SITE PLAN CHECKLIST
The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan. The
Department of Planning and Development will review the application to ensure that it is complete. If
any portion is not included or complete, the site plan application will not be accepted and returned to
the applicant(s).

agencies prior to final site plan approval. It is recommended that applicants contact

This letter is in response to your correspondence received by this office on May 17, 2004, requesting a
zoning conformation on the above -referenced properties. In your correspondence, the following questions
were asked:
1. The current zoning of the property? Research of County records indicates the subject property is located
in the Fort Collier Industrial Park and zoned M-1 (Industrial, Light District). A warehouse use is an allowed
use in the M-1 zoning district.
2. Are there any overlay districts? There are no overlay districts involved with this property.
3. Did the property receive site plan approval? This property has a number of approved site plans associated
with this use. You will need to file a Freedom of Information Act (FOIA) requesting copies of any records
from this office. I have enclosed a copy of the FOIA.
4.What are the abutting zoning districts? The abutting zoning districts are all M-1 (Industrial, Light District).
5. Are there any outstanding building or zoning violations on file? There are currently no zoning violations
on the property. This office does not handle building code issues or certificate of occupancy permits. You
will need to contact Frederick County Inspections at (540) 665-5650/5694.
6. Were there any variances or special permits issued? There are no variances or special permits regarding
this property.

as required by the
Virginia Freedom of Information Act

General
1) The Freedom Of Information Act (FOIA) only covers existing public records. It does not
require the county to create a new record or report that does not exist. Requests for
information about a particular subject or lists of questions to be answered are not subject to
the Act. We are not required to sununerize information fi•om existing records. Only requests
for particular documents or other specific existing records are subject to the act.
2) Persons requesting public records need to identify the records they are seeking "with
reasonable specificity."
3) The individual does not need to cite that their request is a Freedom of Inforniation Request
nor the reason they want the information.
4) The FOIA does not speak to whether or not a locality may insist that requests be in writing,
however, for efficiency and accuracy and in order to achieve a "reasonable specificity" in
requests, departments should utilize the attached FOIA request form.
5) The initial response to a request must occur witlun five working days. The response may be
in one of three forms.
providing the requested records;
inform the requestor that the records (or a portion thereof) are being withheld based
on an exemption from the FOIA. If this is the response, it must also cite that
section(s) of the code that exempt the record and the approximate volume and subject
of the records being withheld; or
inform the requester that it is not practical to identify or collect the requested records
within the five days and why. If this is the case, the county is given seven additional
days to make one of the above responses.

Charging for Time Spent
1) The act permits the locality to recoup only the actual costs incurred to locate, duplicate and
supply records. The county does not charge for overhead.
2) If the charges for providing the records are expected to exceed $200, payment may and
should be required in advance.
3) An estimate for fulfilling a request will include an hourly rate for the staff person(s)
retrieving, copying or otherwise preparing the records requested as well as copying charges
at a rate of .20 cents per 8.5x11 page (.40 cents if the page is a 2 sided copy), .25 cents per
legal sheet (.50 cents for 2 sided), and .50 cents for l 1x17 (100 for 2 sided copies), $1.60 for
tapes, and $2.00 for video tapes plus any fees associated with duplicating the video if sources
other than staff are used.

The Virginia Freedom of Information Act (Virginia Code Section 2.2-3700, et. seq.) provides for
inspection and copying of the official public records of the County of Frederick by citizens of the
Commonwealth and media representatives.
The procedures for inspecting or obtaining copies of County of Frederick public record(s) are as
follows:
1) A request must be submitted to the County of Frederick identifying the public record(s)
sought with reasonable specificity.
2) The County of Frederick will act diligently to locate and produce requested public records.
However, the Freedom of Information Act allows five (5) work days to respond, and
citizens should not expect the county's response to be instantaneous. If an extraordinary
volume of records is requested, the county will advise the requestor in writing within the five
(5) work day period which provides the county with an additional seven (7) work days to
respond by statute.

3) The Freedom of Information Act allows the County of Frederick to assess a reasonable
charge to access, search for, duplicate, and supply requested public records. There is a fee
for the county's services which must be paid before the records are received. The
County of Frederick will charge the hourly rate of pay for the time expended by its
employees in searching for and reproducing the record. The County of Frederick will also
charge for copying at the rate of $0.20 per page for letter size duplication, $0.25 per page for
legal size duplication, $0.50 per page for 11 x 17 duplication, $0.40 per page to duplex letter
size public records, $0.50 to duplex legal size public records, and $1.00 to duplex 11 x 17
public records. Prior to the search, the County of Frederick will estimate the cost of
providing the public record(s) to the requestor. Where estimated costs exceed $200, the
County of Frederick will require payment of the estimated cost by the requestor in advance.
4) The County of Frederick is not required to create or prepare a particular requested
record if it does not already exist. The County of Frederick is not required to abstract
or summarize information from official records, or to convert a record from one form
to another. Only existing public records are subject to the Freedom of Information Act.
Not all public records of the County of Frederick are obtainable under the Freedom of Information
Act. Examples of exempt public records include, but are not limited to, police investigation records,
personnel records, closed session memoranda, tax returns, opinions of the county attorney, litigation
records, customer utility records (including the customer's name and service address, but excluding
the amount and costs of service), appraisal and cost estimates, and trade secret information.
If it is determined that all or part of requested public records are exempt under the Freedom of
Information Act, the county will respond with a written explanation.

1. Whenever the Principal shall be, and be declared by the Obligee to be in default under the Contract, the Obligee having
performed th6- Obligee's obligations thereunder, the Surety may promptly remedy the default, or shall promptly:
1.1 Compete the Contract in accordance with its terms and conditions, or
1.2 Obtain a bid or bids from alternative contractors to complete the Contract in accordance with its terms and
conditions, and upon determination by the Surety of the lowest responsible bidder, or if the Obligee elects, upon
determination by the Obligee and the Surety jointly of the lowest responsible bidder, arrange for a contract between such
bidder and the Obligee, and make available as work progresses (even though there should be a default or a succession
of defaults under the contract or contracts of completion arranged under this paragraph) sufficient funds to pay the cost of
completion less the balance of the contract price; but not exceeding, including other costs and damages for which the
Surety may be liable hereunder, the amount set forth in the first paragraph of this bond. The term "balance of the
contract price," as used in this paragraph, shall mean the total amount payable by the Obligee to the Principal under the
Contract and any amendments thereto, less the amount properly paid by the Obligee to the Principal.
2. Notwithstanding any other provision of this bond or the Contract, or otherwise, the Surety is not responsible for and shall
not be held liable to the Obligee for any hazardous waste removal and the Surety shall not be held liable to, or in any
other respect be responsible to, the Obligee by way of indemnity, claims or otherwise, or to any public authority or to any
other person, firm or corporation, for or on account of any fines or claims by any public authority or for bodily injuries or
property damage to any person or thing, including, but not limited to, injury or damage due to the release or threat of
release of hazardous substances of any kind or damage to real estate or to the environment or clean-up costs or other
damages of whatever kind or nature arising out of any act of commission or omission by the Principal, the Principal's
agents, servants, employees, subcontractors or suppliers or any other person in connection with the performance of the
Contract. This limitation applies regardless of when any such fine is assessed, claim is made, or injury, damage, release
or threat of release occurs and without regard to any term or condition of the Contract.

This memo is to document the minor revision to site plan #12-01 that have been requested by
Southeastern Container and approved by staff. The revisions are shown on the attached addendum
to the site plan. The only changes that are being made are to Building Plan #1. The sidewalk is
being eliminated and replaced with landscaping. Minor changes are also being made to the two
raised islands and the electric connection. In my opinion the changes will not negatively effect the
site, nor do they require an officially revised site plan.

As we discussed previously in our phone conversation, please incorporate Site Plan #01-98 into Site
Plan #12-01. Site plan #01-98, for the construction of a railroad spur and parking area, was not
approved by staff. Furthermore, both of these features currently exist on the subject property.
Therefore, staff requires that these features be approved before any new development can occur on
the property.
I am providing you with a copy of staffs review comments for Site Plan #01-98. Please review these
comments and include Site Plan #01-98 into a revision of Site Plan #12-01 as appropriate. Please
remember to label the railroad spur and parking area as existing features and provide a reference to
Site Plan #01-98. Staff is particularly concerned with the required landscaping for the parking area,
the paving specifications of that parking area, and review comments from the Fire Marshal,
Inspections, and Public Works. In addition, please provide staff with a copy of the recently recorded

Dear Mr. Smith:
I had the opportunity to review the above -referenced site plan on March 27, 2001. Unfortunately,
at this time, several changes are required before staff can consider the site plan for approval. Please
review the following comments prepared by staff:
1. Please inform staff of the status for Site Development Plan #01-98. This site plan is or a
proposed railroad spur on Southeastern Container's property, which has not been approved.
During an inspection of the property, I observed these railroad spurs already constructed on
the site. Furthermore, they are shown on this site plan as existing features.

2. Staff requests that you highlight the four areas of proposed development on the site plan,
similar to what is shown.
3. Please provide a statement below the Zoning Administrator's signature box to the effect that
this site plan will be valid for five years from the date of approval.
Please label the existing trash dumpster in the existing parking area and ensure staff on the
site plan that this dumpster will be removed or relocated to an approved location.
5. Please correct the adjoining lot information for the four lots shown on the enclosed site plan.
The information provided is based on our data for the adjoining lots.
6. Please include the boundary line adjustment information for the property to be consolidated
into the lot designated for the proposed parking area.

After you have revised the site plan, please lease resubmit one copy so that I may verify the information
contained a the plan. I will then need all approved review agency comment sheets and five copies
of the final site plan for approval. Comment sheets are required from the following agencies: The
Virginia Department of Transportation (VDOT), the Frederick County Sanitation Authority, the
Frederick County Inspections Department, the Frederick County Engineer (Public Works), and the
Frederick County Fire Marshal. If there is a gas line on the property, staff would advise that you
contact Shenandoah Gas Company for comments as well.
