SITE PLAN APPLICATION CHECKLIST
The checklist shown below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan. It is recommended that applicants
contact the Department of Planning & Development to determine which review

Dear Mr. I-Iowett:
A Notice to comply elated August 24, 2009, was sent to you by certified mail requesting
that you contact this office by September 4, 2009. Consequently, on September 9, 2009,
Enviroiunental Inspector II, Ben Whitlock and I met onsitc, with you and Candy Donovan of
Donovan Trucking and Excavating to discuss the site deficiencies and corrective measures. At
that time, the following deficiencies were discussed:
l . Pond does not appear to have been installed in accordance with the approved plan.
Engineer shall Inspect the pond. Submit report from engineer certifying that pond Is
installed in accordance with the approved plan and will function as designed;
2. Regrade, seed and straw all eroded areas on slopes;
3. Stabilize all denuded areas;
4. Regrade pond to eliminate ruts in the bottom;
5. Stabilize pond in accordance with the approved plan.
These areas shall be permanently vegetated in accordance with the approved plans. You
have until October 6, 2009, to correct these violations.
After the violations have been corrected and you have obtained a new land disturbance
permit, a reinspection of the subject project shall be scheduled with the Frederick County Public
Works Department. Please note that you will be required to reapply for the land disturbance

permit, pay the $700 permit fee as well as the $50 reinspection fee. If the corrective measures

A routine inspection of the subject project was performed on October 2, 2008. The following
violations of the Virginia Erosion and Sediment Control minimum standards and Chapter 79, Frederick
County Code, Erosion and Sediment Control Ordinance were observed:
1. Install erosion and sediment control measures below slope in accordance with the approved
plan. MS-4.
2. Complete stabilization of pond and all slopes at rear of site immediately. MS-1, MS-5 and
MS-7.
During a telephone conversation with Richard Donovan on October 2, 2008, I indicated that these
violations required immediate correction. At that time, I informed Mr. Donovan that it would be necessary
to perform site maintenance as soon as possible to stop the erosion problems. Additionally, I indicated that
the pond needed to be seeded and mulched. Mr. Donovan assured me that the violations would be
corrected immediately. A subsequent inspection performed on October 8, 2008, revealed that the
corrections have not been made.
This letter is to inform you that notice is hereby given that these erosion and sediment control
violations shall be corrected in accordance with the approved plan on or before October 17, 2008. Failure
to comply with this notice will result in necessary legal enforcement action by the locality to effect the
implementation of the approved plan. Please contact this department if there are any questions or to
schedule an inspection upon completion of the work listed above.

gutter, striping, and handicap access.

THIS LEASE AGREEMENT made and dated this day of 20 , by and
between ASH HOLLOW MINI STORAGE, LLC. 1-Iereinafler called LANDLORD, and
hereinafter called TENANT, witnesseth:
LANDLORD does hereby demise and lease unto TENANT unit number , at ASH HOLLOW MINI
STORAGE, LLC in Winchester (Frederick County), Virginia. The term of this lease shall be from month

which the leased space is a part. LANDLORD shall have the right to enter into said unit at any reasonable
time without notice to TENANT to inspect, repair, and maintain the premises, and, if deemed necessary by
LANDLORD, shall have the right to remove and/or move the contents of the storage unit to other suitable
storage facilities.

AUTHORITY TO LOCK OR OTHERWISE SECURE THE LEASED UNIT AND SHALL NOTIFY

RECEIPT REQUESTED, TO TENANT'S LAST KNOWN ADDRESS. THE NOTICE SHALL

Therefore we believe that the perimeter landscaping as shown should
be acceptable. We have also dedicated the entire area of existing
trees at the rear of site into a Permanent Conservation easement.
This provides far in excess, of required tree plantations and feel this
should be an acceptable alternative.

14. We have no Interior Islands with this type of development on which to plant trees.
Interior parking lot landscaping is intended to provide shade for parked vehicles.
We however will have no long term parking with a self storage facility and should
be exempt from the requirement. We are willing to plant some additional trees
along the perimeter of the site.
15. Notes have been added to sheet 6 and we have dedicated the area of existing trees
into a permanent conservation easement.

Upon review of the revised site plan dated, August 14, 2006, we offer the following
comments:
It will be necessary to provide a plan which reflects the existing contours that are legible.
2. Place a note on the plan that indicates that it will be necessary to submit a geotechnical
engineering report for review. The report shall address slope stability, controlled fills and
pond embankment construction. It appears that the entire site contains uncontrolled G11.
Consequently, the report shall provide recommendations for footings, slabs, parking
areas, etc.
3. The plan depicts the pond outfall discharging upstream into the existing stream. It is
recommended that the pond discharge with the flow direction of the creek.
4. The stormwater pond shall be designed as a sediment basin in accordance with the
Virginia Erosion and Sediment Control Handbook standard 3.14. In addition, it will be
necessary to utilize a standard outlet structure for the sediment basin instead of the device
proposed in the plan. Construction of the sediment basin shall be completed prior to
initiating the site work.
5. Provide both pre- and post -developed hydrographs as well as time of concentration
calculations.

6. According to table 5-1 of the VESCH, the Rational Method is not an acceptable method
for generating runoff hydrographs. In the past, Frederick County has allowed this
method; however, the rescinding limb factor of the hydrographs should be at least 2.5 to 1
in order to more accurately represent the typical rainfall distribution. Please use either
TR-55 or revise your hydrograph parameters.
We will reserve our approval until receipt of the above revisions. Please submit one set
of plans for further review and highlight the changes listed above on the revised plan.

appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval. Also please provide four (4) sets of approved construction
plans with signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 762
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of
any/all recorded plats of dedication for drainage easements or additional right-of-way required
for implementation of this proposed project should be provided to VDOT prior to issuance of
any land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty

Dear Mr. Richardson:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Magisterial District. This site is in the Red Bud District, not Stonewall.
2) General Notes. On the coversheet, the following notes need to be provided:
• All outdoor lighting must be shielded to prevent glare onto adjoining properties and road right-of-
ways.
• All utilities must be underground.
• Individual units shall not exceed 1,000sf in size.
• No use, sale, repair or activity other than self storage shall be permitted to occur.
• Unit Spacing — 30'.
3) Environmental Features. There is a creek/stream that runs through the rear of this property and the
grading plan shows that entire area being graded. The zoning ordinance requires a 35' riparian buffer
from the scar line on both sides. The riparian buffer cannot be disturbed and the grading plan needs
to be revised. Sheets 2, 4, 5 and 6 need to be revised to show the buffer.
4) Parking Space Calculation. The parking calculation shown needs to show one space per 5,000sfof
self storage.
5) FAR Calculation. Under the FAR section on the coversheet, it only shows the acreage of the
property; provide the actual FAR.
6) Sales Office. This site does not show a rental office or any public utilities. Provide the location from
where theses units will be rented.
7) Loading, Areas. Striped loading areas in front of the units need to be shown to ensure that the travel
lanes will not be blocked by customers accessing their units.
8) Handicap Parking Width. Handicap spaces need to be a minimum of 12' in width.
9) Si na e. The sign shown on sheet 4 needs to be ten feet off of all property lines.
10) Dumpster Location. A dumpster needs to be provided for the site.
11) RV Parking Area. Many self storage sites have RV storage areas. Indicate if this site is planning to
have RV parking/storage.
12) Stop Sign and One Way Signs. On sheet 4, provide a stop sign as indicated as well as one-way/do

not enter signage and striping so customers do not turn left into the site.
13) Self Storage Landscaping. The landscaping requirement on sheet 6 refers to § 165-44F(3). This site
is not covered by a master development plan and, therefore, the landscaping that needs to be used is
§165-44F(1).
1.1) Parking Lot Landscaping. This site is also subject to the landscaping requirements of §165-
27E(1 ])(a).
15) Zoning District Buffer. Sheet 6 only shows a woodland strip for the zoning district buffer. While
mature woodlands can be used for the zoning district, it needs to be 50'. The woodlands on this
property only appear to be around 20' in width with the remainder on the adjacent RP property.
This buffer needs to be supplemented with a six foot opaque fence and evergreen trees. A silt/safety
fence needs to be shown on sheet 3 and 6 around the trees to be preserved so they are not removed
during the grading process. The grading tiplans need to be revised to show that the trees are not going
to be removed.
16) Plant Sizes. On sheet 6, show the deciduous trees in calipers, not height (two inch minimum).
17) Landscaping Notes. On sheet 6, notes need to be provided that state (1) all planting shall
conform with § 165-36B of the Frederick County Zoning Ordinance (Plant selection, planting
procedure, and maintenance), and (2) any plant substitutions must be approved in writing by the
Frederick County Planning Department.
18) Special Limited Power of Attorney Form. Please have the property owner sign the attached Special
Limited Power of Attorney Form prior to further review or approval. This form should be notarized
and completed to grant the applicant (you) with authorization to represent them for this site plan.
19) Lease Agreement. A copy of the lease agreement for the site needs to be submitted for review by the
Planning Department.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained
on the plan. I will need all approved review agency comment sheets and at least five copies of the final plan
for approval. Comment sheets are required from the following agencies: the Frederick County Inspections
Department, the Frederick County Department of Public Works (County Engineer), the Frederick County
Fire Marshal and the Virginia Department of Transportation.

SITE PLAN CHECKLIST
The Site Plan Checklist, shown below, lists the information which is required to be on each site plan. Site plans which
are incomplete or missing information, will be returned to the applicant (s) for revision.

describes the proposed development.
(2) The name, address, and phone number of the land owner, developer, and designer.
(3) The Frederick County Property Identification Number (PIN) of all lots included on the site
plan.

The number and type of dwelling units included on the site plan for residential uses.
The total land

area and total developed land area of all lots included on the site plan.
(6)
A detailed description of the proposed use or uses of the development, as well as a
description of the existing use or uses.

A reference to any other site plan or master development plan approved by the county for
the site.
(8)
The date the site plan was prepared and a list of all revisions made, including the date and
a description of why the site plan was revised.
(9)
A table of contents including all pages of the site plan.
(10)
A list of all proposed utility providers, with their address, name and phone number.
(11)
An inset map showing the location of the site, along with the location of streets, roads and
land uses within five hundred (500) feet of the property.

A statement listing all requirements and conditions placed on the land included in the site
plan resulting from approval of conditional zoning or a conditional use permit.
