RE: Preliminary Site Plan Review - Federal Express Facility
Dear Ron:
I have had an opportunity to review the above referenced site plan. The following
comments need to be addressed prior to final approval of this site plan:
1) Please change Victory Lane to read Victory Road.
2) Please provide the location and dimension for the loading space.
3) Please provide any outdoor areas that will be used as trash dumpsters, compactors,
or recycling containers. Any such area will need to be enclosed by a six foot high
opaque fence with a latched gate.
4) Please provide the location and dimension for any proposed sign, outdoor lighting
fixture, or outdoor storage area.
5) Please provide the location and dimension of any utility easements on this property.
6) Please provide the dimensions, signage, and ramping for the proposed disabled
parking space to ensure compliance with ADA. The minimum parking space
requirement includes a width of twelve (12) feet. A three -foot -wide curb ramp
should be provided to enable access to the sidewalk.
7) The configuration of the parking lot does not comply with the parking lot setback
requirements. As stated in the Zoning Ordinance, parking lots should be located no
closer than twenty-five (25) feet to any road right-of-way. A portion of the parking
lot on this site is only eighteen (18) feet from the Victory Road right-of-way.
Please revise your site plan to address these comments. I will need to receive the site plan
review fee, all approved review agency comments, and five copies of the final site plan in
order to proceed with approval of this project. This site plan will appear on the Planning
Commission Bimonthly Report after we receive the site plan review fee.

This is to acknowledge receipt of the referenced project's revised site plan dated December 6,
1994. It appears all of our earlier comments have been addressed.
The plan is approved contingent upon the proposed Phase 1 8" water main being installed to the
right—of—way/property line. This will eliminate the need to extend the water main within the
right—of—way at a future date.
Please advise the owner of our approval and that the appropriate land use permits may now be
applied for to,cover work within the Route 728 right—of—way. Said permits are issued by this
office and will require a processing fee and surety bond coverage. Permits of this nature
normally take approximately thirty days to process and issue once satisfactory application has
been made.

As requested we have reviewed the above referenced project site plan dated October 7, 1994. Our
comments may be found on the enclosed plans marked in red and as follows:
1.) Your entrance design will need to be revised to include standard CG-7 curb & gutter.
2.) The Victory Lane widening detail will need to be upgraded to include 3" Type BM-2 asphalt
concrete. It should also be revised to include the curb & gutter on the entrances and shoulder
width on the right turn lane noted.
3.) The proposed acceleration lane on the south side of the entrance will need to be eliminated
and a standard 36' taper provided.
4.) To ensure proper coverage a profile of the proposed water and sewer services should be
provided.
5.) The enclosed standard CG-7 specification will need to be incorporated into the plan.
Please revise and resubmit four (4) copies for final approval. Should any changes be deemed
necessary, please design them to meet or exceed the above recommendations.

In accordance with your request letter of November 4, 1994 are given permission to install
a temporary construction entrance at the reference location. This letter is to be considered
your permit to do so.
The following provisions will be required:
Work area protection signage in accordance with the attached while working on the
right-of-way will be required.
• All work on the right-of-way is to be confined to the temporary entrance location only.
A minimum 6" depth of VDOT #1 (2-3 inch stone) course aggregate by 30' in width will
be required. It is to be placed from the edge of pavement and extended back onto
private property far enough to prevent the carrying of mud onto the roadway.
• Positive drainage is to be maintained %tiithin the right-of-way at all times.
Any disturbed areas of the right-of-way or damages to the pavement structure adjacent
to this entrance will be repaired by you to our satisfaction.
• This permit is being issued for 180 days.
All work is to be completed in accordance with the enclosed Virginia Erosion & Sediment
Control Handbook, Specification 3.02.
The entrance is to be installed at the location shown on the site plan prepared by G. W.
Clifford & Associates dated October 7, 1994. I would like to point out this office has yet
to approve this project's site plan. -

Our office has reviewed the site plan forwarded by your office for the above referenced site.
Based on the height and existing ground elevation we do not find that this structure will be an
obstruction to the Part 77 7:1 transitional surface for a precision approach. In addition, the
materials and orientation of the structure do not appear to be in conflict with any hazards to air
navigation.

Please consider the following comments when reviewing this
Request for Master Development Plan:
The Developer should be familiar with and be required to
comply with the provisions of the Frederick County Airport Zoning
District (AP-1) and Airport Support Area (ASA) described in the
Frederick County Comprehensive Policy Plan. The developer should
also be familiar with the provisions and requirements of the
following codes:
Title 15.1 Code of Virginia, Section 489 (Purpose of Zoning
Ordinances) and Section 491.02 (Airport Safety Zoning).
Title 5.1-25.1 Code of Virginia (Permits Required for Erection of
Certain structures.)
As Winchester Regional Airport expands services and
operations, noise associated with such expansion is very likely
to increase. The Airport Support Area established by the
Frederick County Comprehensive Policy Plan is designed to
discourage residential development in the vicinity of the airport
to preclude citizen concerns for noise created by aircraft
operating on, to and from Winchester Regional Airport.
If the developer is planning residential development
adjacent to the ASA or under a flight path used regularly by
aircraft outside of the ASA as they arrive or depart the Airport,
he should be either required or encouraged to insulate all
habitable structures for noise and be required to specifically
address, in the property Covenants and Easements, existing
airport related noise and the probability of increased noise as
airport operations expand.

This is to acknowledge receipt of the referenced project's revised site plan dated December 6,
1994. It appears all of our earlier comments have been addressed.
The plan is approved contingent upon the proposed Phase 1 8" water main being installed to the
right-of-way/property line. This will eliminate the need to extend the water main within the
right-of-way at a future date.
Please advise the owner of our approval and that the appropriate land use permits may now be
applied for to cover work within the Route 728 right-of-way. Said permits are issued by this
office and will require a processing fee and surety bond coverage. Permits of this nature
normally take approximately thirty days to process and issue once satisfactory application has
been made.

Regarding : FEDERAL EXPRESS FACILITY
at the AEROCENTER BUSINESS PARK
The submitted site plan for the Federal Express facility does not comply with the Frederick
County Zoning Ordinance. It is the understanding that the applicant intends to acquire a portion
of the Victory Road right-of-way from the Virginia Department of Transportation. With the
addition of at least 15 feet of this right-of-way land, the submitted site plan will comply with the
parking facility setback requirements of the Zoning Ordinance.
The process of acquiring a portion of the Victory Road right-of-way will involve numerous
procedures. These required procedures are listed below, in the order in which they should be
addressed:
► Written verification from VDOT confirming their abandonment of this portion of
right-of-way.
► Review and an approval recommendation from the Frederick County
Transportation Committee.
► Review, approval and recommendation by the Frederick County Planning
Commission.
► Public hearing at a Board of Supervisors meeting. Approval by the Frederick
County Board of Supervisors. Prior to the Board of Supervisors meeting, the
right-of-way abandonment must be advertised for the public hearing.
Following the abandonment of the right-of-way process, the land must be consolidated with the
main portion of the Aerocenter Business Park parcel. The Aerocenter Business Park must then
be surveyed to reflect this addition of land, and a site plan must be submitted to the County.
Following the submission and approval of the final site plan, the construction permit can be
issued.
A LDP and footing foundation permit may be issued prior to obtaining the right-of-way, under
several stipulations:
1. The County does not hold responsibility for the location of the proposed Fed
Express building
2. That all grading and footing foundation work is at the liability of the applicant
3. The relocation of the proposed parking lot to serve this building is the
responsibility of the owner in the event that this abandonment is not
accomplished.
Frederick County will require a written statement from the owner which describes the intent to
accomplish this right-of-way abandonment and boundary line adjustment. This commitment by
the owner will enable Frederick County to work with the developer to accomplish construction
schedules.

RE: Preliminary Site Plan Review - Federal Express Facility
Dear Ron:
I have had an opportunity to review the above referenced site plan. The following
comments need to be addressed prior to final approval of this site plan:
1) Please change Victory Lane to read Victory Road.
2) Please provide the location and dimension for the loading space.
3) Please provide any outdoor areas that will be used as trash dumpsters, compactors,
or recycling containers. Any such area will need to be enclosed by a six foot high
opaque fence with a latched gate.
4) Please provide the location and dimension for any proposed sign, outdoor lighting
fixture, or outdoor storage area.
5) Please provide the location and dimension of any utility easements on this property.
6) Please provide the dimensions, signage, and ramping for the proposed disabled
parking space to ensure compliance with ADA. The minimum parking space
requirement includes a width of twelve (12) feet. A three -foot -wide curb ramp
should be provided to enable access to the sidewalk.
7) The configuration of the parking lot does not comply with the parking lot setback
requirements. As stated in the Zoning Ordinance, parking lots should be located no
closer than twenty-five (25) feet to any road right-of-way. A portion of the parking
lot on this site is only eighteen (18) feet from the Victory Road right-of-way.
Please revise your site plan to address these comments. I will need to receive the site plan
review fee, all approved review agency comments, and five copies of the final site plan in
order to proceed with approval of this project. This site plan will appear on the Planning
Commission Bimonthly Report after we receive the site plan review fee.

I am enclosing an application for site plan approval for a Federal Express
Facility on Victory Lane, Va. Route 732. The developer is CMI, Inc. A land
disturbance permit and foundation permit have previously been issued.
Four sets of plans are provided. These plans have been revised per review
agency comments. Revised copies have also been returned to review agency's for
final approval.
Please note that this plan does not allow for vacation of right of way along
Route 732. It is our intention to proceed with the site development without the
vacation. If in the future the owners gain that land, the plan will be revised to add a
few parking spaces in front of the building.
