application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the

(1) One (1) set of approved comment sheets are required from each relevant review

.4ttached please find the quotes for the Rt. 50 buffer work and the additional
work around the hotel. As we are not able to get the asphalt to add to the biker
trail until warmer weather, we are adding the cost for that work into the totals.
We are proposing posting a cash bond in lieu of a letter of credit.
Please let me know if the attached proposals are acceptable and if you will
accept the cash bond.
We have prepared an estimate for the Botanical work and have forwarded that
along with your request for the final proffer payment to the Medical Center.

Dear Ron:
The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on April 8, 2005. The site plan is approved for the construction of an 84,400 square foot
hotel on Marriott Drive off of Northwestern Pike (Route 50 West) in the Gainesboro Magisterial District. This
hotel contains 136 rooms, a 2,877 square foot restaurant area and a 36 seat meeting area. Some of the required
site improvements include the following:
• Construction of a parking lot with 177 spaces (including eight handicap accessible), including curb
and gutter, a sidewalk around the building, landscaping, striping, and handicap access.
• Construction of a dumpster pad site with a six (6) foot wooden fence for screening.
• Four 12' x 45' loading spaces
• A ten foot asphalt walking/bike path to be built by the developer.
• Improvements to Route 50 per the rezoning proffers.
• Construction of a portion of Botanical Boulevard, Marriott Drive and Conference Center Drive.
• Landscaping (screening) along Route 50 and Botanical Boulevard and landscaping throughout the
Marriot site per the landscaping sheets of the site plan (Sheets 33-35).
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan, including
review agency comments from all relevant review agencies. I am providing you with three (3) copies of the
approved site plan. Please forward these copies to the appropriate representative(s). Furthermore, advise the
owner(s) that a copy should be kept for future reference, and an approved copy must be kept on the
construction site throughout the development process. Once site development is complete, the owner(s) should
contact this office to schedule an on -site inspection. Do not hesitate to contact me if you have any questions or
concerns.

This is to acknowledge receipt of your revised plans dated January 7, 2005 for the referenced
project. The plans appear satisfactory and are approved. Please advise the developer
accordingly. Please provide seven (7) sets of approved construction plans with signed seal
for VDOT distribution, to include 65' minimum radius at Route 50 entrance lane.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the attendance of
the contractor, various County agencies and VDOT prior to initiation of work.
• Materials used and method of construction shall apply to current observed VDOT Road &
Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist such
that additional measures are warranted, such measures shall be completed to the satisfaction
of the Department prior to inclusion into the Secondary Road System.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to
a pipe or drainage easement.

• The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.
• The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned Inspector.
• Private entrances will be installed in accordance with VDOT Standard CG-11. This is the
developer's responsibility.
• Any entrances constructed from the referenced street(s) shall meet VDOT minimum
standards. This is the developer's responsibility.
• Any signs to be installed will be in accordance with attachments.
• I suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the possibility of
any pavement settlement.
• A copy of any/all RECORDED PLATS of dedication to public use (the County of
Frederick) for drainage easements or additional right-of-way required for implementation of
this proposed project should be provided for VDOT review prior to issuance of any land use
permit.

Staff is in receipt of the site plan for the above -referenced project, accepted on October 4, 2004. At this time,
the site plan is denied until the following comments are adequately addressed.
Review Comments:
1) Subdivision Administrator Approval Line. On the cover sheet, please remove the signature line for
the subdivision administrator.
./2) Property Identification Number. The Marriott parcel has already been subdivided and the PIN# is 53-
A-68A not 53-A-68. Please revise the plan to reflect this.
(:3) Developed Area. The application submitted for the Marriott states that they are only developing 3.95
acres; however, the existing parcel area is listed as 13.4680 acres and the disturbed area is listed as
14.29 acres. Please clarify why the disturbed area adds up to more than the entire Marriot site and the
area for road disturbance.
Road Names. On Sheet 4 of 36, label the roads that run along the eastern and western sides of the
Marriott property.
,--5) Sidewalks. Please provide a sidewalk along the back part of the building
Concrete Trail. The concrete trail area running through the Marriott property is labeled as a gravel
road. Please change this to concrete trail, also ensure that there is a detail for the trail.
Parking Calculations. The parking calculations on Sheet 2 do not account for the required spaces for

We've prepared plans for the development of approximately 15 acres on the north side of US Route 50, west of
VA Route 37. The land is zoned commercially (B2). The plans detail the extension of roads and utilities to serve
3 lots owned by Winchester Medical Center and 1 lot owned by LEFTA for development of a Courtyard Hotel.
This is the initial phase of development of the Medical Center's 100 acre parcel.
Water and sewer service is provided by extensions currently under construction by the FCSA. Additional gravity
sewer and waterline extensions are proposed to serve the proposed lots.
As required by the development plan, Botanical Blvd. is designed entirely through the Medical Center property.
One commercial entrance is proposed to the Marriott and the intersection with future Petticoat Gap Lane is
shown. Other entrances off of Botanical to the Medical Center lots may be proposed by individual, future, site
plans.
The stormwater design provides for the conveyance of stormwater from the Wal-Mart site and detention pond,
through the Medical Center site, to the box culvert at Route 50. The Wal-Mart stormwater detention pond
provides the necessary detention to allow commercial development on all the lots proposed, without additional
detention.
The required landscape buffers are provided along Route 50 and the residential RA lands to the west. In
addition to the lots created by this subdivision, open space between Botanical and the RA land, road rights -of -
way and the necessary utility easements will be dedicated.
The Marriott site plan provides for access directly onto a private roadway to be maintained by the owners. It
allows post development drainage from upstream parcels through the stream and meets or exceeds the County's
requirements with regard to landscaping, setbacks and parking lot configuration.
The County's review comments sheets for both the Medical Center Subdivision and Marriott Site Plan projects
are enclosed for your comments. Should you have any questions, please do not hesitate to call.

RE: Erosion and Sediment Control Plan Comments - Marriott Courtyard/Botanical Boulevard

Dear Ron:
Upon review of the subject erosion and sediment control plan, we offer the following
comments:
1) Provide a grading plan for each proposed sediment trap.
2) Provide drainage calculations for all of the proposed stormsewer and temporary
culverts. It will be necessary to ensure that the properties located upstream of this
project are not impacted by the 100-year storm backwater condition created by the
three (3) culverts located under Botanical Boulevard. Water cannot be backed up
on these properties.
3) Provide outlet protection details and dimensions on the plan for all culverts in
accordance with VESCH Standard 3.18. Provide outlet protection for the outfall
of culvert 3.
4) Provide details for inlet protection for all proposed culverts. The county requires
that the stone combination be utilized as inlet protection for culverts.
5) The detail for the silt fence shall include wire reinforcement.
6) A comprehensive review of the site plan will occur at the time of submission.
7) Provide copies of the Department of Environmental Quality's (D.E.Q.) and Army

Corps of Engineers' stream crossing permits at the time of land disturbance
application submittal. These permits will be required prior to our issuing a land
disturbance permit.
