Plaiming Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This
site plan is denied until the issues in this letter, as well as all issues of the other review
agencies, have been adequately addressed. Please review Staff's comments listed below
and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1. Handicapped Parking. The second handicapped parking space is located
in such a way that handicapped access to the building is difficult. Relocate
this space or provide a sidewalk connection from the current location to the
office building.
2. Lighting. A detail has not been provided for the wall packs on the
shop/office buildings; show a detail on the plan.
3. Site Layout Plan. Some of the text on sheet 2 has run off the page; correct
the text so that it is visible.
4. Landscaping. The number of trees provided does not match the numbers
shown in the landscaping chart.
5. Waterline. The waterline shown on the plan says to be dedicated to PCSA.
If this waterline is existing, provide a deed book and page number. If the
waterline is proposed, obtain a comment from the FCSA in addition to the
remaining agency comments required below.

approval can be granted. An inspection of this site revealed that it is not in conformance
with the approved site plan 034-06) Therefore any revisions to the plan should reflect
the current condition of the site Revise the submitted minor site plan accordingly. At
this time, administrative approval cannot be granted. This site plan is denied until the
issues in this letter, as well as all issues of the other review agencies, have been
adequately addressed. Please review Staff s comments listed below and then prepare a
revised site plan which adequately addresses each concern.
Review Comments:
1. Project Information. Provide the address of the property, and the use on
the property should be labeled as maintenance and repairs/office. Provide
square footage for each use.
2. Signage. The sign for this property is existing and should be labeled
appropriately. Provide the square footage/height of the sign on the cover
sheet and on the plan. Remove note 4 as the sign has been approved.
3. Parking Calculations. Parking should be provided at one space per 250
square feet of office space and three spaces per service bay, resulting in 29
spaces for this site.

6. Screening. A board -on -board fence/berm combination has been installed
instead of a chain link fence with evergreens. Revise the plans and
provide a detail of the screen already installed. Continue the board -on-
board screen around the entire outdoor gravel storage area as indicated on
the plan. The screened maintenance area shown behind the existing shop
is unnecessary as the board -on -board fence around the gravel storage area
will satisfy the screening requirerllent.
7. Landscaping. Provide a landscaping plan which provides a breakdown of
all required landscaping on the site including impervious area and parking
lot landscaping. Trees designated as parking lot landscaping should be
located around the parking lots and should be deciduous trees. Sonic of

should be replaced.

RE: Lot 15, Westview Business Center, 285 Independence Drive,
Tax Map Number 64-11-15, Building Permits 2551-2006 and 3158-2006
Dear Mr. Donovan:
This office received a letter from the Zoning Administrator, for Frederick County,
requesting a stop work order be issued for the above location due to violations of the
Frederick County Zoning Ordinance. Addition was installed without plans submitted and
a building permit issued. The above is a violation of the following sections of the
Virginia Uniform Statewide Building Code:
Section 103.11 Functional design. The following criteria for functional design in
accordance with Section 36-98 of the Code of Virginia. The USBC shall not supersede
the regulations of other state agencies which require and govern the functional design and
operation of building related activities not covered by the USBC including but not limited
to (i) public water supply systems, (ii) waste water treatment and disposal systems, (iii)
solid waste facilities. Nor shall state agencies be prohibited from requiring, pursuant to
other state law, that buildings and equipment be maintained in accordance with
provisions of this code. In addition, as established by this code, the building official may
refuse to issue a permit until the applicant has supplied certificates of functional design
approval from the appropriate state agency or agencies. For purposes of coordination, the
locality may require reports to the building official by other departments as a condition
for issuance of a building permit or certificate of occupancy. Such reports shall be based
upon review of the plans or inspection of the project as determined by the locality. All
enforcement of these conditions shall not be the responsibility of the building official, but
rather the agency imposing the condition.

Section 108.1 When applications are required. Application for a permit shall be made
to the building official and a permit shall be obtained prior to the commencement of any
of the following activities, except that applications for emergency construction,
alterations or equipment replacement shall be submitted by the end of the first working
day that follows the day such .work commences. In addition, the building official may
authorize work to commerce pending the receipt of an application or the issuance of a
permit.
Construction or demolition of a building or structure, including the installation or
altering of any equipment regulated by the USBC. For change of occupancy,
application for a permit shall be made when a new certificate of occupancy is
required under Section 103.3.
Movement of a lot line that increases the hazard to or decreases the level of safety
of an existing building or structure in comparison to the building code under
.which such building or structure was constructed.
Removal or disturbing of any asbestos containing materials during the
construction or demolition of a building or structure, including additions.
Section 1.20.1 Notice to owner. When the building official finds that work on any
structure is being executed contrary to the provisions of the USBC or any pertinent laws
and ordinances or in a manner endangering the general public, an order may be issued to
stop such .work immediately. The stop work order shall be in writing. It shall state the
conditions under which work may be resumed. No work covered by a stop work order
shall be continued after issuance, except under the conditions stated in the order.
This letter is to serve as a stop work notice. This stop work order will be lifted after the
Zonine Department has resolved these violation and the building permit has been issued.
Please be aware that the above is subject to Section 106 Appeals of the Virginia
