The checklist shown below specifies the information which is required to be submitted as part of the site plan
application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be retumed to the
applicant(s).
!/ (1) One (1) set of approved comment sheets are required from each relevant review
agency prior to final approval of a site plan. It is recommended that applicants
contact the Department of Planning & Development to determine which review

The above -referenced site plan was approved by staff on July 26, 2004. The site plan is approved
for the construction of an 18,997 square foot office/warehouse/retail building where the existing
Frederick Block Building exists on Martinsburg Pike (Route 11 N). The redevelopment of this
property is consistent with the proffered conditions associated with the rezoning of the property
(REZ #01-03). Furthermore, the site plan meets the requirements of the Frederick County Zoning
and Subdivision Ordinances, and all relevant review agencies have commented on the project.
I am providing you with several copies of the approved site plan. Please forward these copies to the
appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept for future
reference, and an approved copy must be kept on the construction site throughout the development
process. Once site development is complete, the owner(s) should contact this office to schedule an

We have received your revised site plan dated February, 2004 for the subject project. It
appears all our earlier review comments have been satisfactorily addressed. Please advise the
owner of our approval. Also, please provide five sets of approved construction plans with
signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 11
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage and the salary and expenses of a State assigned Inspector. A copy of
any/all recorded plats of dedication for drainage easements or additional right-of-way required
for implementation of this proposed project should be provided to VDOT prior to issuance of
any land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will take approximately thirty (30) days
to process and issue.

is currently pending and the final building permit for the project may not be approved until the site
plan is approved. No written correspondence has been received regarding this site plan since the

Thank you for your resubmission of the above -referenced site plan, received by staff on April 14, 2004.
The majority of comments from staff's original review letter, dated March 3, 2004, have been adequately
addressed. However, the comments listed below do not appear to have been resolved in the revision.
Therefore, at this time, the site plan is denied until the remaining comments are adequately addressed:
2"' Review Comments:
1) Proffer #C2. You indicated in your response letter that the design details of the proposed walls
will be submitted separately for approval. Please understand that the proffer for this property
specifically states that these details will be submitted in conjunction with the site plan.
Therefore, staff looks for you to provide these details prior to site plan approval. I have attached
the proffer for your information.
2) Proffer #C4. The consolidation plat provided to me in your resubmission on April 14`' is not
a legally recorded copy of the plat. Please provide me with the legally recorded copy of the
consolidation plat.
Once you have adequately addressed all of these comments, please resubmit a copy for my review. I will
need all approved review agency comment sheets and at least five copies of the final plan for approval.
Convnent sheets of the most recently revised site plan are required from the following agencies: The
Frederick County Department of Building Inspections, The Frederick County Fire Marshal, The

Dear Craig:
Staff is in receipt of the site plan for the above -referenced project, accepted on February 18, 2004.
At this time, the site plan is denied until the following comments are adequately addressed.
Review Comments:
1) Rezoning Application Reference. Please reference rezoning application #01-03, approved
February 12, 2003 by the Frederick County Board of Supervisors, to rezone 2.63 acres to the
B2 District and 2.01 acres to the B3 District with associated proffers.
2) Proffer #B2. The associated rezoning proffers of this property stipulate that a right -turn lane
will be provided at the new commercial entrances on Martinsburg Pike (Route 11) if
warranted by VDOT. Please show these turn lanes on the site plan if required by VDOT.
3) Proffer #C2. Please provide general details and a design of the proposed walls at the two
commercial entrances.
4) Proffer #C3. Please remove all freestanding business signs other than the one referenced
in the proffer statement. Please also provide details of tlus proposed freestanding business
sign. The proffer statement says that it will not exceed 20 feet in height, and other than
monument style signs, it shall be the only other sign on the premises.
5) Proffer #C4. Please provide me with a copy of the recorded consolidation plat for the site.
The proffer statement indicates that this was to be done within 90 days of rezoning approval.

6) Proffer #D. Please provide a statement on the site plan indicating that the area shown as
dense woodland along the northern property line shall not be disturbed. Please also label the
width of this proposed wooded area to be at least 50 feet.
7) Proffer #E. Please ensure that the proffered monetary contribution to Frederick County, for
Fire & Rescue Services, has been paid.
8) Caliper of Eastern Red Cedars. Do you intend on planting two inch caliper evergreen
trees? I do not believe that this is your intent. Therefore, please remove this reference from
the Tree Legend for the Eastern Red Cedars. The reference that the tree height will be at
least six feet at planting is appropriate; however, the Zoning Ordinance and Proffer
Statement only require the evergreen trees to be planted at a height of four feet at planting.
9) Parking Setback. Please ensure that the five foot parking setback is maintained. Please
also label this requirement on the site plan.
10) Right -of -Way. Please ensure that all right-of-way needed by VDOT for the eventual
widening of Martinsburg Pike (Route 11) is considered for dedication during the site plan
review process. If right-of-way will be dedicated to VDOT, this right-of-way should be
shown on the site plan and appropriately planned for through the site design.
11) Loading Areas & Spaces. Please show all areas that will be used for loading and
maneuvering of trucks. This excludes outdoor display and storage areas. It would appear
that a certain amount of the rear area will need to be paved since a concrete pad is being
planned to be used for truck loading. The area used to access the dumpster pad would also
appear to require an asphalt surface. Please change the site plan as necessary to provide at
least the minimum required site improvements. Please also show all loading spaces.
12) Impervious Area. Please revise the impervious area calculations if there are changes in the
amount of impervious area due to the requirement to pave for loading areas.
13) Interior Landscaping. Please replace the word "or" with "and" in the statement "5% or 1
per 10 spaces". The zoning ordinance requires that both of these site design standards be
met. The 5% refers to the amount of the interior parking area that must be landscaped (i.e.,
raised landscaped island), while the "1 per 10" refers to the requirement to plant at least one
shade tree per ten parking spaces for the interior of the parking area.
14) Zoning Boundary Lines. Please show all zoning boundary lines internal to the parcel.

15) Display Area. What will the area be used for between the existing building to remain for
storage and the proposed outdoor display area? If it is possible that this area will be used for
outdoor display area, I suggest that you go ahead and show it on the site plan and obtain
approval for it.
16) White Oaks. Just as a suggestion, I would recommend that you separate the two white oaks
proposed to the north of the northern entrance. There may not be enough room for these
types of trees, with a wide root span, to survive together in this raised landscaped island. Of
the proposed species, I would venture to say that two Redbud trees would have the best
chance of survival in this location, if two trees are desired here.
17) Retaining Wall. Please label the height of the proposed retaining wall.
Once you have adequately addressed all of these comments, please resubmit a copy in for my re -
review. I will need all approved review agency comment sheets and at least five copies of the final
plan for approval. Comment sheets are required from the following agencies: 772e Frederick County
Department of Building Inspections, The Frederick County Fire Marshal, The Frederick County

on this rezoning application, due to a possible conflict of interest. Chairman DeHaven said that he would
designate the chairmanship of the meeting to Mr. John Light, since Vice Chainnan Thomas was absent from
the meeting.
Planner Abbe S. Kennedy reported that the proposed rezoning in this location is consistent with
the Frederick County Land Use Policy and the Comprehensive Policy Plan; the site is also within the Urban
Development Area (UDA) and the Sewer and Water Service Area (SWSA) and the properties along this section
of Route 11, both in the City and in the County, contain significant commercial and light industrial land uses.
Planner Kennedy reported no significant review agency comments. She noted, however, that the
Comprehensive Policy Plan states that business corridors should implement landscaping for screening of
incompatible uses; that woodland buffers should remain where possible for screening; and that signage may
affect the character of the area.
Planner Kennedy continued, stating that where site development proffers exist, staff would
suggest that a generalized development plan be submitted along with the rezoning proposal to show the

property; and it will provide a continuous turn lane along the property frontage. Secondly, Mr. Wyatt said they
have proffered to refurbish the existing stone wall along Rt. 11; they will provide rounded, decorative walls
at the entrance locations, as well as landscaping and street trees along Martinsburg Pike. He stated their des

in the ground goes through the limits of this property and out to the railroad track, and discharges into Ft.
Collier. He added that the facilities are in place and functioning well.

Mr. Lillard, a neighboring property owner, said that his home is within an adjoining
subdivision. Mr. Lillard wanted to know if the applicant was breaking into an old subdivision with the
proposed rezoning.
Mr. Donald Shockey of the Shockey Companies, a neighboring property owner across the
street, was in favor of the requested rezoning. He stated that Frederick Block has been a good neighbor. Mr.
Shockey said that he has considerable respect for Stephen Slaughter and his family and he knew they would
follow through with what they say. Mr. Shockey believed the development will clean up this area of
Martinsburg Pike, it will be good for the economy, and will help Frederick County.

In response to Mr. Lillard's concern, Mr. Wyatt replied that there will be no access from o�� G1^'
commercial property into the subdivision whatsoever. He explained that pending the approval of the propose,. �e, o� q
rezoning, a lot consolidation will be done to combine the five lots into one, and, at that time, the 20' access will,
be vacated. He assured Mr. Lillard and the Commission there would be no possibility of getting access in a
northern direction.
Commissioner Ours believed this was a well -thought-out plan, especially with the corridor
appearance.

Master Development Plan 01-03 of Canter Estates, Section V, submitted by Greenway Engineering, for
200 single-family detached urban lots. This property is located on the west side of Front Royal Pike (Rt.
522 South) approximately 1,200 feet south of Parkins Mill Road (Rt. 644), and is identified with Property
Identification Numbers 76-A-22 and 76-A-23 in the Shawnee Magisterial District.
Action - Recommended Approval
Planner Jeremy F. Camp stated that the overall concept of the master plan is consistent with
the Comprehensive Polify Plan and the requirements of Article XVII, Master Development Plan, of the Zoning
Ordinance. Planner Camp pointed out five minor issues identified by the Planning Staff which dealt with the
amount of open space in areas of environmental features, the location of environmental features on individual
lots, the design of the proposed road efficiency buffers, the intent of the viewshed protection area, and the
timing of the developer's responsibility for the proposed roads.
Mr. Evan A. Wyatt of Greenway Engineering was representing the owner, Shoemaker
Construction and Jasbo, Inc. Mr. Wyatt began by giving a brief overview of the project. He addressed each
of the issues raised by staff and he informed the Commission that the plan will be modified to address the first
four of staffs concerns prior to administrative approval. Regarding the fifth issue, regarding the timing of the
developer's responsibility for the proposed roads, Mr. Wyatt did not believe it was the developer's
responsibility to pay for the future extension of Warrior Drive and Parkins Mill Road. He believed it was
inappropriate to expect the developer to build those segments of road, which are not currently on the County's
road plan; however, he did believe it was appropriate for the developer to guarantee that right-of-way is
available for the road when it is read}, to be constructed. Mr. Wyatt said they have provided for the right-of-
way area, within the generalized development plan and the proffer statement, in order to dedicate that right -of -

Staff is in receipt of the site plan for the above -referenced project, accepted on February 18, 2004.
At this time, the site plan is denied until the following comments are adequately addressed.
Review Comments:
1) Rezoning Application Reference. Please reference rezoning application #01-03, approved
February 12, 2003 by the Frederick County Board of Supervisors, to rezone 2.63 acres to the
B2 District and 2.01 acres to the B3 District with associated proffers.
2) Proffer #B2. The associated rezoning proffers of this property stipulate that a right -turn lane
will be provided at the new commercial entrances on Martinsburg Pike (Route 11) if
warranted by VDOT. Please show these turn lanes on the site plan if required by VDOT.
3) Proffer #C2. Please provide general details and a design of the proposed walls at the two
commercial entrances.
4) Proffer #C3. Please remove all freestanding business signs other than the one referenced
in the proffer statement. Please also provide details of this proposed freestanding business
sign. The proffer statement says that it will not exceed 20 feet in height, and other than
monument style signs, it shall be the only other sign on the premises.
5) Proffer #C4. Please provide me with a copy of the recorded consolidation plat for the site.
The proffer statement indicates that this was to be done within 90 days of rezoning approval.

6) Proffer #D. Please provide a statement on the site plan indicating that the area shown as
dense woodland along the northern property line shall not be disturbed. Please also label the
width of this proposed wooded area to be at least 50 feet.
7) Proffer #E. Please ensure that the proffered monetary contribution to Frederick County, for
Fire & Rescue Services, has been paid.
8) Caliper of Eastern Red Cedars. Do you intend on planting two inch caliper evergreen
trees? I do not believe that this is your intent. Therefore, please remove this reference from
the Tree Legend for the Eastern Red Cedars. The reference that the tree height will be at
least six feet at planting is appropriate; however, the Zoning Ordinance and Proffer
Statement only require the evergreen trees to be planted at a height of four feet at planting.
9) Parking Setback. Please ensure that the five foot parking setback is maintained. Please
also label this requirement on the site plan.
10) Right -of -Way. Please ensure that all right-of-way needed by VDOT for the eventual
widening of Martinsburg Pike (Route 11) is considered for dedication during the site plan
review process. If right-of-way will be dedicated to VDOT, this right-of-way should be
shown on the site plan and appropriately Alarmed for through the site design.
11) Loading Areas & Spaces. Please show all areas that will be used for loading and
maneuvering of trucks. This excludes outdoor display and storage areas. It would appear -
that a certain amount of the rear area will need to be paved since a concrete pad is being
planned to be used for truck loading. The area used to access the dumpster pad would also
appear to require an asphalt surface. Please change the site plan as necessary to provide at
least the minimum required site improvements. Please also show all loading spaces.
12) Impervious Area. Please revise the impervious area calculations if there are changes in the
amount of impervious area due to the requirement to pave for loading areas.
13) Interior Landscaping. Please replace the word "or" with "and" in the statement "5% or 1
per 10 spaces". The zoning ordinance requires that both of these site design standards be
met. The 5% refers to the amount of the interior parking area that must be landscaped (i.e.,
raised landscaped island), while the "1 per 10" refers to the requirement to plant at least one
shade tree per ten parking spaces for the interior of the parking area.
14) Zoning Boundary Lines. Please show all zoning boundary lines internal to the parcel.

15) Display Area. What will the area be used for between the existing building to remain for
storage and the proposed outdoor display area? If it is possible that this area will be used for
outdoor display area, I suggest that you go ahead and show it on the site plan and obtain
approval for it.
16) White Oaks. Just as a suggestion, I would recommend that you separate the two white oaks
proposed to the north of the northern entrance. There may not be enough room for these
types of trees, with a wide root span, to survive together in this raised landscaped island. Of
the proposed species, I would venture to say that two Redbud trees would have the best
chance of survival in this location, if two trees are desired here.
17) Retaining Wall. Please label the height of the proposed retaining wall.
Once you have adequately addressed all of these comments, please resubmit a copy in for my re -
review. I will need all approved review agency comment sheets and at least five copies of the final
plan for approval. Continent sheets are required from the following agencies: The Frederick County
Departinent of Building Inspections, The Frederick County Fire Marshal, The Frederick County
Engineer, The Frederick County Saiiitatioii Authoi-ity, The Frederick County Aii1-)ort Authority, and
the Virginia Department of Transportation.
