All required information must be submitted prior to the final approval of any site plan. The Department of Planning and Development will review the application to ensure that it is complete. I visited the property on April 21, 2008, and noted three (3) trees removed from the front parking lot. The removal of these trees is a violation of the approved site plan 433-01 approved by Frederick County on November 19, 2001. We will be ready to go to final approval once the Trex Center plan for the water extension to this lot is approved by the FCSA and we can show that line on this plan. I understand that review is on going. Scott Stickley with Greenway called concerning the access easement along our northern property line. Apparently they need to vacate a portion of that easement. The bank has no objection to this change. We do need to keep enough of an easement (65 feet from the Route 522 right-of-way) to cover the shared access there. Please call if you have questions. I've checked with Scott Stickley at Greenway and he has no problem with shifting the connection to Handi-Mart back from Route 522. As you can see, the driveway width provided is 9.5 feet. A few weeks ago I spoke with Evan Wyatt. He indicated that reasonably at least 9 feet should be provided at the drive thru lane. A preconstruction conference should be held by the engineer and/or developer with the attendance of the contractor, various county agencies and VDOT prior to initiation of work. The appropriate land use permit may now be applied for to cover work within the Route 522 right-of-way. The permit is issued by this office and will require a minimum processing fee, surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of any/all recorded plats of dedication for drainage easements or additional right-of-way required for implementation of this proposed project should be provided to VDOT prior to issuance of any land use permits. Dedication should be made to the Commonwealth of Virginia. Once satisfactory application has been made, a permit will normally take approximately thirty days to process and issue. No waiver by the Planning Commission for this spacing requirement has been previously approved. A waiver was approved for the spacing requirement between the main entrance of the Trex Center and an existing residential entrance below it on Route 522. The distance between those entrances is 91 Feet. The master development plan for the Trex Center was approved with the stipulation that Trex would continue negotiations with the adjoining property owner in an attempt to bring about fruition of a signalized intersection at Rt 522 and Fox Drive. I have measured the perimeter to be 480 feet, which would require 12 trees for the perimeter landscaping. Including the interior and perimeter landscaping requirements, 14 trees are required. 9.
