SITE PLAN CHECKLIST
The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).
Site Plan Package
1. One set of approved comment sheets are required from the following review
agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

Dear Austin.
The purpose of this letter is to inform you that the Frederick County Department of Planning and
Development administratively approved the above referenced site plan on April 12, 2001. The
subject site plan was submitted to staff on January 6, 1998. The delay in approval was because all
required review agency comments and a copy of a new recorded plan were not submitted to staff until
recently. The premature construction of the railroad spurs and parking lot constitutes a violation of
the Frederick County Zoning Ordinance. Please advise the property owner that any such future
violation may result in an official zoning violation. There are currently no adverse comments by any
of the required review agencies, however, be aware that you should address any future comment by
these agencies promptly.

a Virginia limited liability company, hereinafter called the
Grantor,
WITNESSETH
WHEREAS, the Grantor is the owner in fee simple of a certain
tract or parcel of land situated in Frederick County, Virginia,
containing 21.0394 acres, known as Lot 42 of Fort Collier
Industrial Park and having the address of 999 West Brooke Road,
said parcel being a portion'' of -'thii--land conveyed to the Grantor
herein by James L. McIlvain!PSr.-7-Ut als, by dead dated
September 18, 1991, of record in the Clerks Office of the
Circuit Court of Frederick County, Virginia in Deed Book 76.6,
Page 73, and being the same parcel created by that certain Deed
of Boundary Line Adjustment dated July 7, 1993, recorded among
the land records of Frederick County, Virginia, in Dead Book 800,
page 577; and
NHBRBAS, the Grantor also owns additional land to the
southwest of said Lot 42, acquired by the Grantor as part of the
same conveyance by James L. McIlvaine, Sr.; and
WHZRBAS, the Grantor now desires to adjust the southwestern
boundary line of said Lot 42 to the southwest, so as to increase
the size of said Lot 42 by 2.5341 acres, to a total size of
23.5735 acres,
NOW THBRBFORS, in consideration of the benefits accruing to
it thereby, the Grantor hereby adjusts the southwestern boundary
line of said Lot 42 to the southwest, so as to increase the size
of said Lot 42 by 2.5341 acres, to a total size of 23.5135 acres,
all as retlected on that certain plat of boundary line adjustment

Dear Gary:
I have reviewed the above referenced site plan received by this office January 6, 1998. The following
comments will need to be addressed in order to proceed with approval of this site plan. Please
provide:
1) Signed and dated certificate of engineer.
2) Confirmation as to the type of pavement proposed for the parking area. Minimum
requirements are bituminous concrete. The plan indicates a concrete surface; is that
accurate?
3) Proposed tree calipers of two inches.
4) Approved Boundary Line Adjustment (gain owner's signature and County approval).
5) Approval comments from the following review agencies: County Engineer,
Inspections Department, Fire Marshal.
Please revise your site plan to address the above comments. Once all comments have been addressed,
please resubmit one copy of the revised site plan to this department for final review. If the revised
site plan satisfies all agency comments, we will request five copies of the final site plan and
recommend the site plan for approval.
