application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is
complete. If any portion is not included or complete, the site plan application will not be accepted

Dear Steve:
I have had an opportunity to conduct a review of the above referenced plan, resubmitted to this office
on March 4, 1997. Previous concerns continue to exist, as do new concerns that have materialized
following your recent site plan revisions. The following comments will need to be addressed in
order to proceed with site plan approval.
Please provide clarification to the following items, previously addressed in a letter from this
department dated July 22, 1996:
1. Item 4: "Location, height, and specifications of existing and proposed outdoor
lighting fixtures."
2. Item 9 and 10: "Calculations describing the required number of parking spaces. My
initial review indicated that 48 spaces were required for the site." While the Parking
and Loading Requirements summary concur with the required number of parking
spaces, the location of the parking spaces has not been addressed. Note: Drive-thru
and stacking lanes do not count toward the parking requirement; and "Existing
Parking" indicated between the gas pumps and Route 277 presently do not exist, nor
is it permitted by the Zoning Ordinance.
Item 11: "Details of the disabled parking spaces, signage, and ramp.' The revised
site plan has relocated the disabled parking spaces. But, signage and ramp details
have not been provided.
4. Item 12: "Landscaping plan for the site. Should include calculations pertaining to
required plantings, location for planting, and description of each plant proposed.
Initial review indicates that 18 trees are required for the parking facility (5 on islands,
13 for perimeter)."

Item 13: "Location and description of required buffers and screening. Description
of proposed plantings (type, minimum caliper/heightat planting)." Item 19: "More
details for the proposed landscape screening (distance between plants, plant type and
number). Initial review indicates that the screen should be 225 feet long (not
counting existing screen). At 225 linear feet, that requires 23 deciduous trees and 45
evergreen trees." Also, to satisfy the Full Screening requirement, a 6-foot opaque
fence (typically a board -on -board fence) should be installed between the parking area
and the plantings.
6. Item 17: "Dimensions for what appears to be a proposed canopy at the drive-thru".
7. Item 21: "Clarify the phasing proposed. Each phase should satisfy proposed use
parking requirements." My calculations indicate that 29 parking spaces will be
required upon the completion of Phase I. These 29 spaces would account for the
required parking for the existing use, plus that required for the oil & lube service.
Please address the following comments that have resulted from the site plan revision:
8. Installation of a sidewalk along Route 277. As mentioned in Virginia Department
of Transportation correspondence, a sidewalk along Route 277 is a requirement of
Frederick County. Installation of the sidewalk will be required if and when the curb
and gutter on Route 277 are reconstructed or modified. The revised site plan
indicated that a CG-12 curb will be installed and that curb and gutter will be replaced
along this portion of Route 277. Therefore, the installation of a sidewalk will also
be necessary at this time.
9. All parking bays should be provided a raised 9-foot wide landscaped island. This
was previously provided on the site plan. Please include the raised islands on the
most recent site plan submission. In particular, the islands should be provided:
A) adjacent to the car wash facility;
B) between the oil & lube office and the car wash facility, separating the
parking from the oil & lube stacking lanes;
C) between the loading area and the oil & lube office, at the end of the
parking bay;
D) along the west perimeter of the oil & lube stacking lanes;
E) and at the end of the proposed parking bay adjacent to the future
drive-thru addition to the existing Red Apple Country Store. Islands painted
on the asphalt are not acceptable.
10. Provide a detail of the proposed surface treatment.

11. Address the technique that will be exercised to allow stormwater to flow from the
proposed asphalt surfaces. In particular, it appears that the flow will be towards the
car wash facility. How is the stormwater to flow beyond the curb and gutter?
12. Provide a statement indicating that all utilities (electric and telephone) will be buried
underground.
13. Provide a statement similar to "This site plan shall expire 5 years from date of
approval".
Enclose you will find a copy of the site plan that I have red -inked. Please address the comments of
both this letter and those found on the red -inked site plan. Please revise your site plan to address
these comments, and the comments provided to you by the review agencies. My files indicate that
the Inspections Department has not approved the site plan.
You will also need to provide this office with an approved comment sheets from all required review
agencies. Once all agency comments have been addressed, please resubmit one copy of the revised
site plan to this department for final review. If the site plan satisfies all agency comments, the
Planning Department included, we will request five copies of the final site plan and recommend the
site plan for approval.

At our April 24, 1997 meeting you posed two questions concerning the possible
signalization of the referenced intersection. The first was concerning cost and what
your share (50%) would be under a signalization agreement. The total cost would be
approximately $90,000.00. Therefore, your share would be $45,000.00.
Secondly, you were concerned with stacking right and left turning vehicles on
Route 1085 would block patrons trying to enter your property through the Route 1085
entrance. While this is certainly a valid concern, this issue can only be addressed when
the signal plans are developed. If at all possible, the stop bars can be adjusted to fit field
conditions. However, we cannot guarantee at this early stage that this could be done to
completely satisfy your concerns. I would like to point out though if signalization at
this location becomes a reality we would not want your patrons blocking south bound
Route 1085 motorists. All factors will need to be considered in our final design.

me know.

Dear Steve:
I have reviewed the above referenced site plan, submitted to this office on July 3, 1996. The
following comments will need to be address in order to proceed with the site plan review
process. Please provide:
1. Name, address, and phone number of the developer.
2. Zoning of the adjoining properties.
3. Location of all proposed and existing signs. This would include proposed traffic
flow/directional signs.
4. Location, height, and specifications of existing and proposed outdoor lighting
fixtures.
5. Location of additional outdoor trash receptacles and enclosures. Is the existing
facility adequate to handle the proposed oil & lube and carwash?
6. Use of all buildings.
7. Posted speed limits of adjacent roads.
8. Location of all entrances on adjoining roads within 200 feet of the proposed or
existing entrances. Satisfy entrance distance requirements.
9. Calculations describing the required number of parking spaces. My initial review
indicated that 48 spaces were required for the site.
10. Location and dimensions of all parking and loading spaces. Parking spaces
should satisfy the 180 square foot requirement. The proposed loading space does
not satisfy dimensional requirements. The proposed loading space should sit atop
a concrete slab.

14. Curb and gutter along the perimeter of all paved surfaces. CG-6 is standard.
15. Minimum stacking requirements for the oil and lube, and the drive-thru.
Minimum stacking for the oil and lube is 40 feet (2 cars). And for the drive-thru,
100 feet (5 cars).
16. Minimum drive lanes of 12 feet. This is most applicable along the southern and
western edges of the proposed facility.
17. Dimensions for what appears to be a proposed canopy at the drive-thru.
18. More information concerning the proposed car wash. As presented, there is no
vehicular access or utilities for this use. Either provide the essential information
or remove the use from the site plan.
19. More details for the proposed landscape screening (distance between plants, plant
type and number). Initial review indicates that the screen should be 225 feet long
(not counting existing screen). At 225, that requires 23 deciduous trees and 45
evergreens. Also state that deciduous trees should contain minimum calipers of
2.5 inches at planting. Four -foot heights for evergreens.
20. Dimensions of proposed sidewalks (widths and depths).
21. Clarify the phasing proposed. Each phase should satisfy proposed use parking
requirements.
22. Pavement stripping and directional arrows to provide safe traffic flow.
Enclose you will find a copy of the site plan that I have red -inked. Please address the comments
of both this letter and those found on the red -inked site plan.
Please revise your site plan to address these comments, and the comments provided to you by
the review agencies. The agencies reviewing this plan should include: the Planning
Department, Virginia Department of Transportation, Sanitation Authority, Inspections
Department, Public Works Department, and Fire Marshall.
You will also need to provide this office with an approved comment sheets from all required
review agencies. Once all agency comments have been addressed, please resubmit one copy of

referenced project. T_he plans appear satisfactory and are approved. Please advise the
developer accordingly.
I offer the following comments:
• A preconstruction conference be held by you and/or the developer with the
attendance of the contractor, various county agencies and VDOT shall be
conducted prior to initiation of work.
• Materials used and method of construction shall apply to current observed
VDOT Road & Bridge Specifications applicable during construction of this
development.
• Our review and comments are general in nature. Should conditions in the field
exist such that additional measures are warranted, such measures shall be
completed to the satisfaction of the Department.
• The contractor shall notify VDOT when work is to begin or cease for any
undetermined length of time. VDOT will also require 48 hours notice for
inspections.
• The appropriate land use permits shall be obtained before any work is
performed on the State's right-of-way. The permits will require a minimum
processing fee, surety bond coverage, and the salary and expenses of a State
assigned Inspector.
• The intersection of Route 277 & 1085 will need to be striped to provide a left turn
lane. You have been provided a copy of the plans showing the suggested
method of pavement marking. Our District Paint Crew can perform this work

• Although signalization of the intersection of Route 277 & 1085 is not warranted
at this time, the additional traffic generated by this project may justify
signalization in the future. Therefore, the developer will be required to enter
into a signalization agreement with the Department for a period of five years to
cover 50% of the design and installation costs of a signal if warranted within the
prescribed time period. This matter needs to be addressed prior to the issuance
of VDOT permits to perform work on the project.
• Since Route 277 is classified as a major collector facility, Frederick County may
require the installation of sidewalk along Route 277 frontage. If so, the existing
entrance on Route 277 will need to be upgraded to include handicap ramps.
Additionallv, the curb & gutter may need to be extended eastward to the
property line.

Dear Steve:
In response to Ron Mislowsky's letter dated October 3, 1996, the county treasurer has
devised a procedure by which Frederick County can accept a contribution related to future
stormwater improvements. Basically, Ron's letter recommended that the developer contribute
$2,000 to a fund established to provide improvements to the downstream channel. This
contribution would be made in lieu of providing on -site detention.
The treasurer has indicated that Frederick County has the authority to accept this
contribution and has taken the necessary steps to establish a separate account. To avoid
confusion, we recommend that the check be made payable to the Treasurer, Frederick County,
and routed through the Public Works Department. In that manner, we can attach an explanation
with the check to ensure that it is credited to the appropriate account.
Please let me know if the developer still intends to make this contribution.

• Our review and comments are general in nature. Should conditions in the field
exist such that additional measures are warranted, such iiWasures shall lie
completed to the satisfaction of the Department.
• The contractor shall notify VDOT when work is to begin or cease for any
undetermined length of time. VDOT will also require 48 hours notice for
inspections.
• The appropriate land use permits shall be obtained before any work is
performed on the State's right-of-way. The permits will require a minimum
processing fee, surety bond coverage, and the salary and expenses of a State
assigned Inspector.
• The intersection of Route 277 & 1085 will need to be striped to provide a left turn
lane. You have been provided a copy of the plans showing the suggested
method of pavement marking. Our District Paint Crew can perform this work

Approximately two weeks ago revised plans, as per your letter of September 12,
1996, were resubmitted to your attention for review and approval. All of your
comments are reflected on the revised plans. Your expeditious review and approval of
the resubmitted plans is welcomed since we have started site construction work and
winter weather is closing in.
All recommended review changes have been incorporated in the new plans to
meet or exceed your comments. Comment item number "4" indicates that the
developer will be required to enter into a signalization agreement for five years and
50% of the design and installation costs if warranted. It is my opinion that this
requirement is excessive both in terms of cost and traffic control for the scope of the
proposed project. We are adding, at this time, only a quick lube and oil change service
to our existing store.
Requiring a traffic signal agreement at this time and at this location for a quick
lube/oil change business severely impacts the economic viability of my project. I
would request that you reconsider your comment for a traffic signal agreement in
conjunction with our latest plan revisions for the Red Apple Country Store,
understanding fully that I oppose such an agreement.
I would respectfully ask that you delete the requirement for a traffic signal
agreement.

We have completed our review of the subject site and only have one major concern:
stormwater management. We have approved previous expansions related to the Red Apple
Country Store contingent upon the installation of stormwater management concurrent with any
additional development.
This requirement was documented in previous review comments for the parking
expansion.
Consequently, we will require on -site stormwater detention designed to accommodate
previous construction. As an alternative, we would consider the developer's offer to improve the
downstream channel from the Red Apple Country Store to the Stephens Ridge subdivision. We
cannot grant our approval of the proposed site plan until one of the above alternatives is
implemented.
The existing drainage ditch should be highlighted on the site plan to ensure that the
proposed fill does not adversely encroach on the drainage easement.
I am available to discuss the stormwater management issue if you should so desire.

As requested, we have reviewed the above referenced project's site plan dated
April 9, 1996. Our comments may be found on the enclosed plans marked in red and
as follows:
1. The two proposed entrances on Route 1085 will need to be designed to a minimum
30' width from face to face of gutter pan. Also the radii length should be specified.
2. The proposed curb & gutter along Route 1085 will need to be installed 20' from the
center of the existing right-of-way to face of curb to allow for an ultimate 36' wide
pavement width. Additionally, the existing curb & gutter may have to be adjusted
to meet this offset requirement.
3. The intersection of Route 277 & 1085 will need to be striped to provide a left turn
lane. We have also enclosed a copy of the plans showing the suggested method
of pavement marking. Our District Paint Crew can perform this work on an

6. Presently drainage sheet flows across the Route 277/1085 intersection onto the
property. As designed, the entrance pavement will maintain the sheet flow. You
may want to consider a structure within the Route 1085 right-of-way and pipe to
Structure No. 2 to eliminate the sheet flow. Additional detail including contours
and top of curb elevations will need to be provided.
7. Other miscellaneous comments as marked will need to be addressed.
Please revise and resubmit four copies for final approval. Should any changes be
deemed necessary, please design them to meet or exceed the above
recommendations.

I have reviewed the above referenced site plan, submitted to this office on July 3, 1996. The
following comments will need to be address in order to proceed with the site plan review
process. Please provide:

existing entrances. Satisfy entrance distance requirements.
9. Calculations describing the required number of parking spaces. My initial review
indicated that 48 spaces were required for the site.
10. Location and dimensions of all parking and loading spaces. Parking spaces
should satisfy the 180 square foot requirement. The proposed loading space does
not satisfy dimensional requirements. The proposed loading space should sit atop
a concrete slab.

11. Details of the disabled parking spaces, signage, and ramp.
12. Landscape plan for the site. Should include calculations pertaining to required
plantings, location for plantings, and description of each plant proposed. Initial
review indicates that 18 trees are required for the parking facility (5 on islands, 13
for perimeter).
13. Location and description of required buffers and screening. Description of
proposed plantings (type, minimum caliper/height at planting).
14. Curb and gutter along the perimeter of all paved surfaces. CG-6 is standard.
15. Minimum stacking requirements for the oil and tube, and the drive-thru.
Minimum stacking for the oil and tube is 40 feet (2 cars). And for the drive-thru,
100 feet (5 cars).
16. Minimum drive lanes of 12 feet. This is most applicable along the southern and
western edges of the proposed facility.
17. Dimensions for what appears to be a proposed canopy at the drive-tluu.
18. More information concerning the proposed car wash. As presented, there is no
vehicular access or utilities for this use. Either provide the essential information
or remove the use from the site plan.
19. More details for the proposed landscape screening (distance between plants, plant
type and number). Initial review indicates that the screen should be 225 feet long
(not counting existing screen). At 225, that requires 23 deciduous trees and 45
evergreens. Also state that deciduous trees should contain minimum calipers of
2.5 inches at planting. Four -foot heights for evergreens.
20. Dimensions of proposed sidewalks (widths and depths).
21. Clarify the phasing proposed. Each phase should satisfy proposed use parking
requirements.
22. Pavement stripping and directional arrows to provide safe traffic flow.
Enclose you will find a copy of the site plan that I have red -inked. Please address the comments
of both this letter and those found on the red -inked site plan.
Please revise your site plan to address these comments, and the comments provided to you by
the review agencies. The agencies reviewing this plan should include: the Planning
Department, Virginia Department of Transportation, Sanitation Authority, Inspections
Department, Public Works Department, and Fire Marshall.
You will also need to provide this office with an approved comment sheets from all required
review agencies. Once all agency comments have been addressed, please resubmit one copy of
