The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).
Site Plan Package
1. One set of approved comment sheets are required from the following review
agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies
are relevant to their site plan application.

which conveys right-of-way along Route 661 for the referenced project.
Unfortunately the deed is unacceptable due to its vagueness. Additionally, the
signature and notary block for the Department of Transportation should not be
included since we were not to sign the deed. Our Right -of -Way Manager is having a
new deed prepared to meet our specific needs. Once I have received it, I'll forward it to
you for re -execution. While this will not hold up the issuance of a land use permit to
complete the right-of-way improvements, we ask that the matter of the new deed be
addressed prior to completion of and our acceptance of the right-of-way work.

WITNESSETH: In consideration of the sum of $1.00 paid by the grantee to the
grantor, receipt of which is hereby acknowledged, the said grantor hereby grants
and conveys unto said grantee in fee simple, with general warranty, the land
located in Stonewall Magisterial District, in Frederick County, and described as

All of that tract containing 10,213 square feet or 0.2344 acre, more or
less, as more particularly described by a plat of survey by Elliott
Ritchie, Jr., licensed land surveyor, dated June 9, 1997, entitled
A PLAT SHOWING 0.2344 ACRE OF THE LAND OF RITE AID OF VIRGINIA, INC.,
TO BE CONVEYED TO THE COMMONWEALTH OF VIRGINIA AND HEREBY DEDICATED FOR
PUBLIC STREET PURPOSES, and being a part of the same land acquired by the
grantor from Lenoir City Company of Virginia by deed recorded in Deed
Book 807, Page 281, in the office of the Clerk of the Circuit Court of said

The grantor by the execution of this instrument acknowledges that the plans
for the aforesaid project as they affect its property have been fully explained
to its authorized representative.

that it has done no act to encumber the said land; that the grantee shall have
quiet possession of the land, free from all encumbrances; and that it will
execute such further assurances of the said land as may be requisite.
The said grantor covenants and agrees for itself, its successors and
assigns, that the consideration hereinabove mentioned and paid to it shall be in
lieu of any and all claims to compensation for land, and for damages, if any, to
the remaining lands of the grantor which may result by reason of the use to
which the grantee will put the land to be conveyed, including such drainage

maintenance of one commercial entrance at the referenced location.
Please ensure a copy of the approved permit assembly is kept at the job site whenever working
within the Route 661 right-of-way. I would also like to remind you of the need to erect and
maintain proper traffic control in accordance with our Virginia Work Area Protection Manual.
For your information the account receivable number for this project is 0245 8563. Any
inspection costs we incur will be billed to you monthly.
Please give Mr. Steve Melnikoff a call at (540) 722-3460 at least 48 hours in advance of the start
of construction to arrange for any necessary inspections.

Temporary Occupancy
Dear Eric,
As a follow-up to our telephone conversation regarding temporary occupancy at Rite Aid, we
offer the following:
1) Rite Aid's immediate intent is only to stock the warehouse.
2) It is our understanding with Steve Melnikoff (VDOT) that use of the temporary entrance
is contingent on maintaining safe and clear access during the entrance construction.
Temporary measures to assure safety may be directed by VDOT.
3) The top coat paving on site is to be completed the week of August 4, 1997.
4) The entrance construction is scheduled to begin as soon as we receive the VDOT permit
(which should be 8/1/97) and Allegheny Power moves the power poles (which we
understand is any time). The entrance work will take approximately three (3) weeks.
We hope this addresses any concerns. We appreciate your cooperation in allowing the
temporary occupancy. It is Rite Aid's and Howard Shockey & Sons' intent to maintain
requirements for this temporary use.

Dear Michael Morris:
This letter is to inform you that the Frederick County administratively approved site plan #006-97
on Ivtarch 18, 1997. This approval allows for a building permit to be issued for the entire project.
As discussed with Mr. John Lewis, Painter -Lewis, P.L.C., and Mr. Robert Childres, Virginia
Department of Transportation, this approved site plan may not address all VDOT concerns. In order
for the contractor to receive the full building permit at this time, Mr. Lewis, Mr. Childres, and
Frederick County have agreed that the issuance of the Certificate of Occupancy will be contingent
upon satisfying all VDOT concerns. Any necessary changes to the site, as a result of VDOT
requirements. will be the sole responsibility of Rite Aid Corporation and their contractor.
Additionally, it will be necessary to revise the site plan to reflect any necessary changes to the site.
This site plan consists of a 161,425 square foot building (151,613 square foot
manufacturing/warehouse portion, 9,812 square foot office). In addition to the proposed building,
there will be 70 parking spaces within an asphalt and concrete curb/gutter parking lot, and asphalt
access roads and tractor trailer staging/storage areas. Landscaping will be installed around the
perimeter of the parking lots, and along the northern property line. The landscaping along the
northern property line will comply with buffer and screening requirements of the zoning ordinance.

appears all of our earlier review comments have been satisfactorily addressed. Please advise the
owner of our approval.
Thank you for your efforts in widening the entrance pavement. When/if warrants establishing
the need for a right turn lane are met, the entrance width and radii will need to be addressed.
The appropriate land use permit may now be applied for to cover work within the Route 661
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage and the salary & expenses of a State assigned Inspector.
All right-of-way dedication plats across the proposed site and adjoining property as shown will
need to be in hand at VDOT prior to issuance of the land use permit. Should you want to submit
plats or agreements to VDOT, we will be happy to review such.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Please provide us with three additional sets of the plans.

The right turn lane and taper for southbound traffic can be deleted at this
stage of development. However, you need to add a note indicating the
developer will install and bear the cost of a right turn lane and taper at such
time in the future the turning activity at the site increases enough to warrant
installation. The need for future right turn lane installation will be
determined by VDOT.
2. The entrance pavement will be 50' at the end of the 45' entrance radii. This
is needed due to deletion of the right turn lane.
3. Please note the attached copy of memo from Robert Crandol outlining a

project. These plans have reviewed by our Residency Office and by our Traffic &
Drainage Engineers at the District Office in Staunton.
We have the following comments regarding the plans and have marked a set in red.
SHEET 4 OF 10:
1) The proposed entrance should be 50' of pavement between the edges of the curb &
gutter at the end of the 45' radii. The curb & gutter should be CG-7 due to the
45 M.P.H. speed. See also Sheet 9 of 10 for detail.
2) Need to provide a right turn lane for southbound vehicles on Route 661 desiring to
turn into the site. The lane should be 100' x 12' with a 150' taper. See also Sheet 9 of
10 for detail.
3) A left turn lane for northbound vehicles on Route 661 desiring to turn into the site is
needed. The lane should be 100'x 12' with a 200' taper. The left turn lane should be
constructed as shown in red, holding the east edge of existing pavement at the
present location throughout the turn lane and proposed project length. Existing
Route 661 right-of-way on the east side has been dedicated by others to meet VDOT
requirements for improvements to their developments. See also Sheet 9 of 10 for
detail.
4) Dedicate sufficient right-of-way on west side on Route 661 to accomplish project
needs through the reach of the proposed site and extend uniformly to intersection of
State Route F-732 south of the project site.

5) Address traffic volumes thoroughly as to effect on pavement design, we see the
intended use of the site primarily as warehousing with increasing use by heavy
truck vehicles. Refer to 1996 issue of Pavement Design Guide for Subdivision and
Secondary Roads in Virginia for proper design features for anticipated heavy truck
volumes. The entire pavement will need to be addressed including existing
Route 661 pavement width for proper depth and structure.
All traffic movements, turn lane designs, etc. should be based on 45 M.P.H. speed limits
on Route 661 (Welltown Pike).

based on? My calculations indicate that approximately 1,600 SF of interior
landscaping is provided within the landscaped islands. This 1,600 SF does not
satisfy the required interior landscaping.

portion of the employee lot that does not comply with this requirement. Please
continue the CG-6 along this southern parking lot perimeter.
7. Provide the location, height, and specifications of any proposed outdoor lighting
fixtures.
8. Provide the location and nature of any proposed outdoor storage areas.

1. Correct the zoning for the property to the north. It should be RA hot M=1. ,

plan as "Limits of Construction." It appears that the "limits" would include most of the 30 acre site.
Therefore, the fee will be $2,250 ($1,000 base + $500 [$100 for each of the first 5 acres] + $750
[$30 for each of the remaining 25 acres]).
You will also need to provide this office with the completed approved comment sheets from the

temporary construction entrance at the referenced location. This letter is to be considered your
permit to do so. The following provisions will be required:
• Work area protection signage in accordance with the attached while working on the right-of-
way will be required.
• All work on the right-of-way is to be confined to the temporary entrance location only.
• A minimum 6" depth of VDOT #1 (2-3 inch stone) course aggregate by 30' in width will be
required. It is to be placed from the edge of pavement and extended back onto private
property far enough to prevent the carrying of mud onto the roadway.
• Positive drainage is to be maintained within the right-of-way at all times.
• A 15"x40' culvert will be required.
• Any disturbed areas of the right-of-way or damages to the pavement structure adjacent to this
entrance will be repaired by you to our satisfaction.
• This permit is being issued for 180 days.
• All work is to be completed in accordance with the enclosed Virginia Erosion & Sediment
Control Handbook, Specification 3.02.
The Department of Transportation will not be held liable for suit should such result from this
operation nor is it granting permission to grade on the property of others or disturb underground
utility lines. If the above listed items are not followed this permit may be revoked.

Along with this letter you will find two copies of the site plan for Rite Aid with revisions
addressing your comments dated January 22, 1997. 1 have received approvals from Engineering,
FSCA, and Inspections. Outstanding approvals are the Fire Marshal, and VDOT.
We have addressed your comments as follows:
Sheet 1/10:
I. The development name has been changed to "1Manufacturing/Wal'ellollslllg/Distribution
Facility".
2. The magisterial district has been changed to Gainesboro.
S Meet 2/ 10:
#S The provided parking is based on maximum employee shift. This number is 60 and
includes office staff. Therefore, we are not assigning I parking space per 250 SF of office.
I prefer to maintain the proposed 73 spaces.
The landscape space calculated for the parking area includes the area between the two
parking lots.
Sheet 3/10
1. The trailer storage areas will be paved with the "heavy" pavement section.
3. Wheel stops have been added to the trailer storage areas.
5. The ramp from the HC parking areas has been adjusted a few feet toward the I -IC spaces.
6. I prefer to leave the south edge of the parking aisle without curbing. Storm water will
sheet flow across the lot and leave the pavement without concentrating. Adding curb will
force the concentration of the flow and increase the possibility of erosion.
7. The outdoor lighting is shown. Tile typical standard height is shown On Sheet 3.
S. Other than trailer storage, no outdoor storage areas are proposed.
