Originally our plan indicated that with Phase 1, 8 handicap spaces would be provided on Lot 4. This lot has 82 parking spaces and therefore only 4 handicapped accessible spaces are required. To correct this disparity, we have revised 2 handicap spaces in the Phase 1 area to standard spaces leaving 6 handicap spaces. I have attached 2 copies of the modified site plan and hope this change can be noted and placed in the file. The site plan is approved for the construction of two office additions to an existing building and one new office building to be built in three phases, at the Dawson Industrial Park located on Dawson Drive in the Back Creek Magisterial District. This development contains the following: • Phase I — 8,000sf office addition to existing office building. • Phase II — 15,000sf new office building. • Phase III — 8,000sf office addition to existing office building. Some of the required site improvements include the following: • Construction of parking lots with a total of 110 new spaces, (including seven handicap accessible), including sidewalks, landscaped islands, striping, and handicap access. • A shared screened dumpster area. • Landscaping as shown on the plan. • ROW dedication on Shady Elm Road. All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan, including review agency comments from all relevant review agencies. I am providing you with six (6) copies of the approved site plan. Please forward these copies to the appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy must be kept on the construction site throughout the development process. Once site development is complete, the owner(s) should contact this office to schedule an on -site inspection. The boundary line adjustment/subdivision needs to be completed and recorded before the site plan can be approved. The owner has recorded the plat on August 8, 2007, instrument number 070013204. Please see attached copy of the BLA plat. 2. Route 37. The interchange proposed for this area needs to be accounted for with this site plan. We have outlined the dedicated R.O.W. as requested by the county on our revised site plan. 3. Shady Elm Road. As indicated in the Frederick County Eastern Road Plan, Shady Elm Road is identified as an improved major collector road (UD4). This plan needs to accommodate an additional lane on their portion of Shady Elm Road (lane, curb, and gutter). A sidewalk needs to be provided along the property's frontage of Shady Elm Road as well. The additional right of way required by the MDP and Subdivision Development Plan has been provided. No further components are necessary to support this development. 4. Shared Parking. Phase 2 and Phase 3 are located on separate parcels. The use of the buildings does not negate the requirement for a shared parking agreement. Shared access and parking easement should be provided over all affected parcels. A note has been added to the site plan. 5. Tree Locations. Trees should be provided between the parking and driving areas and Shady Elm Road. Trees have been relocated as necessary. Please find enclosed two sets of the revised site plans. The boundary line adjustment/ subdivision needs to be completed before the site plan can be approved. The boundary line adjustment plat was submitted on June 29, 2007. 2. Route 37. There is an interchange proposed for this area which needs to be accounted for with this site plan. The site plan is in accordance with the approved Master Development Plan which did not provide any areas reserved for a potential interchange. While the Win -Fred MPO 2030 Transportation Plan indicates a future interchange at Route 37 and Shady Elm Road it is impossible to show the ramp locations without any engineered plans having been completed for the interchange. When the interchange design is available we will show it on our plan. Please see attached approved MDP. 3. Proposed Use. The plan states that the use is office; the only type of office uses permitted in the M1 are construction contractors offices (SIC 15, 16, 17), Engineering (SIC87) and offices that do not provide services to the general public. Provide the type of office this development is proposing. The proposed uses of the site are SIC 15 and 17 (office and storage facilities for building construction contractors and special trade contractors). American Woodmark has many of their offices in the park. There are not generally visited by the public. 4. Shady Elm Road. Indicate if a ROW dedication is needed form this property or if any road improvements are necessary. • A 60-ft ROW dedication has been indicated on the revised plans sheets 4 and 5. There were no road improvements required by the final MDP. 5. Sidewak A sidewallz needs to be provided along the two propertys Shady Elm Road frontage. No sidewalk was proposed along Shady Elm Road on the approved MDP plan. As this is an open section roadway, we do not believe a sidewalk is appropriate at this time. 6. Access Easement. Provide the legal reference for the existing access �/� easement. PH1Li \l Legal reference of access easement has been added to the site plans sheets 4 and 5. 7. Phase I Pal -Icing. The Phase I parking has wheel stops at the end; a rolled asphalt curb should be used instead. NVe have replaced the wheel stops with rolled asphalt 6" curia in parking lot phase 1 and 3. Phase 2 will have access road connection. 8. Existing Parking. The existing parking lot needs to be revised as indicated on sheet 5. Existing parking lot has been revised accordingly. Please review revised plans. 9. Shared Pau-1611g. A shared parking agreement needs to be created and recorded for the parking lot being built with Phase 2 that is being shared with Phase 3. Phase 2 and phase 3 will have the same tenant (American Woodinark). 10. Phase 2 Parldng. Provide wheel stops at the end of the Phase 2 parking lot. Phase 2 parking will connect to the access road and will have curb and gutter enclosure. 11. Phase 1 Landscaping. Revise the tree locations and provide shrubs as indicated on sheet 12. Deciduous trees should be mixed with the evergreen shrubs and additional shrubs need to be provided as indicated on sheet 13. Shrubs have been added along the parking lot. 14. Landscaping Totals. With the total impervious surface and parking spaces, the site should have 73 deciduous trees; only 68 have been accounted for. PRA Indicate on the plan if there are any existing trees. HWe have revised the landscaping to include existing and proposed landscaping trees. 15. Dumpster. Provide a detail for the dumpster fence. Each phase will be accessible through Dawson Drive, a 54-foot wide right-of-way which connects Shady Elm Road (Route 651) with the Blackburn Limited Partnership tract to the north. The approved plan calls for the dedication of a 60-foot right-of-way for the future widening of Shady Elm Road, a regional stormwater management facility designed to serve the 26.4493-acre site, and an ingress/egress easement for the Frederick County Sanitation Authority pump station. At this time, administrative approval cannot be granted. This site plan is denied until the issues in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern. Review Comments: 1) BLA. The boundary line adjustment/subdivision needs to be completed before the site plan can be approved. 2) Route 37. There is an interchange proposed for this area which needs to be accounted for with this site plan. 3) Proposed Use. The plan states that the use is office; the only type of office uses permitted in the MI are construction contractors offices (SIC 15, 16, 17), Engineering (SIC 87) and offices that do not provide services to the general public. Provide the type of office this development is proposing. 4) Shady Elm Road. Indicate if a ROW dedication is needed from this property or if any road improvements are necessary. 5) Sidewalk. A sidewalk needs to be provided along the two property's Shady Elm Road frontage. 6) Access Easement. Provide the legal reference for the existing access easement. 7) Phase I Parking. The Phase I parking has wheel stops at the end; a rolled asphalt curb should be used instead. 8) Existing Parking. The existing parking lot needs to be revised as indicated on sheet 5. 9) Shared Parking.
