Dear Tim:
The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on December 8, 2000. This site plan, for the two -phased construction of an office and
warehouse facility, meets all County requirements for development within the B3 (Industrial Transition)
Zoning District. Site development includes the delineation of forty-two (42) parking spaces, four (4) of
which are handicap accessible spaces. Adequate perimeter and interior landscaping are provided. The
required Category B zoning district buffer, including a full screen element, will be accomplished using a
combination of landscaping and elevation difference as delineated on the site plan.
I have provided you with several copies of the approved site plan. Please forward these approved plans
to the owner and advise the owner to keep an approved copy for their files. Furthermore, the owner should
ensure that an approved copy is maintained on the construction site throughout the development process.
Once site development has been completed, the owner should contact this office to schedule an on -site
inspection.

The title block for Sheet 2 reads "Survey: Marsh and Legge." Please insure that all survey
information is consistent.
2. The landscaping for the future parking area has a symbol of TS. However, this symbol is not
described in the plant list. Please insure that all landscaping is described in the plant list.
Once these changes have been made and all approved agency comment sheets are received, please
forward five copies of the final site plan for approval.

Dear Tim:
I have had the opportunity to review the above -referenced site plan submitted to our department on
September 28, 2000. The following comments should be addressed and included in a revision of this
site plan. The submitted plan is also marked with these comments.
Please include a listing of the proffered conditions associated with Rezoning #11-98
(approved on October 14, 1998) and reference the rezoning number on the site plan. The 60
foot right-of-way, dedicated for the purpose of providing a future collector road, is correctly
depicted on the plan. I have included a copy of the official proffer so the exact wording may
be included on the plan.
2. The stateu use of adjoining properties should be the current use. Therefore, please state the
use of Parcel 75-A-2G as vacant and insure that this modification is reflected on Sheets 1, 3,
and 4 of the site plan.
C 3. Sheet 1 and the General Notes on Sheet 2 indicate that surveying work was done by Painter -
Lewis, P.L.C. However, the title block on Sheets 2 thru 6 read "Survey: Marsh and Legge."
Please resolve this discrepancy. (If Marsh and Legge conducted the land survey and Painter -
Lewis the topographic survey, please disregard statement number 3.)

4. Please provide information regarding the location, height, and dimensions of all signs. If that
information is not available, please include a statement insuring compliance with Section 165-
30 of the Frederick County Zoning Ordinance.
5. Please provide information regarding the location and nature of all proposed outdoor storage
areas. If no such areas are proposed, please provide a statement to that effect.

6. Please provide an F.A.R. calculation for both phases of development and provide a final
F.A.R. which reflects the total for both phases.
7. If known, please show the location of proposed electric service for the site.
8. Please modify the parking calculation for Phase I (Units 2-5). The required number of spaces
is 20, based on 5,000 square feet of office area, not 10 as stated on the plan. This increases
the total number of required spaces for Phase I to 30. Furthermore, the number of parking
spaces provided for on the site plan appears to be based on the office use, rather than a
combination of both office and warehouse uses. Staff is inclined to base the calculation on
the office use alone, given that office uses comprise 61 % of the building area. If 7, 500 square
feet of office space is utilized in Phase I, the future parking area will need to be changed to
Phase I parking.
9. Landscaping for the future parking area should be provided according to perimeter and
interior parking lots specifications. That requirement yields four additional trees.

10. Within the plant list, please insure that the plant quantities correspond to the number shown
on the site plan. Specifically, the number of Hemer Anglojap Yews is 40 in Phase I and eight
in Phase II.
11. Please provide a cross section or profile of the required Category B buffer. It should also be
noted that plants used in the landscape screening should be a minimum of four feet in height.
The three foot height applies to berms or plants used to mitigate the impact of vehicle
headlights. Please modify the note beneath the plant list so that plants used in the landscape
screening are the required four feet in height.
12. An elevation difference is not an appropriate full screen as specified in Section 165-37.B.(2)
of the zoning ordinance. I would suggest the use of an earthen mound or berm to accomplish
this requirement. Please provide a detail of the full screen element to be provided in
coordination with the Category B buffer.
13. Note 2 of the Erosion and Sediment Control Notes references Commonwealth Drive, rather
than Prosperity Drive. Please modify Note 2 accordingly.
14. Sheet 6 contains a sidewalk detail for a townhouse complex. Please modify the title of the
detail accordingly.

y 15. Sheet 6 contains three pavement details. For clarification purposes, please use shading or a
hatched pattern to delineate the location of each of the pavement applications. Please include
a legend which corresponds to the shaded or hatched areas.
16. The existing house trailer is located on the property line. This trailer encroaches into the
inactive buffer area and should be relocated so that it is wholly located on the Horton
Investments property.
17. Please insure that all porches, steps and related features do not extend more than three feet
into the side yard setback. It appears as though the steps to the rear of the Phase I building
encroach four feet into the 15 foot setback.
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will then need all approved review agency comment sheets and five copies
of the final sate Asir for approval. Comment sheets are required from the following agencies: the
Virginia Department of Transportation, the Frederick County Sanitation Authority, the Frederick
County Inspections Department, the Frederick County Engineer, and the Frederick County Fire
Marshal.
