This site plan. approved July 11, 1996, involves the construction of a 15,468 square - foot building. The site plan also includes 130 parking spaces, 5 handicap accessible parking spaces. and landscaping that includes 34 red maples and 112 Japanese holly. CG-2 curbing is to be used in conjunction with the parking facility. As approved, the site will be developed in two phases. Two copies of the approved site plan are enclosed. This will enable you to provide the contractor with an approved copy, and maintain a copy for your records. OF PLANNING NID DEVELWMENT ^ ,' We have completed our review of the subject site plan and offer the following comments: -1. Sheet 1 of 3: Add a note to the erosion and sediment section indicating that the contractor will be required to obtain a land disturbance permit from the Department of Public Works prior to initiating any earthwork. The fee for the permit will be waived if the site plan has been approved by the Board of Supervisors prior to initiating the earthwork. ,2. Sheet 2 of 3: Relocate the proposed drainage swale originating from the proposed 15 inch CMP to the west of the proposed detention pond embankment. 3. Sheet 2 of 3: Add a rip -rap berm on the upstream side of the 24 inch 0 CMP outlet pipe to serve as a sediment trap during construction. The berm should be approximately 18 inches in height and positioned in such a manner to create a semi -circle with a diameter of approximately eight (8) feet. Sheet 2 of 3: Install a rip -rap check dam approximately two (2) feet in height downstream of the existing pond prior to breeching the existing dam. Site inspections are necessary followinga site's disturbance and constructionto determine compliance with the approved site plan and the Zoning Ordinance. During this visit, I observed that the parking lot surface had not been treated with the required surface treatment material. As I have discussed with Max Clatterbuck of the Lantz Construction Company of Winchester. the site was prepared and constructed as approved by the site plan; Lantz did construct the parking lot as illustrated by the site plan. But, the approved site plan did not address the parking lot surface requirement as stated in the Frederick County Zoning Ordinance. The Zoning Ordinance must be complied with at all times. The oversight on the part of the review and the approval of the site plan does not negate the requirements of the Zoning Ordinance and their application to a site. The Frederick County Zoning Ordinance, Chapter 165, Section 27.E(1), requires that the surface material for parking lots located in the RP (Residential Performance) Zoning District. as this site is. must "be paved with concrete, bituminous concrete, or similar material." This site does not compl} ; the site has been paved with a double prime -and -seal treatment. This department will allow for the issuance of the Certificate of Occupancy for Phase I of the sites development, as the site does comply with the approved site plan. When the development of Phase II is initiated, and prior to the issuance of a Certificate of Occupancy for the Phase II improvements. the entire parking lot shall be upgraded to the required surface material: pavement with concrete, bituminous concrete, or similar material.
