The checklist below indicates all the information ..that needs to be submitted as part of the site plan
application. All required information must.be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).

The Frederick County Planning Department administratively approved the above referenced site plan,
9003-99, on March 31, 1999. This site plan, fora revision to the existing parking lot and facility entrance,
and for the change of use of the existing 30,000 square foot building located to the rear of the property,
meets all County requirements for development within the M1 (Light Industrial) Zoning District. The
site plan also calls for the provision of forty parking spaces, the extension of the access driveway, and
parking lot landscaping.
I have provided you with several copies of the approved site plan. Please forward two copies to the owner
and advise them to keep an approved copy for their files and maintain an approved copy on the
construction site. Once the site development has been completed, the owner should contact this office
to schedule a final site inspection. Please be aware that a Certificate of Occupancy will not be issued for
the facility until all site improvements have been completed or bonded.

On January 12, 1999 an inspector was by your job at the above mentioned address. It was noted
that work was being performed without the proper permits being issued. Your building permit
remains in our pending rack awaiting approval from the Planning and Zoning Department. An
additional mechanical permit is required for the expansion of the sprinkler system. Please make
necessary repair to re -activate the dry sprinkler system immediately.
A stop work order has been placed at the above mentioned job site as of January 13, 1999.
The BOCA National Building Code/1996, Section 117.0 Stop Work Order and
Section 117.1 Notice to Owner: Upon notice from the code official that work on any
building or structure is being prosecuted contrary to the provisions of this code or in an
unsafe and dangerous manner, such work shall be immediately stopped. The stop work
order shall be in writing and shall be given to the owner of the property involved, or to the
owner's agent, or to the person doing the work; and shall state the conditions under which
work will be permitted to resume.
The BOCA National Building Code/1996, Section 116.2 Notice of violation: The code
official shall serve a notice of violation or order on the person responsible for the erection,
construction, alteration, extension, repair, removal, demolition or occupancy of a building
or structure in violation of the provisions of this code, or in violation of a detail statement
or a plan approved thereunder, or in violation of a permit or certificate issued under the
provisions of this code. Such order shall direct the discontinuance of the illegal action or
condition and the abatement of the violation.

The BOCA National Building Code/1996, Section 121.1 Application for appeal: Any
person shall have the right to appeal a decision of the code official to the board of appeals.
An application for appeal shall be based on a claim that the true intent of this code or the
rules legally adopted therunder have been incorrectly interpreted, the provisions of this
code do not fully apply, or an equivalent form of construction is to be used.
Work may resume when the required permits are issued by Frederick County. Please be advised
that this is subject to appeals under Section 121 of the Uniform Statewide Building Code
within the BOCA National Building Code.
Please contact our office within five days of receiving this letter of your intention to resolve this
violation and to schedule a meeting to answer any outstanding questions you may have about this
matter.

We have received your revised site plan dated January 11, 1999 for the referenced
project. It appears all of our earlier review comments have been satisfactorily
addressed. Please advise the owner of our approval. Also, please provide seven sets
of approved construction plans with signed seals for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the
Route 861 right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector.
Once satisfactory application has been made, a permit will normally take approximately
thirty days to process and issue. Should you have any questions, do not hesitate to
call.
