All required information must be submitted prior to the final approval of any site plan. The Department of Planning and Development will review the application to ensure that it is complete. Site Development Plan #051-95 Dear Dave: Upon receipt of your most recent site plan for an addition to the existing shop building, it became evident that the above referenced site plan for the metal fabrication shop had never received final approval. The Virginia Department of Transportation had not forwarded their approval of this plan. I am aware that in September of 1997, a Land Use Permit was issued by VDOT for*the construction and maintenance of a right turn lane at this location. Further, Mr. Steve Melnikoff has confirmed that VDOT issues associated with approval of this plan have been addressed. Based upon this information, Site Plan #051-95, for the construction of a new 9,400-square-foot metal fabrication shop has finally been administratively approved. As you are aware, a certificate of occupancy must be obtained for the new building to be legally occupied. During my visit to the site yesterday, I inspected the property to ensure that all site plan improvements have been made. With the exception of the handicap space, all site improvements have been completed. A Certificate of Occupancy may be issued upon provision of the handicap space. Mr. John Trenary, Building Official, will be contacting you regarding this matter. The Certificate of Occupancy can be obtained through the Building and Inspections Department. Site Development Plan Dear Mr. Kollar: I would like to take this opportunity to clarify the status of the above site plan, identify what must be done in order to gain approval of the site plan, and ultimately, a Certificate of Occupancy for your new facility. As you are aware, a site plan has not yet been approved for this project. Final approval of the site plan must be obtained immediately. This final approval is contingent upon satisfying the concerns identified by the Virginia Department of Transportation. The Virginia Department of Transportation has, on several occasions, expressed their ability to work with you in resolving the issues concerning improvements to your entrance onto Route 50. Please resolve these issues and obtain their approval so that final approval of this site plan can occur. All of the other reviewing agencies, including the Department of Planning and Development, expressed their approval of the site plan. A building permit was issued for the construction of your new facility allowing you to proceed prior to obtaining final approval of the site plan. Please be aware that a Certificate of Occupancy for the new building will not be issued until the final site plan is approved and the necessary site improvements have been completed. Mr. Bill Buslunan, Resident Engineer, and our Staunton District Traffic Engineer, Mr. Jim Diamond, reviewed your entrance last Friday, June 14, 1996. Their review concluded the need for a right turn lane at your entrance as we originally communicated to your designer. The basis for this conclusion is the ent ance's location on the inside of a curve, minimal sight distance and slow moving vehicles. As I indicated to you, Mr. Bushman is on vacation this week. However, I'll discuss this project with lum early next week and as you requested suggest a meeting with you. Myself or Mr. Bushman will be back in touch with you shortly. Kollar, President 4530 Northwestern Pike Winchester, Virginia 22603 RE: Building Permit For One StoEy Metal Building Dear Mr. Kollar: I had an opportunity to meet with Mr. Childress this afternoon to discuss the outstanding site plan requirements associated with your new facility. It is my understanding that the construction of a right turn lane along Northwestern Pike and improvements to the existing entrance will be required to meet current VDOT standards and to improve safety within this area. It is also my understanding that a Land Use Permit meeting all VDOT requirements will need to be obtained to construct these improvements. Mr. Childress has advised me that the issuance of the Land Use Permit may take several weeks to complete; therefore, Frederick County is willing to work with D.K. Erectors & Maintenance, Inc., to proceed with the construction process. Mr. Lewis has submitted revised site plans that address all review agency comments except for VDOT and our department. The only outstanding issue associated with our department is the provision of an access drive to the disabled parking space. This access drive must accommodate two way traffic flow and must be constructed with an all weather surface. I have advised Mr. Lewis to include this standard on the final site development plan and to submit five copies along with the VDOT Land Use Permit. Once our department receives this information, we will provide approved site plans to the appropriate persons. In the interim, our department will sign -off on the building permit to allow construction to commence. However, Frederick County will not provide D.K.
