The site plan calls for the construction of a two additional kilns and two storage buildings. Development is planned to be implemented in three phases. During phase one the two kilns will be constructed, along with a gravel outdoor storage area. To meet the requirements for outdoor storage, a double row of evergreen trees will be planted to screen the property from adjoining roads and properties. Part of the screen will be planted in the Virginia Department of Transportation's right-of-way because of the existence of a major power line along the north property line. Negotiations with VDOT have been made to allow the tree plantings, and preliminary approval has been granted. Phase Two will include the construction of a 12,000-square-foot storage building and a new loading space. The second storage building, also 12,000 square feet, will be added in phase three. The site plan meets all requirements for development in the M 1(Light Industrial District). Additional requirements are specified on the site plan for each phase of development. I am providing you with five copies of the approved site plan. Please forward these to the appropriate representative for Moxon Timbers. Furthermore, please advise the owner that a copy should be kept for future reference and an approved copy must be kept on the construction site throughout the development process. A few changes are required before final site plan approval can be considered. The following comments should correlate with the red markings on the enclosed copy of the site plan. Please address each of these continents in a revised site plan. 1. According to Section 165-33, all outdoor storage areas are required to be screened from view of roads. As you are aware from our previous conversations, a double row of evergreens is required along the entire rear property line and approximately 300 feet along the right property line, beginning from the rear. The owners may need to decrease the proposed length of the gravel storage area to avoid the power line easement. 2. Please correct the rear setback to provide a minimum setback of 75 feet. Furthermore, based on the site plan provided, it appears that a 60-foot ROW exists along the right boundary line. If this is a correct assumption, please correct the right setback to indicate a 75-foot setback. The front setback requirements of the Frederick County Zoning Ordinance apply to all boundary lines that abut a road. The subject lot appears to have three sides that abut a road. If a recorded plat shows different setbacks, please provide staff with a copy. 3. Please correct the typographic error on page one of the site plan. Under the Landscaped Area Calculations, you used decimals instead of commas for the total square feet. �. Please provide the height of all structures (this includes the three kilns). ,/5. Please state on the site plan how the proposed development will affect the total number of employees on the site by providing the total number of current employees and the total number of proposed employees after Phase III. Please label the use of the two existing buildings more specifically. For example, if one building is used for the packaging of lumber and the other is used for milling, please state this on the site plan. 1-8. Please provide the location and nature of all fire lanes, fire hydrants, and all other facilities necessary to meet Fire Code requirements. -9. Please provide the speed limit for Industrial Drive. 10. Based on your calculation of the total building square feet on the lot, two loading spaces (� would be required. Please add at least one loading space in order to meet the minimum requirement. If needed, the additional loading space could be included in one of the later phases. However, once the square footage exceeds 40,000 square feet, an additional loading space is required. 11. It appears to staff that your landscaping calculations are incorrect. If you subtract the total disturbed area (above) from the total lot area, you come up with 107,728 s.f which calculates to a total landscaped area of 40 percent. Please correct as necessary. After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the plan. I will need all approved review agency comment sheets and at least five copies of the final plan for approval. The plans need to clearly define the point of connection (is the proposed connection point at the location where the existing hydrant connects to the main?) Note any fittings that may be required. 2. Please include a profile for the proposed main. Plan preparation standards for the City of Winchester note that the upper half of the drawing shall show the utility line in plan and the lower half shall show the utility line in profile along with the existing and proposed final ground surface. Please revise drawings to conform to this requirement. Stationing shall be shown on the plan view to match with the profile. 3. Note on the profile that the pipe type is Class 52, cement lined D.I.P. 4. The discharge location for the proposed storm culvert is immediately above the proposed watermain. We are concerned about the potential for erosion (and loss of cover). Please revise to eliminate the potential for erosion. 5. The 90-degree bend should be replaced with two 45-degree bends. An easement to the City of Winchester should be shown for the watermain. A copy of the recorded easement needs to be submitted to the City. 7. A valve should be added at the point where the new main branches off of the existing main. This would allow the 6-inch main to be shut down. 8. A valve should be shown at the proposed hydrant. No error or omission in either the plans, calculations or applications (whether these plans, calculations or applications have been reviewed by the Public Utilities Department or not) shall permit or release the applicant and designer from constructing this work in any other manner than that provided for in the Winchester Public Utilities Standards. Particularly, you had requested that the County exempt Moxon Timbers from all screening requirements referenced in §165-33(a) of the Frederick County Code. §165-33(a) states that "... outdoor storage ... shall be completely screened from the view of road and street rights -of -way and from surrounding properties by a fence, wall, or by screening." You have indicated that Moxon Timbers' proposed storage areas should be exempt from these screening requirements because grade deferential make screening impractical. I am not empowered to waive these screening requirements. However, the Board of Zoning Appeals (BZA) has been empowered to hear and decide applications for variances from specific terms or requirements of the zoning ordinance. I have enclosed a copy of the variance application should you wish to pursue such a variance request. In reviewing the screening requirements for outdoor storage areas, and considering your position that the topography makes screening impractical for this project, I would offer the following: 1. The ordinance allows for fence, wall or screening to accomplish the intent of screening the outdoor storage; 2. Providing a fence or wall, at a fixed height, may not provide screening as intended; 3. Providing a row of evergreen trees, Leyland Cypress for example, could provide a screen with a height up to 20 feet. Therefore, it is my position that the screening of outdoor storage is feasible, and I would encourage you to consider the landscape screening alternative. Please contact me with any questions.
