All required information must be submitted prior to the final approval of any site plan. The Department of Planning and Development will review the application to ensure that it is complete. The approved site plan calls for the construction of an office/flex building that will be 12,600 square feet and contain seven units, the provision of a paved parking lot that will contain curb and gutter, 47 regular parking spaces, 3 disabled parking spaces with appropriate ramps and signage, raised islands, and interior and perimeter parking lot landscaping, the installation of concrete sidewalks, the construction of a satellite dish and a transmission tower that will be 30 feet in height, improvements to the area between the new building and the Project Hope facility as described on the recorded easement agreement, the provision of landscaping along the perimeter of this site, and all appropriate erosion and sedimentation control measures. This plan also provides for 16 reserve parking spaces that may be required once future tenants have occupied this facility. I have provided you with two copies of the approved site plan. Please provide a copy to the general contractor to maintain on -site and keep a copy for your records. Please advise the general contractor to contact this office to schedule inspections as necessary to obtain Occupancy Permits. Our department will require you to provide a copy of the approval from the FAA prior to the issuance of occupancy permits for this facility. Mr. Miller agrees with the concept that you have proposed to establish five parking spaces per unit initially for a total of 3 5 total parking spaces, with the understanding that the remaining sixteen parking spaces that are reserved shall be constructed if deemed necessary as tenants occupy this facility. Therefore, in order to receive approval from our department, the following items will need to be provided on the final site plan: 1) One more parking space will need to be accounted for in order to provide for the sixteen additional spaces. I have marked -up the site plan to demonstrate where this could be provided. The note that states "Not In Contract" may be confusing down the road. These sixteen spaces should be referenced to General Notes #8 on Sheet 1 of 3 to avoid confusion. 2) Your March 1, 1996 response indicates that the five parking spaces that will be dedicated to the Project Hope facility will not have a sidewalk that will connect to the Adams property sidewalk. This is fine; however, a sidewalk will need to be provided that will connect the six future spaces on the Adams property to the sidewalk in front of the buildings. This can be demonstrated as a sidewalk that will be provided when the six parking spaces are warranted by the Zoning Administrator. 3) A copy of an agreement between Adams and Project Hope will need to be provided that addresses the proposed improvements that are shared between the properties. Three comments from my letter need to be addressed to meet the requirements of our department. Comment number 5 regards the proposed outdoor lighting fixtures. You letter indicates that the type of building mounted lighting has not been specified at this time. This is fine; however, a note should be included on the final site plan which states that building mounted lighting will be designed to avoid spill -over onto adjoining properties. Comment number 8 regards the easement agreement between the Project Hope site and the Pegasus Business Center site. A copy of this easement agreement will need to be provided prior to final site plan approval. Comment number 11 regards the location of disabled parking signs. A disabled parking sign is required for each disabled parking space. Therefore, one additional sign needs to be provide for the proposed parking lot in front of the office/flex building. Thank you for the copy of the survey plat of this property. I have forwarded it to our Real Estate Department for the purpose of updating the County database. Please provide our department with five copies of the final site plan which address comment number 5 and comment number 11, all approved review agency comments that are specified in my letter dated February 21, 1996 and a copy of the easement agreement between the two property owners. Lewis, P.E. wishes to address the Planning Commission on the Pegasus Center Master Development Plan and a request for a waiver of the zoning district buffer. Mr. Wyatt said that the Pegasus Center is located on property owned by Kevin and Patricia Adams and currently houses the Airport Office Building. He said that the proposal will create the Pegasus Business Center on 6.25 acres and will improve access to the adjoining Project Hope facility. The properties are zoned B2 (Business General) and M 1 (Light Industrial), respectively. Mr. John C. Lewis discussed the overall concept and phasing of the project which included flex space for office and storage within a business park setting. He then discussed his request for a waiver of the zoning district buffer. He proposed to relocate the landscaping required by the zoning district buffer to other areas on both properties. He said that this proposal would allow for access improvements to each property and would separate truck traffic from automotive and pedestrian traffic. Members of the Commission stated that Mr. Lewis's concept sounded more like B3 use than B2 use. The staff explained that in prior discussions with Mr. Lewis, he described retail/restaurant-type uses in a campus -style setting, using the rear of some of the buildings for storage for the uses in the office space area. The staff's opinion was that the waiver would be appropriate given the compatibility of the uses. With regard to phasing of the master development plan, members of the Commission felt that if the total number of lots were approved initially, they would not have a problem subdividing off portions, as long as the development was consistent with what was previously approved. A motion was made by Mr. Thomas and seconded by Mr. Romine to approve the waiver request to allow a redesign of the required buffer between the B2 and M 1 properties which will require the same amount of landscaping that will be relocated to the perimeter of these sites. DOUGLAS ADAMS and KEVIN D. ADAMS (hereinafter called Adams); and THE PEOPLE TO PEOPLE HEALTH FOUNDATION (PROJECT HOPE) (hereinafter called Project Hope). WHEREAS, Adams is the owner of property containing a total of 6.0623 acres, located on Bufflick Road (Rt. 726) and Airport Road (Rt. 645) in Shawnee Magisterial District, Frederick County, Virginia, said property being more particularly described on the plat of Elliott Ritchie, Jr., L.S., dated March 1, 1996, attached as Exhibit A; and WHEREAS, Project Hope is the owner of property containing 4.6256 acres, located on Bufflick Road (Rt. 726) and Airport Road (Rt. 645), in Shawnee Magisterial District, Frederick County, Virginia, and adjoining on the west the above -described property of Adams; and WHEREAS, the parties desire to enter into this Joint Easement Agreement to establish a joint ingress/egress easement for the joint and mutual use and benefit of their above - described properties. Phase One Construction: The construction and/or installation of improvements in Phase One shall be the sole responsibility of Adams, and shall be commenced promptly after approval of Adams' pending subdivision application by Frederick County. This inspection is necessary to confirm that the site is in conformance with the approved site plan (SP #007-96) for the Pegasus Business Center, Phase One. Issuance of the final Certificate of Occupancy for a property occurs once all required site improvements have been completed. Site Plan #007-96, approved by Frederick County Planning Department on November 27, 1996, allowed for the parking on this site to be developed in stages. This enabled the developer to initially construct a minimal amount of parking with the understanding that additional parking would be constructed once the building's occupants were determined. This is stated in General Notes #8, on sheet 1/3, of the approved site plan. A copy of note #8 is attached. Now that the occupants of this building have been determined, parking calculations confirm that a minimum of 51 parking spaces should be provided. This calculation is based on the Zoning Ordinance requirement of one space per 250 square feet of office space (12,600 s.f building used for offices divided by 250 s.f. = 51 parking spaces). Forty parking spaces are currently constructed on this site. Therefore, a parking space shortage of 11 spaces exists. The approved site plan indicates the location for the required additional parking spaces. Attached are copies of a portion of the site plan indicating these parking space locations.
