The Frederick County Department of Planning and Development administratively approved
the above -referenced site plan on June 25, 2007. Required site improvements include the
following:
Construction of a paved parking lot with four spaces (including one handicap
accessible).
Construction of a 2,610sf building.
Construction of a screened outdoor storage area.
I am providing you with six (6) copies of the approved site plan. Please forward these copies
to the appropriate representative(s). Furthermore, advise the owner(s) that a copy should be
kept for future reference, and an approved copy must be kept on the construction site
throughout the development process. Once site development is complete, the owner(s)

The application for site plan for this property appears to have little measurable impact on
Route 277, the VDOT facility which would provide access to the property. The present
entrance at the adjacent property is adequate for the proposed improvements as shown on
the submitted site plan. Should business ever expand in the future, entrance may need to be
upgraded.

WHEREAS, the Grantors have agreed to allow Grantees to utilize their
commercial entrance on Fairfax Pike (Virginia Route 277) that provides access
said Route to an existing 50' ingress/egress easement that runs over and upon the
land of the Grantors along the common boundary between the aforesaid properties
of the Grantors and the Grantees;
NOW, THEREFORE, WITNESSETH: That for and in consideration of the
sum of Ten Dollars, and other valuable consideration, the receipt of which is hereby
acknowledged, the Grantors do hereby grant and convey unto the Grantees, their
successors and assigns, a permanent easement for ingress and egress from Route
277 to the property of the Grantees, said easement running the length of the
common boundary of the adjoining tracts of the Grantors and the Grantees and a
width of fifty (50) feet, all as more particularly described on the plat and survey of
Douglas C. Legge, L.S., dated June 7, 2004, attached to the aforesaid deed of
boundary line adjustment recorded as Instrument No. 040013213 and incorporated
herein by this reference as if set out in full.
This conveyance is made subject to all other easements, rights of way, and
restrictions of record, if any, affecting the subject property, including the deed of
easement dated July 9, 2007, from Sadie M. Benton, Trustee, to John Max Leight

Dear Jeremy:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staff's comments listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
Special Limited Power of Attorney Form. Please have the property owner sign the attached Special
Limited Power of Attorney Form prior to further review or approval. This form should be notarized
and completed to grant the applicant (you) with authorization to represent them for this MDP.
Existing Trees. Show the existing trees along the eastern property line and provide a safety fence
along the trees to ensure they are not removed during the construction of the site. Please note that if
these trees are removed, supplemental landscaping will be required.
Adjoining Use. The adjoining property is listed with a use of residential; this property contains a farm
market.
4. Easement. Provide the legal reference for the 60 foot easement.
5. Septic. Show the location of the existing drainfield.
6. Parking Lot. Provide one handicap accessible space.
7. Sign. The location of the proposed sign needs to be shown on the plan.
8. Building Size. The 20 foot x 10 foot area of the proposed building needs to be labeled.
After you have revised the site plan, please resubmit two copies so that I may verify the information contained
