Roderick, EIT Anderson & Associates, Inc. 7722 Main Street Middletown, Virginia 22645 RE: Valley Redi-Mix, Property Identification Number(PIN#): 44-A-6A Master Development Plan Waiver Request Dear Mr. Roderick: I am in receipt of your request for a waiver to the County's master development plan requirement for property owned by Valley Redi-Mix. Specifically, the project proposes the subdivision of Tax Parcel 44-A-6A, zoned M2 (Industrial General), and containing 15.8537 acres, to establish two new tax parcels. It is intended one of the new parcels be utilized for construction of a concrete batch plant. Section 165-134 of the Frederick County Zoning Ordinance provides that the Director of Planning and Development may allow for waivers under certain conditions. The proposed subdivision and development of this parcel, as described in your letter dated May 1, 2003, would not involve the construction of any new roads, does not propose stormwater management systems to serve more than one lot, and does not affect the purpose and intent of the M2 Zoning District. Therefore, the request for a waiver to the County's Master Development Plan process is appropriate in this situation. Please be advised that the waiver of the master development plan for this project does not exempt Valley Redi-Mix from any site design or site development requirements specified in the Frederick County Zoning Ordinance, the Frederick County Subdivision Ordinance, or the Frederick County Erosion and Sediment Control Ordinance. Approval by the Board of Supervisors is necessary prior to subdivision of the property i Sincerely, i r XciR. We have addressed your comments addressed in your letter dated August 12, 2004 as follows: Master Development Plan. A waiver for the requirement of a master development plan was provided on May 9, 2003 for a project previously planned for this site (enclosed). The project for which approval is currently being sought meets the same criteria for the previously granted waiver. We are hereby requesting that the previously granted waiver be transferred to this project, or a new waiver be provided. This request will follow the outline that is presented in Part B of section 165-134 of the Code of Frederick County. 1) The development will not incorporate the construction of any new streets, roads, or rights -of -way. Nor will the development extend any existing or dedicated street, road, or rights -of -way. Nor will the development significantly change the layout of any existing or dedicated street, road, or rights -of -way. The proposed development will incorporate a single entrance onto Route 837. New traffic that will directly be attributed to the new development will not require the construction or extension of any existing street, road, or right-of-way. In fact, the street cannot be extended due to the railroad right-of-way. 2) The development will not incorporate any stormwater management system designed to serve more than one lot. Nor will the development necessitate significant changes to any existing stormwater management systems designed to serve more than one lot. The proposed development will incorporate a stormwater management system that serves the proposed development only. It will not affect any other stormwater management systems in the area. No existing stormwater management systems are known to exist.
