The checklist shown below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will rcN iew the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the

Buildings shall comply with The Virginia Uniform Statewide Building Code and Sections 311,

Proposed warehouse addition of 100000 sq ft. Fully Sprinkled. Unlimited Area permitted — see
IBC 507.2. All required egress shall be handicap accessible. Building egress is not shown on
site plan. Handicap parking shall be provided so as to access main entrance of building. Three
HC parking required Signage shall comply with USBC 1106.8.
Special inspection requirements of Chapter 17 of IBC shall apply to this type of structure. (soils,
concrete, steel etc.)

Emergency Egress shall comply with IBC Section 1014. Exits shall meet the required distance
apart and travel distance shall not be exceeded (T 1015.1) All required egress shall be accessible
in accordance with ANSI Al 17.1-03. Door threshold shall not exceed '/2". All landing shall be
max 1:48 slope and sidewalks shall maintain 2% slope or comply with the ANSI A117.1-03 for
accessible ramps. Exits that do not lead away from the building or to a public way shall be
protected in accordance with IBC Section 1007.8 for assisted area of rescue.
Curb ramps shall have a min 36" landing. Curb ramp landing shall be as wide as curb ramp.
Qgon rear slopes established and exiting requirements.

Dear Eric:
Planning Staff has reviewed the above -referenced site plan to determine if administrative approval can be
granted. At this time, administrative approval cannot be granted. This site plan is denied until the issues
in this letter, as well as all issues of the other review agencies, have been adequately addressed. Please
review Staffs comments listed below and then prepare a revised site plan which adequately addresses
each concern.
Review Comments:
1) Site Plan. This modification requires a minor site plan submission. Please submit a site plan
application and a minor site plan fee.
2) BLA. A boundary line adjustment was completed for the rear parcel after the property was site
planned; a zoning district buffer is now required since the gas station property now adjoins
residential. This BLA also stated that the portion of 55-A-34 that was consolidated into 55-A-37
was zoned B3. The official tax maps show that portion of the property as being B2, not B3.
3) Off Premise Business Sign. An illegal off premise business sign for this business was placed on
the Carwash property, west of this property. Off premise business signs require the approval of a
Conditional Use Permit. Since this sign did not receive approval, it needs to be removed. There
is an off premise sign for the diesel price on the property across Eckard from this site which needs
to be removed as well.
4) Additional Sij4n. The property was site planned with one large pylon sign which has been
constructed on the property. After inspection of the property for occupancy, another freestanding
sign was added to the property; remove this sign.
5) Property Zoning. This site is zoned B2, not B3, and a U-Haul business cannot operate anywhere
on this property. The U-haul business that has been operating from this site needs to be removed.
6) U-Haul Storage. In addition to the U-Haul trucks being stored in the front parking lot, an older
U-haul truck is being stored behind the building in the grass/dirt. All the U-Haul trucks need to
be removed from this property.

7) Eckard Circle Entrance. The first entrance (exit only traffic) is not functioning property, as
vehicles can enter fi-om this area. Provide signage that clearly delineates that this is for "exit
only"
8) 7-11 ParkinI4 Lot. The 7-1 1 parking lot needs to be adjusted to remove parking spaces from the
VDOT ROW.
9) Special Limited Power of Attorney Form. Please have the property owner sign the attached
Special Limited Power of Attorney Form prior to further review or approval. This form should
be notarized and completed to grant the applicant (you) with authorization to represent them for
this site plan.
After you have revised the site plan, please resubmit one copy so that I may verify the information
contained on the plan. I will need all approved review agency comment sheets and at least five copies of
the final plan for final administrative approval. Comment sheets are required from the following
agencies: the Virginia Department of Transportation.

We are in receipt of your comments letter of April 5, 2007, and offer the following comments:
Comments from Frederick County Department of Planning and Development:
Comment l: Signature Blocks. A signature block needs to be provided for the Zoning Administrator.
Response: A signature block has been added to sheet 1.
Comment 2: Entrance. An easement for the shared entrance needs to he created/recorded before the site
plan can he approved
Response: The proposed easement is shown on the plan. We are in the process of preparing the plat for
recordation. A copy will be forwarded to your office upon completion.
Comment 3: Freestanding Signs. Label the locations of the two signs on the property and label the sign
that will he removed
Response: The sign locations have been approximated on the plan with a note for the one to be removed.
Comment 4: Stop Signs. Provide stop signs as indicated
Response: Please see the striping and signage detail on sheet two for all sign locations.
Comment 5: Zoning District Bu/1`er. Revise the buffer detail and tree si:e as indicated; also revise the
evergreen tree si_e to scn• four foot, not two inch caliper.
Response: The zoning district buffer detail and plant legend have been revised accordingly.

The above -referenced site plan was approved on November 2, 2007. The site plan is approved for an
addition to the existing facility located at 320 Independence Drive in the Westview Business Centre,
which is located in the Shawnee Magisterial District. Required site improvements include the following:
• Building Expansion — 100,000 square feet.
• Construction of parking lots which will provide the site with a total of 58 spaces (including five
handicap accessible), including curb and gutter, striping, handicap access and landscaping.
• Five striped loading spaces.
• Landscaping and outdoor lighting as shown on the site plan. Please note that any lighting (pole)
must utilize the flat lens shown on sheet 7 of the site plan.
All requirements of the Frederick County Zoning Ordinance have been met in the approved site plan,
including review agency comments from all relevant review agencies. I am providing you with two (2)
copies of the approved site plan. Please forward these copies to the appropriate representative(s).
Furthermore, advise the owner(s) that a copy should be kept for future reference, and an approved copy
must be kept on the construction site throughout the development process. Once site development is

On behalf of the Winchester Regional Airport Authority, I would like to thank you for your cooperation in responding to
our comments regarding the site plan for Virginia Apple Storage.
Our final review was pending review of the FAA's determination study and review by the Authority's engineering firm
which we have received. According to the FAA determination study the proposed building will not be an obstruction to
our approach surfaces.
Therefore further comments or special conditions will not be required.by the Airport Authority. This completes our
review of the proposed site plan.

This is to acknowledge receipt of your revised plans with latest revisions dated October
17, 2007 for the referenced project. The plans appear satisfactory and are approved.
Please advise the developer accordingly. Please provide 6 sets of approved construction
plans with signed seal for VDOT distribution.
I offer the following comments:
* A preconstruction conference be held by the engineer and/or developer with the
attendance of the contractor, various County agencies and VDOT prior to initiation of
work.
Materials used and method of construction shall apply to current observed VDOT Road
& Bridge Specifications applicable during construction of this development.
x Our review and comments are general in nature. Should conditions in the field exist
such that additional measures are warranted, such measures shall be completed to the
satisfaction of the Department.
x All drainage is to be carried within the right-of-way in ditch lines or gutters
along the street to a pipe or drainage easement.
* The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.
x The appropriate land use permits shall be obtained before any work is performed on
the State's right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector.
Any entrances constructed from the referenced street(s) shall meet VDOT minimum
standards. This is the developer's responsibility. Present entrance is adequate for the
proposed improvements provided the trips per day stay proportional with the current
facility. Should business or daily trip count ever expand in the future, entrance may
need to be upgraded to current VDOT standards.
* Any signs to be installed will be in accordance with the Manual on Uniform Traffic
Control Devices (MUTCD), 2003 Edition, and the approved plans.
x I suggest any utilities and/or storm sewer placed within the proposed right-of-way
be backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the
possibility of any pavement settlement.
x A copy of any/all recorded plats of dedication for drainage easements or additional
right-of-way required for implementation of this proposed project should be provided to
VDOT prior to issuance of any land use permit. Dedication should be made to the
Commonwealth of Virginia.
A copy of any/all RECORDED PLATS of dedication to public use (the County of
Frederick) for drainage easements or additional right-of-way required for implementation
of this proposed project should be provided for VDOT review prior to issuance of any land
use permit.

It was a pleasure for Jim Markle of Virginia Apple Storage and me
to meet with you regarding a site plan for the Phase II proposed
warehouse of the Virginia Apple Storage project at Westview Business
Centre situated on Independence Drive adjacent to the airport in
Frederick County, Virginia. Phase I of this project was completed in
1997 in conformance with the approved site plan that shows the plan
for both the Phase I and Phase II proposed warehouse facilities.
We understand that the approved site plan for Phase II expired
after five years and, therefore, it will be necessary to re -submit an
updated site plan for the Phase II construction. It is the intent of
Virginia Apple Storage to construct Phase II in conformance with the
expired site plan; however, we will review the current requirements
for site plans for the property and address those issues concerning
parking, '1c.n(1Sc ctp111i� anu ot,, er elcil:er1ts n'C ccssar'y' 'or a ric4r site plan
approval.
The original site plan for this project was completed by Ronald
A. Mislowsky, P.E., of G. W. Clifford & Associates, which is now doing
business as Patton, Harris, Rust & Associates (P,H,R & A). We have
met with Ron Mislowsky and he will be handling the site plan submittal
for approval.
Marsh & Legge Land Surveyors will complete the as -built survey
necessary for the new site plan, to include the locations of existing
utilities, drainage structures, existing site improvements, and other
features necessary for site design and project site plan approval.
We also understand that at the time of the original site plan
approval, the Phase I proposed warehouse was constructed having a

proposed finished floor elevation of 692 feet and a building height of
36 feet. I know at that time Virginia Apple Storage went through
specific approval with the FAA for the aviation easement. The Phase
II proposed warehouse has a proposed finished floor elevation of 680
feet, which is 12 feet lower than the existing building of Phase I.
We would expect that the FAA approval for the Phase I and Phase II
project completed ten years ago would satisfy the FAA, particularly in
light of the fact that the Phase II proposed warehouse is
significantly lower than the existing facility.
We further understand that review and approval of the site plan
will be administrative, and the fee for the site plan review by
Frederick County will be $1,500.00 base fee plus $200.00 per acre of
disturbed area. At the time of our site plan application submittal,
we will determine the total disturbed acreage for this project.

Virginia Apple Storage and our firm in the approval process for this
Phase II proposed warehouse project. Should you have any questions

We've prepared plans for an expansion of the Virginia Apple Storage Warehouse site located on Victory Road
near the Winchester Regional Airport approximately 0.45 miles from Route 50 in Frederick County. The
expansion will include the construction of a 100,000 square foot warehouse with loading areas meeting all
parking requirements. The total disturbed are for this site is 7.41 acres.
The site gill drain through proposed inlets and culverts to an existing storm water detention pond that was
constructed during the first phase of the development of this site (see plans approved in April 4, 1997, SP#i 050-
96).
I have attached copies of the plans and other materials needed for your review and approval. The site plan
