The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted priorto the final approval of any site plan. The
Department of Planning and Development w11 review the application to ensure that it is complete. If
any portion is not included or complete, the site plan application will not be accepted and returned to
the applicant(s).
Site Plan Package
1. One set of approved comment sheets are required from the following review
agencies prior to final site Iplan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

We hereby issue our Irrevocable Letter of Credit Number 11-03-3 in favor of the Treasurer,
County of Frederick, Virginia, for the account of Avis Hill Trust, its agents, successors or
assigns for a sum not exceeding $10 000 00 U.S. dollars ($10 000.00) available by your sight
draft on the above stated Issuing Bank and accompanied by documents stated below:
A certified statement signed by the Zoning/Subdivision Administrator or any authorized
representative, stating that Avis Hill Trust, has not satisfactorily completed the
construction of, and/or satisfactorily maintained, all physical improvements that includes, but is
not limited to, streets, curbing, gutter, sidewalks, above ground facilities, underground utilities and
facilities, recreational facilities, drainage systems, and landscaping requirements,
designated open space and other required improvements located in or on 321 Arbor Court, the
approved subdivision or site plan.
A statement signed by the Zoning/Subdivision Administrator or his representative that : "The
drawing is for the explicit purpose of providing for the completion or maintenance of a required
facility or function pursuant to the requirements of Chapter 144, Subdivision Ordinance, and/or
Chapter 165, Zoning Ordinance, of the Frederick County Code and pursuant to the agreement of

the Subdivider, Developer, or his agent to comply with said ordinance as a condition of the
approval of the subdivision or site plan to the satisfaction of the Zoning/Subdivision
Administrator."
We hereby engage with drawers, endorsees and bona fide holders that all drafts drawn in
compliance with the terms of this credit shall be duly honored upon presentation and delivery of
the above documents. This Irrevocable Letter of Credit shall remain in full force and effect for a
minimum of one (1) year from date hereof and shall be automatically extended for additional
terms of six (6) months from the present or future expiration dates, unless sixty (60) days prior to
such date or dates, the above named bank or financial institution issuing the instrument, notifies
the County in writing by certified mail, that they elect not to renew the instrument for such
additional period. During the last thirty (30) days while this Letter of Credit is in force and effect
after notice of termination has been given, the County may draw up to the full amount of the sum
when accompanied by a document stating that Avis Hill Trust, has failed to provide an
acceptable substitute Irrevocable Letter of Credit or deposit in escrow, and a document stating
that "The drawing will be held by the County for the sole purpose of providing for the completion
and/or maintenance of the site plan and/or subdivision requirements to the satisfaction of the
Zoning/Subdivision Administrator or his authorized representative." This credit shall be
terminated upon the Zoning/Subdivision Administrator or his authorized representative giving
written release to (Permittee or Developer) Avis Hill Trust, stating that they have
satisfactorily performed and fulfilled the obligations and requirements of the subject site plan or
subdivision.

The Frederick County Department of Planning and Development administratively approved the above -
referenced plan on September 30, 2002. The site plan meets all requirements for development in the M 1
Zoning District. Currently, there are no adverse conlrnent:s by any of the required review agencies; however,
any future conlnients by these agencies should be addressed promptly. Below is a list of the primary
inlprovenlents of this development:

24,000 square feet.
153 total parking spaces, including eight handicapped.

To Jeremy Camp:
Following are our responses to the comments received from The Frederick County
Department of Planning and Development in the comment letter dated August 2, 2002.
Please call if you have any questions or require clarification.
1. The review fee for a minor site plan ($500.00) is provided with this submission.
2. Reference to site plan #27-01, which was the first revision of the original plan, was added
to sheet C-1.
3. Curb & gutter has been added to the northern and western sides of the site per marked
up copy of the plans that was submitted to us with the referenced comments.
4. Statement added to sheet C-1, which explains what is to be parked in the 153 proposed
parking spaces. Uses of the building were also addressed (see General Note #18, sheet
C-2).
5. Detailed parking calculations are shown on sheet C-1 showing how the required number
of parking spaces was calculated.
6. A detail showing the proposed surface material was added to sheet C-3.
7. Planting schedule revised to show "Flowering Pear" instead of "Bradford Pear" trees.
8. Owners name, address, and phone number were added to sheet C-1.
9. The owner is also the developer for this project.
10. Triad Engineering's phone number and address are included in the title block.
11. Landscaping calculations were revised to show that 5% of parking areas to be
landscaped "and" one tree is required for every 10 parking spaces. Total acreage of
landscaped area provided for parking areas is also included.

Dear Mr. Dunlap:
Thank you providing me with the revised site plan proposed for the above -referenced development.
I have reviewed the site plan, and there are a few details that should be addressed before approval
of the plan can be considered. Please read the review comments listed below and prepare a revision,
which adequately addressed each of the comments. To assist you, I am enclosing a red -lined copy
of the site plan to illustrate the concerns of staff. Staffs review comments are as listed below:
Review Comments
1. `f Review Fee. Please provide the required review fee for a minor site plan ($500.00). The site
plan cannot be accepted as an official site plan until this application fee is paid.
2. Reference to Revision #1. Please provide a reference to site plan #27-01, which was the
First revision of original plan.
3. [-�C urb & Gutter. The zoning requirements regarding curb & gutter have been amended since
the original site plan and, also, since the application was first submitted for the first revision
of that site plan. The zoning ordinance now requires curb & gutter. Please provide curb &
gutter for at least fifty-nine (59) parking spaces, which is the total number of new spaces
proposed.
4. /Parking. Please provide a statement on the site plan which explains what is planned to be
parked in the 153 proposed parking spaces. If a use other than warehousing is proposed by
the owner, then this should be addressed during the site plan process.
5. " Parking Calculations. Please showier how the required number of parking spaces, shown
on the plan, were calculated.

6. Surface Material. Please provide details of the proposed surface materials on this site plan.
The current site plan only shows surface material details for the area around entrances.
7. �/ Flowering Pear. The County is presently undergoing efforts to revise the Zoning Ordinance
which would restrict Bradford Pear Trees from being used as required landscaping. I request
that you provide the species of "Flowering Pear" on the site plan, and that it not be a
Bradford Pear.
8. V Owner's Name, Address, & Phone. Please state who the owner is, and provide an address
and phone number.
9. v/Developer's Name, Address, & Plione. Please state who the developer is, and provide an
address and phone number.
10. ` Engineer's Phone. Please provide Triad Engineering's phone number on the site plan.
11. `' Landscaping Calculations. Interior landscaping requires at least 5% of parking areas to be
landscaped "and" one tree is required for every 10 parking spaces. Please change the word
11or" to "and" on the site plan, under your Interior landscaping calculations. Furthermore,
please provide the total square feet of landscaped area provided for parking areas.
After you have revised the site plan, please resubmit one copy, so that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five
copies of the final plan for approval. Comment sheets are required from the following agencies:

Please find the attached site plan drawings, for your review, of the Airport Warehousing
project in Frederick County. The attached plan is a revision of a previously approved site
plan by G.W. Clifford & Associates, dated 02-24-99 and approved on 10-20-99 (site plan
#15-99). The revisions per this plan are additional parking and landscaping, change in
the finished floor of the proposed building (drops V), and some minor grading changes in
the storm -water management area.
