Secretary of Natural Resources Valley Regional Director July 20, 1999 CERTIFIED MAIL Return Receipt Requested Mr. Dale Clift, District Manager Flying J Travel Plaza 1011 North Mountain Street Blacksburg, S.C. 29702 RE: Flying J Travel Plaza VPDES Permit No. VA0089214 Dear Mr. Clift: We are very concerned about recent losses of wastewater solids and grease to Duncan Run from your Clear Brook facility. Our records indicate a significant solids loss on or about June 25th, and a second solids loss on or about July 14th. We understand that a third solids loss was imminent earlier this week. The State Water Control Law and the VPDES Permit Regulation make it unlawful to discharge sewage, industrial wastes, other wastes, or any noxious or deleterious substances into state waters, except as authorized by a permit. Va. Code § 62.1- 44.5; 9 VAC 25-31-50(A). Your permit only allows discharges of treated wastewater that meet the specified limits for BOD, suspended solids, TKN, chlorine, and dissolved oxygen. Discharge of solids is specifically prohibited. We had hoped that the corrective action agreed to in your recent Consent Special Order would lead to prompt assessment and correction of the problems at your facility. The Consent Order requires clean up of Duncan Run, which has not yet occurred. In fact, because of the two recent solids losses, the stream is now in a more degraded condition than it was when the Consent Order was approved by the State Water Control Board last month. The Consent Order further required an analysis of the plant's design and operations to determine what corrective measures were necessary to prevent future solids losses. four Mr. Dale Clift Flying J Travel Plaza Page 2 company submitted a very general discussion of the plant's operation, but no concrete recommendations for corrective action and no schedule. At our request, Flying J has now retained Patton Harris & Rust to conduct a complete assessment of plant operations, and that report is expected this week. The Department of Environmental Quality is extremely concerned about the continuing pattern of non-compliance at this facility. We must have your commitment to a schedule of compliance for correcting all the above deficiencies. We want to see clean up of Duncan Run commenced immediately. We have reviewed the proposal from Alken-Murray to use a bacterial bioremediation product to clean up the solids and grease in the stream, and feel we cannot approve it. It appears that any product placed in the stream will flow immediately into groundwater. We do not have sufficient documentation to assess the potential impacts to groundwater resources from the use of this product, so we feel the safest option will be physical removal of the solids and grease. We are also concerned about the quality of the wastewater being discharged from your facility. General effluent quality is good, but the periodic nature of the solids losses is difficult to assess. The State Water Control Law and regulations require permit sampling to be representative of the monitored activity, 9 VAC 25-31-190(J)(1), and allows us to require submittal of pertinent information necessary to determine the effect of the wastes from your discharge on the quality of state waters. Va. Code § 62.1-44.21. The once per month sampling now required by your permit is insufficient to accurately assess the quality and the environmental impact of your discharge. Accordingly, we request that you immediately install an automatic sampler to allow the taking of 24-11our composite samples for BOD, suspended solids, and TKN. This sampling should be conducted daily until all corrective action has been completed and plant operations have been stabilized. At that point, with DEQ's concurrence, you can resume permit - required monthly monitoring. We would also like to see a concrete schedule for corrective actions for the wastewater plant as soon as the Patton Harris assessment is complete, and a good faith commitment on your part for carrying out any necessary actions promptly. Please provide Lis with a Written summary of corrective actions to be taken to fix the grease trap problems. To resolve the problem of grease in the treatment plant and the consequent growth of Nocardia preventing solids from settling, the Alken-Murray product (or one similar) may be used in the treatment plant only. You have verbally agreed to pump and haul the effluent from the grease trap (restaurant Wastes) until the grease problems have been resolved. Please continue this practice until DEQ concurs With halting it. Additionally, (lows to the wastewater plant have been higher than originally anticipated during the design of the plant. We ask that you take action to reduce Wastewater flows to the plant if hydraulic overloadim-, is contributing to the plant's violations. It would be appreciated if you could inquire further on the possibility of Flying J contributing to the improvement of the bridge on Route 669 that spans Interstate 81 at the White Hall Interchange. Due to the heavy volume of truck traffic, increasing traffic congestion problems are occurring. An estimated construction cost to improve the bridge from two lanes to four lanes is approximately $4.8 million. Frederick County and the Virginia Department of Transportation have recognized the significance of this problem and have identified $2.3 million for this project. It would be appreciated if Flying J could commit to the remainder of the cost for construction of this much needed improvement. Riley, Jr. County Administrator County of Frederick 107 North Kent Street Winchester, VA 22601-5000 Ref: Flying "J" Route 669, Frederick County Dear Mr. Riley: On August 6, 1999, we completed cleaning out the silt buildup in Duncan Run between the north and south bound lanes of I-81. The channel was restored to its post I-81 construction condition and includes filter fabric, erosion control stone and silt fence. The firm cleaning the sludge, The Salem Group, Inc., has apparently completed their cleanup responsibility. However, VDOT is concerned with the quality of work performed. The south bound boxes under I-81 were not completely cleaned as promised. The riprap placed in the channel to the west was excavated and replaced in a haphazard manor. VDOT will request the riprap channel be restored to the original condition prior to cleanup. I've reviewed the location of the existing "No Parking" signs and have found the need for an additional sign on Route 669 opposite the Flying "J" store. This sign will be installed as soon as our Sign Foreman can work it into his schedule. All areas disturbed by The Salem Group, Inc. and other Flying "J" contractors should be seeded and mulched. I would like to again state VDOT is not satisfied with the traffic flow on the Flying "J" site. We will only endorse corrective measures which will reduce traffic backups on Route 669 and the I-81 off ramps. We are open to offering review assistance and comments regarding additional entrances on Zachary Ann Lane, etc. Please pass on our concerns to the appropriate individuals within the Flying 'J" organization. The fence does not enclose the entire perimeter of the propane tank. • Item #5: The accessory building located near the water tank has been located and added to the plan. There is no sign affixed to this building. • Item #6 The existing dumpster on the western edge of the parking area has been removed from the site.
