Dear Steve:
The Frederick County Planning Department administratively approved the above referenced site plan,
911-99, on May 19, 1999. This site plan, for the construction of a four -million gallon water storage
tank, meets all applicable County requirements for development within the RA (Rural Areas) Zoning
District. The development of this water storage tank incorporates the waiver of the minimum lot size
and minimum width of access easement granted by the Frederick County Board of Supervisors on
March 24, 1999.
I provided you with several copies of the approved site plan. Please ensure that two approved copies
are forwarded to the property owner and advise them to keep an approved copy for their files and
maintain an approved copy on the construction site. Once the site development has been completed,
the owner should contact this office to schedule a final site inspection.

corporation ("Fruit 1-Iill"), of the one part, hereinafter called the Grantor, and FREDERICK
COUNTY SANITATION AUTIIORITY, a Virginia corporation Organized and existing
under the provisions of the Virginia Water and Waste Authorities Act (§ 15.2-5100), et seg.,
Code of Virginia, 1950, as amended ("Sanitation Authority"), of the other part, hereinafter
called the Grantee.
WIIEREAS, Fruit Hill is the owner of various parcels of land lying and being situate
m Gaincsboro Magisterial District, FI-CCICI-iCl< County, Virginia; and
WI-IEREAS, Fruit 14111 is desirous of conveying a portion of its land to Sanitation
Authority for the location of Sanitary Authority's water storage tank and granting various
water, sewer and other casements relative thereto.
NVITNESSETH: That for and in consicicratioil of the slim of Ten Dollars ($10.00),
cash 111 ]land paid, and other good and ValUablc consideration, the receipt of all of which is
hereby acknowledged, the Grantor does hereby grant, bargain, sell and convey with general
warranty of title, U11t0 the Grantee, its successors and assigns, the following described
property and appurtenances thereuntO belonging:
All of that certain lot or parcel of land, together with the improvements
thereon and the Casements and other appUrtC11a11CCS tI1CrCL1nto belonging, lying
and being situate in Gaincsboro Magisterial District, Frederick County,
Virginia, containing 2.5712 acres and being more particularly depicted as
"F.C.S.A. Tank Site" on that certain plat made by Douglas C. Legge, L.S.,
dated February 22, 1999 (DWG. #PWL-7) attached hereto as Exhibit A and by
reference made a part hereof, TOGETHER WITH a 30' wide permanent
easement and right of way to and from Thwaite Lane and the property herein
conveyed for the following purposes:
A. Vehicular and pedestrian ingress and egress for the benefit of
the "F.C.S.A. Tank Site";
B. Water cascillcnt for the installation, laying, maintaining,
repairing and replacing water lines ]necessary for the
construction, maintenance, use and operation of the water tank
located on the "F.C.S.A. Tank Site"; and
C. Utility casement for the installation and construction of variOl1S

said casement containing 20,800 square feet or 0.4775 acre, across the property
of the Grantor herein depicted as PIN 42-A-180, and which casement is
depicted as "30' Ingress/Egress, Utility and Permanent Water Easement" on
the aforesaid plat attached as Exhibit A, and being a portion of the same
property acquired by the Grantor herein by deed from Jane C. Adams, et al,
dated June 21, 1976 and recorded in the Office of the Cleric of the Circuit
Com-t of FI'cdCrlCk County, Virginia, in Deed Book 459 at Page 844.
Reference is here made to the aforesaid i11Strui11C111S alld the attachments and the
references therein contained for a further and more particular description Of the property
hereby conveyed.
This conveyance is made subject to all duly recorded and enforceable restrictions,
casements and rights of way.
Grantor covenants that it has the right to convey said property to the Grantee; that it
will execute such further assurances of title to said property as may be requisite; that it is
seized in fee simple of the property conveyed; and that the Grantee shall have quiet possession
of said property free from all encumbrances.

Grantor further grants and conveys unto the Grantee, with general warranty of title, the

Grantor herein depicted as PIN 42-A-193 on that certain plat made by Douglas C. Legge,
L.S., dated February 22, 1999 (PLAT: PLAT7.DWG) attached hereto as Exhibit B and by
reference made a part hereof, and which easements are depicted as "Permanent Water &

attached as Exhibit B.

sewer easement and a 10' wide temporary construction casement adjacent to Said water and
sewer casement, said 30' water and sewer easement and 25' sewer easement containing 40,546
square feet or 0.9308 acre, and Said ConstrUCtloll casement containing 14,180 square feet or
0.3255 acre, said 30' wide permanent water and sewer easement extending across the property
of the Grantor herein depicted as PIN 53-A-2 for a distance of approximately 364 feel
southward from Fruit Hill's PIN 42-A-191, at which point the 25' wide permanent Sewer
casement begins, and continuing across PIN 53-A-2 depicted On Sheet 1 of 2 on that certain
plat made by Douglas C. Legge, L.S., dated February 22, 1999 (PLAT: PLAT3B.DWG)

The water and sewer and utility casements granted and conveyed herein by the Grantor
grant to the Grantee the perpetual right to install, lay and maintain water and Sewer lines (and
any other utilities), including the right to go on, over and upon the Said permanent caseIllents
for the purpose of installing, laying, maintaining, repairing and replacing the same as needed.
The temporary construction easements granted and conveyed herein by the Grantor grant to
the Grantee the temporary right to construct the water and sewer facilities described herein

and said temporary construction Casements shall expire upon conlplelioll of construction of
the said water and sewer lines. Grantor shall retain the fight to use its land which 1S subject to
the casements acquired herein in any manner which shall not interfere with the use and
enjoyment of said rights by Grantee. Grantor shall at all times have the right to cross over and
upon the said easements and to use the surface over the casements in such a manner as will
neither injure ]tor Interfere with the COI1Stl-LICt1011, operation or maintenancc Of the Said water
and sewer lines, except that no building or other Structure shall be erected over said permanent
casements unless by mutual consent of the panics or their successors.
The Grantee covenants and agrees that the water and sewer lines (and any other
utilities) to be installed by the Grantee shall be laid in a trench dug within the easenicritS
granted herein, which trench, aftcr the water and sewer lines (and any Other Utilities) are
placed therein, shall be refilled with not less than thirty-six (36) inches of cover over the water
and sewer lines (and any other utilities), and the soil Shall be level with the normal surface Of
the land ill SLlch a manner as not t0 interfere with the normal cultivation of the land. FLII-thel',
Grantcc Covenants and agrees that any aboVC-grolllld valves shall be ill the nature Of, Or
similar to, posts of a sufficient height to be readily visible and shall be clearly marked and
encased in suitable matcrial so as to pl'cvcnt damage t0 Or C1CSlrL1Ct1O11 Of such Valves from
agricultural activities conducted on the land; any damage to or destruction of the valves shall
be repaired by Grantee.
Whenever the enjoyment of its rights hereunder requires Grantcc to disturb the surface
Of the ground, it shall be the obligation of Grantee to restore the same to its condition prior to
being so disturbed at Grantee's expense. The Grantee further agrees to repair or to pay for
any actual damage which may be done tO growing crops, timber, fences, buildings or other
structures directly caused by the Grantcc in the exercise of any of the rights granted herein;
provided, however, that the Grantee shall not be liable for any damages caused within the
easements by the clearing of trees, undergrowth or brush from the easements.

Dear Steve:
The Fhstoric Resources Advisory Board (HRAB) reviewed the above -referenced site plan during their
meeting on March 16, 1999, and offered the following comments:
1. Existing vegetation should be preserved on the site to the greatest possible extent. A
statement to this effect should be included on the site plan.
2. The storage tank should be painted an earth -tone color. It was determined that such
treatment would serve to further mitigate the impact of the structure on the battlefield's
viewshed.

The plat for the subdivision of land for this Xroject has been forwarded to Mr. Eric Lawrence for approval and
is expected to be final approved on the 24 of March, 1999 by the Board. With this schedule in mind, we
appreciate your prompt review so that we can meet an important construction window for this needed public
improvement.
This tank site is located approximately 1,000' ± southeast of Va. Secondary Route 725 (Thwaite Drive) in the
Gainesboro Magisterial District. The project is located on a 2.5 ± acre site with access via a 30' wide right-of-
way. After careful study of the Frederick County land use policy regulations, we conclude that the project site
is within an area designated as Rural Area and located outside of the Urban Development Area Boundary
(UDA) and the Sewer and Water Service Authority (SWSA). We presume that your approval of our plat and
site plan will acknowledge that our use is acceptable under- your comprehensive plan.
