This property is bounded by Tasker Road to the west, church property to the east, commercial property to the north and undeveloped property to the south. This project outlines the improvement plans for the proposed self -storage development and will conform to the requirements and methodology of the State of Virginia and Frederick County. Existing Conditions: This site drains to the south and its ground coverer with an adequate stand of grasses and trees. Runoff from this site discharges along the southern property line into a natural drainage way. Soils data was for this project has been obtained from the "Soil Survey of Frederick County Virginia", 1977. The soils for this area are made up primarily of Wiekert-Berks Channery Silt Loams and Blairton Silt Loams (313.) Some areas toward the southeast are made up of Clearbrook Channery Silt Loam (9b). See the soils exhibit. Post Development: This site shall provide detention facitlities provide a post development runoff rate to a condition that is at or below the predevelopment rate. The runoff generated within this development will be discharged into the natural drainage way that lies along the southern boarder of this site. Erosion and Sediment Control: Unless otherwise indicated, all vegetative and structural sediment & erosion control practices shall be constructed and maintained according to the minimum standards and specifications of the regulations. The minimum standards shall be adhered to unless otherwise waived or approved by a variance. All erosion and sediment control measures have been addressed on the plans. UPON DEFAULT BY THE OCCUPANT, THE OWNER HAS A LIEN ON ALL PERSONAL PROPERTY STORED IN OCCUPANT'S SPACE FOR RENT, LABOR, OR OTHER CHARGES IN RELATION TO THE PERSONAL PROPERTY, AND FOR ITS PRESERVATION OR EXPENSES RESONABLY INCURRED IN ITS SALE OR OTHER DISPOSTION PURSUANT TO THIS AGREEMENT. IF ANY MONTLY INSTALLMENT IS NOT MADE BY THE FIFTEENTH DAY FOLLOWING THE MONTHLY ANNIVERSARY DATE ON WI-IICI-I SUCH INSTALLMENT WAS DUE, OR IF ANY CHECK GIVEN IN PAYMENT IS DISHONORED, THE OCCUPANT IS IN DEFAULT FROM DAY PAYMENT IS DUE. X The space named is this agreement is to be used by the Occupant solely for the purpose of storing personal property (except personal property which is otherwise prohibited by law or by this agreement) belonging to the Occupant. The Occupant agrees not to store any explosives or any highly inflanlinable goods or any goods in the space which could cause danger to the space. The Occupant agrees that the property will not be Used for any Unlawful purposes and the Occupant agrees not to commit waste, nor alter, nor affix Signs on the space, and will keep the space in good condition during the term of this agreement. X OWNER DOES NOT PROVIDE ANY TYPE OF INSURANCE WHICH WOULD PROTECT THE OCCUPANT'S PERSONAL PROPERTY FROM LOSS BY FIRE, THEFT, OR ANY OTHER TYPE CASUALTY LOSS. IT IS THE OCCUPANT'S RESPONSIBILITY TO PROVIDE SUCH INSUUANCE. OCCUPANT WILL PROVIDE PROOF OF SUCH INSURANCE TO OWNER UPON REQUEST BY OWNER. §165-44. Self-service storagelilities. (Amended 12-11-1996) • Where allowed, self-service storage facilities shall meet the following requirements. A. Self-service storage facility operations shall be permitted as a primary or accessory use in all zoning districts in which they are permitted. B. All parking areas, travel aisles and maneuvering areas associated with the self-service storage facility operations shall be paved with asphalt, concrete or similar material to provide a durable hard surface. C. Buildings are permitted that provide interior and exterior accessible units. Individual units within the self-service storage building shall not exceed 1,000 square feet in area. D. Minimum building spacing shall be 30 feet apart. Loading areas shall be delineated to ensure that adequate travel aisles are maintained between buildings. E. Recreational vehicles and boats shall be permitted to be stored within completely enclosed areas of the self-service storage facility, provided that the storage area is separate from the parking areas and travel aisles and is depicted on the approved site development plan. Areas utilized for this purpose shall be exempt from the surface requirements specified under 5165-44B. F. Self-service storage facilities shall meet the following landscaping or screening requirements. (1) Facilities located in the B-2 Business General District shall be completely screened around the perimeter of the property by a double row of evergreen trees that are staggered and planted a maximum of eight feet off center and are a minimum of six feet in height when planted. (2) Facilities located in the B-3 Industrial Transition District of the M-1 Light Industrial District shall be required to landscape the yard area within the front yard setback to provide for a double row of evergreen trees that are staggered and planted a maximum of eight feet off center. The side and rear yards shall be planted with a single row of evergreen or deciduous trees that are planted a maximum of 40 feet off center. All trees shall be a minimum of six feet in height at the time of planting. (3) Facilities located on parcels that are within a master planned industrial park or office park shall be required to landscape the perimeter of the facility with a single row of evergreen or deciduous trees that are planted a maximum of 40 feet off center. All trees shall be a minimum of six feet in height at the time of planning. (4) The required planting of all trees described in the Subsection F shall occur in an area that is between the adjoining property boundary line and the placement of security fencing. The installation of an opaque wall or fence that is a minimum of six feet in height may substitute for required landscaped areas in all zoning districts. G. Self-service storage facility operations shall be designed to accommodate the storage of residential, commercial and industrial items, excluding hazardous, toxic and explosive materials. No use, sale, repair or activity other than storage shall be permitted to occur in self-service storage facility operations. A copy of the lease agreement which describes the requirements of this subsection shall be approved in conjunction with the site development plan for the self-service storage facility operation. For purposes of the Owner's Lien: "personal property" means movable property, not affixed to land and includes, but is not limited to, goods, merchandise, and household items; "Last known address" means that address provided by the Occupant in the latest rental agreement or the address provided by the Occupant in a • • MAR 2 l 2005 subsequent written notice of eange of address. The owner's lien eches as of the date the Occupant is considered in default. The OWNER'S lien is superior to any other lien or security interest except those which are perfected and recorded prior to the date of this agreement in Virginia, in the name of the OCCUPANT, either in the County of the OCCUPANT'S "last known address" or in the county where the self-service storage facility is located except those liens or security interested of which the OWNER has knowledge through the OCCUPANT'S disclosure in this rental agreement or through other written notice. Owner and Owner's agents, and employees shall have no liability for loss or damage to any property of occupant stored on the premises or otherwise and occupant hereby expressly releases owner and owner's agents or employees from any losses and/or damages to said property, regardless of whether such loss or damage is caused by the negligence of third parties, by the acts of god, by fire, theft, water, rain, rodents, insects, unlawful entry, mysterious disappearance, the active or passive acts or omissions or negligence of owner or owner's agents or employees, or the failure, interruptions, or malfunction of utilities, or any cause whatsoever. 4. Owner, Owner's agents, and employees, shall not be liable to occupant and/or occupant's guests or invitees for any personal injuries or death sustained by occupant and/or occupants guests or invitees while on or about owner's premises even if such injury or death is caused by the active or passive acts, omissions or negligence of owners, owner's agents or employees. 5. Occupant is responsible for and shall defend, indemnify and hold harmless owner from all claims, demands, actions, causes of action, damages, losses, costs and expenses (including attorney's fees) that are hereinafter suffered by or brought against owner arising out of occupant's use of the premises, or from any personal property stored there or from any activity, work or things done, permitted or suffered by occupant or occupant's guest or invitees including claims for owner's negligence. 6. Insurance on occupant's property is a material condition of this agreement and is for the benefit of both occupant and owner. Occupant, at occupant's expense, shall maintain a policy of fire, extended coverage endorsement, burglary, vandalism and malicious mischief insurance for the actual cash value of stored property or shall self -insure the property. Occupant's decision to self -insure means that occupant expressly agrees that the insurance carrier shall not be subrogated to any claim of occupant against owner, owner's agents or employees. 7. Occupant expressly agrees and covenants that Occupant will not use the Owner's premises for any unlawful purpose or in any manner which would violate any easement, condition, restriction or other matter which applies to the premises and that Occupant will reimburse Owner promptly for the amount of any loses, property damages, or costs of repairs or service costs arising out of the negligent or improper use by the Occupant of the Owner's Premises. Such reimbursement shall be due and payable upon Owner's demand. Owner's failure or delay in demanding loss or damage requirements, late payment penalties, return check charges, or other sums due by Occupant, shall not be deemed a waiver thereof and Owner may demand same at any time during or subsequent to the term of this Rental Agreement, or extension thereof. • h 4 0 8. Owner'or representative oay governmental authority including ps and fire officials may, but shall not be obligated to, enter the space at all reasonable times, without notice to Occupant, for the purpose of inspecting, repairing, and maintaining the space, to comply with law, or to enforce any of Owner's rights. The contents of the space may be removed to other storage unit(s) or other suitable storage facilities. Any property in the space which is prohibited by this agreement may be removed and disposes of by Owner or Owner's agents at Occupant's cost. 9. Occupant shall not affix shelving or other articles to the walls, ceiling or door of the space and shall not make or suffer to be made any alterations of the Owner's Premises or post any signs. Occupant shall not commit or suffer to be committed, any waste on or to the Owner's Premises. Occupant expressly represents to Owner that at no time will Occupant, Occupant's agents, servants, employees or invitees, use all or any part of the space for residential purposes or for storing property owned by others or for the purpose of storing money, jewelry, heirlooms, collectibles, property with sentimental, emotional or other special value, perishable property, animals, controlled substances as defined by government authorities, dangers, hazardous, explosive, inflammable or combustible materials or objects, drums (whether empty or not), not any illegal goods, merchandise, or other property of any kind. Because the value of the property stored may be difficult or impossible to ascertain, Occupant agrees that the aggregate value of all property stored does not exceed, nor will deemed to exceed the amount of the insurance policy obtained by Occupant covering the stored property. If Occupant elects to self -insure, Occupant agrees that the aggregate value of all property stored does not exceed, nor will be deemed to exceed $5,000.00. Occupant may store property worth substantially less than $5,000.00 and nothing contained in this agreement shall be evidence or admission that the aggregate value of the property stored is, or is expected to be, at or near $5,000.00. It is specifically understood and agreed that Owner need not be considered with the kind, quantity or value of property stored by Occupant. Occupant also agrees not to use the space in any manner which would interfere with the use of any other party of any portion of the self storage facility or surrounding properties and not to use the space for any improper or offensive use or any other use which would constitute a nuisance. 10. Occupant must at all times keep the space locked. If Owner provides a lock for Occupant's use, then Occupant shall use the lock provided by Owner. Otherwise, Occupant shall use a heavy-duty case hardened steel lock provided by Occupant. In the event Occupant fails to keep the space locked or Occupant's lock is broken or damaged, Owner shall have the right, but not the obligation, to place its lock on the space either by overlooking the lock provided by Owner to Occupant or by placing a different lock on the space; provided, however, that in such event Owner shall have no liability to Occupant for any loss or damage whatsoever, and Occupant shall indemnify and hold Owner harmless from and against any loss, cost or expense in connection with locking the space. At the termination of this agreement, Occupant will remove and dispose of its lock and key. Occupant shall never put more than one lock on the space. 11. This agreement expires on each monthly anniversary date of this agreement. The Owner may terminate this agreement at its option if Occupant is not in full compliance with the terms of this agreement. Subject to Owner's approval, which Owner any condition or withhold for any reason or for not reason, in Owner's sole discretion, Occupant's failure to vacate the space on the anniversary date of each month automatically renews this agreement for (1) more month. This agreement shall automatically terminate if Occupant abandons the space. Occupant shall have abandoned the space and all of the property therein if Occupant fails to bring current Occupant's rental payment to Owner after Owner has sent certified letter Occupant's last known address, giving Occupant twenty (20) days to bring Occupant's obligations current, and upon such abandonment Occupant agrees that Owner may dispose of all of such property in any manner selected by Owner, and Occupant waives all rights related to such property and the disposal thereof, whether statutory or otherwise, and Occupant waives all claims against Owner and releases Owner from all liability for such property and its disposal. 12. Occupant agrees to give*vner ten (10) days prior written notief Occupant's intention to vacate the space. THERE ARE NO PRORATED RENT REFUNDS in the event the space is vacated before the last day of the agreement. If the space is vacated on or after the last day of the agreement, a full month's rent is due. Occupant shall deliver the space to Owner broom -swept and in the same condition as Owner delivered the space to Occupant. 13. Rental payments are due on the anniversary date of each month. Payments received after the fifth (5`s) day following the anniversary date, and checks that are dishonored, cause Owner to incur damages which are extremely difficult to measure, and because of this, Occupant agrees to pay to Owner, Ten Dollars ($10.00) for each late payment, and Twenty Dollars ($20.00) for each dishonored check. If rental payments are not received in full by the fifteenth (ltth) day following the anniversary date, including applicable Late Charge, returned check change and/or administrative charge, the Occupant is considered to be in default as of the anniversary date, and will be subject to an additional $10.00 later charge. No notice need be given of default. OWNER DOES NOT SEND OUT BILLINGS FOR MONTHLY RENTAL CHARGES AND OCCUPANT SHALL PAY RENT WITH OUT NOTICE, DEMAND, OFSET OR OTHER DEDUCTION. Late charges, returned check charges, administrative charges, and any other sums due by Occupant to Owner hereunder shall be deemed additional rent. 14. TIME IS OF ESSENCE in the performance of this agreement and in the payment of each and every installment of rent and each and every other charge herein covenanted to be paid. If any installment of rent or other charge shall be due and unpaid, or if Occupant shall fail or refuse to perform any of the covenants, conditions or terms of this agreement, occupant shall be conclusively deemed in default in the performance of this agreement. 15. IN ADDITION TO SUCH LIENS AND REMEDIES PROVIDED BY LAW TO SECURE AND COLLECT RENT AND ACCUMULATIVE THEREWITH, OCCUPANT IS HEREBY GIVEN NOTICE THAT OWNER MAY EXERCISE OWNER'S RIGHTS UNDER VIRGINIA LAW TO COLLECT THE PAST DUE RENT BY DISTRESS ON OCCUPANT'S PROPERTY PURSUANT TO THE STATUTE LAWS OF STATE OF VIGINIA, INCLUDING THE SEIZURE AND SALE OF OCCUPANT'S PROPOERTY IF NECESSARY. This agreement contains the entire agreement between Owner and Occupant, and no oral agreements shall be of any effect whatsoever. Occupant specifically acknowledges that no representations have been made with respect to safety, security or other special suitability of the space for storage of Occupant's property, and that Occupant has made his or her own determination of such matters solely from inspection of the space and the premises. Occupant agrees that Occupant is not relying, and will not rely, upon any oral representation made by owner, or by any of Owner's agents or employees purporting to modify or add to this agreement in any way whatsoever. Occupant agrees that this agreement may be modified only in writing, signed by both parties, in order such modifications to have any effect whatsoever. 17. In the event Occupant pays the entire amount owing hereunder after the Owner has taken possession of the Occupant's property as a result of Occupant's default, Owner shall remove all its locks placed on the space to secure payment hereunder. It is the Occupant's responsibility to immediately lock the space at the time Owner's lock is removed to ensure the security of Occupant's property. 0 • MPR Z 20�`� 18. In the event Owner is reed to obtain services of an attorney Onforce any of the provisions of this rental agreement, Occupant agrees to pay, in addition to the sums due hereunder, any additional amount incurred as and for attorney's fees and court costs. 19. Any of the terms of the agreement may be changed by Owner, including without limitation the monthly rental rate, deposit amount, late charge, retuned check charge or any other charges due from Occupant to Owner, such changes to be effective on the first (1 ") day of the month, following the notice period described below. Occupant shall be given thirty (30) days written notice of any such change and this agreement shall be deemed to be altered if Occupant continues Occupant's occupancy beyond the effective date of the change, with no requirement that a revised rental agreement be executed. All notices required by law, or by this agreement, may be sent to Occupant at Occupant's last known address, by first class mail, postage pre -paid, and shall be deemed given when deposited in the U.S. mail. The Occupant's address given above with occupant's name shall be deemed occupant's last known address until Owner actually receives notice of change or Occupant's address. Occupant is responsible for notifying Owner in writing of any change of Occupant's address. Any notice from Occupant to Owner shall be deemed given upon actual receipt by Owner. 20. A Security Deposit, if required, shall be refunded if: 1) the space is vacated on or before the month for which rent has been paid and all terms and conditions of this agreement are met by Occupant, 2) Occupant has given Owner ten (10) days prior written notice of vacancy, 3) the space is returned broom clean, empty and in good repair, subject only to normal wear and tear and 4) Occupant's lock is removed upon termination of occupancy. Otherwise, the security deposit shall be retained by Owner, but Owner shall not thereby be deemed to have waived any of its rights hereunder or under applicable law. Owner may deposit the security deposit into any account which Owner deems best. 21. The covenants herein contained shall extend to and be binding upon the parties thereto, their respective heirs, executors, administrators, successors and assigns. 22. This agreement is a written rental agreement under the Virginia Law Code Section 55-416 and no estate for years is being granted by this agreement. All provisions of this agreement shall be governed by the laws of the State of Virginia. This agreement is executed by multiples copies, one for the Occupant and one or more for Owner. 23. Any right granted herein to Owner may be exercised by Owner's Rental Agent or other representative or agent. 24. Occupant shall not assign this agreement or sublet the whole or any portion of the space. 25. Owner and Occupant waive their respective rights to trail by jury of any cause of action, claim, counterclaim or cross complaints in any action brought by either Owner against Occupant or Occupant against Owner on any matter arising out of or in any way connected with this agreement, Occupant's use or occupancy of the space or premises, or any claim of bodily injury or property damage or the enforcement of any remedy under any law, statute or regulation. 26. If any part of this agreement is held to be unenforceable for any reason, in any circumstance, the parties agree that such part shall be enforceable in other circumstances, and that all remaining parts of this agreement will nevertheless be valid and enforceable in all circumstances. 27. Owner shall the right to establish or change hours of operation or to promulgate rules and amendments, or additional rules and regulations for the safety, car, and cleanliness of the premises, or the preservation of good order on the premises. Occupant agrees to follow all of Owners' Rules now in effect, or that may be put into effect from time to time. 0 • 28. Occupant's access to thoemises may be conditioned in any n&er deemed reasonably necessary by Owner to maintain order on the premises. Such measures may include, but are not limited to, requiring verification of Occupant's identity, limiting hours of operation, requiring Occupant to sign -in and sign -out upon entering and leaving the premises and denying access to Occupant if Occupant is in default under this agreement. 29. So long as Occupant is not in default under this agreement, Occupant may pay all sums due by check, money order or Owner -approved credit card. If Occupant is in default under this agreement, Occupant must pay by certified check or money order. CASH WILL NOT BE ACCEPTED. All payments shall be made to Owner at the premises. 30. Owner, at is option, may provide an electric light fixture or in near Occupant's space. Such light fixture, if provided, is for illumination use only and cannot be used as an electrical source for other purposes. Electricity for purposes other than illumination may be provided by Owner's option and is subject to an additional charge. The perimeter of all impervious areas must be landscaped with shade trees. One tree shall be provided for every 2,000 square feet of impervious surface of the entire site. A three foot high evergreen hedge, fence, wall or berm must be provided around all parking lots where headlights can shine on roads or adjoining properties. 13) Parking Lot Landscaping (interior). A minimum of 5% of the interior portions of parking lots shall be landscaped for the purpose of providing shade trees. Within the parking lot, raised islands and landscaped areas should be used. No less than one tree per ten spaces shall be provided in the interior of the parking lot. 14) Self Storage Landscaping. A double row of evergreen trees are required around the entire self storage area. Also, existing vegetation is not an option to use with self storage landscaping; a double row of evergreen trees must be provided in addition to any existing trees. 15) Landscaping Notes.
