All required information must be submitted prior to the final approval of any site plan. The Department of Planning and Development will review the application to ensure that it is complete. The approved site plan calls for the construction of an annex to the existing point of presence building that will provide an additional 460 square feet of space, the development of an asphalt parking lot that will contain two regular parking spaces, one disabled parking space with appropriate disabled signage and concrete wheel stops, the provision of a concrete landing and sidewalk to provide access to the building, the installation of two 1,500 gallon septic tanks to be utilized in conjunction with the pump and haul system, the provision of a new chain link fence, and the planting of a flowering dogwood tree adjacent to the parking lot. I have provided you with two copies of the approved site development plan. Please provide an approved copy to the contractor to maintain on -site and keep the other copy for your records. Please ensure that the contractor contacts this office to schedule an on -site inspection once all improvements are complete. An inspection of all required site development improvements is required prior to the issuance of an occupancy permit for this annex. The issue involved with your project is a side yard setback._ .I am allowed to permit exceptions as appropriate but I -cannot grant variances. This situation is an existing nonconforming use that violates the setbacks that are required under the existing ordinance. Since this situation predates the ordinance requirement it is a legal nonconforming use. I will permit the addition to the existing structure to violate the setback requirement the same amount as the existing structure intrudes into the zone.
