As of this date it appears the building pad is on grade and underground plumbing installed. At this writing we have yet to complete our review of the project's site plan nor have we approved any entrance locations. Of equal importance is the fact a final design or location for the service road to serve this and the adjacent First Virginia Bank property has yet to be approved. When considering these factors it is very possible on site modifications i.e. building location, parking lot layout, internal traffic flow patterns, etc. may be necessary to accommodate the service road. We realize the Burger Buster Corporation is anxious to construct their facility. However, providing safe access to the property while maintaining certain levels of service for motorists on Welltovm Pike (Route 661) is of the utmost importance to this Department. We have relayed our concerns about this issue and the desire for a service road to you in writing on at least two different occasions, copies of which I am enclosing for your reference. We would appreciate your cooperation in Withholding any additional County permits until we have had the opportunity to complete our review of the project's site plan and all questions about the access to both properties can be answered. O. Box 601 Frederick County Winchester, VA 22604 Dear Mr. Wyatt: This is to follow-up on our recent telephone conversation concerning the referenced project. As discussed, we have no overall objections to the project provided adequate access to the site is provided and impacts on the adjacent Route 11/37/661 intersection are considered. As you know, we received the project site plan on September 14, 1994 and have therefore only just begun our review. However, after a first glance of the plan we would like to offer the following. There is currently 7,000 vehicles per day on this section of Welltown Pike (Route 661). There is no doubt this project coupled with the proposed Burger King/Amoco Service Station/Car Wash on the property to the southwest will increase this number and further impact the adjacent Route 11/37 signalized intersection. In an attempt to ease the increased burden on the intersection, especially from east bound Route 661 traffic, a service access road concept built partially on our right-of-way was original discussed (see copy of letter to Mr. R. W. Watkins dated June 13, 1994 concerning this issue). The service access road is not being proposed in this design. However, a intra-parcel connector is being provided on the rear of the lot. Although the connector will allow for access between the two properties, we do not believe it will obtain the same desired affect as the service access road concept. Our basis for this conclusion is that a service road in front of a restaurant is certainly more visible and therefore more attractive to motorists. The location of the intra-parcel connector behind the Taco Bell Restaurant and the use of asphalt speed control bumps will most probably deter its use. State law does not allow for the installation of private advertisement signs on highway rights -of -way. Therefore, the sign will need to be relocated to private property. We question the need for a sign anyway when motorists from Route 11/37/661 will have an unobstructed view of the facility. Once we have finished our review of the site plan, we will forward any additional comments to you. W. Clifford & Associates has submitted a plan for a proposed Burger King Restaurant, Amoco Sir -.-ice Station, carwash and office building on the First Virginia Bank properly. Ingram -Tudor & Company has submitted plans for a proposed Taco Bell Restaurant on property owned by Nfr. Paul D. ivfuldo,xney. Both plans specify an entrance onto Welltown Pike (Route 661) at different locations and appear to conflict with one another. We have had several discussions with Mr. C. E. Maddox, Jr. of G. W. Clifford & Associates over past months about a possible joint entrance/service access road onto Route 661 to serve both properies. A large portion of this service access road would be constructed on VDOT right-of-way due to its width at this location. When considering the current alignment of Route 661 and available frontages of the properties involved, this concept may be the best possible scenario. Both parties of course would have to agree to this concept. I* did speak with Mr. Muidowney and Mr. Tudor last week and neither had any knowledge of this joint entrance concept. Knowing the nature of both developers involved and the potential for either project to b°.-ome "fast tracked", I wanted to write and inform you of the situation. Also of concern is the Route 11.3='661 improvement project. We will be taking a hard look at how our plans will affect these two proje--: and vice versa. The approved site plan calls for the construction of a restaurant facility that will be 2,652 square feet, the provision of a paved parking lot complete with 42 regular parking spaces, two disabled parking spaces with appropriate ramping and signage, curb and gutter, direction arrows, and parking lot landscaping (this parking lot will provide a 24 foot wide access lane to the adjoining property in conformance with the proffer agreement), the installation of a franchise sign that will be 35 feet in height and 150 square feet in area, the construction of a private sewage pump station, the provision of an outdoor trash receptacle that will be completely enclosed by six foot high concrete block wall with latched gates, and all appropriate erosion and sedimentation control measures. Enclosed are two copies of the approved site plan. This will enable you to provide a copy to the contractor and maintain a copy for your records. Our department will need your firm to provide a copy of the recorded easement plat required by the City of Winchester Public Utilities Department, the appropriate bond to cover the cost associated with the installation of a future fire hydrant, and the original proffer statement that is signed by the property owner. Staff believes that the following items need to be discussed prior to the recommendation for approval of this site plan: 1) Access - This site is located near the intersection of Welltown Road (Route 661) and Martinsburg Pike (Route 11). This area experiences a high average daily traffic count due to existing land uses and the proximity to industrial parks. The adjoining property owner is in the process of developing plans for a restaurant, service station, and car wash. Staff believes that it is important to provide a connection between these properties. This will provide vehicle access without utilizing the overloaded intersection area. The Virginia Department of Transportation (VDOT) has suggested that an access road be developed in front of the Taco Bell and adjoining property. VDOT will allow this access road to be developed on their right-of-way because they believe that it will function more efficiently. The applicant is proposing an intra-parcel connector in the rear of the site. This is located in the area that is proposed for patron parking, and calls for the installation of a speed bump. 2) Entrance Spacing Requirements - Staff has asked the applicant to indicate the existing entrances along Welltown Road (Route 661) that are within 100 feet of the proposed entrance. Staff needs this information to ensure that the minimum driveway spacing requirements for collector roads is met. STAFF RECOMMENDATIONS OF 10/5/94: Approval, provided that the applicant address all review agency comments, as well as all comments and concerns of the Planning Commission. Sr e QZ/,_`7If 9 Mr. Clinton Ritter spoke positively about Mr. Cook's reputation and ability as a fine mechanic. Mr. Ritter felt that many people in the eastern part of the county used him for their automobile service. He added that Mr. Cook's garage is well -kept and neat in appearance. Because of the high visibility of this parcel from the church, adjoining residences, and the road, Commissioners felt it would be in the best interest of everyone to limit the number of vehicles waiting to be worked on. Mr. Cook said this would not present a problem to him. Upon motion made by Mr. Light and seconded by Mr. Thomas, BE IT RESOLVED, That the Frederick County Planning Commission does hereby unanimously recommend approval of Conditional Use Permit #008-94 of Donald E. Cook for a garage for automobile repair without body repair with the following conditions: 1. All work will take place inside the garage intended for this use. 2. No outside storage of parts or supplies shall be allowed. 3. No inoperative vehicles shall be openly displayed on the property at any time. 4. Hours of operation shall be limited to 7:00 a.m. until 9:00 p.m., Monday through Saturday. 5. All review agency comments must be complied with at all times. 6. No more than six vehicles awaiting repair shall be allowed on the property at any time. Site Plan #016-94 of Taco Bell Restaurant for a proposed restaurant to be located at the corner of Welltown Road (Route 661) and Martinsburg Pike (US Rt. 11). This property is identified as PIN 43-2-A in the Gainesboro District. ACTION - APPROVED WITH CONTINGENCY Mr. Miller said that this area experiences a high average daily traffic count due to existing land uses and the proximity to industrial parks. He said that this is located in the area that is proposed for patron parking and calls for the installation of a speed bump. Mr. Guy C. Tudor, engineer with Ingram -Tudor & Company, was present to represent the owner, Burger Busters. Mr. Tudor said that they did not prefer to use the connection suggested by VDOT, but they were not opposed to the adjoining property owner constructing it. He felt they were severely limited in size to get the required parking and landscaping, as well as the drive -through and vehicular traffic flow. Mr. Tudor said that they have approached the owners of the adjoining bank site and the people they purchased this property from in an attempt to procure additional land, but they were not successful. Commissioners were very much concerned about locating the intra-parcel connector at the rear of the site where there were designated parking spaces and where it might interfere with the drive -through area. There was also concern about the applicant's proposal to place the loading area in the designated handicapped parking spaces area. The Commission understood that this was an extremely limited site, however, they felt they needed to consider the overall impact of this site and the adjacent sites as they relate to the Route 11/Route 661 intersection area. They felt they could not support the site plan as presented and felt that the applicants of both this site and the Holtzman Oil Company site needed to coordinate their design efforts. Mr. Charles W. Maddox, Jr., with G. W. Clifford & Associates, Inc., was representing Holtzman Oil Company, the purchaser of the adjacent site which includes a convenience center, gas station, Burger King restaurant, and a telecommunications office building. Mr. Maddox presented a draft site plan for the Holtzman project and described two options that he felt might be a way that the two sites could function well together for traffic purposes. One of the options provided a free -flowing roadway adjacent to the existing VDOT right-of-way. The Planning Commission realized that the applicant was under time constraints and they were willing to allow the staff to administratively approve the site plan instead of bringing the plan back to the Commission, however, they felt that work needed to be done so there was coordination of traffic flow between the various sites. This property is located off of Airport Road (Route 645) on the north side, just east of Front Royal Pike (Route 522), in the Shawnee District. ACTION - RECOMMEND APPROVAL Mr. Tierney said that the applicant currently has an approved MDP that permits the construction of 117 townhouse units on 22 acres resulting in an overall gross density of 5.3 units per acre. He said that the proposed revision to this MDP calls for the construction of townhouse and garden apartment units for a total of 156 dwelling units, creating an overall gross density of 7.09 dwelling units per acre. Mr. Tierney said that the allowable gross density for residential developments which contain more than 10 acres and less than 100 acres is 5.5 dwelling units per acre. Mr. Tierney said that the applicants were unaware of the density amendment to the RP District that took place in May of 1994 and proceeded with their application and plans preparation under the assumption that the old density requirements were still in effect. He said that the applicant requested that their application be considered to be vested, and as a result, the staff sought an opinion from the Commonwealth Attorney. Mr. Tierney said that the Commonwealth Attorney's opinion stated that the increased density was not a vested right under the previous zoning ordinance and was clearly not permitted under the recent amendment. Upon motion made by Mr. DeHaven and seconded by Mr. Thomas, the Commission unanimously agreed to make Mr. Lawrence R. Ambrogi's letter a part of the official record. (letter follows at end of minutes). The parties involved with the application, Mr. Fred Price of PHR&A, the design company; Mr. Richard Trembly of Silver Development Co., the owners; and Mr. Frank McDermott of Hunton & Williams, attorneys, gave a chronology of events that they felt showed they were acting in good faith. They pointed out some of the economic decisions that were made, such as a sales contract for the 72 apartment units, the investment made on infrastructure, and the applications made for Federal tax credits, that were based on the ordinance before it was revised. DISCUSSION REGARDING A REQUEST FROM TACO BELL FOR A WAIVER FROM BUFFER REQUIREMENTS Action - Approved Mr. Watkins stated that the Planning Commission is being asked to grant a waiver of the provisions specified by Section 165-371)(5) of the Frederick County Zoning Ordinance. He said that this section allows the Planning Commission to waive any or all of the requirements for zoning district buffers on a site plan if the proposed uses are allowed on the proposed parcel and the adjoining parcel. Mr. Watkins said that the required buffer is defined as a B-Category Buffer with full screening; a minimum distance of 50' is required, as well as an opaque screen with landscaping. Mr. Guy C. Tudor, P.E. & L.S. of Ingram -Tudor & Co., P.L.C., said that he was representing Burger Busters, a franchise of Taco Bell. Mr. Tudor said that Taco Bell is interested in developing a new restaurant on PIN #43-2-A, zoned M1. He said that the adjoining parcel, PIN #43-3-D, located on the southwest side, is zoned B2. Mr. Tudor said that this waiver is requested as a fall back position by Taco Bell, as they are planning to rezone the property to B2 in the near future. There was no public comment. Mr. Watkins said that this section permits the Planning Commission to allow other means of motor vehicle access provided that left turns are restricted and one-way travel is ensured. He said that the spacing requirements for entrances on arterial highways with speeds greater than 35 miles per hour is 200' . Mr. Charles E. Maddox, Jr., of G. W. Clifford & Associates, said the First Virginia Bank is currently located on this property. He said the owner plans to develop a fast food restaurant and a convenience store with gasoline pumps. Mr. Maddox said that the proposed new entrance will connect to Martinsburg Pike (Route 11 N) and is less than 200' from the existing commercial entrance. Mr. Maddox said that a waiver of the spacing requirement (for a commercial entrance on an arterial, highway) is needed. The Commission was concerned about the traffic problems in this area. The proposed aisle widths need to be a minimum of 22 feet when the dimensions of the regular parking spaces are adjusted. The two regular parking spaces that are closest to the proposed entrance need to be adjusted so that there is no conflict with the row of sixteen parking spaces to the north. The current design will create problems where these rows meet each other. 15) Fourteen shade trees need to be provided around the perimeter of the parking lot. All raised islands need shade trees as well. It appears that some of the proposed landscaping will be located off -site. This needs to be approved by the property owners prior to any planting. The Frederick County Planning Commission has requested the opportunity to formally review this site plan. In order to accomplish this, our department will need you to provide the site plan application, the site plan review fee, a copy of all review agency comments, and seventeen copies of the site plan for distribution. This will enable our clerical staff to place this site plan on the next available Planning Commission agenda. The review agency comments do not need to be approved in order for you to submit for the Planning Commission meeting. Our comments may be found on the enclosed plans marked in red and as follows: Since visibility to the restaurant is not obstructed from Route 661 /11 /37, the proposed entrance sign cannot be allowed on the State's right-of-way. 2. The pavement design on the right-of-way will need to be increased to provide a minimum 8" of 21-B base aggregate and the typical section revised to reflect such. A minimum 6' shoulder to remain consistent with the existing shoulder width on Route 661 will be required along the right turn lane and taper. 3. Due to the flatness of grade in the area spot elevations will need to be shown along the center line and edge of Route 661 as noted to determine the full extent of required entrance and turn lane improvements. 4. Based on the pipe inverts and finished grade given, you provide only 0.2' of cover over the twin 15" diameter entrance pipes. Some method of strengthening the pipes is necessary. We recommend the pipes be backfilled with Class A-3 concrete. 5. Due to drainage problems we have experienced in this area over the past years, extensive grading on the Route 661 right-of-way may be needed to ensure positive drainage is obtained/maintained. Existing ditch elevations 100' upstream and downstream of the site will need to be shown. The 43of H.D.P.E. pipe on the Route 661 right-of-way will need to be changed to reinforced concrete Class III. 7. Additional detail of the proposed water services within the right-of-way will be required. Also, if the existing City of Winchester water service to the property is no longer needed can this water line be abandoned/removed from the right-of-way? 8. The proposed method of addressing the existing gravel entrance into the Muldowney property is unacceptable. This entrance will need to be upgraded to minimum commercial standards with adequate drainage culvert(s) provided. The proposed right turn lane will need to be extended across the entrance and 3:1 taper started on the north side. The entrance pavement design should match that of the right turn lane and your survey extended to include the entrance location, design and necessary grading. 9. Other miscellaneous comments as marked will need to be incorporated into the plan. 10. Since our meeting with Frederick County Officials on October 20th, we have received a site plan from Mr. C. E. Maddox, Jr. of G. W. Clifford & Associates which details a joint use entrance and two-way access road along the Route 661 right-of-way line to the adjacent Holtzman property. As you are aware it has been our position all along that a two-way access road would best serve the needs of both projects as well as motorists on Route 661. While we have just started our review of Clifford's plan and cannot speculate on the final design or approval, it does appear Mr. Maddox has kept your design in mind. To prevent further delays to your client in obtaining site plan approval, location of the access roadway will not need to be shown on your plan. However, to protect everyone's interests the following note will need to be added to the plan: "Burger Busters, Inc. acknowledges the joint use entrance and access road concept as proposed by the adjacent First Virginia Square Developers and agrees to any entrance modifications as deemed necessary by VDOT in' order to accommodate said joint use/access road. As of this date it appears the building pad is on grade and underground plumbing installed. At this writing we have yet to complete our review of the project's site plan nor have we approved any entrance locations. Of equal importance is the fact a final design or location for the service road to serve this and the adjacent First Virginia Bank property has yet to be approved. When considering these factors it is very possible on site modifications i.e. building location, parking lot layout, internal traffic flow patterns, etc. may be necessary to accommodate the service road. We realize the Burger Buster- Corporation is anxious to construct their facility. However, providing safe access to the property while maintaining certain levels of service for motorists on Welllown Pike (Route 661) is of the utmost importance to this Department. We have relayed our concerns about this issue and the desire for a service road to you in writing on at least two different occasions, copies of which I can enclosing for your reference. We would appreciate your cooperation in withholding any additional County permits until we have had the opportunity to complete our review of the project's site plan and all questions about the access to both properties can be answered. Our basis for this conclusion is that a service road in front of a restaurant is certainly more visible and therefore more attractive to motorists. The location of the intra-parcel connector behind the Taco Bell Restaurant and the use of asphalt speed control bumps will most probably deter its use. We realize that this method will accommodate the tight site constraints. However, it also has several disadvantages: a) With time, the voids within the gravel fill are subject to clogging and a reduction in storage volume. For this reason, we recommend that consideration be given to oversizing the detention basin. b) The site is located in a limestone environment which could be subject to solutioning. It is my understanding from reviewing this site plan that it is anticipated that the Taco Bell will be served by tho Frederick County Sanitation Authority. In addition, the Superior Block Company water service will be transferred from the City of Winchester to the Frederick County Sarutation Authority. I have the following comments regarding these issues, Regarding the note on the site plant bldicating the existing water meter to be abandoned by the City of Winchester, I think it would be more appropriate to say that contractor shall abandon existing City of Winchester water service. Abandonment shall be made at tap to existing City water line, 4f course we would like to have the motor returned to us. In addition to this same issue, I note that new meter setter and lateral will be installed for Superior Block and tied to the Sanitation Authority's water main. It would be appropriate that a formal request be made to the City regarding this chango in service.
