Candice,
Thank you for your time this morning to discuss dumpster pad and other issues at Fredericktowne
Crossing and we concluded as follow:
1. Dumpster Pad issue:
- Dumpster pad may be located at the future expansion area which already paved with heavy duty
pavement layer.
- The owner shall provide at minimum board on board fencing for the dumpster pads.
- Greenway will send an update sheet showing the new location of the dumpster pads and add
additional note on the site plan: " Dumpster Pad shall be relocated when future expansion
of the building (Martin) is ready for construction. The relocation of the dumpster pads shall
be coordinated and approved by the County."
2. Direct access at Nottoway Subdivision:
If the Nottoway HOA insisted to close the access, County has no objection to close the access
and the owner can provide the gate for maintenance access purpose behind the board on board
fence.
3. Tree removal at Freeton Subdivision:
As discussed, Richard shade Chairman of Freeton HOA has agreed to removed the four existing
Leyland Cyprus that was planted inside the right of way due to safety precautious for motorist
traveling this area. RVG Management will replace with 6 white pines 10'-12' height at planting time to
maintain the screen buffer.
4. Expedite plat review:
Thank you for your help conveying and coordinating the Fredericktowne Crossing Plats to Mark
Cheran to expedite the review and approval. The Owner and the Bank are in process concluding the
financial business agreement and in need of these County approved plats.

The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on August 27, 2007. The site plan revision is approved for the addition of a 225 square
foot freezer area at the existing Fredericktowne Crossing Development located on Double Church Road in thr
Opequon Magisterial District.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan, including
review agency comments from all relevant review agencies. 1 am providing you with three (3) copies of the
approved site plan. Please forward these copies to the appropriate representative(s). Furthermore, advise the
owner(s) that a copy should be kept for future reference, and an approved copy must be kept on the
construction site throughout the development process. Once site development is complete, the owner(s) should

granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern.

THIS DEED OF LOT CONSOLIDATION AND RIGHT OF WAY DEDICATION (this
"Deed") is made as of the 20th day of September, 2005, by and between STEPHENS CITY GF,
LLC, a Virginia limited liability company ("Company"), as grantor and grantee for indexing
purposes, and the COMMONWEALTH OF VIRGINIA, ("State") as grantee for indexing
purposes.
RECITALS
A. Company is the owner of three (3) parcels of land located in Frederick County,
Virginia, said parcels being designated as (i) T.M. 86-A-10 containing 9.7952 acres, and (ii) T.M.
86-A-I I containing 9.7094 acres, and (iii) T.M. 86-A-83 containing 0.2245 acres, all as more
particularly described on Exhibit A attached hereto and made a part hereof by this reference (the
"Property"). Company acquired the Property by deeds from (i) Jeni Company, dated June 13,
2005, recorded June 20, 2005, in the Clerk's Office of the Circuit Court of Frederick County,
Virginia, as Instrument No. 050013248, and (ii) Elizabeth Properties, L.C., dated June 14, 2005,
recorded June 20, 2005 in the aforesaid Clerk's Office as Instrument No. 050013249, and (iii)
Jennings Lee Lichliter, dated June 15, 2005, recorded June 20, 2005, in the aforesaid Clerk's
Office as Instrument No. 050013247.
B. Company wishes to consolidate the Property into one (1) parcel, and to dedicate a
parcel containing 0.5371 acres to the Commonwealth of Virginia for future road widening
purposes.
AGREEMENT
NOW, THEREFORE, for and in consideration of the premises, the sum of One Dollar
($1.00) cash in hand paid, and other good and valuable consideration, the receipt of which is
acknowledged, it is agreed as follows.

1. Dedication. Company hereby quitclaims unto State, all of its right, title and
interest in and to that certain parcel of land containing 0.5371 acres (the "Right of Way Parcel"),
as shown on a plat entitled "Final Plat for Lot Consolidation and Right of Way Dedication of the
Land of Stephens City GF, LLC, made by Greenway Engineering, Mark D. Smith, Land
Surveyor, dated July 15, 2005, which plat is attached hereto as Exhibit B and made a part hereof
(the "Plat"), reference to which Plat is made for a more particular description of the Right of Way
Parcel. This conveyance is made subject to restrictions, easements, and conditions of record
insofar as they may be lawfully applicable to the property hereby conveyed.
2. Consolidation. Company does hereby declare that the Property, less and except
the Right of Way Parcel, is hereby consolidated into one (1) parcel containing 19.1920 acres (the
"Consolidated Parcel"), said parcel being shown on the Plat as "Consolidated Tax Parcel 86-A-
10, 19.1920 Acres," reference to which Plat is made for a more particular description of the
Consolidated Parcel.
This Deed is made with the free consent and in accordance with the desire of the
Company, and in accordance with the statutes of the Conunonwealth of Virginia governing the
platting of land.
This Deed is further made subject to all matters shown on the Plat attached hereto as
Exhibit B, and to all easements, restrictions, reservations and other matters contained in duly
recorded deeds, plats and other instruments constituting constructive notice in the chain of title to
the property hereby dedicated and consolidated, which have not expired by limitation of time
contained therein or have not otherwise become ineffective.

Magisterial District, Frederick County, Virginia, fronting on the northeastern side of Double
Church Road (Va. Route 641) containing 9.651 acres, more or less, being more particularly
described on that certain plat dated July 7, 1986, drawn by Greenway Engineering & Surveying
Co., Inc., which plat is attached to and made a part of that certain Deed dated October 3, 1990,

591; and being the same land acquired by the Grantor herein by deed from Elizabeth Properties,
L.C., dated June 14, 2005, and recorded June 20, 2005, in the aforesaid Clerk's Office as
instrument No. 050013249.

appurtenances thereunto belonging, lying and being situate along the Northern side of State
Secondary Road Number 277, in Opequon District, Frederick County, Virginia, about (1) mile
East of Stephens City, Virginia. said lot beginning at the Southeastern corner of the R. E. Albin
land acquired by Albin by deed from Philip C. Bowman, of record in the Clerk's Office of the
Circuit Court of Frederick County, Virginia, in Deed Book 190 at Page 374, and extending in a
generally Eastern direction along the Northern boundary of said road a distance of sixty five (65)
feet, thence in a direct line in a generally Northwestern direction a distance of one hundred
seventy nine (179) feet, more or less, to a set stake; thence in a direct line in a generally Western
direction a distance of forty five (45) feet, to a stake set in said Albin's Eastern boundary line
thence in a generally Southern direction in Albin's said line to the point of beginning and further
described as containing 0.2245 acre or 9,779 square feet on metes and bounds description of
Richard A. Edens, L.S. dated March 17, 2005; and being the same land acquired by the Grantor
herein by deed from Jennings Lee Lichliter, dated June 15, 2005, and recorded June 20, 2005, in
the aforesaid Clerk's Office as Instrument No. 050013247.
