Ramey: We have checked our records and we do not have the Letter of Credit that you refer to in your letter dated April 25, 2006. We contacted the Department of Public Works and found that the $2,920.00 was the bond amount required for the erosion and sediment control measures for the proposed addition. According to Public Works, the land disturbance permit is still waiting, to be issued. Public Works contacted Shenandoah Valley Construction and left a message on their volcemall on 10/24/04 at 4:39 p.m. but never received a call back. Unfortunately, I have no Letter of Credit number or other information I can give you, as I'm not sure who originally set this Letter of Credit up. I can tell you that it is in the amount of $2,920.00, was issued on September 2004, and was for the purpose of improvements for the Travelodge. It is our understanding that this had to do with an addition being added on. This addition work has been completed now for some time. We would respectfully request that the County release us from this letter of credit. If you need further information from us or if you find information that contradicts our understanding, please let me know. At this time, the site plan is denied until the following review comments are adequately addressed. Review Comments: 1) Minimum Lot Size. Please remove the reference to a minimum lot size requirement of 1 acre from the Zoning Requirement Section of the site plan, found on page 2 of 9. This is not a requirement of the Frederick County Zoning Ordinance. 2) Parcel Information. County records indicate that the proposed development exists on parcel 64-A- 1D. The reference on the cover sheet for parcels 64-A-1, 3 and 4A appears to be inaccurate. Furthermore, the lot shown as 4-A on the site plan does not appear to be a legal lot. Please modify the site plan to ensure that all lots shown and referenced are accurate. After you have revised the site plan, please resubmit one copy so that Staff may verify the information contained on the plan. Staff will need all approved review agency comment sheets and at least five copies of the final plan for final administrative approval.
