application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the

The above -referenced site plan revision was approved on April 28, 2005. The site plan is approved for the
construction of a new concrete batch plant located in the Global Stone-Chemstone Property and is accessed off
of Walters Mill Lane. Required site improvements include the following:
Three parking areas for employees and trucks. The parking lot closest to the control office contains
one handicap accessible parking space and a concrete sidewalk to the office.
A landscape screen along the front portion and southern side of the lease parcel and supplemental
landscaping around the existing woodlands to screen the outdoor storage.
I am providing you with three (3) copies of the approved site plan. Please forward these copies to the
appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference,
and an approved copy must be kept on the construction site throughout the development process. Once site
development is complete, the owner(s) should contact this office to schedule an on -site inspection. Do not

Dear Mr. Patton:
Planning Staff has reviewed the revised site plan for the Shockey Batch Plant located on the Global Stone-
Chemstone property. At this time, this site plan is denied until the following comments are adequately
addressed.
Review Comments:
1. Landscaping. The landscaping shown on Sheet 7 of 13 is less than what was shown on the approved
site plan. The outdoor storage areas have not changed as a result of the revision and therefore the
landscaping plan should be the same as what is shown on the approved plan.
2. Pump and Haul Permit. A copy of the approved pump and haul permit needs to be submitted to our
department.
Once you have adequately addressed this comment, please resubmit a copy for my review. I will need at least
five copies of the final plan for approval. A comment sheet is required from Frederick Counth, Public Works.

A sight review was conducted on March 9th, 2005 with Shockey's representative, Mr. Tim
Wells, and VDOT representatives, Mr. Jerry Copp and myself. It was agreed upon that the
entrance to the proposed concrete plant could be relocated as requested.
Also, Shockey's agreed to overlay Route 836, Walter's Mill Lane, from Route 11 to the end of
State maintenance with 1.5" of surface mix asphalt. In addition, they would also place 3" of
base asphalt from approximately 1450' east of Route 11 to the railroad crossing. VDOT has
agreed to remove the railroad crossing and make repairs as needed.

The following are our responses to your comments provided for the above referenced
plan.
Comment 1. Property Identification Number. The PIN on the site plan is 44-A-98; however,
the Frederick County Tax Map shows this property as 44-A-144. Please clarify
which is the correct PIN.
Response 1. Agree. The correct PIN is 44-A-144. The site plan has bee revised accordingly.
Comment 2. Truck Parking Spaces. Are the spaces provided for truck parking adequate to
accommodate the space required to turn around?
Response 2. Yes (see previous response letter dated September 27, 2004). The trucks that
will utilize the truck parking area are the concrete mixing trucks which can make
all of the necessary turning movements within the pavement area. We have
included a sketch of the turning movements with this letter for your review.
Comment 3. Creek. Label the creek that is behind the lease parcel.
Response 3. Agree (see previous response letter dated September 27, 2004). The creek that
is behind the lease parcel has been labeled. See sheet 4, 6, 8 or 9 for the creek
name.
Comment 4. Building Height. Show the height of the control/office building and the reclaimed
waste building.
Response 4. Agree (see previous response letter dated September 27, 2004). All
building/structure heights have bee shown on sheet 4 of 15.
Comment 5. Dumpster. Sheet 2 states that there are going to be 12 employees working out
of this site; a dumpster might be appropriate. If a dumpster is not being
provided, please indicate how trash disposal will be conducted.

sheet 2 of 16 for the disposal of trash generated on this site. Although there are
12 employees working from this site, 10 of the employees will be driving the
delivery trucks. The two remaining employees will be the only employees that
are located at this site full time.
Comment 6. Outdoor Storage. Please note that all outdoor storage areas require adequate
screening.
Response6. Agree. Adequate screening is provided by the existing tree line along Clearbrook
Run. Additional screening has been included around the storage areas as
shown on sheet 8 of 18

Dear Mr. Patton:
Planning Staff has reviewed the preliminary site plan for the Shockey Batch Plant located on the Global
Stone-Chemstone property. At this time, this site plan is denied until the following comments are adequately
addressed.
Preliminary Review Comments:
1) Master Development Plan. In accordance with Section 165-133 of the Frederick County Zoning
Ordinance, a Master Development Plan is required prior to any development in the EM (Extractive
Mining) Zoning District. However, in accordance with Section 165-134B, this property may be
eligible for a waiver of the Master Development Plan. To obtain a waiver of this requirement, you
must provide this department with correspondence requesting a waiver and explaining why this
property is eligible. If this property is subdivided in the future or additional development occurs on
the site, a Master Development Plan will be required.
2) Complete Application. Please submit a complete application for formal submission of this
site plan. A complete application includes a site plan, signed application, special limited
power of attorney, and application fee. The application fee for this project is $1,000.00 plus
$100.00 per acre plus $50.00 per acre for each acre over five. With eight acres, the total fee
will be $1,650.00.
3) Location Map. On the vicinity map. please remove the topography and show where the entrance
to this site will be on Brucetown Road.
4) Paving. It is suggested that the paved parking areas be connected to the main access road with
pavement as indicated on the plan.
5) Traffic Flow. Please show which way traffic will be going on the existing gravel road. If traffic
will be going both ways, label which road the gravel road leads to.
6) Parking Spaces. Eighteen spaces are shown on the site plan on Sheet 3. The notation about parking
on Sheet 2 states that there are 16 spaces.

Upon review of the subject site plan, we offer the following comments:
1) Include the sediment basin final design elevations as shown on Sheet 6 of 11 on the
sediment basin schematic shown on Sheet I I of I I.
2) Provide profiles and cross -sections of the emergency spillway for the sediment
basin and the final spillway for the proposed stormwater pond.
3) The detail for the silt fence shall include wire reinforcement.
4) The optional stone combination shall be used for all culvert inlet protection.
5) Provide details on the plan of the outlet structure for the proposed stormwater
pond which clearly indicates the proposed weir section. Provide some language
which clearly outlines the conversion of the sediment basin to the permanent
stormwater pond on the plan.
6) Provide recommendations for the proposed temporary and permanent vegetation
which is specified on the plan. Provide the type of seed, rate of application, etc. as
specified in the Virginia Erosion and Sediment Control Handbook, Standards 3.31
and 3.32. In addition, it will be necessary to provide a rate of application for the
propose mulch in accordance with the Virginia Erosion and Sediment Control
Handbook, Standard 3.35.
7) The use of topsoil is reconunended to promote vegetative growth on all permanent

& 836 right-of-way. The permit is issued by this office and will require a minimum processing
fee, surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy

The following are our responses to your comments provided for the above referenced
plan.
Comment 1. Master Development Plan. In accordance with Section 165-133 of the Frederick
County Zoning Ordinance, a Master Development Plan is required to any
development in the EM (Extractive Mining) Zoning District. However, in
accordance with Section 165-134B, this property may be eligible for a waiver of
the Master Development Plan. To obtain a waiver of this requirement, you must
provide this department with correspondences requesting a waiver and
explaining why this property is eligible. If this property is subdivided in the future
or additional development occurs on the site, a Master Development Plan will be
required.
Response 1. Agree. A waiver of the Master Development Plan requirement for this project
was granted on July 22, 2004. A copy of the waiver approval has bee included
as part of the submission package.
Comment 2. Complete Application. Please submit a complete application for formal
submission of this site plan. A complete application includes a site plan, signed
application, special limited power of attorney, and application fee. The
application fee for this project is $1,000.00 plus $100.00 per acre plus $50.00
per acre for each acre over five. With eight acres, the total fee will be $1,650.00.
Response 2. Agree.
Comment 3. Location Map. On the vicinity map, please remove the topography and show
where the entrance to this site will be on Brucetown Road.
Response 3. Agree. The site entrance on Walters Mill Road has been shown on the vicinity
map.
Comment 4. Paving. It is suggested that the paved parking areas be connected to the main
access road with pavement as indicated on the plan.

Response 4. Exception. If the paved employee and truck parking areas were connected to
the main access road with pavement as you indicated, this pavement would be
torn up with the heavy equipment that is utilized in moving the stockpile material
to the aggregate hopper. We feel that it would be better to leave this area as
gravel so that periodic top dressing and grading can be accomplished as
needed.
Comment 5. Traffic Flow. Please show which way traffic will be going on the existing gravel
road. If traffic will be going both ways, label which road the gravel road leads to.
Response 5. Agree. The traffic flow on the existing gravel road has been identified. The site
plan includes an overall site layout showing the existing gravel road connecting
to Walters Mill Lane as well as the improvements to Walters Mill Lane and Route
11 that were required by VDOT.
Comment 6. Parking Spaces. Eighteen spaces are shown on the site plan on Sheet 3. The
notation about parking on Sheet 2 states that there are 16 spaces.
Response 6. Agree. The parking space notation on sheet 2 has been revised to show 18
spaces.
Comment 7. Truck Parking Spaces. Are the spaces provided for truck parking adequate to
accommodate the space required to turn around?
Response 7. Yes. The trucks that will utilize the truck parking area are the concrete mixing
trucks which can make all of the necessary turning movements within the
pavement area.
Comment 8. Handicap access. Access from the handicap parking spaces to the office
building (ramp/sidewalk) needs to be provided.
Response 8. Agree. A concrete sidewalk has been provided from the end of the handicap
aisle to the building.
Comment 9. Creek. Label the creek that is behind the lease parcel.
Response 9. Agree. The creek that is behind the lease parcel has been labeled.
Comment 10. Building Height. Show the height of the control/office building and the reclaimed
waste building.
Response 10. Agree. All building/structure heights have bee shown on sheet 4 of 15.
Comment 11. Dumpster. Sheet 2 states that there are going to be 12 employees working out
of this site; a dumpster might be appropriate. If a dumpster is not being
provided, please indicate how trash disposal will be conducted.
Response 11. Agree. See note 8 on sheet 2 of 16 for the disposal of trash generated on this
site. Although there are 12 employees working from this site, 10 of the

I am in receipt of your letter, dated June 30, 2004, which requests a waiver to the requirement for a
master development plan for the development of a batch plant on the above -referenced property. The
owner of this parcel is listed as Global Stone - Chemstone and is located off of Quarry Lane in
Clearbrook.
Section 165-134 of the Frederick County Zoning Ordinance gives the Director of Planning and

substantially affect the purpose and intent of the Zoning Ordinance. Therefore, your request for a
waiver to the master development plan requirement is appropriate in this situation. Please be advised

Frederick County Subdivision and Zoning Ordinances. Prior to the development of this property, as ite
plan must be reviewed and approved by Frederick County. Future subdivision of this parcel or other
development of this property may require a Master Development Plan.

Planning Staff has reviewed the preliminary site plan for the Shockey Batch Plant located on the Global
Stone-Chemstone property. At this time, this site plan is denied until the following comments are adequately
addressed.
Preliminary Review Comments:
1) Master Development Plan. In accordance with Section 165-133 of the Frederick County Zoning
Ordinance, a Master Development Plan is required prior to any development in the EM (Extractive
