application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan. It is recommended that applicants

Dear Kurt:
Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This site
plan is denied until the issues in this letter, as well as all issues of the other review agencies,
have been adequately addressed. Please review Staff's comments listed below and then
prepare a revised site plan which adequately addresses each concern.
Review Comments:
1. Subdivision. It is unclear if this parcel has been subdivided yet; please provide a
recorded copy of the subdivision plan. Also, the property identification number
given is 43-A-48. Verify that this number is correct as it appears to be divided from
43-A-63.
2. Vicinity Map. The vicinity map needs to include all properties and roads within
1,000 feet of the site.
3. Magisterial District. The Magisterial District shown on the plan is incorrect; it is
located in the Stonewall Magisterial District, not Gainesboro.
4. Lighting. Show all lighting that will be associated with this development. Also
include the statement that "Outdoor lighting shall be arranged to deflect glare away
from adjoining properties and public streets" per §165-35A of the Frederick County
Zoning Ordinance.
5. Utilities. Provide a statement under the notes section on the cover sheet stating that
all utilities must be underground.
6. Building Restriction Lines. The BRL's need to be depicted on the site plan.
7. Adjoining Properties. On Sheet 2 of 18, provide the owner, property identification
number, and use and deed book/page number for all adjoining properties.

Tyson Drive. On Sheets 7 and 8 of 18, show and label the entire 80 foot right-of-
Nvay for Tyson Drive. Also, on Sheet 10, provide the legal reference for the temp turn
around easement that is being vacated.
9. Sidewalks. On Sheets 7 and 8 of 18, label the widths of the sidewalks. Also, provide
a detail for the sidewalk.
10. Handicap Ramp. Please specify if a ramp is necessary for access onto the sidewalk
located at the rear of the building.
11. Landscaping. A three-foot high evergreen hedge, fence, berm or wall must be
provided along the front of the parking area to prevent headlights from shining on the
road. Also, provide a breakdown of the trees required for interior landscaping and
perimeter landscaping.
12. Landscape Plantings. On Sheet 15 of 18, provide a statement to the effect that all
plantings shall conform Nvith § 165-36B of the Frederick County Zoning Ordinance.
13. Special Limited Power of Attorney Form. Please have the property owner sign
the attached Special Limited Power of Attorney Form prior to further review or
approval. This form should be notarized and completed to grant the applicant
(you) with authorization to represent them for this site plan.
After you have revised the site plan, please resubmit one copy so that I may verify the
information contained on the plan. I will need all approved review agency comment sheets
and at least five copies of the final plan for final administrative approval. Comment sheets
are required from the following agencies: the Frederick County GIS Department, the
Frederick County Inspections Department, the Frederick County Department of Public
ff'orks (County Engineer), the Frederick County Fire Marshal, the Frederick County
Sanitation Authority, the Frederick County Airport Authority, and the Virginia Department of
Transportation.

This is to acknowledge receipt of your revised plans dated March 23, 2005 for the referenced
project. The plans appear satisfactory and are approved. Please advise the developer
accordingly. Please provide 6 sets of approved construction plans with signed seal for
VDOT distribution.
I offer the following comments:
• A preconstnrction conference be held by the engineer and/or developer with the attendance of
the contractor, various County agencies and VDOT prior to initiation of work.
• Materials used and method of construction shall apply to current observed VDOT Road &
Bridge Specifications applicable during construction of this development.
• Our review and continents are general in nature. Should conditions in the field exist such
that additional measures are warranted, such measures shall, be completed to the satisfaction
of the Department prior to inclusion into the Secondary Road System.
• Attached is a copy of the minimum requirements and information needed prior to acceptance
of subdivision streets into the Secondary System. This is the responsibility of the developer.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to
a pipe or drainage easement.

• The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.
• Since this project does not directly tie into a VDOT numbered route, no Land Use Permit is
required. Caution should be exercised at point of impact on VDOT system to maintain debris
free condition.
• Private entrances will be installed in accordance with VDOT Standard CG-11 and plan. This
is the developer's responsibility.
• Any entrances constructed from the referenced street(s) shall meet VDOT minimum
standards. This is the developer's responsibiliq.
• Any signs to be installed will be in accordance with attachments.
• I suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 121-B Stone. This will greatly reduce the possibility
of any pavement settlement.
• A copy of any/all RECORDED PLATS of dedication to public use (the County of
Frederick) for drainage easements or additional right-of-way required for implementation of
this proposed project should be provided for VDOT review prior to issuance of any land use
permit.
• Final plans submitted for approval should include Special Design #2045 at .Triple Line of
Culverts at cul-de-sac.

SUBDIVISION STREETS INTO STATE SECONDARY SYSTEM
Subdivision streets may be considered eligible for acceptance into the State Secondary System
when:
• Built according to plans approved by the Department of
Transportation, properly maintained since completion and
• Rendering a public service [serving three (3) occupied dwellings or
three (3) businesses per street].
THE FOLLOWING WILL BE REQUIRED TO BE FURNISHED TO VDOT (Edinburg
Residency Office or Winchester Complex) AT LEAST THIRTY (30) DAYS PRIOR TO
ADOPTION OF THE RESOLUTION BY THE BOARD OF SUPERVISORS REQUESTING
THE ADDITION:
1. Three (3) copies of as -built construction plans showing:
■ Roadway Geonletrics
■ Drainage & Drainage Easements
2. Three (3) copies of the final plats with date & place of recordation,
deed book nuIllber and page number or lnstrrrlllellt number.
3. Signed permits covering all utilities, publicly or privately owned,
