Dear Mr. Oates:
The Frederick County Department of Planning and Development administratively approved the
above -referenced site plan on September 25, 2007. The site plan is approved for improvements
to the country store located at 5057 Northwestern Pike (intersection of Northwestern Pike and
Hayfield Road) in the Back Creek Magisterial District. This construction includes the following:
Construction of paved parking areas with a total of 19 spaces, (including one handicap
accessible).
Closure of one of the existing entrances on Northwestern Pike.
Landscaping and screening as indicated on the plan.
The site plan meets all conditions and requirements placed on this property by Conditional Use
Permit #08-06. All relevant review agencies have approved the project at this time. I am
providing you with five (5) copies of the approved site plan. Please forward these copies to the
appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for
future reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this office
to schedule an on -site inspection. Do not hesitate to contact Inc should you have any questions or

We have received your revised site plan dated April 6, 2007 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval. Also please provide six (6) sets of approved construction
plans with signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 50
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of
any/all recorded plats of dedication for drainage easements or additional right-of-way required
for implementation of this proposed project should be provided to VDOT prior to issuance of
any land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

THIS DEED OF DEDICATION, made and dated this 14 day of September,
2007, by and between THE EASY CHAIR COMPANY (Grantor) and the
COMMONWEALTH OF VIRGINIA, Grantee.
RECITALS
A. The Grantor is the owner of a certain tract or parcel of land containing 1.206 acres,
more or less, at Hayfield, in Back Creek Magisterial District, Frederick County, Virginia (the
"Property"), having acquired said parcel from Gail M. Nail, et al, by deed dated June 22,
2000, of record in the aforesaid Clerk's Office in Deed Book 968, at Page 1819 and by deed of
boundary line adjustment, dated June 25, 2007, with Stuart M. Perry, Inc., of record in the
aforesaid Clerk's Office as Instrument No. 070010650; and
B. The Grantor desires to dedicate to public use for street purposes that portion of the
Property identified as a 25' R.O.W. DEDICATION TO TIME COMMONWEALTH OF
VIRGINIA on that certain plat titled "Final Survey of A Right of Way Dedication to the
Commonwealth of Virginia from The Easy Chair Company" dated June 29, 2007, drawn by
Gary R. Oates, L.S., a copy of which is attached hereto and made a parl hereof.
C. The Grantor desires to dedicate a 10'X85' Drainage Easement to the
Commonwealth of Virginia, as more particularly shown as the hatched area on the aforesaid
plat.

and other good and valuable consideration deemed adequate at law, the receipt of which is

Planning Staff has reviewed the above -referenced site plan to determine if administrative
approval can be granted. At this time, administrative approval cannot be granted. This
site plan is denied until the issue in this letter, as well as any issues of the other review
agencies, has been adequately addressed. Please review Staffs comments listed below
and then prepare a revised site plan which adequately addresses this concern.
1. Landscaping. The site plan does not match the number of proposed trees. One
tree is missing from the plan. The calculations for the types of trees do not
correlate with the site plan.
After you have revised the site plan, please resubmit two copies so that I may verify the
information contained on the plan. All agency comments have been received, except the
Virginia Department of Transportation.

To Whom It May Concern:
On February 21, 2007 this office received a set of site plans along with a request for site
plan comments. This office has no objections to this proposal so long as the following conditions
and comments are met and understood.
I. As previously stated on the Conditional Use Request Form on 08/1 1/06,
there can be no increase in water use.
2. A permit for the existing well can not located in our files, and the well is
located less than 50' from the existing building. Any buildings or new
construction within 50' of the well can not be chemically termite
heated.
3. The well water can not be served to the public. The Health Department
also suggests that the well be tested for E-Coli and Total Coliform .
4. The Health department will not approve any food preparation.
5. The existing drainfield was permitted in 1958 and the Health Department
can not guarantee the system will continue to function properly. Also be
aware that the department never received a walkover request of the
existing system.
6. It is the owner and contractors responsibility to mark and protect the
existing drainfield. Any damage to the field will require a repair permit
from the Health Department; however, there is never a guarantee that
a field can always be repaired.

3. Business Sign. The existing sign height is taller than five feet. If a new sign is
proposed with a five foot height, please note that on the plan.
4. Landscaping. The site plan does not match the number of proposed trees. One
tree is missing from the plan. I-Iedgerows are required along parking spaces that
face adjoining properties.
5. Building Restriction Lines. Please provide the appropriate BRL's to the project
site.
6. Adjoining Properties. Provide the PfNs and legal references for the properties
adjoining this property. This includes properties across right-of-ways.
7. Speed Limit. Please provide the speed limit for adjoining S. Hayfield Road.
8. Stop Sign. Stop signs are needed at each exit.
