The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).

• This Department has no record of any past or pending zoning violations having been filed, with
respect to the property; and the undersigned is unaware of any violations of the applicable
• portions of the Zoning Ordinance. To determine wlicther the property has any unresolved
building violations and/or complaints, please contact Mr. John Trenary, Building Official, with
the Frederick County Inspections Department (540)665-5650.
• Currently there are three approved site plans (Site Plan 1115-82, revised #15-82, and 411-98) for
the properties.
• The properties are currently in compliance with the "Zoning Ordinance, with the exceptions noted
below in relation to the ALTA survey.
• A listing of allowable uses in the MI — Light Industrial District, is attached.
Additionally, we are in receipt of Greenway Engineering's ALTA/ACSM Land Title Survey for
All Points Warehousing, Cole Lane, dated December 19, 2007. In reviewing the survey, there
appears to be a few building setback issues that affect the existing buildings. Below is an
1 overview of the issues identified by the ALTA survey, and the corresponding resolution.
Resolution of the issues is overcome by one of two measures: (1) grandfathered status (legally
j nonconforming) based on previously approved Site Plan 1115-82 (September 16, 1982), and its
1 revision (September 12, 1983); or (2) acquisition of a variance from Board of Zoning Appeals.
The Site Plan approved September- 16, 1982 established a 37 foot building setback from the Cole
Lane right-of-way. The revised Site Plan approved September 12, 1983, established the northern

boundary setbacks of 16 feet, and the eastern boundary setbacks of 15 feet.
{ 167 Cole Lane. Road setback is legally nonconforming based on Site Plan 415-82.

Additionally, via Zoning Administrator interpretation, it has been determined that the

encroachment is appropriate.

193 Cole Lane. Northern and Eastern property line set is legally nonconforming based on
revised Site Plan 415-82 (revised 9/12/1983). Western property line setback violation may be
resolved with a Lot Consolidation or a variance obtained from the Board of Zoning Appeals.

variance is obtained from the Board of Zoning Appeals

The Frederick County Planning Department administratively approved Site Plan #011-98 for the above
referenced site plan on June 9, 1998. This site plan, for the construction of an additional five self -storage
warehouses for a total of 23,000 square feet, meets all County requirements for development within the M1
(Light Industrial) zoning district. The development of this property also includes the provision of self storage
facility screening, and a zoning district buffer adjacent to the Franklin Mobile Home Park.
You have already received three copies of the approved site plan. Please keep an approved copy for their
files and maintain an approved copy on the construction site. Once the site development has been completed,
you should contact this office to schedule an on -site inspection.

I have reviewed the revised site plan for the project referenced above, which was received by our department on
May 29, 1998. There are still a few revisions which need to be made in order to satisfy our requirements:
1. Please recalculate the existing buildings information --Building #7 should be 5,040 square feet rather
than 5,760 square feet. In addition, please recalculate the gross area of buildings for the FAR calculation --the
FAR should be 0.34 instead of 0.17.
2. Denote the surface treatment for this site. The Zoning Ordinance states that all parking areas, travel
aisles and maneuvering areas associated with the self-service storage facility operations shall be paved with
asphalt, concrete or similar material to provide a durable hard surface.
Please revise your site plan to address these comments, as well as the comments provided by the required review
agencies. Once all comments have been addressed, please resubmit one copy of the revised site plan along with
all approved review agency comment sheets. If the revised site plan satisfies all review agency comments, we
will request five copies and recommend the site plan for approval. Please contact me if you have any questions.

VDOT approval is primarily based on the low volume dead end condition at the
proposed site. Please provide three additional sets of the plans for VDOT use.
The appropriate land use permit may now be applied for to cover work within the
Route 672 right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector.
Once satisfactory application has been made, a permit will normally take approximately
thirty days to process and issue. Should you have any questions, please feel free to call.

We have completed addressing your comments of March 2, 1998 and are herewith resubmitting
the plan for your review. Where have been some major changes to the plan since the first
submission. They are as follows:
1. Buildings #8,9,10 & l 1 have been shortened by twenty feet and building #12 has been
moved to the west by twenty feet. This results in considerably less disturbance of the
existing woodlands and steep slopes.
2. Building #12 has been shortened by seventy feet. This has resulted in meeting the 100'
buffer of RP zoned land on parcel 39.
J 3. We have secured a photo taken in 1993 which shows the site fairly devoid of trees. ,after
review of the photo with Eric Lawrence, Eric has agreed that a large portion of the
E� ,c property is not classified as woodlands. In addition, he has agreed to a double row of

size and are not considering a variance as a part of the site plan review, at this
time.
2. Comment: Copy of the lease agreement which describes the requirements of Section 165-
44G. This shall be approved in conjunction with the site plan.
Response: A copy of the lease agreement is shown on sheet 4.
3. Comment: You have indicated that you wish to vacate the lot line between Lot 4 and Lot
5. A boundary line adjustment/lot consolidation will need to be approved
before final site plan approval will be given. Since you are consolidation Lot 5
with Lot 4, you will need to show pertinent details on Lot 4 such as
boundaries, location of parking spaces, and location, dimensions, and uses of
all structures.

features exist on this site, please provide a statement to this effect.

13. Comment: You need to specify the type Of trees that are to be used in order to satisfy the

addition, you need to provide a statement concerning the minimum height at

Upon review of the subject site plan, we offer the following comments:
Sheet 1 of 6
1. Note 15 describing the maximum woodland disturbed area indicates that 11
percent will be disturbed by this development. However, after viewing the site, it
appears that most of the site is covered by woodland areas. Clearly indicate the
total area of woodlands on the site plan and how much will be disturbed by this
development. The zoning ordinance - Section 165-31 indicates that only 25
percent of woodlands can be disturbed on a site. (see attachment 1)

accordance with standard 3.07 and 3.08 of the. erosion and sediment control
handbook.
5. Provide a detail of the required construction entrance with a washrack in
accordance with standard 3.02 of the erosion and sediment control handbook.
6. Provide a detail and sizing of all culvert outlet protection in accordance with
standard 3.18 of the erosion and sediment handbook.
7. We do not recommend the use of a sediment trap at the outlet of the stormwater
pond. We recommend designing the stormwater pond as a sediment basin in
accordance with standard 3.14 of the erosion and sediment handbook. Provide all
design calculations and provide a detail of the proposed structure. Also, place a
note indicating that the construction of the sediment basin shall be the first step in
the construction sequence.
8. Provide adequate slope protection at the outfall of the proposed 24 inch RCP
culvert to ensure that no erosion will occur on the slope or within the main
drainage swale downstream of the discharge point. Add comment about slope
stability for 2:1 and diverting stormwater away from property boundary at outfall.
Also, relocate discharge point to prevent point source flows at property boundary.
9. Sheet 4 of 6
You need to include a complete erosion and sediment narrative which includes the
phasing of construction, seeding requirements, etc. as shown on attachment 2.
Also, include details of all specified erosion and sediment control measures.
10. Note two indicates that a structural engineer will need to design the outlet
structures of the stormwater pond. These calculations will need to be submitted to
this office for review prior to issuance of a land disturbance permit.
11. Sheet 5 of 6
Place a note on the site plan indicating that issuance of a land disturbance permit
will be required by this office prior to any site grading operations.
12. Recommend using a grass -lined channel in lieu of the rip -rap lining for the crest of
the emergency spillway. The rip -rap will change the characteristics of the
emergency spillway flow. Adequate slope protection is still required on the

downstream slope.
13. The pre -developed run-off coefficient of 0.5 is not representative of the onsite
Martinsburg Shales. The "C" value for woodland areas in these shale conditions
should be on the order of .30 0.35. The stormwater calculations and the sizing of
the stormwater pond shall be revised to reflect this change. Resubmit the revised
design calculations for our review.
Once these comments have been addressed, resubmit two (2) copies of the site plan for
further review.

considering that 52 percent of the site is comprised of steep slopes varying
from 15 percent to 35 percent. In addition to this, if you will recall from our
site visit together, another 15 percent of the pre -developed site has been
disturbed to an exposed shale. Further, the remainder of the site has been
determined to not be Woodlands. I called to discuss this but was unable to get
you. Please call to discuss, if you feel it necessary.

1. The existing entrance is deficient in the taper offset based on current VDOT
standard. The minimum offset allowed is 10'. The entrance could be relocated as
shown and brought up to current standard.
2. With the tree planting buffer zone shown on the plan around the north side of the
cul-de-sac, the drainage from Route 672 should be redirected as shown by
directional flow arrows.

Dear Mr. Sweitzer:
We have completed addressing the comments from the first submission of the above referenced
site plan.
The owner has indicated that he could not move the entrance to the location you had indicated for
security reasons. Since we are not doing any construction within the VDOT right-of-way and th,-,
existing driveway entrance was approved with the site plan for the existing facility, we have
proposed to utilize this existing driveway.
We understand that it would be better to rebuild that entrance to current standards, however this
is not possible because of grading. The drainage on the approved street plan calls for the drainage
to circle the cul-de-sac and follow the drainage easement along the lot line of Lot 6 and 7. I have
enclosed a copy of this easement for your review.

I have reviewed the site plan referenced above. Please provide the following information on a revised
copy:
Jl . You have indicated that you wish to apply for a variance for a front setback reduction. You
will need to make application for this and reference the variance application number on the
site plan. The site plan will not be given final approval until a decision has been reached by
the Board of Zoning Appeals (BZA). t
/2. Copy of the lease agreement which describes the requirements of Section 165-44 G. This
shall be approved in conjunction with the site plan.
J3. You have indicated that you wish to vacate the lot line between Lot 4 and Lot 5. A boundary
he adjustment/lot consolidation will need to be approved before final site plan approval will
be given. Since you are consolidating Lot 5 with Lot 4, you will need to show pertinent
details on Lot 4 such as its boundaries, location of parking spaces, and location, dimensions,
and uses of all structures.
4. Copy of the approved subdivision plat (there seems to be discrepancies between the site plan
and our zoning maps in regard to the property owners and zoning of the parcels which are
contiguous to the subject parcel).

enclose receptacles. Board on board fencing can be utilized for this purpose (please provide
a detail showing this).

10. If no new water and sewer hook-ups will be made on this site, please provide a statement that
reflects this.
11. Since this is an industrial site, it must meet all necessary parking lot requirements in regard
to surface materials, space demarcation, curbs and gutters, raised islands, setbacks,
handicapped spaces, entrance requirements, aisle requirements, and landscaping.
12. If steep slopes are present, please identify where they are. In addition, please clearly delineate
the boundaries of the stream and the woodlands that are present on this site. Please keep in
mind that a steep slope disturbance of 25% is allowed on the site --you have indicated a steep
slope disturbance of 28%. If no floodplains, wetlands, sinkholes or other environmental
features exist on this site, please provide a statement to this effect.
13. You need to specify the type of trees that are to be used in order to satisfy the landscaping
and screening requirements for self-service storage facilities. In addition, you need to provide
a statement concerning the minimum height at time of planting.
14. A Category C buffer is needed adjacent to PIN 55-A-38. The woodlands will not be allowed
as a full screen.

Upon review of the subject .site plan, we offer - the following comments:
Sheet 1 of 6
1. Note 15 describing the maximum woodland disturbed area indicates that 11
percent will be disturbed by this development. However, after viewing the site, it
appears that most of the site is covered by woodland areas. Clearly indicate the
total area of woodlands on the site plan and how much will be disturbed by this
development. The zoning ordinance - Section 165-31 indicates that only 25
percent of woodlands can be disturbed on a site. (see attachment 1)
2. Note 14 indicates that 28 percent of steep slopes will be disturbed by this
development. The zoning ordinance 165.31 indicates that only 25 percent of steep
slopes can be disturbed. You will need to reduce the amount of steep slopes
disturbed or obtain approval from the board of supervisors as outlined in the
ordinance. (see attachment 1)
3. Sheet 3 of 6
The stormwater detention pond as well as all stormwater culverts and structures
need to be located within a dedicated drainage easement.

4. Provide a detail of the required inlet protection for all stormwater structures in
accordance with standard 3.07 and 3.08 of the erosion and sediment control
handbook.
5. Provide a detail of the required construction entrance with a washrack in
accordance with standard 3.02 of the erosion and sediment control handbook.
6. Provide a detail and sizing of all culvert outlet protection in accordance with
standard 3.18 of the erosion and sediment handbook.
7. We do not recommend the use of a sediment trap at the outlet of the stormwater
pond. We recommend designing the stormwater pond as a sediment basin in
accordance with standard 3.14 of the erosion and sediment handbook. Provide all
design calculations and provide a detail of the proposed structure. Also, place a
note indicating that the construction of the sediment basin shall be the first step in
the construction sequence.
8. Provide adequate slope protection at the outfall of the proposed 24 inch RCP
culvert to ensure that no erosion will occur on the slope or within the main
drainage swale downstream of the discharge point. Add comment about slope
.stability for 2:1 and diverting stormwater away from property boundary at outfall.
Also, relocate discharge point to prevent point source flows at property boundary.
9. Sheet 4 of 6
You need to include a complete erosion and sediment narrative which includes the
phasing of construction, seeding requirements, etc. as shown on attachment 2.
Also, include details of all specified erosion and sediment control measures.
10. Note two indicates that a structural engineer will need to design the outlet
structures of the stormwater pond. These calculations will need to be submitted to
this office for review prior to issuance of a land disturbance permit.
11. Sheet 5 of 6
Place a note on the site plan indicating that issuance of a land disturbance permit
will be required by this office prior to any site grading operations.
12. Recommend using a grass -lined channel in lieu of the rip -rap lining for the crest of
the emergency spillway. The rip -rap will change the characteristics of the
emergency spillway flow. Adequate slope protection is still required on the

downstream slope.
13. The pre -developed run-off coefficient of 0.5 is not representative of the onsite
Martinsburg Shales. The "C" value for woodland areas in these shale conditions
should be on the order of .30 0.35. The stormwater calculations and the sizing of
the stormwater pond shall be revised to reflect this change. Resubmit the revised
design calculations for our review.
Once these comments have been addressed, resubmit two (2) copies of the site plan for
further review.

We have reviewed the site plan dated February 16, 1998 for the referenced project. Our
comments are as follows and as shown in red on the enclosed plan sheet.
1. The existing entrance is deficient in the taper offset based on current VDOT
standard. The minimum offset allowed is 10'. The entrance could be relocated as
shown and brought up to current standard.
2. With the tree planting buffer zone shown on the plan around the north side of the
cul-de-sac, the drainage from Route 672 should be redirected as shown by
directional flow arrows.
All miscellaneous comments shown in red should be addressed.
When all the above comments have been addressed, please submit five copies of the
revised plans for review.
