WHEREAS, Rezoning H05-06 of Commonwealth Business Center, Lot 2, Ventures 1, submitted by
Grey%Volfe, Inc., to rezone 12 acres from B3 (Industrial Transition Business) District to B2 (General
Business) District with proffers was considered. The property is located at Commonwealth Court (Route
1167), north of the Route 1 1 and Route 37 Interchange, in the Back Creek Magisterial District, and is
identified by Property Identification Number (PIN) 75-A-9113.
WI IEREAS, the Planning Commission held a public hearing on this rezoning on April 19, 2006; and
WHEREAS, the Board of Supervisors held a public hearing on this rezoning on May 10, 2006; and
WHEREAS, the Frederick County Board of Supervisors finds the approval of this rezoning to be in
the best interest of the public health, safety, welfare, and in conformance with the Comprehensive
Policy Plan;
NOW, THEREFORE, BE IT ORDAINED by the Frederick County Board of Supervisors that
Chapter 165 of the Frederick County Code, Zoning, is amended to revise the Zoning District Map to
change 12 acres from 133 (Industrial Transition Business) District to B2 (General Business) District with
proffers, as described by the application and plat submitted, subject to the attached conditions

Ventures I of Winchester, LLC (the applicant) is the owner of a parcel of land which
contains approximately 12 acres of land currently zoned B3. The parcel is located on
Route 1167, Commonwealth Court, off of Route 11. The applicant proposes to rezone
and subdivide the parcel of land, TM# 75-A-91 B, also referred to as Lot 2 of
Commonwealth Business Park. This parcel is a 12 acre tract that is currently zoned B3.
Pursuant to the applicable provisions of the Frederick County Zoning Ordinance, the
undersigned applicant proffers that in the event that the Board of Supervisors of
Frederick County shall approve Rezoning Application # 05-06 for the rezoning of
parcel TM# 75-A-91 B from B3 to B2, the use and development of the subject property
shall be in strict conformance with the following conditions set forth in this proffer except
to the extent that such conditions may be subsequently amended or revised by the
applicant and such are approved by the Board of Supervisors in accordance with the
Code of Virginia and the Frederick County Zoning Ordinance. These proffers shall be
binding on the owner and their legal successors or assigns.
PROFFERS
1.) Generalized Development Plan
The applicant agrees to proffer a Generalized Development Plan (Exhibit 1), dated April
7, 2006, for the purpose of identifying the following proffered conditions.
2.) Extension of Route 1167, Commonwealth Court
The applicant will construct the extension of Route 1167, Commonwealth Court, from
the existing cul de sac through the subject parcel and terminating at the property
boundary between the subject parcel and TM# 75-A-10A. This road extension will be
completed before occupancy of any structure on the property. The road will be designed
to VDOT standards for acceptance into the VDOT Secondary Roads System.
Adjustments in the alignment of the road through parcel 75-A-91 B may be made to
accommodate an alternative subdivision layout provided the extension of the road is in
place prior to the occupancy of any structure on the property.
3.) Dedication of Land for a Future Interchange
The applicant will reserve a portion of the TM 75-A-91 B for the purpose of facilitating the
construction of a new traffic ramp from Interstate 81 southbound to Route 37. No
development of TM 75-A-91B will occur in the areas shown on Exhibit 1. The area of
restricted development contains approximately 48,375 square feet (1.11 acres). Upon
receiving 180 days notice from the Virginia Department of Transportation, the applicant
will dedicate the reserved land to the Commonwealth of Virginia for the proposed
interchange improvements.
4.) Signalization Agreement
The applicant agrees to construct a traffic signal, meeting VDOT standards, at the
intersection of Route 11 and Route 1167. The application understands that Signalization
Agreements typically allow the development of the land to proceed without the

installation of signalization and VDOT will secure actual traffic counts or ;oth'er-traffiq
study to provide the warrants to initiate the design and construction of the traffic signal.
The applicant also understands that he may be required to commit a certain
percentage, or all, of the overall costs of the traffic signal based on past or future
agreements between VDOT and adjacent property. The traffic signal will be operational
prior to the occupancy of any structure on the property.
5.) Storm Water Management
The applicant agrees to construction a storm water detention facility in accordance with
the design standards of the Frederick County Zoning Ordinance. The facility will, to the
extent practicable, provide storm water detention for the entire development area. The
detention facility will be owned and maintained by an association of local land owners.
The association will be established by the applicant.
6). Monetary Contribution to Frederick County Service Organizations
The owner will donate or will cause to be paid to the Stephens City Volunteer Fire
Company the sum of $1,000.00 for impacts to fire control services. This sum will be paid
upon receipt of the first building permit issued subsequent to the approval of this
rezoning for any proposed structure.
The conditions proffered above shall be binding on the heirs, executors, administrators,
assigns, and successors in the interest of the owner. In the even that the Frederick
County Board of Supervisors grant this rezoning and accepts these proffers, then these
proffers shall apply to the land rezoned in addition to the other requirements of the
Frederick County Code.

• Ventures I of Winchester, LLC (the applicant) is the owner of a parcel of land which
contains approximately 12 acres of land currently zoned B3. The parcel is located on
Route 1167, Commonwealth Court, off of Route 11. The applicant proposes to rezone
and subdivide the parcel of land, TM# 75-A-91 B, also referred to as Lot 2 of
Commonwealth Business Park. This parcel is a 12 acre tract that is currently zoned B3.
The owner wishes to have this property rezoned to B2 to accommodate preferred land
uses within a future subdivision of the land. The proposed layout and division of the
parcel can be seen in Exhibit 1 of the rezoning application. The applicant recognizes
that good planning practice demands that consideration be given to local traffic patterns
and to the management of storm water runoff. Therefore, Rt. 1167, Commonwealth
Court will be extended to the adjoining parcel to the south. See Proffer 1. Land will be
reserved for the future construction of a new interchange between Interstate 81 and
Route 37. See Proffer 2. The applicant will enter into an agreement with VDOT to
provide funding for a traffic signal at the intersection of Route 11 and Route 1167. See
Proffer 3. To the extent practicable, a storm water management facility will be
constructed on the land to provide storm water control for the entire development. See
Proffer 4.

The above -referenced site plan was approved on August 8, 2006. The site plan is
approved for the construction of a 57,730 square foot Gander Mountain store on
Commonwealth Court (Route 1167). Required site improvements include the following:
• Construction of a parking lot with 283 spaces (including eight handicap
accessible), including curb and gutter, landscaping, sidewalks, striping, and
handicap access.
• Construction of the Commonwealth Court extension and roundabout.
• A zoning district buffer that consists of a 50' full screen adjacent to the Sportsplex
property.
• Three loading spaces.
• A three foot evergreen hedge row will be required as indicated on sheet 7.
Prior to occupancy of the Gander Mountain building, the following must be completed:
(1) the 5.933 acre Gander Mountain parcel must be created, (2) the right-of-way for the
Commonwealth Court extension must be created, and (3) the 1.1 acre area adjacent to I-
81 must be dedicated. I am providing you with four (4) copies of the approved site plan.
Please forward these copies to the appropriate representative(s). Furthermore, advise the
owner(s) that a copy should be kept for future reference, and an approved copy must be
kept on the construction site throughout the development process. Once site development

Thank you for taking the time to meet with us regarding this project in Mike Ruddy's
office on March 22.
Please be advised that Gander Mountain has conducted traffic counts at six of their stores
that are approximately the same size as the store planned for Winchester (57,300 square
feet). They have found that their counts are very much in line with the trip generation
rates for a specialty retail store from the 2003 ITE Trip Generation Reports. We assume
that you have access to this report. If that is not the case, please let me know exactly what
additional information you need from us.
The addition of a traffic control light at the intersection of U.S. Route 11 and
Commonwealth Drive is a requirement of the lease with Gander Mountain; thus making
this project contingent upon the addition of this traffic control light. We would appreciate
your input at your earliest convenience as we are moving ahead and spending money as
though this will be approved.

A VDOT review has been completed on the final plat dated o9/19/o6 for the referenced project. The
plat appears to reflect the information shown on the approved project plans and is therefore approved
by this letter.
The application for subdivision of this property appears to have a measurable impact on Route 1167,
Commonwealth Court, the VDOT facility which would provide access to the property.
Before development, you will need to contact Mr. Bill Stover, Maintenance Superintendent at our
Stephens City Headquarters at (540) 869-11oo to secure the necessary private entrance permits.
Entrances will have to be constructed to VDOT minimum standards to allow for safe egress and
ingress of the property.
We are returning five (5) signed copies of the plat to your office, one copy is being retained for our
.work file. Please provide one copy of the plat of dedication fully signed and recorded at
the appropriate County Clerk's Office prior to the issuance of any land use permit from
VDOT.

Along with this letter you will find one set of revised plans for the Gander Mountain site plan.
The revisions address your comments contained in a letter dated July 24, 2006. The revi-
sions are as follows:
1. Requiring that the subdivision occur prior to site plan approval will add more time to
the approval process. Typically, land owners need assurance of the site plan approval
before they permit the subdivision of their land. Where in the Frederick County Ordi-
nances is it required that subdivision occur prior to site plan approval? Your letter
states the 1.1 acres along 1-81 be dedicated to the County. This does not seem to re-
flect the proffer as stated in Rezoning #05-06. Please explain.
2. Note 12 on Sheet 1 states that the utilities be installed underground.
3. The buffer between the site and the Sportsplex is 25' and 25'.
4. Additional screening plants have been added for the outdoor storage area.
5. This is not an entrance. It is a temporary, hammerhead turn -around requisite to the
termination of Commonwealth Court.
6. The symbol for the hedges has been change to "JV".

Building shall comply with The Virginia Uniform Statewide Building Code and section 309, use
group M (Mercantile ) of the International Building Code/2003. Other code that apply are ICC/
ANSI Al 17.1-2003 Accessible and Usable Buildings and Facilities.

Dear Mr. Lewis:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can
be granted. At this time, administrative approval cannot be granted. This site plan is denied until the
issues in this letter, as well as all issues of the other review agencies, have been adequately addressed.
Please review Staffs comments listed below and then prepare a revised site plan which adequately
addresses each concern.
Review Comments:
1) Subdivision. The subdivision for the Gander lot needs to be completed prior to the approval of
the site plan. This plat needs to show the Gander lot, the dedication of the 1.1 acre portion of the
property as right-of-way to the County and the creation of the Commonwealth Court right-of-
way.
2) Notes. On the coversheet, a note that states "all utilities must be underground" has not been
provided.
3) Buffers. On sheet 4, the buffer distance between the Gander site and the Sportsplex property
does not add up to 50'.
4) Outdoor Storage. The outdoor storage area shown on the plan needs to be screened. Provide a
detail for the proposed screening.
5) Commonwealth Court. The entrance shown on the western side of Commonwealth needs to be
aligned with the rear Gander entrance, or a note provided that states that when this area develops,
the entrance needs to be moved to align with the Gander entrance.
6) Plant Types. The symbol provided for the hedges does not correspond to anything in the
planting schedule.

Plan. The revisions address your comments contained in a letter dated May 25, 2006. The
revisions are as follows:
1. The category A buffer has been added to the 132/133 property boundary and shown on
Sheet 2.
2. The buffers along the developed 133 are now depicted with an opaque fence and the
detail on Sheet 3 contains the fence.
3. The plant numbers have been revised.

John Lewis asked me to update you on the status of the above referenced project. The following
submissions have been made in reference to this project: The Master Development Plan was sub-
mitted on April 17, 2006, the Site Plan was submitted May 3, 2006, and a Land Disturbance Ap-
plication was submitted on May 3, 2006.
As you are aware, we are on a tight schedule and trying to obtain the grading permit by June 1,
2006. To that end, we would appreciate any help or input you can give toward meeting the dead-
line of June 1.

Area Protection Manual.

. Land Use Permit Application, LUP-A2005
. Permit Special Provisions, LUP-SP-2005 (signature required)
. Surety is needed in the amount of $2500.00 and may be submitted using one
of the following methods:
o Form LUP-SB, Land Use -Permit Surety Bond:
• Power of Attorney must be attached.
. Once land use permit has been satisfactorily completed, single performance
insurance bonds are returned to the principal via certified mail.
o Form LUP-LC Irr_e_vocable Letter of Credit:
. Must be issued for a period of two years.
. May be reproduced on bank letterhead, but must be in same format.
. Once land use permit has been satisfactorily completed, letter of credit is
returned to the issuing bank via certified mail.
o Cash Bond:
. Submitted in check form, made payable to VDOT.
. Notice to Permittee Placing a Cash Suretyto be signed.
. Once land use permit has been satisfactorily completed, permittee should
allow at least thirty days for return of cash bond.
o Continuous Surety_: Many contractors have a continuous surety with VDOT that
is drawn upon when applying for various land use permit projects.
In addition, a check in the amount of $40 made payable to VDOT to cover the land use
permit processing fee is required.

they would typically have the owner file for the Temporary Construction Entrance Permit. So I am back in the loop

Dear Mr. Lewis:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can
be granted. At this time, administrative approval cannot be granted. This site plan is denied until the
issues in this letter, as well as all issues of the other review agencies, have been adequately addressed.
Please review Staff s comments listed below and then prepare a revised site plan which adequately
addresses each concern.
Review Comments:
1) Subdivision. The subdivision for this parcel and the 1.1 acre dedication need to be completed
before the site plan can be approved.
2) Notes. On the coversheet, provide a note that all utilities must be underground.
3) Buffers. On sheet 4, the buffers need to be revised. There is a Category A (50') no screen
required between the Gander site and the undeveloped 133 property, and a Category B buffer is
required between the Gander site and the Sportsplex property.
4) Easement. Provide an easement to the 1.1 acre property that is intended to be dedicated to
V DOT.
5) Handicap Parking. The handicap symbols on sheet 7 are hard to see and HC signs need to be
shown.
6) Parking Space Labeling. Revise the labels for the parking space numbers as indicated on sheet
4.
7) Outdoor Storage. If any outdoor storage or display areas are proposed, they need to be labeled
on the plan,

8) Commonwealth Court. On sheet 4, Commonwealth Court is shown as not being constructed to
the property line. The pavement for the road should be extended to the property line as well as
the curb and gutter and sidewalk. Also, the entrance shown on the western side of
Commonwealth needs to be aligned with the rear Gander entrance.
9) Sidewalks. The sidewalks need to be extended as indicated on sheet 4. Handicap ramps along
entrances need to be provided as indicated.
10) Landscaping. On sheet 7, revise the landscaping plan to reflect the Category A and B buffer
requirements as indicated. Also, evergreen trees should be placed along part of the rear of the
store as indicated to screen the loading areas.
11) Plant Types. The hedges are shown as being common cherrylaurel. Please revise to show an
evergreen hedge permitted by the Zoning Ordinance.
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five copies of
the final plan for approval. Comment sheets are required from the following agencies: the Frederick
County Inspections Department, the Frederick County Department of Public Works (County Engineer), the
Frederick County Fire Marshal, the Frederick County Sanitation Authority, and the Virginia Department of
Transportation.
