Loudoun Street Winchester, Virginia 22601 RE: Regency Lakes Estates Section "C" Dear Mr. Wyatt: For final approval of the revised site development plan of Regency Lakes Estates, Section "C" and to receive building permit approval for new units in Section "C", the following items are needed to satisfy your department: 1. Complete all required site development improvements such as streets, driveways, seeding, etc. before any units are occupied in Section "C" or bond the improvements that are not complete. There has to be safe public and emergency access to and within Section "C" in addition to an adequate bond. The primary purpose of this requirement is to assure all improvements as planned and approved are in place when there is public occupancy. 2. Make provisions for completing the emergency loop access drive around the "Regency Lakes" connecting with Regency Heights. The primary purpose of this measure is to assure that the roads to Regency Heights will be accepted by the Virginia Department of Transportation (VDOT). For VDOT acceptance of Regency Heights roads, a secondary access, not a VDOT street, must be provided through Regency Lakes Estates. If the dams should ever fail, breaching the main road, this road would provide access to the Regency Heights Subdivision. To comply with the above two stipulations of site plan approval and building permit approval/occupancy the owners must complete all required improvements for Section "C" and need to address completing the emergency access loop connection to Regency Heights. Mr. Evan Wyatt October 171994 • Page 2 Site Planning Improvements To assure compliance with your request, the owners of Regency Lakes Estates have taken the initiative to begin completing all required public improvements for Section "C". To date, all sewer, water and drainage improvements have been installed. All utilities such as TV cable, electric power and telephone have been installed. In addition, all grading and final seeding is complete. What remains to be complete is the asphalt paving for all Section "C" roads that are now completely graded and stoned. By October 31, 1994, I fully expect the majority of work to be completed for Section "C". The final layer of asphalt road surface may not be in place, but the undercoat surface provides a safe and adequate road surface for winter travel, and far exceeds the standards of your zoning subsection 1650-81; C Streets; 2(b) Street Construction requiring only a prime and double seal surface on a six inch base. The owners of Regency Lakes believe that they are in compliance with the site plan requirements and seek approval of the plan as submitted. Regency Lakes will assure that all improvements as required by the zoning ordinance are installed by completing the improvements prior to occupancy as spelled out in Article XVII Site Plans; 165-129; (J). If the improvements cannot be completed prior to occupancy, a bond will be prepared for the yet to be installed public improvements. Proper drainage as well as erosion control standards need to be addressed prior to installation of the emergency access loop. Additionally, since this road will be replaced by the final Regency Lake access drive the location needs to be finally tied down on a site plan as opposed to a master development plan. The site plan will show the final location of the emergency access loop and it's construction and drainage standards. The emergency access loop will be graded with a stone surface capable of supporting vehicular traffic should the dams fail at Regency Lakes. Wayne, it is my understanding that these two items are the only items preventing you from approving the Section "C" site plan for Regency Lakes Estates. The improvements as required are in place and will be ready for your inspection on October 31, 1994. The loop road will be shown on Section "D" and will be installed with your approval planned for February 1995. I also understand that you now have all the deeds and other needed paperwork necessary for the acceptance of Regency Heights roads in the State (VDOT) system. This includes all the roads of Regency Heights and the access road from the Route 7 entrance to the entrance of Regency Heights along the dams of Regency Lakes Estates. At this writing, Regency Lakes Estates does not want to pursue VDOT acceptance of any additional right-of-way except that which you now are pushing for acceptance as above. The design and construction of the emergency loop as part of Section "D" should provide you with the means to have the above referenced roads accepted. Clifford and Associates, Inc. 200 North Cameron Street Winchester, Virginia 22601 RE: Regency Lakes Estates, Section "C" Frederick County, Virginia Dear Scott: We have completed our review of the proposed development and offer the following comments: 1) Revise the project description narrative to reflect the construction of 77 new "mobile" home sites. 2) Revise the dates of construction to reflect a commencement date in the spring of 1994. 3) Sheet 1 of 8: Revise note number 14 to include utility trenches within pavement areas. 4) Sheet 2 of 8: The proposed improvements include replacing the existing pavement on Pyramid Drive to correct existing settlement. This settlement is primarily the direct result of improperly backfilled utility trenches. Also, poor surface drainage has contributed to the degradation of the roadway. It is recommended that the repair of the roadway follow the guidelines indicated on the typical cross- section for private roads. This section includes roadside ditches as well as eight (8) inches of compacted 21A and a bituminous prime and double seal surface course. 5) Sheet 2 of 8: Indicate the inverts of the existing manholes adjacent to MH-A-1-A and MH-D-3. 6) Sheet 2 of 8: Revise the invert elevations indicated for MH-A-1. The indicated inverts are 699.65 and 699.45. We believe these inverts should be corrected to 669.65 and 669.45. 7) Sheet 2 of 8: Refer to the typical unit parking detail. In light of the problems experienced under Pyramid Drive, we strongly recommend the use of crushed stone for backfilling utility trenches within the pavement area. Compaction requirements outlined under note number 14, Sheet 1 of 8 can be applied to the placement and compaction of crushed stone (21A). If the use of crushed stone proves to be uneconomical, we recommend that the on -site weathered shale be used and properly placed and compacted to achieve the desired compaction and minimize long term settlement. We recommend that the shale be placed in maximum four (4) inch loose lifts to facilitate compaction using hand operated compactors. 9) Sheet 4 of 8: Indicate if a turn around area will be required at the end of Lisa's Drive. 10) Sheet 4 of 8: Revise the contours within area DA-F to reflect a mounding effect rather than a depression. 11) Sheet 4 of 8: Indicate a drainage easement behind the mobile home sites (northwest) along Fowler Drive. 12) Sheet 8 of 8: Re-evaluate culvert number one (1). Based on the design flows furnished for Regency Lakes Estates, Section "C", it appears that a 33 inch RCP rather than a 27 inch RCP would be required under Regency Lakes Drive. Also, check the indicated invert out of 600.70. Based on the existing grades, this invert should be 660.7. 13) Sheet 8 of 8: Furnish the design flows and related calculations used to design culvert nine (9).
