The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).
Site Plan Package
1. One set of approved comment sheets are required from the following review
agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

Date: April 27, 2004
On April 23, 2004, 1 met with the owner of Blue Ridge Barbecue, Mr. M. Brett Payne, at the above -
referenced site to discuss the site plan requirement for the change of use of the former fabrication building
to food packaging. During this meeting Mr. Payne provided me with a floor plan of the proposed food
packaging use and a copy of the Health Department's approval letter for the proposed accessory restaurant
use (see attachments). The accessory restaurant use will consist of a small area in the front of the building,
and will be used only for carry -out and catering.
After discussion with Mr. Payne, and review of the attached information, it appears that a site plan is not
required for the proposed change of use. The 12 existing parking spaces are adequate for the proposed
food packaging use and accessory catering use. Mr. Payne informed me that there will be a maximum of
7 employees at the site at one time. All other conditions on the site appear to be in conformance with the
site plan requirements for the M 1 Zoning District. Therefore, a new site plan for the proposed change of
use is not required by the Department of Planning and Development.

This office has reviewed the blue line prints and specifications for the Breckenridge Barbecue to
be located at 310 Victory Road, Winchester, Virginia. This letter is to inform you of the approval of
said plans as received by the Frederick County Health Department. It also serves to notify you
that before issuing a food service permit for the facility, the following must be completed:
1. Roughly one week before opening the restaurant, a member of our office needs
to perform a pre -opening inspection.
2. Our office must receive a copy of the Certificate of Occupancy as issued by the
Frederick County Building Department.
3. A fee of $40 is needed in order to issue a food establishment permit.

This letter is to inform you that the Frederick County Department of Planning and Development
administratively approved Site Plan #015-98 on May 14, 1998.
This site plan consists of a 5,000 square foot building (4,000 square feet for fabrication, 500 square
foot office, and 500 square foot showroom). In addition, this plan consists of 12 parking spaces
including 1 disabled parking space. Furthermore, landscaping which meets the requirements of the
Frederick County Zoning Ordinance will be installed on the site.
Enclosed are two copies of the approved plan. You may provide your contractor with one copy, and
you may keep the other for your records. Please have the contractor contact our department to
schedule an on -site inspection once all improvements have been completed.

I have reviewed the revised copy of the site plan referenced above. A few revisions need to be made in
order to satisfy our requirements. Please provide the following information:

,/2) Location of outdoor trash receptacles and dimensions of structure (fencing, etc.) required to
enclose receptacles. Per Mr. Lawrence's suggestion, the owner may choose not to install the
receptacle initially, but if trash accumulates on the site, he will be required to install the receptacle
and enclosure that is shown on the site plan.
Please revise your site plan to address these comments, as well as the comments provided by the required
review agencies. Once the revised site plan is satisfactory, I will need all approved review agency
comment sheets and five copies of the final site plan. Please keep in mind that our department needs to
be provided with a copy of an approved subdivision plat before the site plan can be recommended for final

project. It appears all of our earlier review comments have been satisfactorily
addressed. Please advise the owner of our approval.
Any drainage easements required to complete the construction on the project
should be dedicated prior to issuance of VDOT land use permits.
The appropriate land use permit may now be applied for to cover work within
the Route 728 right-of-way. The permit is issued by this office and will require a
minimum processing fee, surety bond coverage, and the salary & expenses of a
State assigned Inspector.
Once satisfactory application has been made, a permit will normally take
approximately thirty days to process and issue. Should you have any questions,
please feel free to call.

We have reviewed the preliminary site plan dated March 3, 1998 (received March 9, 1998) for the
referenced project. Our comments are as follows and as shown in red on the enclosed plans:
1. A 24' pavement with curb & gutter should be provided across the front of the property as shown. An
additional 5' of right-of-way should be dedicated to VDOT in order to obtain new roadway within
the right-of-way.
VDOT will establish the center line and profile for Route 728 (Victory Lane) between Independence
Drive and Route 50 for use in development of a uniform grade line.
(The above items relate to earlier discussions concerning inadequate pavement and right-of-way to
obtain safe and reasonable access to ever increasing customers adjoining this VDOT facility.)
2. Please provide VDOT with a copy of the shared access agreement covering the entrance.
3. A drainage easement should be provided similar to that shown in red on the plan at the northeast
corner of the property.
4. If the discharge has been calculated for the 15" c.m.p. to be installed on the south side of the
property, a portion of which arrives there from a pipe culvert under Route 728, VDOT would
appreciate a note on the plan indicating no increase in discharge will occur.
All miscellaneous notes in red should be addressed. When all the above comments have been addressed,
please submit five sets of revised plans for review. Should you have any questions, please do not
