We are in receipt of the comments dated July 20, 2005 and offer the following responses. Also attached is
one copy of the revised plan for your re -review.
Comments from Frederick County Planning
Comment l: Landscape Buffer. The zoning district buffer requires three trees per ten linear feet. There is
approximately 300' that requires the zoning district buffer and this would equate to 90 trees. The buffer
detail provided on sheet 7 is incorrect as it only shows two trees per ten linear feet (one full and two half
trees). The landscape plan and buffer detail need to be changed to reflect the correct amount of trees.
Response: The adjacent RA zoned, residential use property, as shown on plans, shares a common boundary
of approximately 153.5'. Pleas note that the other RA zoned parcel is unimproved and does not require a
zoning district buffer. The landscape plan and buffer detail has been revised to reflect three plants per ten
feet.
Comment 2: Common Shared Buffer. The active and inactive portions of the common shared buffer need
to be shown on the site plan and landscape plan.
Response: The active and inactive portions of the common shared buffer have been added to the plan as
requested.
Comment: An approval comment is still required from the Frederick County Inspections Department.
Response: Inspections approval is included.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues
in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please
review Staffs comments listed below and then prepare a revised site plan which adequately addresses
each concern.
Review Comments:
1. Landscape Buffer. The zoning district buffer requires three trees per ten linear feet. There is

Response: Proffers have been added to sheet 8 of 8.
Comment 2: Sign: Our records indicate that this property has a proffer for sign requirements for any
potential sign located on the site. Please indicate in your sign information these requirements per the
rezoning application #09-04.
Response: Note has been revised to indicate the requirements per rezoning on sheet 1 of 8 as requested.
Comment 3: Zoning Information: Please include the zoning information for the adjoining parcel
numbers, 42-A-80 and 42-A-79, on this site plan.

Comment 6: Burnt Church Road: Please indicate whether or not a right-of-way dedication is needed off
of Bunt Church Road.
Response: No right-of-way dedication is required for this site development. However, a 15-foot dedication
is being provided to VDOT for the portion of the site that is encumbered with an existing prescriptive right-
of-way.
Comment 7: Landscape Buffer: The proposed landscape buffer provided on sheet 7 of this .ipplication
does not match the landscaping provided on the actual landscape plan. Please correct this issue and
indicate the location of the required fencing. The landscape screen Hurst include three trees per ten linear
feet. Staff calculations have concluded the required number of trees needed for the landscape screen is
ninety. This screen must also stretch along the entire northern property line in order to be in compliance.
Response: The landscape buffer as shown on sheet 7 has been corrected to indicate the fence location and
to provide three trees per linear foot. The screening as shown extends beyond the limits of the adjacent
residential use property (42-A-80) as required by 165-37D(3). The developer has agreed with the adjacent
property owner to screen the portion of (42-A-79) as shown.
Comment S: Common Shared Buffer: The proposed common shared buffer located on the northern
property line is not in compliance with section 165-37(9) of the Frederick Cozarty Zoning Ordinance. This
section states that developments required to provide buffers and screening as determined by section 165-
37D(1)(b). However, the 50' buffer is a requirement of section 165-37D(3). On this site, you must provide
a 50' buffer entirely on the subject parcel.
Response: The common shared buffer as shown is in conformance with the "Buffer distance waiver" as
approved on April 26, 2005 by Frederick County Board of Supervisors. Copies of the required "Owner
Consent Document" were supplied to Frederick County Planning on May 19, 2005
Comment 9: Parking Landscape: Please provide the required landscaping requirements along the
parking spaces located at the eastern edge of the site and in front of the two proposed handicap parking
spaces in accordance with section 165-11(a) of the Frederick County Zoning Ordinance.
Response: Parking landscaping, as required, has been added as requested.
COrrnmentl0: Location of Interior Trees: The current location of several of the required interior trees is
located inside of the VDOT right of way. Please relocate these trees elsewhere.
Response: Interior tree locations have been revised.
Comment: Comment sheets are required fr•on the Frederick County Department of Building Inspections,
the Frederick County Fire Marshal, the Frederick County Engineer, the Frederick County Health

Dear Mr. Hicks:
This letter, in conjunction with the plans attached, constitutes your permit to install a sewage
disposal system. The application for a permit was submitted pursuant to § 32.1-163.5 of the
Code of Virginia which requires the Health Department to accept private soil evaluations and
designs from an Authorized Onsite Soil Evaluator (AOSE) or a Professional Engineer working in
consultation with an AOSE for residential development. The permitted site was certified as
being in compliance with the Board of Health's regulations by David Racey, ROSE 9 .139, (540)
662-4185. This letter is issued in reliance upon that certification,
The Board of Health hereby recognizes that the soil and site conditions acknowledged by this
correspondence, and documented by additional records on file at the local health department, are
suitable for the installation of an onsite sewage disposal system. The attached plans show the
approved area for the sewage disposal system. This letter is void if there is any substantial
physical change in the soil or site conditions where a sewage disposal system or is to be located.
If modifications or revisions are necessary between now and when you construct your dwelling,
please contact the Authorized Onsite Soil Evaluator (AOSE) or Professional Engineer (PE) who
performed the evaluation and design on which this permit is based. The name, address, and
phone number of the AOSE,/PE appears on the certification form attached to this permit. Should
revisions be necessary during construction, your contractor should consult with the AOSEIP11
that submitted the site evaluation or site evaluation and design. The AOSE or PE is authorized to
make minor adjustments in the location or design of the system at the time of construction
provided adequate documentation is provided to the Frederick County Health Department.

This authorization is null and void if conditions are changed from those shown on the application
or conditions are changed from those shown on the attached construction drawings, plans and
specifications. No part of my installation shall be covered or used until inspected, corrections
made if necessary, and approved by the Frederick County Health Department or unless expressly

We have received your revised site plan dated April 11, 2005 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval. Also please provide five (5) sets of approved construction
plans with signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 678
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of
any/all recorded plats of dedication for drainage easements or additional right-of-way required
for implementation of this proposed project should be provided to VDOT prior to issuance of
any land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

Church Road to ensure they are designed to convey a ten (10)-year design storm
based on the proposed development.

assigns, (hereinafter called "FLOWERS").
WITNESETH:
WHEREAS, Hicks owns certain property located in Frederick County, Virginia, Tax Map
Number 42-A-81 , zoned B-2, more fully described as follows:
All of that certain lot or parcel of land containing 37,367 square feet, more
or less, together with all improvements and appurtenances thereto belonging, lying
and being situate along the Western Side of U. S. Highway No. 522 and the
Northern Side of what is known as the Burnt Church Road, about three miles
Northwest of Winchester, in Gainesboro District, Frederick County, Virginia, and
more particularly described by plat and survey of Michael M. Artz, L.A., dated May
21, 1998 of record in the Office of the Clerk of the Circuit Court of Frederick
County, Virginia, in Deed Book 909, at Page 563, (hereinafter referred to as Hicks
Property).
WHEREAS, Flowers owns certain property adjacent to the Hicks Property, being part of
Frederick County Tax Map Numbers 42-A-79 and 42-A-80, zoned R-A and more fully described
as follows:
All of that certain lot or parcel of land, lying and being situate on the West
side of U. S. Route #522 (formerly Virginia State Highway #7) about three miles
Northwest of Winchester, and being the same land which was conveyed to William
F. Kirk by dated July 14, 1939 and described therein by metes and bounds as
follows;
"Beginning at a stake on west side of Route 47, corner to Mary I..

All of that certain lot of land, together with all appurtenances and privileges
thereto belonging, located in Frederick County, Virginia, about three and one-half
miles Northwest of the City of Winchester, on the West side of the North Frederick
Turnpike, known as Route #522, which lot has a frontage of 50 feet on the rear of
the present Flowers property to the South thereof, and extends back for a distance
of 156 feet on its Southern boundary and 136 feet on its Northern boundary, with
a width in the rear of 50 feet, adjoining the property known as the Mary Janney
property and the other lands of Milburn,"(hereinafter referred to as Flowers
Property).
Mamie Flowers is now deceased.
WHEREAS, Section 165-37 of the Zoning Ordinances as contained in the Code of the
County of Frederick, Virginia, ("the Zoning Ordinance"), establishes certain requirements for
buffers and screening, with particular attention to adjoining lands in different zoning districts; and,
WHEREAS, Section 165-37(9) of the Zoning Ordinance, adopted by Frederick County on
June 12, 1996, permits adjoining owners of properties in different zoning districts to establish
common shared buffers; and,
WHEREAS, the parties have agreed to cooperate in establishing such a common shared
buffer for the mutual benefit of their properties, and wish now to memorialize that agreement.
NOW THEREFORE, for and in consideration of the mutual promises herein exchanged,

and the sum of ten dollars ($10.00) by each party paid to the other, receipt of which each party
hereby acknowledges, the parties agree and take action as follows:
1. Hicks hereby grants and conveys to Flowers an easement thirty-five feet in width
over the Hicks Property and along its boundary with the Flowers Property, the location of
said easement being more fully described as the Common Shared Buffer and Screening
Easement - Exhibit 1 prepared by Greenway Engineering, dated September 27, 2004, which
plat is attached as Exhibit 1 hereto and incorporated herein. The easement is granted for
purposes as described below.
2. Flowers grants to Hicks an easement fifteen feet in width over the Flowers Property,
and along its boundary with the Hicks Property, such easement being more fully described
as the Common Shared Buffer and Screening Easement - Exhibit 1, prepared by Greenway
Engineering, dated September 27, 2004. This easement is granted for purposes as
described below.
3. The purpose of both easements herein created is to create a zoning district buffer
as that term is used in Section 165-37 of the Zoning Ordinances. In addition to granting
the easements above the parties undertake as follows:
a. Hicks agrees to provide, construct, plant, and maintain the easement, at its
sole expense, all such berms, plantings and other improvements as may be required
on the easement of the thirty-five foot easement on Hicks, twenty-five feet is active
and ten feet is inactive. The active portion shall include parking spaces and travel
aisles. The ten foot inactive portion shall contain landscaping that shall include
three (3) trees per linear feet and a six foot tall opaque fence, as identified on
Exhibit 1, all of which Hicks shall maintain.

b. The fifteen foot easement on Flowers shall be all inactive. Further Flowers
grants Hicks a 15' maintenance easement within the fifteen foot easement to
maintain the above referenced opaque fence and landscaping. Hicks is responsible
for maintaining the fifteen foot easement of Flowers.
C. The length of the easement is approximately 225 and the exact location and
size is depicted on the attache plat.
4. Should the Zoning Ordinance, or the zoning of either parcel, change so that a
common shared buffer becomes unnecessary, or so that the burden thereof may be reduced
without harm to either owner, the parties agree in good faith to meet and consider a
modification agreement for that purpose.
5. The obligations contained herein shall be binding on Hicks and Flowers, their
successors and assigns. The burdens herein created shall run with each parcel, for the
benefit of the other parcel, in perpetuity.

Staff is in receipt of the site plan for the above -referenced project, accepted on September 29,
2004. At this time, the site plan is denied until the following comments are adequately
addressed.
Review Comments:
1) Proffers: Please include a list of the proffers on this property required by the rezoning
application #09-04.
2) Sign: Our records indicate that this property has a proffer for sign requirements for any
potential sign located on the site. Please indicate in your sign information these
requirements per the rezoning application #09-04.
3) Zoning Information: Please include the zoning information for the adjoining parcel
numbers, 42-A-80 and 42-A-79, on this site plan.
4) Handicap Spaces: Please include the actual width and length of the two proposed
handicap parking spaces located on site.
5) Dumpster Fence: Please include information regarding the specifications of the fencing

7) Landscape Buffer: The proposed landscape buffer provided on sheet 7 of this
application does not match the landscaping provided on the actual landscape plan. Please
correct this issue and indicate the location of the required fencing. The landscape screen
must include three trees per ten linear feet. Staff calculations have concluded the required
number of trees needed for the landscape screen is ninety. This screen must also stretch
along the entire northern property line in order to be in compliance.
8) Common Shared Buffer: The proposed corm -non shared buffer located on the northern
property line is not in compliance with section 165-37 (9) of the Frederick County
Zoning Ordinance. This section states that developments required to provide buffers and
screening as determined by section 165-37D(1)(b). However, the 50' buffer is a
requirement of section 165-37D(3). On this site, you must provide a 50' buffer entirely on
the subject parcel.
9) Parking Landscape: Please provide the required landscaping requirements along the
parking spaces located at the eastern edge of the site and in front of the two proposed
handicap parking spaces in accordance with section 165-27-11(a) of the Frederick
County Zoning Ordinance.
10) Location of Interior Trees: The current location of several of the required interior trees
is located inside of the VDOT right of way. Please relocate these trees elsewhere.
Once you have adequately addressed all of these comments, please resubmit a copy in for my re -
review. I will need all approved review agency comment sheets and at least five copies of the
final plan for approval. Comment sheets are required from the following agencies: The
Frederick County Deparonent of Building Inspections, The Frederick County Fire Marshal, The
Frederick County Engineer, The Frederick County Health Deparhnent, The Frederick Counij,
Ailhort Authority, and the Virginia Deparhnent of Transportation.
