Box 356 Middletown, VA 22655 Dear Bill: We recently received our- Site Plan Approval for The Office Addition Project and are proceeding with the building permit process. I appreciate your help during this review process and wanted to clarify two items of discussion that arose during our review. First, the Newmans of Monte Vista are aware of the buffering requirement solution (double row of trees) arrived at during our site plan review. They are still very concerned about the horses being boarded on the property and have stated they will pursue a stop -work order if any damage to the fence occurs during construction. I will forward a copy of this letter- to Howard Shockey & Sons, Inc. and convey the mood and disposition of your neighbors to Larry Dubyk. The other item of discussion concerned the office addition being constructed over the existing sanitary sewer line and easement. The concern is the restriction of excavation to repair or maintenance this line. The Town of Middletown (who own and operate this line) was provided plans during the review process and had no comment. I do not recommend we relocate this line at this point for three reasons. First, the cost to relocate this line is equally expensive whether we do it now or later and I understand your desire to maintain minimal cost at this time. Secondly, the short-term potential for having a problem is unlikely due to the depth of the line. Third, the long-term potential for having a maintenance problem is unlikely due to and the location of existing manholes on either side of the office. These manholes provide good access for clearing or cleaning this sewer line. During our site visit you requested that I inquire about the existing zoning and current uses of the adjoining property, Monte Vista, to aid yourself in establishing any buffering requirements. Current deed research indicates that both properties are zoned M-1. I telephoned Mr. Eugene Newman to inquire about uses and learned that his daughter, Dr. Lee Newman operates a veterinarian office and permanently resides at the location. There is a stable on the property for boarding horses. During the phone conversation I scheduled a visit to the property to fully explain the scope and location of the office addition. The following is a brief synopsis of that visit and discussions. I visited with Mr. & Mrs. Eugene Newman and Dr. Lee Newman on the afternoon of Tuesday, February 6 to discuss the proposed addition. I explained that you had requested the inquiry and that Stowe -Woodward was not aware of your request nor with my meeting with them that day. It was noted that I did not have any authority regarding the Fred. Co. Ordinance requirements nor any authority to represent Stowe -Woodward, Inc. The Newmans stated they have been peaceful neighbors with Stowe -Woodward since its initial construction. The only complaint ever communicated involved the plant addition about 6 years ago. The excess soil after excavation was temporarily stock -piled on the site creating an erosion control and visual concern for the Newmans. This earth pile was eventually removed from the site. Most importantly the Newmans were concerned that the historic integrity of Monte Vista be maintained. They noted their recent historic designation from Frederick County, their affiliation with the Cedar Creek Battlefield, and their historic designation on the National Register. The Newmans generally did not object to the finished office addition. The Newmans did not feel that the office addition would be visible from the house due to the location of the grain barn and the existing topography. The Newmans stated their greatest concern was due to the noise, dust, and security issues during the actual construction period. Dr. Newman has several mares due to give birth this spring. She stated these folds are very valuable and her concern was the noise disturbance of the mares before birth and the colts after birth. She was also concerned that the existing fence might be temporarily damaged and allow her horses to escape. She also stated that wind-blown dust associated with the construction process was a concern. The Newmans stated their desire was to have a permanent 6' high solid board fence constructed along the property line to aid with dust control, noise control, and visual surveillance. They stated they would like this fence constructed before any construction begins to sheild the horses from any disturbance. The Newmans also requested assurances that no excavation stock -piles are allowed after construction is completed. The Newmans felt the best method to resolve everyone's concerns was to schedule a meeting with Stowe -Woodward, Frederick County Planning Department, and themselves present. I suggested that if this meeting was agreeable to all parties that it would be most appropriately held at Stowe -Woodward so the actual addition location could be visited and discussed. The Newmans stated they would be out of town beginning Feb. 22 for two weeks and would like to have these issues resolved before they leave. I request your review of this letter and inform all parties of your interpretations or decisions. I would ask that you organize any further- meetings and I offer my attendance if desired. I asked the Newmans to inform yourself directly or myself if they feel I have misinterpreted or misrepresented their concerns or discussions. Please call if your have any questions.
