1. DESIGN NARRATIVE
The purpose of this design is to construct a restaurant on the grounds currently owned by Alma
and James Biggs, and Interstate Properties Company. Once Titans, Inc. has acquired the
properties, a boundary line adjustment will be recorded to provide adequate area for the
' construction of the restaurant and associated improvements.
Primary access to the site will be from Travelodge Drive. An access point and easement have been
' provided on the western side of the property to allow traffic movement between the two lots. This
future lot will have an entrance on 522, and could provide an alternate entry into the facility.
' Existing water, sewer, gas and electric utilities near the property will serve the restaurant. The
water and sewer will be provided via mains owned by the City of Winchester, natural gas is to be
provided by Shenandoah Gas, and Allegheny Power will provide electric service.
' Fire coverage is to be provided via a proposed hydrant in the utility strip along Rt. 522. A single
run of 6" ductile iron pipe will tap into the 12" main along the rear of the property with a tapping
' valve and sleeve. A fire lane has been provided along the front of the parking lot.
Stormwater runoff from the improvements will utilize both existing and proposed stormwater
' management facilities. All stormwater runoff from the proposed improvements shall be routed
through a proposed underground detention facility, which will reduce the proposed rates of runoff
to pre -developed rates for the 2, and 10 year storm events.

2. STORMWATER MANAGEMENT NARRATIVE
' One third of the site lies within an area currently covered by a stormwater management
agreement. A copy of this document is enclosed with the report along with the calculations for the
' pond currently serving the watershed. Stormwater management is provided for the Biggs
property, which is not included in the existing stormwater management agreement. Calculations
follow for the individual parcels in their pre and post -developed states.
' Hydrograph #15 defines the flow rates into the existing inlet, peaking at 3.2 cfs. The design
criteria for the Cracker Barrel facility has been modeled, combined with the flows from the
' existing inlet, and routed through the existing facility. The resulting peak flow rate of 12.07 cfs,
shown in hydrograph #22, is less than the allowable rate of 15.29 cfs shown in the calculations for
the facility. The existing pond was then modeled in its current state for comparison, and as shown
' in hydrograph # 30, a peak occurs at 12.06 cfs. The effect of this development on the existing
facility is negligible.

THIS DEED OF DEDICATION AND DECLARATION OF PLAT, made
this 25th day of February, 1983 by OLD DOMINION SAVINGS AND
LOAN ASSOCIATION, a Virginia corporation, party of the first
}dart, INTERSTATE PROPERTIES LIMITED PARTNERSHIP, a Virqinia
limited partnership, party of the second part and the COUNTY
OF FREDERICK, VIRGINIA, party of the third Dart.
WHEREAS, OLD DOMINION SAVINGS AND LOAN ASSOCIATION
is the owner in fee simple of the hereinafter described real
estate, and
WHEREAS, under the terms of an unrecorded Real Estate
Sales Contract dated October 12, 1982 OLD DOMINION SAVINGS AND
LOAN ASSOCIATION agreed to sell said real estate to Interstate
Properties, a Virginia partnership which, in turn, assigned
all of its rights under said contract to INTERSTATE PROPERTIES
LIMITED PARTNERSHIP, by Assignment dated February 25, 1983, and
WHEREAS, OLD DOMINION SAVINGS AND LOAN ASSOCIATION and
INTERSTATE PROPERTIES LIMITED PARTNERSHIP desire to subdivide
said property, to make certain covenants and stipulations with
reference to said property and to dedicate to public use the
streets shown on the attached plat,
NOW, THEREFORE, THIS DEED OF DEDICATION AND DECLARATION
OF PLAT, WITNESSETH: That for valuable consideration and the
benefits which will accrue by reason of this Deed of Dedication
and Declaration of Plat, the party of the first part and the
party of the second part with their ;Free consent and in
accordance with their desires do hereby subdivide the property
as shown on the attached final plat of INTERSTATE PROPERTIES
SUBDIVISION made by H. Bruce Edens, C.L.S., dated February 21,
1983, said real estate being subdivided into five (5) parcels,
'
shown on said plat as Parcel 1, Parcel 2, Parcel 3, Parcel 4
and Parcel 5, and being the same real estate conveyed to
'
OLD DOMINION SAVINGS AND LOAN ASSOCIATION by'Deed of UCM Corp.,
n California corporation dated March 8, 1979, of record in the
'
Office of the Clerk of. the Circuit Court of Frederick County,
'
Virginia in Deed Rook 506, at Page 3.41.
The party of the first Part and the party of the second
'
part do hereby dedicate to the COUNTY of rn=RICI', VIRCINIA
all of the streets shown on the plat of said property.
'
All parties, includinq corporations, who now own or shall
hereafter acquire any right, title or interest in any land in
'
said subdivision shall be taken as held to agree with the
owners of the aforedeacribed land and with their successors
'
and assigns to conform to and observe the following covenants
'
and stipulations to run with the land and to relate to the
entire subdivisions
'
1. INTERSTATE PROPERTIES LIMITED PARTNERSHIP shall
construct a retention -basin, a thirty inch concrete pipe leadin(I
'
from a curb inlet across Parcel 4 to the retention basin and
a spillway twenty feet in width as Shown on the attached final
'
plat, the purpose of such basin and spillway being to provide a
collecting and runoff area for surface water.from the roads
PROPERTIES SUBDIVISION.
and other areas within the INTERSTATE
All the -above facilities shall be constructed to the specifica-
tions shown on the attached final plat anal/or Virginia
'
nepartment of Highways and Transportation specifications.
2. The cost of maintenance of the retention basin, the
'
thirty inch concrete pipe and the twenty foot spillway, as
shown on the attached final platy shall be borne by the owners
'
of each numbered parcel, pro rata, bared upon the ratio of the
'

area of each such numbered parcel to the total area of all of
the numbered parcels.
3. INTERSTATE PROPERTIES LIMITED PARTNERSHIP shall also
construct a surface water drainage system comprising manholes,
curb inlets and concrete pipes as shown on the attached final
plat. The responsibility for and cost of maintenance of those
portions of the system (with the exception of the portion
referred to in Paragraph 2 above) not within the bord6ra of
roads accepted for maintenance by the Virginia Department of
Highways and Transportation located in the subdivision shall
be borne by the owner of the numbered parcel wherein such
portion of the surface water drainage system is located.
4. The owners of the numbered parcels shall have the
right of ingress and egress to and from Parcel 4 for the purpose
of inspecting, repairing, maintaining and replacing the.retiention
basin, the thirty inch concrete pipe and the twenty foot
spillway referred to in Paragraph 2, above. They shall also
have an easement or right of way comprising an area ten feet
on either side of the centerline of said pipe, the area of the
retention.basin and an.area of a uniform width of twenty feet
around it as well as the area of the spillway and an area
twenty feet on either side of it for the purpose of performing
such functions.
S. The COUNTY OF MDERICK, VIRGINIA is hereby granted
a perpetual easement ten (10) feet on either aide of the
centerline of the pipes, manholes and curb inlets shown on the
attached plat and i■ further granted a perpetual easement
comprising the area of the retention basin and an additional
area having a uniform width of twenty (20) feet around it as well

as the area of the spillway and an area twenty (20) feet in
width on either side of it, with a perpetual easement and the
' .. right to ereot, construct, install and lay and thereafter use,
inspect, repair, maintain, replace and remove the surface water
drainage system or any part thereof, together with the right of
ingress and egress over the real estate shown on said plat for
the purposes of said easement.
6. In the event of failure on the part of the
responsi-ble property owner or owners referred to in Paragraphs 2 and
3 hereinabove to.properly maintain the surface water drainage
system within ten (10) days of receipt of a written request
by a duly designated ggent of the COUNTY OF FREDERICK, VIRGINiA,
the COUNTY OF TREDERICK, VIRGINIA shall have the right to

perform such maintenance or cause such maintenance to be
performed, and the responsible property owner or owners shall
be liable to _ the COUNTY of FREDERICK, VIRGINIA for the cost of
such maintenance. Any determination by the duly authorized
agent of the . COUNTY of PREDERICK, VIRGINIA as to what maintenance
is necessary shall be final and binding on the responsible
landowner or Iandowners.
7. The owners of the numbered parcels shall indemnify
and hold harmless the Commonwealth of Virginia, the Commonwealth
of Virginia Department of Highways and Transportation and the
COUNTY OF FREDERICK, VIRGINIA from any and all claim or claims
for taking and/or damaging pursuant to the provisions of

Article I, Section 11 of the Revised Constitution of Virginia of
property of any and all land9wners who might be adversely

affected by drainage which exits the boundaries of INTERSTATE
PROPERTIES SUBDIVISION such indemnification to be made by the
owners of each numbered parcel, pro rats, based upon the ratio
of the area of each numbered parcel to the total area of all
of the numbered parcels.
9. The owners of the numbered parcels shall indemnify
and hold harmless the Commonwealth of Virginia, the Virginia
Department of Highways and Transportation and the COUNTY Of
FREDERICX, VIRGINIA from any and all costs or expenses incurred
as a result of the denial, settlement and/or litigation of such
claims for taking and/or damages from drainage from INTERSTATE
PROPERTIES SUBDIVISION, such indemnification to be made by the
owners of each numbered parcel, pro rata, based upon the ratio
of the area of each such numbered parcel to the total area of
all of the numbered parcels.
9. The owners of the numbered parcels shall reimburse
the Virginia Department of Highways and Transportation and the
COUNTY OF FREDERICK, VIRGINIA for repairs to roadways -damaged
as a result of lack of proper maintenance of the surface water
drainage system, such indemnification to be made by the owners
of each numbered parcel, pro rats, based upon the ratio of the
area of each numbered parcel to the total area of all of the
numbered parcels.
10. The owner of any of the numbered parcels or the
COUNTY OF FREDERICK# VIRGINIA may seek redress at law or -in
equity to enforce compliance with .any of the foregoing covenants
and stipulations, and all costs of any proceedings, including
attorneys fees, shall be paid by the lot owner or owners held
to have violated any one or more of the covenants and stipula-
tions.
11. Invalidation of any one of these covenants and
stipulations by judgment or court order shall in no way
invalidate any other covenants, stipulations and provisions

herein and such other covenants, stipulations and provisions
herein shall remain in full force and effect.

The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on August 23, 2000. This site plan, for a new 4,100-square-foot restaurant, meets
all County requirements for development within the B2 (Business General) Zoning District. The site plan
provides for sixty-one (61) parking spaces, including three handicap accessible spaces. Adequate interior
and perimeter landscaping have been provided including evergreen plantings to mitigate the impact of
headlights on adjoining properties and roadways.
I have provided you with several copies of the approved site plan. Please forward these approved plans
to the owner and advise the owner to keep an approved copy for their files. Furthermore, the owner
should ensure that an approved copy is maintained on the construction site throughout the development
process. Once site development has been completed, the owner should contact this office to schedule an

I have had the opportunity to review the above -referenced site plan submitted to our department on
June 30, 2000. The following comments should be addressed and included in a revision of this site
plan. The submitted plan is also marked with these comments.
Under the zoning administrator's approval, please provide a statement specifying that the site
plan is valid for five years from the date of approval.
2. Please specify the use for all adjoining parcels (i.e. vacant, commercial, industrial).
3. Within the zoning table under setbacks, please state the 5' parking setback and delineate the
location of this setback on the site plan.
4. Please ensure that the proposed IHOP sign is located at least 10 feet from all property lines
by delineating the 10' required setback on the site plan.
5. Please provide a statement specifying that outdoor lighting shall be directed so that light is
not cast onto adjoining properties.
6. Please specify the location and nature of all outdoor storage areas. If no such areas are
proposed, please provide a statement to that effect.
7. Within the zoning table, please specify the maximum height in the B2 district (35 feet).
8. Please show the calculation associated with the provided FAR in the zoning table.

specifying that all new utilities are to be placed underground.
10. Please note that the 1.4 parking spaces per 100 square feet of area for the parking calculation
reflects fast-food and drive-in restaurants. Other restaurants must provide one space per
every 100 square feet of area. Please ensure that the correct parking calculation has been
specified. Additionally, it does not appear as though a loading space is required.
11. It appears as though 61 total parking spaces are provided. However, the zoning table
specifies that 63 are provided. Please ensure that the provided number of spaces on the site
plan is consistent with the zoning table.
12. Please show the location of all steep slopes, woodlands, floodplains, wetlands, sinkholes,
streams, drainage ways, and other environmental features present on site. If no such features
exist, please provide a statement to that effect.
13. In the landscaping plan, please provide a note specifying that all planting sizes refer to the
height at the time of planting. In addition, please note that the Coton Easter Horizontals
should also be a minimum of 36 inches at the time of planting in order to prevent headlights
from shining onto the public right-of-way. Finally, plantings used to mitigate the impact of
headlights should be evergreen in variety rather than deciduous.
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will then need all approved review agency comment sheets and five copies
of the final site plan for approval. Comment sheets are required from the following agencies: the
Virginia Department of Transportation, the Frederick County Sanitation Authority, the Frederick
County Inspections Department, the Frederick County Engineer, and the Frederick County Fire
Marshal.

Upon review of the subject site plan, we offer the following comments:
Sheet 2 of 7
1. Place a note on the demolition plan indicating that prior to demolishing the existing
structure, a demolition permit shall be obtained from the Frederick County Inspections
Department. At the time of application for the demolition permit, an asbestos report for
the structure shall be also be filed.
2. Provide a sediment trap in the southwest corner of the site as indicated on the marked
copy of the plan. On sheet 6 of 7, you indicate elevations for two (2) sediment traps that
are not indicated on the plan. Provide a detail of the actual elevations for the proposed
sediment trap.
3. Provide inlet protection for the existing drop inlet #1.

4. Indicate that the proposed 18 inch RCP storm sewer from structure #2 to the existing
drop inlet #1 is placed within a drainage easement.

and a certification letter from a professional engineer shall be submitted to the building
inspections department at the time of application for the building permit. The certification
letter shall indicate that the compacted fill was placed in accordance with the uniform
building code in regards to footings and slabs.
6. It appears your drainage calculations meet the stormwater management requirements for
the proposed site. Through the use of the on -site underground stormwater structure, the
maximum 10 year storm flow leaving the site is 3.2 cfs (hydrograph #15) which is less
than the required 3.3 cfs indicated on the Cracker Barrel stormwater calculations. It shall
be noted that when the remainder of the site is developed, additional stormwater
management shall be required.
7. As indicated on sheet 2 of 7, the wash rack for the proposed construction entrance shall be
required.
Once these comments are addressed, submit two (2) copies of the site plan for further
