The Department of Planning and Development will review the application to ensure that it is complete.

Dear Mr. Cook:
This correspondence is intended to clarify the bond required to ensure completion of all site improvements
associated with the above -referenced project. Specifically, the amount of the bond must be sufficient to
guarantee the installation of all landscaping shown on the Landscape and Erosion and Sediment Control sheet
of the approved site plan. The landscape schedule provided with this section of the site plan has been copied
and attached for your reference. Please ensure that the amount of the bond accurately reflects the projected
cost of acquiring and installing the plantings outlined through the landscape schedule in the appropriate
quantities and sizes.
Upon installation of the landscaping delineated on the approved site plan, the site developer should contact
this office to schedule a site inspection with staff to verify project completion. The bond will be released
following staff confirmation that all landscaping has been installed on the subject property in conformance
with the approved site plan. It is important to note that the installation of required landscaping is expected
to occur no later than May 2000.

day of November, 1999, by and between CMS- WINCHESTER, LLC, a
Virginia Limited Liability Company, party of the first part, hereinafter called
Grantor, and COMMONWEALTH OF VIRGINIA, party of the second part,
hereinafter called Grantee.
WHEREAS, CMS -Winchester, LLC, is the owner of all of that certain
tract or parcel of land, known and designated as Lot 9, Westview Business Centre,
located in Frederick County, Virginia, and being the same land to CMS -
Winchester, LLC, a Virginia Limited Liability Company, by Deed dated August
11, 1999, from Westview Business Centre, L.C., of record in the Office of the
Clerk of the Circuit Court of Frederick County, Virginia in Deed Book 944 at
Page 1582; and,
WHEREAS, the Grantor desires to dedicate a certain portion of land
containing 3,213 square feet (0.0738 acre) to the Commonwealth of Virginia for
future road widening; and,
WHEREAS, the County of Frederick, Virginia has approved the
subdivision as evidenced by the signature of its Subdivision Administrator on the
aforesaid attached survey.
NOW, THEREFORE, THIS DEED OF DEDICATION
WITNESSETH: That for and in consideration of the premises and benefits
which will accrue by reason of this dedication, the Grantor does hereby subdivide,
grant and dedicate, in fee simple, unto the Grantee, all that certain tract and parcel
of land containing 3,213 square feet (0.0738 acre) and more particularly described
on the plat drawn by Mark D. Smith, L.S., dated August 23, 1999, attached hereto
and by this reference made a part hereof as if set out in full for the purpose of
widening Victory Lane and other public use and to create a public right of
possession of the same and being a portion of the same land conveyed to CMS -

Dear Scott:
The Frederick County Department of Planning and Development administratively approved the above -
referenced site plan on August 31, 1999. This site plan, for the development of a 9,600-square-foot office
and warehouse facility, meets all County requirements for development within the M1 (Light Industrial)
Zoning District. Specifically, the site plan delineates the construction of one industrial building
consisting of 7,200 square feet of warehouse space and 2,400 square feet of office area which will be
complemented by a screened outdoor storage area comprised of 3,390 square feet. The facility will be
served by one (1) loading space and twelve (12) parking spaces, of which one (1) will be designed for
handicapped use. The site plan also includes the provision of a zoning district buffer (category B), as
well as perimeter parking lot landscaping that consists of both shade trees and evergreen hedgerows.
Several copies of the approved site plan were provided to the general contractor responsible for site
development. Please ensure that the owner maintains an approved copy on the construction site
throughout the development process. Once site development has been completed, the owner should
contact this office to schedule an on -site inspection.

Dear Mr. Mohn:
After reviewing our in-house records and several discussions with people that have been involved with the
Westview Business Center project for the last three years, we are resubmitting the Branch Electric site plan
with the entrance shown as originally submitted. The entrance has been placed in the location we have
shown for the following reasons:
The Westview Business Center Master Development Plan was created with the understanding that Victory
Lane would service the properties adjacent to the right of way. The Branch Electric entrance is also
adjacent to the remaining parcel owned by the Garber family, which is being used as a residential home.
The entrance is located adjacent to that line in order to establish another entrance between Branch Electric
and the existing Bandit Kart building. Also, when we developed entrances along Victory Lane in the past,
entrance spacings were not designed in accordance to the spacing requirements stated in your comment
letter.
It was my understanding from previous discussions with the owner and the other County Staff members,
which are not involved in this particular review process, that Victory was not being considered as a major
collector. It is evident that this is the case because right of way dedications were not requested to meet
those horizontal requirements or vertical alignment conditions. I was particularly involved in the vertical
discussions with VDOT and the County and there was no concern for these vertical alignments to change
and therefore curb and gutter along the frontage of the properties developed on Victory Lane was
established at the existing grade.
As you know, Victory Lane is a rolling type of vertical alignment and would not come close to meeting
major collector design standards. I believe if yourself and Mr. Ruddy discuss this issue with Mr. Kris
Tierney and Mr. Evan Wyatt, they will have historic recollection as to the intent of the development along
Victory Lane. If for some reason, there is going to be a change in the spacing requirement, then it becomes
obvious that Mr. Glaize, the developer of Westview, will only be able to obtain the sale of one more parcel
on Victory Lane in this particular area. Currently, there are lots being platted that create the Branch Electric
parcel and another parcel between Bandit Kart and Branch Electric. We did however, explore shared
entrance potential with Branch Electric and they are not in the position to want or need a shared entrance.
Additionally, it made their financing very difficult for the parcel.
It would be greatly appreciated if you would meet with the appropriate County Staff to discuss these issues.
If needed, please request our attendance along with the Westview Business Center owner, Mr. George
Glaize, so we may resolve the spacing issue on Victory Lane. It is imperative for us to know, because we
have represented what we felt to be our historic knowledge to prospective buyers such as Branch Electric.
This obviously puts my firm and Mr. George Glaize in a very precarious situation.

We have received your revised site plan dated July 28, 1999 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval. Also please provide seven (7) sets of approved construction
plans with signed seal for VDOT distribution.
The appropriate land use permit may now be applied for to cover work within the Route 728
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of
any/all plats of dedication for drainage easements or additional right-of-way required for
implementation of this proposed project should be provided to VDOT prior to issuance of ar ly
land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

In accordance with your request dated June 29, 1999, you are given permission to install a temporary
construction entrance at the referenced location. This letter is to be considered your permit to do so. The following
provisions will be required:
• Work area protection signage is to be in accordance with the current Mork Area Protection Manual
while working on the right-of-way.
• All work on the right-of-way is to be confined to the temporary entrance location only.
• A minimum 6" depth of VDOT 91 (2-3 inch stone) course aggregate by 30' in width will be required.
It is to be placed from the edge of pavement and extended back onto private property far enough to
prevent the carrying of mud onto the roadway.
• Positive drainage is to be maintained within the right-of-way at all times.
• A wash rack will be required.
• Any disturbed areas of the right-of-way or damages to the pavement structure adjacent to this entrance
will be repaired by you to our satisfaction.
• This permit is being issued for 180 days.
• All work is to be completed in accordance with the enclosed Virginia Erosion and Sediment Control
Handbook, Specification 3.02.
• The entrance is to be installed at the location shown on the site plan prepared by Greenway
Engineering dated June 25, 1999.
The Department of Transportation will not be held liable for suit should such result fi-om this operation nor
is it granting permission to grade on the property of others or disturb underground utility lines. If the above listed
items are not followed this permit may be revoked.

Dear Scott:
I have had the opportunity to review the above referenced site plan submitted to our department on June
28, 1999. The following comments are offered and should be addressed during the revision of this site
plan. I have also marked the enclosed plan for your use.
1) Please ensure that the engineer's certificate is signed.
2) Please ensure that the survey coordinate for the northeast property boundary is shown
completely on the site plan.
3) Please delineate the location of all parking lot setbacks on the site plan.
4) Please delineate the location, height, and dimensions of any signs proposed for the facility. A
statement should be added to the site plan regarding the applicability of the sign standards of
the Frederick County Zoning Ordinance to all signage installed on the subject property.
5) In accordance with Section 165-33A of the Frederick County Zoning Ordinance, outdoor
storage areas within industrial zoning districts must be screened from view from adjoining
properties and road rights -of -way. Such screening must be opaque in nature and may be
accomplished through the installation of a fence, wall, and/or landscaping. Please ensure that
the proposed outdoor storage area is effectively screened from all relevant visual perspectives.
A chain link fence does not represent adequate screening in this case. Furthermore, the fence
proposed to surround the storage area appears to encroach within the inactive portion of the
required zoning district buffer. It is imperative that neither the fence nor the storage area extend
into this area. Please expand the statement in the Project Information table regarding outdoor
storage to stipulate that only equipment and materials directly associated with the principal use
of the facility are to be stored within the designated area on the site plan.
6) Please state the gross floor area of the proposed facility in the Project Information table. This
figure should reflect the sum of the floor areas indicated on the site plan for the respective uses
of the building (7,200 sq ft./warehouse + 2,400 sq. ft../office = 9,600 sq. ft.).

7) Please identify the speed limit applicable to Victory Lane (Route 728). If such information is
not posted along the right-of-way, VDOT should be consulted regarding the appropriate speed
limit.
8) Please be advised that Victory Lane (Route 728) is classified within the Comprehensive Plan
as a major collector road. In accordance with Section 165-29A(6) of the Frederick County
Zoning Ordinance, the minimum entrance spacing requirement applicable to major collector
roads is 150 feet. The proposed entrance to the subject property from Victory Lane is shown
less than 150 feet from the existing entrance to the Winchester Woodworking Corp.
manufacturing facility. Please relocate the proposed entrance to ensure that it is separated by
a minimum of 150 feet from all existing entrances on Victory Lane.
Relocation of the proposed entrance will have a significant impact on the future entrance needs
of the adjoining property (PIN 64-A-159Q). Specifically, the ultimate location of the entrance
to the subject parcel will likely preclude the installation of an independent entrance to the
adjoining property due to the close proximity of other existing entrances on Victory Lane.
Therefore, it is recommended that a shared entrance between the two parcels be established.
Such action would ensure that a legally oriented entrance was available to serve both properties
thereby providing concurrent resolution of both current and future spacing issues.
9) Please indicate the size of the water main intended to serve the proposed facility. Furthermore,
a statement must be included on the site plan confirming the underground placement of all
utilities on the subject property.
10) Please delineate the dimensions of all loading spaces on the site plan. The width of the
proposed travel aisle must also be identified. Furthermore, please provide curb and gutter along
the raised island located at the south end of the proposed row of five (5) parking spaces.
11) Please provide the dimensions of the proposed handicapped parking space.
12) Please state the minimum landscaped area requirement applicable to development in the MI
Zoning District (25%) and further provide a calculation indicating the landscaped area provided.
In the Landscape Calculations, please modify the text to read "perimeter" rather than "exterior".
Please add a column of data to the Landscape Schedule specifying the spacing of all proposed
plantings. The spacing of shrubs should not exceed 3.5' - 4.0' o.c.
13) Please relocate the opaque fence proposed as part of the full screen component of the required
category B zoning district buffer. Specifically, this device must be located along the "interior"
boundary of the landscape screen, as opposed to its present location on the property line.
Furthermore, a note should be added to the site plan specifying that the finished side of the
fence must face the adjoining properties. The profile of the wood fence provided on the details
sheet should be clarified to indicate the proposed use of such fencing as both an enclosure for
the outdoor trash receptacle and element of the required zoning district buffer. It is
recommended that the plant symbols used on the detail of the landscape screen be modified to
better distinguish the variety of plantings proposed.
