application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).
(1) One (1) set of approved comment sheets are required from each relevant review

Dear Mr. Berneburg:
The above -referenced site plan was approved on May 11, 2007. The site plan is approved for the
construction of a new 3,978 square foot McDonald's at the Orrick Commons development located on
Senseny Road and Greenwood Road in the Redbud Magisterial District. Required site improvements
include the following:
Construction of a parking lot with 56 spaces (including three handicap accessible), including curb
and gutter, striping, handicap access and landscaping.
Sidewalks as indicated on the plan.
One loading space and a dumpster area as indicated on the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with three (3)
copies of the approved site plan. Please forward these copies to the appropriate representat ive(s).
Furthermore; advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is
complete, the owner(s) should contact this office to schedule an on -site inspection. Do not hesitate to

Dear Ms. Perkins:
Enclosed please find five (5) complete sets of revised site and civil plans for the
above referenced project. These site plan sets are sent to you for your review
and approval.
With respect to your comment concerning the FAR on the Cover Sheet, we have
revised as requested the 6.13% to .06
Also enclosed are the Approval Letters from the following departments;
Frederick Co. Sanitation Authority dated 2-13-07
Virginia Department of Transportation dated 1-31-07
Orrick Cemetery Company, Inc. dated 3-13,07
County of Frederick Department of Public Works dated 2-13-07

The Frederick County Fire and Rescue Department had one final comment as to
the location of the closest Fire Hydrant to the McDonald's Restaurant.
We now show the closest Fire Hydrant to the McDonald's Restaurant, which is to
be provided by the Orrick Commons Developer. The Fire Hydrant is located
approximately 185 feet off of the northeast corner of the McDonald's Restaurant,
across the internal access road within the Orrick Commons Development.
Two (2) complete sets of site plans have also been provided to the Frederick
County Fire and Rescue Department for their review and Final Approval
concerning the Fire Hydrant location on the Site Plan sheets.

Dear Ms. Perkins:
Enclosed please find one (1) complete set of revised site and civil plans for the
above referenced project.
These are sent to you for your review and comment, and in response to your
review letter of March 1, 2007.
With respect to the comments contained in your letter, please note the following:
1. The subdivision of the parcel is being handled by the Developer. We
understand final site plan approval cannot be granted until the subdivision
is complete.
2. We have added a signature block to the Site Plan Sheet (C-1) for the
Zoning Administrator.
3. We have added a note to the Cover Sheet indicating the McDonald's
building design must be in accordance with the proffers from the
rezoning.
4. We have added the requested Site Information to the cover sheet.
5. We have added a note to the site Plan stating that all utilities are to be
underground, and all outdoor lighting must be shielded.

6. We have added the building restriction line for Senseny Road to all
applicable sheets.
7. We have revised all plan sheets to mirror what has been approved with the
Orrick Food Lion Site, with respect to the site access road.
8. We have modified the dimensions of the proposed parking stalls to 9'x20',
180 SF, as required by ordinance.
9. We have added one (1) parking stall to our original count, now providing
56 stalls.
10. We have revised all aisle widths to be 22-feet in width.
11. We have designated the 12'x45' loading space on the Site Plan.
12. We have revised the curb and gutter detail on Sheet C-7 to reflect the
standard CG-6 detail.
13. We have added crosswalks, driving arrows and signage, as indicated on
the red -lined plan.
14. We have deleted the shopping center monument sign, which was
erroneously shown in the right-of-way.
15. We have reviewed the comment regarding consolidating the two (2)
entrances into one (1) entrance for the McDonald's. Please note
McDonald's respectfully requests the configuration for access to the lot
remain as is. We note a single entry to the property, directly opposite the
middle of the building, will cause access problems for truck deliveries and
drive-thru stack. In addition, the second driveway affords greater
flexibility for trash pick-up, queuing at the exits, and a more comfortable
and traditional traffic flow around the proposed McDonald's building.
Please note the original plans prepared by the Developer for this out -
parcel showed two (2) driveways. And, please keep in mind the ring road
directly adjacent to the McDonald's represents a secondary access drive,
as the Food Lion is located some 300-feet away, and there is over 200-feet
of stack to the Senseny Road exit.
16. We have added notes to the Landscape Plan stating all plantings to
conform to Frederick County Zoning, and any plant substitutions must be
approved in writing.

17. We have added seven (7) additional trees to the Site, and have revised the
Landscape Requirements Chart accordingly.
18. We have calculated and listed the required interior green space for the
parking lot, and have indicated such on the Landscape Plan.
19. We have added a note to the Photometric Plan (C-9) stating low impact
lighting will be used.

Dear Jeff:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. "Phis site plan is denied until the issues in
this letter, as well as all issues of the other review agencies, have been adequately addressed. Please review
Staffs comments listed below and then prepare a revised site plan which adequately addresses each concern.
Review Comments:
1) Subdivision. Currently this development is shown on parcel 55-A-201 A, which is a 4.33 acre
property; the site plan application states that 1.49 acres of this area is being developed with the
McDonald's. This 1.49 acre parcel must be created before the site plan can be approved.
2) Approval Block. A signature block is required on the coversheet of the site plan for the Zoning
Administrator. This approval block also needs to have the statement "site plan valid for five years
from date of approval".
3) Building Desil4n. Insure that the design of the McDonald's building is in accordance with the
proffers from the rezoning (see highlighted proffers on the coversheet).
4) Site Information. On the coversheet or on sheet C-1, the following site information must be
provided: PIN#, BRL's, total acreage and developed acreage, building height, zoning, and the FAR.
5) Notes. On sheet C-2, provide notes that state: all utilities must be underground and all outdoor
lighting must be shielded to prevent glare on adjacent properties and road right-of-ways.
6) BRL's. On sheet C-2, show the front building restriction line for Senseny Road.
7) Bike Path/Site Access. The site access (Senseny Road entrance) does not reflect what is shown on
the site plan for the Food Lion Development. Also, the bike path is shown without ramps and a
crosswalk for the entrance. Revise the plan to mirror what is being approved with the Orrick Food
Lion Site Plan.
8) Parking Space Size. The parking spaces are shown on the plan as 162sf, ordinance requires parking
spaces to be a minimum of 180sf.
9) Parking Space Number. Fifty six parking spaces are required for the site.
10) Aisle Width. The parking spaces are shown at a 75' angles and 90' angles and the aisles are 20 feet
in width. Parking spaces Nvith angles of 90' require a minimum 22 foot driving lane width for one
way traffic. Since 90' angle spaces are mixed with 75' angle spaces, the aisles need to be 22 feet.
The aisle width can go down to 18 feet if the entire site contained spaces with angles between 60' and
750.

II) Loading Space. One 12 foot x 45 foot loading space is required for this site.
12) Curb and Gutter. The perimeter of all parking spaces is required to have a minimum of CG-6.
Sheet C-7 shows a reveal curb and a modified CG-6; please note that the reveal curb cannot be used
around parking spaces.
13) Crosswalks and Driving Lanes. Provide crosswalks and driving arrows as indicated on sheet C-2.
Also, since the site has a one way travel isle, one way signs/striping should be utilized.
14) Monument Sign. Sheet C-2 depicts the shopping center monument sign within the ROW that was
dedicated to VDOT.
15) Site Entrances. The first entrance into the McDonald's site is very close to the main road that
accesses the shopping center. The two entrances should be consolidated into one entrance that aligns
with the entrance into the Food Lion parking lot.
16) Landscaping Notes. On sheet C-4, notes need to be provided that state (1) all planting shall conform
with S 165-36B of the Frederick County Zoning Ordinance (Plant selection, planting procedure, and
maintenance), and (2) any plant substitutions must be approved in writing by the Frederick County
Planning Department.
17) Street Trees. The proffers from the rezoning stated that street trees need to be provided on Senseny
Road that are a maximum of40 feet apart. This street tree requirement is separate from your parking
lot tree requirement. The road frontage for this site would require seven trees and the parking lot.
plantings require 23 trees; therefore, the entire site will require 30 trees.
18) Interior Green Space. The proffers from the rezoning required that the interior portions of the
parking lot contain a mininnunn of 6% green space; on sheet C-4 provide the total this parking lot has.
19) Outdoor Lighting. Ensure that proffer 9.1, which states that low impact outdoor lighting will be
used (dark sky criteria), is being implemented on the site.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained
on the plan. I will need all approved review agency comment sheets and at least five copies of the Final plan
for approval. Continent sheets (approvals) are required from the following agencies: the Frederick County
Inspections Department, the Frederick County Engineer (Public ilforks), the Freclerick Coui7ty Fire Marshal
and the Frederick County Sanitation Authority.

This office has received the request for a preliminary design review. Unfortunately our office
does not do preliminary reviews. The I icallh Department does require a Plan Review For the
1McDonald's to be located at Orrick Conllllons, Out Parcel No. 92, \Vincllcsler, VA. This letter is
t0 Inform you that the information listed below must be received by the FreClerick County I-Icaltll
Department 110 later than 30 days prior to the facility Opening. It also Serves to notify you that
before issuing a food service permit for the facility the following must be completed:
1. Complete application received and plan review. As well as an $80 fee must be
paid "S40 for permit and S40 for plan review f ce."
2. A complete list of food suppliers and vendors must be submitted "this ilia), be
given to the Environmental 1-iealtlI Specialist at time Of constrn uctioinspection".
3. \Vatcr Supply and sewage information "letter or bill" stating the facility is on
public water.
4. Our Office must receive a site plan and Floor plan.
