May 03'd 2011 Building Permit came through for a change of use permit was flagged and tenant was called. May 5th Mark and Dana met with tenant informed them that this form was signed and should not have, and that we would not allow them in the building for an indoor recreation May 6ch Kris Tierney, Eric Lawrence, Mark Cheran, and Dana Johnston met with tenant. Cheran, Zoning and Subdivision Administrator Re: Westview Business Centre — Lot 16 Interpretation Request Letter Dear Mr. Cheran: On behalf of the developer, we are requesting two interrelated formal zoning ordinance interpretations for Lot 16 in the Westview Business Centre. The site plan, which is adjacent to properties with compatible zoning designations, includes a 6' high board on board fenced in gravel materials/equipment storage yard to be located behind the building. During the review process, Candice Perkins from your office has stated the proposed material/equipment storage yard is regulated under the provisions of Zoning Ordinance § 165-27, Off- street parking; parking lots. In our reading of the provision of §165-27, we question whether a materials/equipment storage yard is synonymous with a parking lot. It was our understanding that this matter was recently resolved in the Board of Zoning Appeals decision concerning James River Equipment in the Yardmaster Court development. Ms. Perkins has further stated in an email dated August 27, 2007: the gravel surfaced storage yard is to be landscaped with a minimum of "one tree per 2,000 square feet of impervious area". She has cited § 165-27 as the basis for this requirement, although it appears that more specifically she is citing § 165-27.E. I Ea, Perimeter landscaping. Our reading of the opening words of the first sentence of § 165-27.E.1 1 (essentially a statement of the purpose and intent of the subsections to follow) indicates the regulation is intended for application to "parking lots". If one were to overlook the pivotal words "parking lot", it is understandable one might then be mislead wherein § 165-27.E.11.a then refers to "impervious areas". However, we understand that in this instance the use of the words "impervious areas" is not intended to supersede the use of the prevailing purpose evidenced in the term "parking lot" in § 165-27.E. ] 1. For the record, paved off-street parking, in full compliance with the Frederick County zoning ordinance, will to be provided for employees and customers of the proposed business. This parking lot is to be located in front of the proposed building. Because of the fienn-e right-of-waY being located on this property, this site plan must go to the Planning Commission and Board of Supervisors for review. Response: The GIS copy of the Eastern Road plan that we obtained from the County shows an unidentified improved minor collector road in the general vicinity of the property. However, we were unable to determine if' indeed this road was going through the property. Per your comment, it is our understanding that approval of this application will be delayed until review by the Planning Commission and the Board of Supervisors. Because of this delay and uncertainty in the location of the future road, we are requesting a copy of the location map that will go with the agenda for the site plan discussion with the Planning Commission and the BOS. According to the FAA, the proposed building will not be a hazard to air navigation therefore they are not requiring the structure to be lit with obstruction lights. Please note that any changes In the maximum height of twelve (12) feet AGL as submitted, would require a separate review by this office and the FAA. This would include any/all appurtenances (i.e. HVAC systems, antennas, vent stacks, etc) that would exceed the height previously listed. In addition, the determination study does not include any temporary construction equipment such as cranes, derricks, etc, that exceed the height of twelve (12) feet AGL. The use of equipment during construction requires a separate 7460-1 to be filed with the FAA with a copy forwarded to this office for record. The FAA has determined that the proposed building does not appear to be an obstruction in the approach surfaces to the Winchester Regional Airport.
