The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan.
The Department of Planning and Development will review the application to ensure that it is complete.
If any portion is not included or complete, the site plan application will not be accepted and returned
to the applicant(s).

agencies prior to final site plan approval. It is recommended that applicants contact
the Department of Planning and Development to determine which review agencies

§ 165-38 FREDERICK COUNTY CODE § 165-38 -'
§ 165-38. Shopping centers, office parks and industrial parks.
The intent of this section is to ensure that private restrictions are established
in certain types of development. In order to promote orderly economic
development and to protect property values in commercial and industrial areas,
the following requirements shall apply to all shopping centers, office parks and
industrial parks:
A. A harmonious coordination of uses, architectural styles, signs and
'andscaping shall be provided to ensure the aesthetic quality and value
of the development. Deed restrictions, dedications, agreements,
contracts, guaranties or other means shall be instituted to ensure that
such coordination occurs.
B. Architectural styles should avoid massive, monolithic or repetitive
building types and facades. No portion of an unpainted concrete block
or unpainted sheet metal building shall be visible from roads or
surrounding properties.
C. Appropriate landscaping shall be provided or required through deed
restrictions, dedications, agreements, contracts, guaranties or other
means throughout the development.
D. Deed restrictions, dedications, agreements, contracts, guaranties or j
other means used to ensure the above shall provide specific standards
and means for enforcement. The Zoning Administrator shall review
such methods before any site plan is approved to ensure that they
accomplish the intentions of this section. The Zoning Administrator
shall review such methods to ensure that private controls are
established to address the requirements of this section. The Zoning
Administrator shall not control the particular designs, styles or
methods used as long as the requirements of this chapter have been
met.

Dear Pat:
This letter is to inform you that the Frederick County Planning Department administratively approved site plan
#003-97 on April 3, 1997. This site plan consists of a 1,659 square -foot restaurant with 31 parking spaces. The
parking lot will be paved with bituminous concrete and provided with curb and gutter. A van -accessible parking
and loading space will be provided as illustrated on the approved plan. Landscaping will be provided on site to
the effect of a three-foot evergreen hedge along the parking lot perimeter, and 15 deciduous trees.
Attached are two copies of the approved plan. This will enable you to provide your contractor with an approved
copy, and maintain a copy for your records. Please have the contractor contact this office to schedule an on -site
inspection once all improvements are complete.

This will acknowledge receipt of your revised site plans dated March 10, 1997 for the
referenced project. It appears you have addressed all VDOT concerns and comments in
a satisfactory manner and the plans are hereby approved. Please advise the developer
accordingly.
I offer the following comments:
1) A preconstruction conference held by you and/or the developer with the
attendance of the contractor, various county agencies and VDOT be conducted prior
to initiation of work.
2) Materials used and method of construction shall apply to current observed VDOT
Road & Bridge Specifications applicable during construction of this development.
3) Our review and comments are general in nature. Should conditions in the field exist
such that additional measures are warranted, such measures shall be completed to
the satisfaction of the Department.
4) The contractor shall notify VDOT when work is to begin or cease for any
undetermined length of time. VDOT will also require 48 hours notice for
inspections.
5) The appropriate land use permits shall be obtained before any work is performed on
the State's rights -of -way. The permits will require a minimum processing fee, surety
bond coverage and the salary & expenses of a State assigned Inspector.

Your site plans for the referenced project dated January 13, 1997 have been reviewed by
our Residency and District Offices. We are returning your plans along with our
comments marked in red on the plan sheets and as follows:
1) Reconstruct the existing entrance (i.e. base, pavement, etc.) and identify box
(drainage) under paved entrance to Delco Plaza.
2) Extend the existing CG-7 and 5' sidewalk from Route 522 to the west side of the
proposed site entrance and tie into the proposed CG-6. Provide a DI-313 on the west
side of the entrance.
3) Provide a DI-7 with Type B grate to replace the existing ES-1 at the west end of the
existing 18" pipe culvert or extend the pipe in a southvvp5t direction to relinNe the
safety hazard of the ES-1 at its present location. Regrade the right-of-way to drain to
the new DI-7 or new ES-1; the entire drainage plan needs to be reworked.
Need to address the adequacy of downstream channel by indicating that the site
improvements do not increase downstream drainage flows. Also drainage
calculations and drainage maps covering the site plan are needed.
4) Identify the limited access line (N 59005'29" E - 158.53') by use of a low profile berm
(earth, shrub, etc.), or standard FE-W1, W2 (woven wire fence).
5) Relocate existing radial curb between the proposed entrance and existing entrance to
Delco Plaza, 14' from EBL edge of pavement (Route 50) to the face of new curb.

6) Trip generation traffic volume and source are needed with anticipated right turn
volume into the site and return to Route 50 EBL.
7) Typical section(s) of the entrance roads and turn lanes including pavement design is
needed. This information can be secured from VDOT file plans for Project #0017-
034-101, C501 and Project #0081-034-001, G305.
Any miscellaneous items marked in red on the attached plan sheets will need to be
addressed.
When you have addressed the above comments, please resubmit five (5) copies of the
revised plans for final approval.

Upon review of the subject site plan, we offer t11e following comments:
1) Indicate how much additional stormwater will be produced from this site
utilizing a ten year and 100 year storm. Indicate where the stormwater
flows from the drop inlets. Verify that the adjacent stormwater piping and
inlets are adequate.
2) Sheet 4 of 4
Install silt fence along the west side of the site.
3) Sheet 4 of 4
Change the contour line 729.0 to correspond with the 629 contour shown
on the subject site plan.
4) Sheet 4 of 4
Indicate the location of the construction entrance on the subject site plan. A
washrack will be required.

Dear Mark:
I have reviewed the above referenced site plan, resubmitted to this office March 20, 1997. The
submittal appears to satisfy most planning concerns. Two additional items should be addressed.
They are as follows:
I . The proposed landscape hedge should be 3-foot-high at the time of planting. Also, include
a list of the type and number of plants, and distance between plantings, to accomplish this
hedge.

The above referenced site plan was received by this office on January 17, 1997. I have conducted
a preliminary review and determined that the following items need to be addressed. Please provide:
1. The location, height, and dimensions of all signs. Ordinance requirements for any
proposed signs: Setback of 10 feet to any property line; minimum distance of 50 feet
from any existing/proposed signs; height limit of 35 feet; maximum size of 150
square feet.
2. The height of all buildings and structures.
3. Posted speed limit of existing adjacent roads.
4. A loading space that satisfies the dimensional requirements (45' by IT). This loading
space should not be placed in a manner that restricts/blocks access to the parking lot
driving lane or the trash dumpster.

1. All utilities should be underground. The submitted plan has `proposed overhead
electric.'
2. The entire parking facility should be provided with curb and gutter. This includes
that portion of the parking lot immediately adjacent to the proposed building.
3. Parking lot setbacks. The parking facility should be located no closer than 5 feet to
any property line; 3 feet to any structure (building, sign post). This concern needs
to be addressed for the handicapped parking area.
4. The area delineated as a loading space, dumpster pad access, and the dumpster
pad/enclosure will need to be modified. The loading space should be a minimum of
45 feet in length. This may be achieved by moving the dumpster pad/enclosure
closer to the building.

2. Please include a note concerning the outdoor lighting. The ordinance requires that
outdoor lighting be arranged to deflect glare away from adjoining properties and
pubic streets. Sources of light on a lot should be hooded or controlled to prevent

Provide a 3-foot evergreen hedge around the perimeter of all proposed parking. This
is necessary to keep headlamps from glaring on adjoining property and roads.
Parking lot landscaping requirements pertain to all proposed parking. Please revise
the landscaping calculations to address all proposed parking, both on and off site.
The plan indicates that six new parking spaces will be provided on the adjoining
property. If these spaces are to be utilized by the Waffle House project, then
landscaping requirements will apply. Trees and an evergreen hedge should be
proposed.
Enclosed is a red -lined copy of this plan. Please address all comments noted above, in addition to
those on the red -lined plan.
You will also need to gain site plan review approval from the following agencies: Virginia

Dear Mark:
The above referenced site plan was received by this office on January 17, 1997. I have
conducted a preliminary review of this plan that revealed a significant conflict with the Zoning
Ordinance.
As we discussed last week, there appears to be some discrepancy over whether the proposed
entrance onto U.S. Route 50 East is permitted. Staff feels that such an entrance would violate
the driveway entrance spacing requirements of the Zoning Ordinance. This conflict has been
discussed with yourself, in addition to Ms. Pat Brasher, Delco Development Company of
Winchester.
The placement of any site's entrance plays a significant role in the site's overall design. Based
on the uncertainty of the proposed entrance's location, I will delay any further review of this site
plan until the entrance issue has been resolved.

FOR : Large shrub or small, often multi-trunked tree of variable outline. Usually grown with open,
rounded crown atop an expanse of bare ornamental trunk.
LEAVEN: Simple leaves are opposite or may be whorled or alternate on rapidly growing stems. They
are elliptical to oval and 1" - 2 3/4" long and 3/4" - 1 1/2" wide. The medium to dark green, often shiny
leaves have entire margins and very short petioles. The leaves generally have a red or bronze color as they
initially open.
FAL.i. COLOR: Yellow, orange or red with all colors often occurring on the same plant.
STEMBTIDSBARK: When young the slender stems are greenish brown, angled and often winged.
With age they become smooth and tan to brown. Small, solitary, oblong buds are closely pressed to the
stem. Smooth, tan to gray bark peels to expose shades of brown to gray or pinkish underbark. Mature
branches and stems often have a muscled appearance.
FLOWERS: Clusters, 6" - 8" or more in length and 3" - 5" wide, are borne at the end of current
season's growth. Individual flowers, 1" - 1 1/2" wide, have six crinkled petals and color ranges from white
to shades of pink, purple and red; showy.
'FLOWERING July through September, one of the showiest woody plants during the summer.
FBIIIT: A round, tan capsule, 1/2" wide, which usually splits into six parts, each holding a small winged
seed.
LANDSCAPE USES: Crape myrtle is used as a specimen or may be planted in groups. The smaller cul-
tivars can serve as deciduous screens, hedges and massings. The ornamental bark has year-round interest,
especially when crape myrtle is planted with an evergreen background and/or ground cover. The summer
bloom is very showy and long lasting.
CULITTRF: Crape myrtle grows best in moist, well -drained soil high in organic content,
although it is drought tolerant and adaptable to various soils. Suited to sunny, hot locations; such sites also
discourage the growth of powdery mildew. Prune for size and shape in very early spring before new
growth begins. Keep deadwood and sucker growth removed but do not flat -top as this drastic shearing re-
sults in poor shape development. Remove spent flowers whenever possible before the fruit develop to en-
courage some reblooming. Crape myrtle responds to supplemental fertilization.

pink bloom. 'Powhatan' - Mildew -resistant, 10 'tall, abundent purple flowers. 'Seminole' - Medium
growth (8' tall and 6' - 7 ' wide), high mildew -resistance, many pink flowers open over a 6 - 8 week pe-
riod. 'Tuscarora' - Mildew -resistant,
ornamental light brown bark, large oral -pink flowers with recurrent bloom, grows to 15' high and wide.
Many additional cultivars exist including dwarfs and plants with multicolored flowers. Generally a culti-
var is available for any size property and for any landscape use.
