application. All required information must.be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned

Dear Steve:
The Frederick County Planning Department administratively approved the above referenced site plan,
#063-98, on February 12, 1999. This site plan, for the construction of a 384-square foot addition,
meets all County requirements for development within the B2 (Business General) zoning district. The
development of this property also includes the provision of a raised island, the re -striping of the
parking area, the seeding of the rear lot, and several landscape plantings.
I previously provided you with several copies of the approved site plan. Please forward two approved
copies to the property owner and advise them to keep an approved copy for their files and maintain
an approved copy on the construction site. Once the site development has been completed, the owner
should contact this office to schedule a final site inspection.

been abandoned last fall. We have received comments back from all the agencies that you had requested.
All the agencies approved the plan as initially submitted. Their comments have been addressed by this
revised site plan, which I am submitting for your review. We would appreciate your continued help in
expediting the site plan review and plan approval process as we now have an owner anxious to begin
construction.

THIS AGREEMENT, made and dated this 17th day of
July, 1964, by and between Winchester Holiday Corporation, a
corporation organized under and pursuant to.the laws of the
Commonwealth of Virginia, party of the first part, and Gulf Oil
Corporation, a corporation organized under and pursuant to
the laws of the State of Pennsylvania, party of the second part.
WHEREAS, the said party of the first part bias
conveyed all of that certain tract of land designated as Tract
B and containing 0.415 Acres; adjacent to other property owned
by the said party of the first part, by deed dated July 17 ,
1964, of record in 'the Clerk's Office of the Circuit Court of

Frederick County, Virginia in Deed Book ,306, Page RSQ.
NOW, THEREFORE, WITNESSETH: That for and in con-
sideration of the mutual covenants hereinafter set forth, the
said party of the first part agrees that:
1. In the event that it does not erect a Holiday
Inn Motel on the property adjoining the tract of land described
in the aforesaid deed within a period of two years from date,
the purchase price of Sixty Thousand ($60,000.00) Dollars shall
be refunded to the said party of the second part upon receipt .
and delivery of a good and sufficient deed to the said tract
of land, free and clear of all liens and encumbrances.
2. The said party of the first part agrees that
the said party of the second part shall be permitted to erect
a Gulf High Rise identification sign at a location to be
selected by the said party of the first part on its property.
3. The said party of the first part shall permit

4: The said party of the second part shall have the
right to make the necessary connections for water and sewer on
the property of the said party of the first part for the sole
purpose of supplying water and providing sewerage facilities to
the aforesaid tract of land.
5. The said party of the first part will pro -rate
the real estate takes for 1964 as of the date of closing and
delivery of the deed to the aforesaid property, and this share
of the taxes shall be based upon the tax rate used for the.year
1964.
The said party of the second part agrees that:
1. It shall save the said party of the first part
harmless from any and all liability arising from the erection
and maintenance of the sign erected on the property of the said
party of the first part; from the use and maintenance of the
water and sewer lines to the aforesaid property; and from the
movement of traffic over the land of the said party of the first
part.
2. The said party of the second part agrees -to pay
for the connection, installation and use of the water and sewer
facilities necessary on this property, and to'pay for the erects,
and maintenance of the Gulf High Rise sign to be erected on the
property of the said party of the first part as hereinbefore
provided.

RE: Review of Raymart Site Development Plan #063-98
Dear Mr. Diehl:
I have had the opportunity to review the above referenced site plan submitted to our department. Please
address the following comments during the revision of this plan:
1) Please revise the location of the required building restriction lines. In particular, the 3 5' front yard
setback along Tulane Drive. In the B2 zoning district, there is no side and rear yard setback
requirement.
2) Please revise the location of the dumpster enclosure. The dumpster should be located behind the
35' front setback. A 10' concrete apron should be provided in front of the dumpster. Please show
a detail of the wooden dumpster enclosure.
3) Please provide a copy of the recorded access easement that allows this property to use the access
driveway on the property of the Holiday Inn. If this easement does not exist, one should be
executed in order to allow access to the dumpster located to the rear of the Raymart building.
4) Areas that are not used for building, parking, and circulation should contain a landscaped cover.
With this requirement in mind, please reseed the area to the rear of the proposed addition. In
addition, the landscape plantings that you propose to place in the VDOT right-of-way should be
relocated as marked on the enclosed plan. It is unlikely that VDOT will permit the plantings
within their right-of-way.
5) The site contains no distinguishable pavement markings. Therefore, in conjunction with the
development of this site, please re -stripe all necessary parking spaces and pavement markings.
A note to this effect should be included on the site plan.

After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will then need comment sheets from all of the reviewing agencies and five
copies of the final site plan for approval. Comment sheets are required from the following agencies, the
Virginia Department of Transportation, the Frederick County Sanitation Authority, the Frederick County

The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
