeam,
As a former member of the Cedar Creek Battlefield Foundation Board
of Directors, I have had the opportunity to see the summary of the
report done by the structural engineer of the recently purchased
Visitor Center on Route 11 in Middletown.
Mr. Thomas A. Lewis, current President of the CCBF has been quoted
as saying the renovations being done are primarily cosmetic. I
agree that renovations are needed to enhance the appearance and
appeal of the structure. However, there are possible ADA
requirements that need to be addressed, as well as tests and
surveys recommended by the engineer regarding electrical, water,
and septic issues. Local residents have said that the building was
once used as a gas station, and there are conflicting stories as to
whether or not the underground tanks were ever removed. Either
way, there may be EPA issues to be considered.
There are many who have not agreed with various decisions made by
the CCBF during the last six months, and I will readily admit that
those decisions and the manner in which they were made prompted my
resignation from the board.
The CCBF does not need the additional headaches of another misstep.
I wish them well, and urge you to do whatever you can to make sure
the necessary standards are met.

once used as a gas station, and there are conflicting stories as to
whether or not the underground tanks were ever removed. Either
way, there may be EPA issues to be considered.
There are many who have not agreed with various decisions made by
the CCBF during the last six months, and I will readily admit that
those decisions and the manner in which they were made prompted my
resignation from the board.
The CCBF does not need the additional headaches of another misstep.
I wish them well, and urge you to do whatever you can to make sure
the necessary standards are met.

project. Our comments may be found on the enclosed set of plans marked in red and as
follows:
1. The southern entrance should be increased to 44' between curb faces to allow easier
ingress/egress for larger vehicles. The north entrance is to be eliminated.
2. The entrance to be constructed on the VDOT right-of-way should show the
proposed elevation by contours and spot elevations.
3. The plans should show proposed drainage (swales or ditches) and include flow
arrow.
4. Erosion control measures should also be shown on the plans.
Please revise and resubmit six copies of the plans for final approval. Should any
changes be deemed necessary, please design them to meet or exceed the above
recommendations.

It will be necessary to slope drainage away from both entrances toward cross culverts
under Route 11. The culvert on the private entrance north of the referenced project
should be uncovered and used to convey site drainage to cross culverts. The plan
needs pavement design and profile details. Other items are marked in red on the
attached plan. More detail concerning bus and camper parking and maneuvering
locations are needed.
Once the plans are revised to meet VDOT standards, please resubmit four copies for

The sewage disposal system proposed to serve the subject
establishment was evaluated today and appeared to be functioning
properly. The septic tank should be pumped at least once every
three years by a permitted pumper, and any system failure must be
reported to this office.
Kelly Vanover, Environmental Health Supervisor, has reviewed the
file on this sewage disposal system and determined that the system
is adequate for the proposed use.
The existing well must be upgraded to a public water supply, if
water is to be supplied to the public. Please contact this office,
if this is proposed.
An adequate number of portable toilets must be provided during
reenactment weekend.
Therefore, in consideration of the above, the health department has
no objection to the proposal as outlined in the Request for Site
Plan Comments and attachments.
