SITE PLAN APPLICATION CHECKLIST
The checklist shown below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan. It is recommended that applicants
contact the Department of Planning & Development to determine which review

Dear Mr. Lawson:
Thank you for your response letter regarding the site plan violation for Titan Concrete in
the matter of paving Woodside Road (Rt. 671). Staff on December 4, 2018, met with
VDOT, Supervisor McCann -Slaughter, and Frederick Water representatives to discuss
your proposal of routing Titan trips to Brucetown Road (Rt. 672) and closing the entrance
onto Woodside Road (Rt. 671) along with a site plan revision. There was consensus at the
meeting that this would be an acceptable plan provided that the following issues can be
addressed:
1. In your meeting with Staff, statements were made regarding how few trips Titan
generates and also that there are fewer trips from Carmeuse onto Brucetown Road
which as been improved with a signal since Titan opened. It would be appropriate
to document the generation of trips and conduct a basic intersection analysis to
substantiate the fact that placing all of Titan traffic on Brucetown Road will not
have a significantly negative impact on roadway operations. To be clear, we are
not requesting a full Traffic Impact Analysis (TIA), just an analysis of the
intersection of Brucetown Road and Route 11.
2. It has been brought to our attention that the settlement agreement between
Canneuse and Frederick Water requires that Frederick Water destroy the entrance
that both Frederick Water and Titan currently use onto Brucetown Road and
return it to grass by Spring 2020. The County will need documentation assuring
that Titan will continue to have permanent and unimpeded access to Brucetown
Road prior to approving a new site plan.

Enclosed please find a preliminary Amended Site Plan, which depicts that the existing
entrances on Woodside Road are closed and locked and that after approval of the Amended Site
Plan access to the site will be along the industrial access driveway, which connects to Brucetown
Road with the existing hard surface entrance, along with acceleration and deceleration flares
coming into and exiting the site.
In addition to the preliminary Amended Site Plan, I also provide you the following
narrative which relates to trips. As you may recall from our meeting, Titan records the number of
trips. Currently those trips include mixers, delivery trucks and employees which arrive and
depart for work via their own personal vehicles. Currently vehicles have used both Woodside
Road and the industrial access driveway. Under the proposed Amended Site Plan, Woodside will
no longer be used for any of those trips and all trips will be via the industrial access driveway
which connects to Brucetown Road. On an average day there are 32 mixer truck trips and 20
employee trips (10 employees arriving and departing from work via their personal vehicles) for a
total of 52 trips per day. Our review of the VDOT records reflect that there are a total of 49 trips
per day on Woodside Road. With the approval of the Amended Site Plan, 73% of those trips will
be removed from Woodside Road (assuming, of course, historically all vehicle trips to and from
the plant have used Woodside Road). Our experience tells us otherwise because both entrances,
Woodside and the industrial access driveway, have been used. Although it is difficult to
estimate, we believe of those 52 trips historically half were using Woodside Road and the other
half were using Brucetown. Assuming that estimate is correct, the increased number of trips of
personal vehicles and cement mixers on Brucetown Road will be an additional 26 trips per day.
There are also deliveries of aggregate and sand products from Carmeuse and other
suppliers. Those deliveries do not occur on a daily basis and, therefore, any attempt to include
those trips would be a fractional number if provided on a daily tally. We are also cognizant of

the fact that VDOT and the County focus heavily on a.m. and p.m. peak hour trips. Titan's shifts
are scheduled such that Titan has no peak trips and while it is possible that a mixer could be
leaving at the very end of an a.m. peak, Titan's drivers try to time their arrivals and departures so
that they are traveling either before or after a.m. or p.m. rush. Our experience is that deliveries
are also made during times that are not at the a.m. or p.m. peak. The net of all of this is that we
do not anticipate having any impact on the a.m. or p.m. trips.
Please review the enclosed preliminary Amended Site Plan and advise us of any
comments. Consistent with our previous submittals, we are sending you this under a reservation
of rights and in an effort to amicably resolve the County's concerns about traveling on Woodside
Road.

Enclosed please find a preliminary Amended Site Plan, which depicts that the existing
entrances on Woodside Road are closed and locked and that after approval of the Amended Site
Plan access to the site will be along the industrial access driveway, which connects to Brucetown
Road with the existing hard surface entrance, along with acceleration and deceleration flares
coming into and exiting the site.
In addition to the preliminary Amended Site Plan, I also provide you the following
narrative which relates to trips. As you may recall from our meeting, Titan records the number of
trips. Currently those trips include mixers, delivery trucks and employees which arrive and
depart for work via their own personal vehicles. Currently vehicles have used both Woodside
Road and the industrial access driveway. Under- the proposed Amended Site Plan, Woodside will
no longer be used for any of those trips and all trips will be via the industrial access driveway
which connects to Brucetown Road. On an average day there are 32 mixer truck trips and 20
employee trips (10 employees arriving and departing from work via their personal vehicles) for a
total of 52 trips per day. Our review of the VDOT records reflect that there are a total of 49 trips
per day on Woodside Road. With the approval of the Amended Site Plan, 73% of those trips will
be removed from Woodside Road (assuming, of course, historically all vehicle trips to and from
the plant have used Woodside Road). Our experience tells us otherwise because both entrances,
Woodside and the industrial access driveway, have been used. Although it is difficult to
estimate, we believe of those 52 trips historically half were using Woodside Road and the other
half were using Brucetown. Assuming that estimate is correct, the increased number of trips of

Dear Mr. Bocchicchio:
This will acknowledge our on -site visit, of the reference plant Thursday, November 8, 2007. The
inspection increased concerns about the potential of storm water runoff from the site polluting the source
water for our James T. Anderson Water Treatment Plant. The site is graded so the majority of the storm
water runoff is directed to source water pit for our plant. It's certainly unfortunate, since the site engineer
could have very easily designed the site so storm water would have flowed away from our source water
pit. It appears the engineer was not aware that the site was adjacent to the source water for a water
filtration plant serving over 15,000 people. As a result, any chemical or fuel leaks from the plant facilities
will drain to the source water supply through two culverts located adjacent to the site. The waste area and
drain field on the southern part of the site also drain to the source water supply through a third culvert
located south of the site.
The only way to satisfactorily to eliminate this problem is to redirect the storm water to the west, away
from our source water pit. Otherwise mitigation measures should be installed that will detain and remove
silt, oils, grease and harmful chemicals from storm water runoff.
The foregoing recommendations are made on behalf of the Sanitation Authority with all parties'
acknowledgement that your site has been graded to the potential detriment of the water treatment plant,
but also in the spirit of cooperation so as to eliminate or mitigate the potential run off problem. Such
recommendations are made without prejudice to the Authority's rights and remedies to promote and
assure the Authority's and the public's interests in protecting the source water for the water treatment
plant.

The following is in response to your comment letter dated December 8, 2004.
Comment 1: Woodside Road Improvements: On Sheet 3 of 8, it states that
the existing gravel road is to remain. Please provide a notation on
the plan regarding the future improvements to be made to
Woodside Road as required by VDOT as well as the timeframe that
is applicable and the bond.
Response: As part of VDOT's approval we have provided notes on Sheet 4
regarding the above information.
Comment 2: Trailers. There appears to be trailers shown on the Titan Ready
Mix site plan. The Frederick County Zoning Ordinance does not
allow trailers to be used as structures in the EM Zoning District.
Response: A note has been added to Sheet 5 clarifying that these units are
modular spaces and will require design/plans for building permit
application.
Comment 3: Special Limited Power of Attorney. Please submit a completed
power of attorney for Frederick Land Company and Titan Virginia
Ready -Mix LLC.

Response: The property owner did sign the initial application for the project.
Titan's attorney Mr. Ty Lawson has discussed this with the County's
attorney, Mr. Lawrence Ambrogi, and they concurred that this
comment is not applicable to this situation. It is our understanding
that Mr. Ambrogi was to relay this understanding to staff.
Enclosed are the approvals from the various agencies. Based on the submission
of these comments, these are the final issues that need to be addressed in order
to obtain site plan approval. Subsequently, we would expect to receive site plan
approval within a week. If you have any questions, please contact us at your

I am in receipt of your letter, dated November 24, 2004, which requests a waiver to the requirement for
a master development plan for the development of a concrete batch plant facility on the above -
referenced property. The property is located on Woodside Road in Clearbrook; the owner of this parcel
is listed as Frederick Land Company, Inc.
Section 165-134 of the Frederick County Zoning Ordinance gives the Director of Planning and
Development the ability to waive the requirement for a master development plan under certain
conditions. The proposed development meets these conditions. It does not contain any new streets,
roads or right-of-ways; it does not propose any stormwater management system designed to serve more
than one lot; is not an integral portion of a future development; it is planned to be developed in a
manner that is harmonious with surrounding properties and land uses; and, the development does not
substantially affect the purpose and intent of the Zoning Ordinance. Therefore, your request for a
waiver to the master development plan requirement is appropriate in this situation. Please be advised
that this waiver does not eliminate any applicable development and design requirements of the Frederick
County Subdivision and Zoning Ordinances. Prior to the development of this property, a site plan must
be reviewed and approved by Frederick County. Future subdivision of this parcel or other development
of this property may require a Master Development Plan.

The application for site plan for this property appears to have a measurable impact on Route
671, the VDOT facility which would provide access to the property. Your recent resubmittal
appears to address our previous comments and is acceptable.
If any work is performed on the State's right-of-way, a land use permit will need to be applied
for and issued to cover said work. The permit is issued by this office and requires a fee and
surety bond coverage.

The application for site plan for this property appears to have a measurable impact on Route
671, Woodside Road, the VDOT facility which would provide access to the property.
The following items need to be noted on the site plan:
• The proposed sight distance easement located between Station 16+00 and Station 20+00
needs to be a recorded easement with deed book and page number.
• It is noted on the plans you say the existing gravel road is to remain. This is only for a
period of two (2) years. At which time Titan will be required to pave the road or participate
in a realignment of Woodside Road if additional industrial development occurs. Therefore,
a $100,000 bond will need to established with Frederick County to be utilized for paving
this roadway or as a matching fund for revenue sharing improvements on the roadway as
deemed appropriate by Frederick County.
• Please extend the curb & gutter between the two (2) proposed entrances so we will have
continuous curb & gutter.
• Titan will be responsible for maintaining the Route 671 gravel roadway (between Route 11
and the proposed entrance) to an acceptable surface, including dust control until such time
it is paved.
If any work is performed on the State's right-of-way, a land use permit will need to be applied
for and issued to cover said work. The permit is issued by this office and requires a fee and
surety bond coverage.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval
can be granted. At this time, administrative approval cannot be granted. This site plan is denied
until the issues in this letter, as well as all issues of the other review agencies, have been adequately
addressed. Please review Staff s comments listed below and then prepare a revised site plan which
adequately addresses each concern.
Review Comments:
1. Woodside Road Improvements. On Sheet 3 of 8, it states that the existing gravel road is to

Section 165-134 of the Frederick County Zoning Ordinance gives the Director of Planning and
Development the ability to waive the requirement for a master development plan under certain
conditions. The proposed development meets these conditions. It does not contain any new streets,
roads or right-of-ways; it does not propose any stormwater management system designed to serve more
than one lot; is not an integral portion of a future development; it is planned to be developed in a
manner that is harmonious with surrounding properties and land uses; and, the development does not
substantially affect the purpose and intent of the Zoning Ordinance. Therefore, your request for a
waiver to the master development plan requirement is appropriate in this situation. Please be advised
that this waiver does not eliminate any applicable development and design requirements of the Frederick
County Subdivision and Zoning Ordinances. Prior to the development of this property, a site plan must
be reviewed and approved by Frederick County. Future subdivision of this parcel or other development

The following is in response to your comment letter dated November 5, 2004.
Comment 1: Right -of -Way Dedication. On the previously submitted plan there
was a dedication to VDOT for Woodside Road. The revised plan
does not show any dedications: please clarify why this was
removed from the plan.
Response: Based on the meeting between the developer and VDOT, what
is currently shown on the plans is what VDOT considered the
minimum needed to provide access from Woodside Road.
VDOT has provided comments to us and is not requesting a
dedication at this time.
Comment 2: Proposed Access Road. On Sheet 3 of 8 the "proposed access
road" is still shown. It is understood that trucks might cross the
Global Stone Property; however, this road will not be approved
without a Master Development Plan. Please remove the 'proposed
access road" and provide a notation on the plan that Woodside
Road is the main access to this site.
Response: The referenced note was a typo left over from the previous
layout when access was proposed from Brucetown Road. The
note has been removed and a note added that Woodside Road
is the main access to the site.
Comment 3: Master Development Plan: In accordance with Section 165-133 of
the Frederick County Zoning Ordinance, a Master Development
Plan is required prior to any development in the EM (Extractive

On behalf of our client, Titan America, we hereby request a waiver of the Master Development
Plan requirement of Section 165-133 for the Titan Virginia Ready -Mix, LLC site plan. The
subject property is located in the Clearbrook area between Martinsburg Pike, Route 11 and
Brucetown Road, Route 672. The site plan proposes a lease area of 5.6 acres to construct and
operate a concrete batch plant. This request is made in accordance with Section 165-134B
specifically with the following requirements:
1. No new streets, roads or rights -of -way are being proposed. Access to this site will be
from Woodside Road, Route 671, an existing road within the state system.
2. There is no regional stormwater management system proposed with this project.
3. This is not an integral portion of a property planned for future development. The lease
area comprises 14% of the total parcel area.
4. This property is planned to be developed in a manner harmonious with surrounding
properties. Global Stone Chemstone Corporation owns the land surrounding the lease
area. It is our understanding that a similar batch plant is proposed on Global's property
off of Brucetown Road, Route 672.
5. This development does not substantially affect the purpose and intent of Chapter 165 of
the Zoning Ordinance.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval
can be granted. At this time, administrative approval cannot be granted. This site plan is denied
until the issues in this letter, as well as all issues of the other review agencies, have been adequately
addressed. Please review Staff s comments listed below and then prepare a revised site plan which
adequately addresses each concern.
Review Comments:
1. Right -of -Way Dedication. On the previously submitted plan there was a dedication to
VDOT for Woodside Road. The revised plan does not show any dedications; please clarify
why this was removed from the plan.
2. Proposed Access Road. On Sheet 3 of 8 the "proposed access road" is still shown. It is
understood that trucks might cross the Global Stone Property; however, this road will not be
approved without a Master Development Plan. Please remove the "proposed access road"
and provide a notation on the plan that Woodside Road is the main access to this site.
3. Master Development Plan. In accordance with Section 165-133 of the Frederick County
Zoning Ordinance, a Master Development Plan is required prior to any development in the
EM (Extractive Mining) Zoning District. However, in accordance with Section 165-13413,
this property may be eligible for a waiver of the Master Development Plan. To obtain a
waiver of this requirement, you must provide this department with correspondence requesting
a waiver and explaining why this property is eligible. If this property is subdivided in the
future or additional development occurs on the site, a Master Development Plan will be
required. Please note that this property will only be eligible if the "proposed access
road" is removed.

The following is in response to your comment letter dated September 17, 2004
Comment 1: Master Development Plan. In accordance with Section 165-133 of
the Frederick County Zoning Ordinance, a Master Development
Plan is required prior to any development in the EM (Extractive
Mining) Zoning District. Before this department reviews this
application further, a Master Development Plan for this property
must be submitted and approved by Frederick County.
Response: A meeting is scheduled for Thursday, October 141' with the
county, VDOT, the developers, their land use attorney and
WHGA to discuss access and the MDP process. The plans will
be revised accordingly base on the outcome of this meeting.
Comment 2: Special Limited Power of Attorney. Please submit a completed
power of attorney for Frederick Land Company as well as Global
Chemstone, since the access road is going through their property.
Response: We will provide a revised application form with the signatures
of all parties who own land involved with this plan. On past
projects, the county has not required the special limited power
of attorney if the owner(s) sign the application.
Comment 3: Adjoining Properties. On Sheet 3 of 12, some of the adjoiner
information is incorrect. Please include the zoning and use for each
property as indicated.
Response: The adjoining property information has been corrected.

Comment 4: Handicap Parking and Access. The handicap parking space on
the property needs to be revised to be twelve inches wide and a
three-foot wide curb ramp must be provided for access into the
building.
Response: The handicap parking has been revised to depict an 8' wide
space and an 8' wide stripped aisle (van accessible) per ADA
requirements. A curb ramp is not needed due to the parking
and sidewalk being at the same elevation. An accessible route
and ramp has been provided to the trailer.
Comment 5: Additional Building Restriction Lines. On Sheets 2 and 4 of 12,
the extended BRL Zoning Ordinance reference is incorrect; it is
165-24 (7).
Response: The reference has been corrected.
Comment 6: Aggregate Storage Area/Hopper Area. Please specify if the area
where the aggregate storage area and hopper area is proposed
gravel. Also, it is unclear how truck traffic will flow through this
area. Specify how trucks will get from the main entrance road to
this area and back onto the main road.
Response: A note has been added to the plans specifying gravel as the
finished surface in this area. Traffic flow around the plant
consists of the following:
1. Mixer truck will enter the plant through the first entrance off
the main entrance road, drive under the plant, get loaded, hit
the wash down area, drive around the front of the plant
and exit onto the main entrance road.
2. Tanker trucks hauling cement and fly ash will drive around
the front of the plant, back-up, unload and leave the same way.
3. Dump trucks hauling aggregates will enter through the first
entrance off of the main entrance road, dump their material
into the respective aggregate storage bin and leave the same
way.
Comment 7: Existing Dirt Road. Is the existing dirt road that they are
improving a deeded right of way? If it is, please provide a legal
reference. If it is not a right of way, it will have to be platted, giving
this property access through the Global Chemstone Property.

Response: The existing dirt road is currently not a deeded right-of-way.
The right-of-way will be platted to provide access across
Global Stone's property.
Comment 8: Right of Way Dedication. For the purposed 50' right-of-way
dedication on Woodside Road, specify that this is to VDOT.
Response: The note has been revised to specify that the dedication is to
VDOT.
Comment 9: Total Acreage. The total acres for the site are listed on the plan as
39.9 acres; however, the Frederick County Commissioner of the
Revenue has this property as being 58+ acres. Please explain this
discrepancy.
Response: After researching the tax maps and reviewing the plans with
the surveyor, Marsh & Legge Land Surveyors, PLC, there are
discrepancies between the tax maps and the actual
boundaries. The boundaries shown on the plans are correct
based on the most recent, recorded subdivision/BLA plats. It
appears that the tax map does not have the most current
boundaries and areas. The actual area of the subject property
is 39.90848 acres. A copy of the recorded plat is attached for
your reference, sheets 10 and 11 of the plat depict the subject
property.
Comment 10: Outdoor Storage and Processing. This site appears to have a
significant amount of outdoor storage and outdoor processing.
These areas must be completely screened from the view of the
road and street right-of-ways and adjoining properties by a fence,
wall or by screening.
Response: Notes have been added to show the height of the proposed
walls for the aggregate storage and the sludge drying pads.
The aggregate storage walls will be 6' in height and the sludge
drying pad walls will be 8' in height. A 6' board -on -board fence
has been provided along the frontage of Woodside Road as
indicated on the marked up plan set to provide the required
screening.
Comment 11: Tanker Truck Area. There is an area labeled on the plan as
"tanker trucks". Please specify if this area is planned as tanker
truck storage or parking area.

Response: The note had been revised to indicate temporary parking for
the tanker trucks to unload. There is no permanent tanker
truck parking or storage proposed.
Comment 12: Power Line Easement: On Sheet 4 of 12, label the power line
easement adjacent to the lease lot.
Response: The power line easement has been labeled on Sheet 4 as
requested.

Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staff comments listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Master Development Plan. In accordance with Section 165-133 of the Frederick County Zoning
Ordinance, a Master Development Plan is required prior to any development in the EM (Extractive
Mining) Zoning District. Before this department reviews this application further, a Master
Development Plan for this property must be submitted and approved by Frederick County.
X 2) Special Limited Power of Attorney. Please submit a completed power of attorney for Frederick
Land Company as well as Global Chemstone, since the access road is going through their property.
Adjoining Properties. On Sheet 3 of 12, some of the adjoiner information is incorrect. Please
include the zoning and use for each property as indicated.
✓4) Handicap Parking and Access. The handicap parking space on the property needs to be revised to
be twelve inches wide and a three foot wide curb ramp must be provided for access into the building.
f5) Additional Building Restriction Lines. On Sheets 2 and 4 of 12, the extended BRL Zoning
Ordinance reference is incorrect; it is 165-24 (7).
V,6) Aggregate Storage Area/Hopper Area. Please specify if the area where the aggregate storage area
and hopper area is proposed gravel. Also, it is unclear how truck traffic will flow through this area.
Specify how trucks will get from the main entrance road to this area and back onto the main road.

x 7) Existing Dirt Road. Is the existing dirt road that they are improving a deeded right of way? If it is,
please provide a legal reference. If it is not a right of way, it will have to be platted, giving this
property access through the Global Chemstone property.
8) Right of Way Dedication. For the proposed 50' right-of-way dedication on Woodside Road, specify
that this is to VDOT.
✓9) Total Acreage. The total acres for the site are listed on the plan as 39.9 acres; however, the Frederick
County Commissioner of the Revenue has this property as being 58+ acres. Please explain this
discrepancy.
V,"I 0) Outdoor Storage and Processing. This site appears to have a significant amount of outdoor storage
and outdoor processing. These areas must be completely screened from the view of road and street
right-of-ways and adjoining properties by a fence, wall or by screening.
V/11) Tanker Truck Area. There is an area labeled on the plan as "tanker trucks". Please specify if this
area is planned as a tanker truck storage or parking area.
✓12) Power Line Easement. On Sheet 4 of 12, label the power line easement adjacent to the lease lot.
Once you have adequately addressed all of these comments, please resubmit a copy in for my review. I will
need all approved review agency comment sheets and at least five copies of the final plan for approval.
Comment sheets are required from the following agencies: The Frederick County Sanitation Authority, The
Frederick County Department of Building Inspections, The Frederick County Fire Marshal, The Frederick
County Engineer, The Frederick County Health Department, The Frederick County GIS Department, The
Air port Authority, and the Virginia Deparhnent of Transportation.
