This site plan is approved for the construction of a heavy equipment sales and service facility. Required site improvements include the following: • A 1,500sf office, 5,850sf warehouse and a 3,250sf expansion area. • Construction of a parking lot with 12 spaces (including two handicap accessible), including curb and gutter, landscaping, sidewalks, striping, and handicap access. • A gravel heavy equipment mobilization area that is screened by a six foot board -on -board fence. • Construction of a dumpster pad with a six (6) foot wooden fence for screening. • One 12' x 45' loading space. If our action is influenced by the planned routing of Rt. 37, could that be construed to be "taking" on our part by restricting the use of their land because of a future planned transportation route and access? L. AMBROGI: That would ultimately be up for a court to decide, but there are some things that concern me, such as the fact that Rt. 37 has been used as a political football, not by this body or by the Board of Supervisors, for quite some time. I don't think: there is any specificity as to when it's ever going to be started or completed. I don't know how definite that path is. It could be considered a "taking" under the circumstances, but there is no way to say definitely. I don't think anybody could tell you that. It would be up to a court to decide based on the cases. As Ms. Perkins said, this is not here for you to make a decision, it is just for your information and to be passed on to the Board, I assume, and they will have to consider that issue. C. Molin: When was this lot created? CM: I believe in 2005. C. Mohn: The path of the roadway, the preferred alternative, is pretty much been on the books during that time frame, correct? So, the County approved the subdivision with the road going through it, ...... now the site plan is in and we're running it up the flag pole and I'm not sure what the Board, when it gets to them, what they're supposed to do with it, or really what we're supposed to advise if we did approve a subdivision with that knowledge. ERL: If I can be of assistance on that... Route 37 has been on the books for about ten years now at Alternative "C" location and it's only been in the recent months that we're starting to see development proposals within the Rt. 37 corridor on by -right zoned property. What we've determined in working with the County Administration legal staff is that anytime a subdivision comes before us or a site plan comes before us, so it is in a by -right situation, we're going to take it through the public process so that you all and, ultimately, the Board of Supervisors, can be aware of what is being proposed within the alignment of Rt. 37. This subdivision was the first subdivision Nve had where it really raised concern. So what the policy is now is, all subdivisions that are presented to us will ultimately get reviewed by yourself and the Board and then all site plans for the property within that corridor will get reviewed solely by the Planning Commission. Because this particular site did not get a subdivision review, we opted for let's go ahead and for FYI purposes, let's let the PC and BOS know what's happening in this corridor. The biggest goal is just so the BOS, when it comes time to build a road, they're not surprised that something is in the corridor. We want the public process to be aware so there is no surprises for anyone. C. Mohm: So, it's more informational. ERL: Most definitely. GK: Did you say this was approved in 2005. ERL: Yes... in the past six months, nine months, something of that nature that the subdivision was approved. GK: So Rt. 37 was back on the books again, so to speak? ERL: Correct. JW: When was it decided to bring items like this before us? Frederick Count}, Planning Commission Page 1670 Minutes of Marcli 1, 2006 0 0 ERL: Within the last six months. Basically, the creation of this lot, the subdivision, is what triggered this discussion. Staff is in a situation where the subdivision, the site plan, is a administerial exercise, so if it meets the criteria of the ordinances, you approve it. But, we felt because of the sensitivity and the importance of Rt. 37, we have the ability through the ordinance to bring these things through the PC and BOS FYI and we've elected to do that. RM: Two points come to mind. One is that none of us know how long it will be before we ever see the first bit of ground turned for Rt. 37. It could be a long time. Secondly, how long might a business constructed here exist before it becomes non-existent, either in its current form or even as far as the building itself. And the third point, if someone actually constructs knowingly in an area where Rt. 37 would be constructed, what might be the potential outcome of any litigation after that. Those are my points... the length of time it might take to build Rt. 37; how long might a company exist before it is completely renovated or rebuilt; and the circumstances under which a "taking" or imminent domain would occur. On that basis, I would feel to some extent, that if they built there knowing that this was a corridor, so be it. GO: When I see this, I see another instance where, of course now we have the Transportation Committee; however, I think it is Lime the County, the BOS in particular, sits down and definitely defines the true centerline of Corridor "C," the survey centerline, adopt it, and stick to it. We have a broad area that it could or couldn't be in the path, it may hit the building, it may not. I really think it is time, since all this has come to light that we finally nail down the exact path of Rt. 37, right to the "T," and my recommendation would be for the BOS to send this to the Transportation Committee and get this hammered out ASAP. CM: I'd like to take Commissioner Oates' recommendation a step further and recommend that the BOS actually consider putting Rt. 37 on the CIP, so that we can focus some investment on that and really identify a ROW and start working towards acquisition of that in fairness to all of the property owners and future users of property in its path. GO: I agree whole-heartedly with that. JL: My opinion of this is that there is a by -right use here for the present time and the immediate future. If somebody wants to use it, they should be able to because there is nothing on the books delineating any other such thing. It would be no different than any parcel any where in the county traversing RA that somebody's building a house on. They have a by -right; they have the ability to use it; there is no plan. I don't quite know why we are discussing this. It would be no different than if you were building a house somewhere else in this alternative; you're house would not be held up for this. This probably won't be held up for this. If there was a designated centerline, I think it complicates matters more as to what decision we would make, because if there was a centerline, I would justify that as a "taking" at that point. So, if we're going to have Rt. 37, yes I agree, do something about it or forget about it. For this immediate parcel and this immediate use, I think we're discussing something that shouldn't be discussed. They have a by -right, they have a right to use it. If Rt. 37 goes there, VDOT is going to have to buy the properly and take it just like all the other properties. GO: I agree that is by -right and what they want to do, full speed ahead. It has definitely been the county that's notched things up and got this addressed sooner. But, I think by establishing a centerline we can at least, whenever a rezoning comes before us, we can stipulate that strip of land within that ROW will not be rezoned and should be left as R.A. JW: I think this is what as known as a collective "heads up" for all of us. The options here are excellent. Three hundred and ninety [390] feet of intersection sight distance is required at this commercial entrance due to the 35 mile per hour speed limit. As indicated in the attached PDF files the sight distance has been changed to reflect the required distance of 390 feet. 2. The width of the proposed commercial entrance "scales" approximately twenty feet. The minimum width of two-way commercial entrance is thirty (30) feet, measured face to face of standard CG-6 curb. As indicated in the attached PDF files the minimum width distance has been changed to reflect the required distance of 30 feet and is labeled the exact distance. 3. The length of radii on entrance flare(s) shall accommodate the anticipated type of vehicular usage.
