All required information must be submitted prior to the final approval of any site plan. The Department of Planning and Development will review the application to ensure that it is complete. If any portion is not included or complete, the site plan application will not be accepted and returned to the applicant(s). Site Plan Package 1. The site plan is approved for the conversion of the existing house on the property into an office building and the construction of a new 8,060-square-foot office building. A list of the primary improvements required for this development are listed below: • The legal recording of a common shared buffer with the property to the northwest, which will be subdivided at a later date. A recorded plat shall be provided to the Frederick County Planning Department prior to the approval of any building permits. • Planting of a 10' landscape screen with a 6-foot-high berm in the active area of the common shared buffer. • The construction of 52 parking spaces, including four handicap parking spaces. • The establishment of a fire lane/no parking lane around the perimeter of the north, east, and west portions of the travelway. • Planting of 32 trees around and within the proposed parking areas. • The removal of the existing entrance onto Route 11 and the construction of a new entrance further to the north. Construction of an outdoor patio area in the rear of the existing house (not required). A Joint review & approval has been done by the City of Winchester aIld FredeI-ick County for this development, because the City & County jurisdictional boundary line transverses the property. Building permits and all inspections will be Issued by the County for the conversion of the existing house. The City will be permitting and inspecting the proposed building located within their boundary lines. I am providing you with ten copies of the approved site plan. Please forward these copies to the appropriate representative. Furthermore, advise the owner that a copy should be kept for future reference, and an approved copy must be kept on the construction site throughout the development process. Please look over the following comments and provide me with a revised site plan which adequately addresses all of the comments so I may review it. These remaining issues are listed below: (1) Title Change. Because you have given the townhouse development the same title/name as this development, I would like for you to at a minimum provide a subtitle which we can use to differentiate between the two plans. (2) Landscaping Schedule & Plan. Please ensure that the landscaping plan is correct in all aspects. For example, the last plan you provided me shows a six-foot (6) opaque fence. Since that time I have received a site plan for the townhouse development which shows a six- foot (6) berm instead. (3) Existing Parking Spaces. Please remove the statement on the site plan that says, "Ex. 7 Parking Spaces To Remain." This statement is located beside the existing veterinary practice building. If the spaces are to remain, how will they be accessed once the entrance is removed? (4) Existing Entrance Statement. Please reword this statement to say that the existing entrance will be removed by the owner prior to a final occupancy permit. (5) Details of Entrance Removal. Please establish and record by plat the common shared buffer easement shown between the RP and B2 portions of the subject parcel. (7) Proffer Statement #2. Please reword proffer statement #2 (Brooke Road Extension), shown on the site plan, to match the wording of the approved proffer statement. The statement should read as follows: "A sixty foot right-of-way shall be provided for the fixture extension of Brooke Road from Martinsburg Pike to North Frederick Pike. The location of this sixty - foot right-of-way shall be depicted on the site development plan which will require approval by the City of Winchester and Frederick County. " Furthermore, please address this issue by providing the location and specifications of the required sixty (60) foot right-of-way mentioned above. (8) Interior Landscaping Trees. Please correct the number of parking spaces shown under your interior landscaping calculations. There are actually thirteen (13) parking spaces proposed, as indicated in the parking calculations section and shown on the site plan. (9) Remaining Agency Comment. Unfortunately, several changes are necessary before staff can consider the plan for approval The following comments should be addressed and uicluded in a revision of this plan. Review Comments (1) Required Front Setback. The Zoning Ordinance requires a fifty (50) foot front setback, not the thirty-five (35) foot setback which is shown. Please correct this error on Pages 1 of 5, 2 of 5, and 3 of 5. If the existing two-story dwelling is a legal nonconforming structure, no increase in the degree of its nonconformity is permitted. (2) Required Landscape Screen Specifications. The ten (10) foot landscape screen is insufficient as shown on the site plan. The Zoning Ordinance requires that a landscape screen consist of at least three species of trees. in addition, the majority of the trees must be evergreen and at least 1 /3 of them must be deciduous Please revise the landscape screen so it meets all of these requirements- (3) Extent of Landscape Screen. In the best interest of all parties, i "recommend" that the proposed landscape screen be extended through the portion of the property located in the City of Winchester. (4) Landscaping Calculations. On Page 1 of 5, you indicate that a total of 18 trees will be provided with the development located within the County. However, I count a total of forty-two (42) deciduous landscape trees. Please clarify the number of trees that you will be providing. (5) Existing Parking Spaces. Please remove the statement on the site plan that says, "Ex. 7 Parking Spaces To Remain." After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the plan. Mr. Eric R. Lawrence, Zoning Administrator, reported that the DRRS discussed entrance canopy requirements to allow pedestrian entrance canopies to be closer to the front yard setback. Comprehensive Plans & Programs Subcommittee (CPPS) - 01/27/99 ,Mtg. Mrs. Copenhaver, subcommittee member, reported that the CPPS held a worksession with the Board of Super isors on January 27, 1999 concerning the South Frederick Land Use Study Area. Mrs. Copenhaver said the land use study was very well received and Mr. Evan Wyatt, Deputy_ Planning Director, did an excellent job with the presentation. Transportation Committee - 02/02/99 Mtg. Mr. Evan A. Wyatt, Deputy Planning Director, reported that the Primary Road Plan was presented to the Transportation Committee. lie said that it is virtually in the same form as the previous year's plan with some minor modifications to the I-91 project, which is Priority #4. Mr. Wyatt added that the top priority on the Primary Road Plan remains the Route 37 project, as it has been for the past several years. ,,PUBLIC IIEARI YG Rezoning 00001-99 of K & M Enterprises, submitted by Greenway Engineering, to rezone 0.60 acres from RP (Residential Performance) to B2 (Business General). This property is located on the west side of Martinsburg Pike (Route 11 North) across from Brooke Road (Route 1328), and is identified with P.I.N. 54-A-50 in the Stonewwall Magisterial District. Action - Recommended Approval with Proffers Mr. Evan A. Wyatt, Deputy Planning Director, stated that the proposal to rezone this property conforms with the recommendations of the Land Use Chapter of the Comprehensive Policy Plan. Mr. Wyatt said that the property can be adequately served by the existing infrastructure and will not create a significant negative impact to adjoining properties. He stated that the applicants proffer statement mitigates the majority of the impacts identified by staff. however, it is unclear if the proffer to limit access to one commercial entrance is intended to utilize a shared entrance with the adjoining property to the south. The subject of the Citv's re-evaluation of the FEMA National Flood Plain Maps was raised by Commission members and if the re-evaluation would have any impact on the property in question. Mr. Smith believed that this particular property would not be in any future flood -zoned area. No other issues were raised by the Commission. There were no citizen comments. Since the site drains into Frederick County, evaluate the pre and post -developed conditions of the site and determine if an adequate channel exists downstream of the outfall. There are existing flooding problems in this area and a complete evaluation is necessary. 2. It appears that the stormwater generated within the northern portion of the site will just flow around the parking lot and drain into Route 11. We recommend additional stormsewer be included within the site design to convey the proposed stormwater to the existing outfall. A washrack is required for the proposed construction entrance. Also, a temporary construction entrance permit needs to be obtained from the Virginian Department of Transportation (VDOT) prior to obtaining a land disturbance permit. Our comments are as follow and are shown in red on the enclosed plan sheets: Plan Sheet 2 of 4 1. It appears portions of the site plan would fall within the proposed Brooke Road extension. Could this be adjusted to avoid possible future conflicts? 2. Storm Water Management should be accomplished on site with appropriate measures. While we accept the validity of the drainage study, other factors will come in following comments. 3. The existing Route 11 laneage striping should be shown on the plan to help clarify the existing condition. 4. A 15" CMP culvert was placed at this location as one release for the west side of Route 11 watershed on a 1935 Route 11 road plan and is still in place. Please locate and show on the plan, culvert condition and functioning capacity. Also note once again the dimensions of an arch culvert is span first the arch here should be 24"x17" unless it is lain vertical. Is it? If so, there is a difference in the capacity of flow. 5. The coverage over the existing 24"x17" culvert under Route it is very limited. Further, the discharge outlet is directly onto railroad property. Visible signs of significant scour indicate that any additional flow and/or culvert capacity discharge would have an adverse impact on railroad property and should be discouraged. The BM-2 portion of VDOT right-of-way pavement structure should be 4" instead of 3" as shown on the plan. 7.
