SITE PLAN CHECKLIST
The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted prior to the final approval of any site plan. The
Department of Planning and Development will review the application to ensure that it is complete. If
any portion is not included or complete, the site plan application will not be accepted and returned to
the applicant(s).

Dear Tim:
This office has received a complaint of parking lot trees being removed for the above -
referenced property. I visited the property on April 21, 2008, and noted three (3) trees
removed from the front parking lot. The removal of these trees is a violation of the
approved site plan 433-01 approved by Frederick County on November 19, 2001. You
will need to replace these trees to bring your site in to compliance with the approved site
plan. The Pin Oak trees to be planted shall be 6" caliper in size. Please contact me in ten
(10) days with a plan and date to replant these trees. Failure to comply with the approved site
plan will result in a violation of the Frederick County Zoning Ordinance.

Dear Mr. Mislowsky:
The Frederick County Department of Planning and Development administratively approved the above -
referenced plan on November 19, 2001. The site plan meets all requirements for development in the B2
Zoning District. Currently, there are no adverse comments by any of the required review agencies;
however, any fixture comments by these agencies should be addressed promptly. Below is a list of the
primary improvements of this development:
• Construction of a 2,500-square-foot building for use as a bank.
• 17 parking spaces, including one handicapped space.
• Planting of 14 trees and 26 shrubs.
• four drive-thru lanes to serve the bank.
I am providing you with seven copies of the approved site plan. Please forward these to the appropriate
representative. Furthermore, please advise the owner that a copy should be kept for future reference and
an approved copy must be kept on the construction site throughout the development process. Once site
development is complete, the owner should contact this office to schedule an on -site inspection. This is
required prior to the issuance of an occupancy permit by the Department of Building Inspections.

Center. John Lewis, of Painter and Lewis prepared those plans. He has indicated that the Fire Marshal has

This letter is to confirm action taken by the Frederick County Planning Commission at their October
4, 2001 meeting. Your request for a waiver of the driveway spacing requirement, Section 165-
29A(4), of the Frederick County Zoning Ordinance was approved.
This approval was granted with the understanding that no other entrances going into the Trex Center
from Route 522/North Frederick Pike would be proposed. The entrance for which this waiver was
necessary will be approximately 188 feet from Exeter Drive and will be shared with the proposed
Handy Mart.

We've revised our plan again to create a larger island on the south side of the shared access to Route 522. You
will also note the employee parking behind the bank has been removed. I've enclosed a copy for your review.
We will be ready to go to final approval once the Trex Center plan for the water extension to this lot is
approved by the FCSA and we can show that line on this plan. I understand that review is on going.
Scott Stickley with Greenway called concerning the access easement along our northern property line.
Apparently they need to vacate a portion of that easement. The bank has no objection to this change. We do
need to keep enough of an easement (65 feet from the Route 522 right-of-way) to cover the shared access
there.

The bank has asked that we revise the parking arrangement at their northwest corner as shown on the attached
sketch. I've checked with Scott Stickley at Greenway and he has no problem with shifting the connection to
Handi-Mart back from Route 522.
Could you take a look at this and let me know if you have any problems with the change. I understand Painter
and Lewis will have the new waterline location design done next Tuesday. If I could here from you soon, we
can make these changes simultaneously and move to final approval. I look forward to your call.

I have attached a section of the drive thru facility at The Bank of Clarke County. As you can see, the driveway
width provided is 9.5 feet.
A few weeks ago I spoke with Evan Wyatt. He indicated that reasonably at least 9 feet should be provided at
the drive thru lane. As you can see, we meet this requirement.

We have received your revised site plan dated August 22, 2001 for the referenced project. It
appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval. Also please provide seven (7) sets of approved construction
plans with signed seal for VDOT distribution.
A preconstruction conference should be held by the engineer and/or developer with the
attendance of the contractor, various county agencies and VDOT prior to initiation of work.
The appropriate land use permit may now be applied for to cover work within the Route 522
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector. A copy of
any/all recorded plats of dedication for drainage easements or additional right-of-way required
for implementation of this proposed project should be provided to VDOT prior to issuance of
any land use permits. Dedication should be made to the Commonwealth of Virginia.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

Entrance Conflict The second entrance (western entrance) along Route 522 does not meet the
spacing requirements of the Zoning Ordinance. No waiver by the Planning Commission for this
spacing requirement has been previously approved. A waiver was approved for the spacing
requirement between the main entrance of the Trex Center and an existing residential entrance
below it on Route 522. The distance between those entrances is 91 Feet. The master
development plan for the Trex Center was approved with the stipulation that Trex would
continue negotiations with the adjoining property owner in an attempt to bring about fruition of a
signalized intersection at Rt 522 and Fox Drive. There is no previous mention of the additional
entrance proposed on the Bank of Clarke County site plan
Employee Parking On the site plan there is no access area between the drive thru stacking lanes
and the employee parking. These areas/lanes should be separate from drive thru lanes.. Chapter

We've revised the site development plan per your comments of 15 August 2001. The changes include:
1. We've added a fire hydrant at the southwest corner of the building.
2. Exeter Drive has been labeled. Please note, there is no posted speed limit.
3. By agreement between the bank and Trex Center, Trex Center will be installing the driveway to
access the drive thru facility. I understand plans for the road are being prepared by John Lewis.
We agree that this driveway is required for the drive-thru portion of bank operations. While we
fully anticipate the road being ready at the time the bank is ready to open, should the entrance not
be ready, the bank could open for walk in business. A note to that effect has been added to the
plans.
4. We've revised the loading space calculations. As our building is less that 30,000 S.F., we believe
no loading is required.
5. We've adjusted the perimeter landscaping calculations and added the additional two required trees.
6. The drive-thru lane area has been expanded to 60' for 5-12 foot wide lanes.
7. We've revised the maximum height for the building and sign to 35 feet.
Please note the following:
1. The 4" curb is required for the widening on US Route 522.
2. Trex Center believes the common entrance has been previously approved, I've asked Ty Lawson
consul for Trex Center to research this issue. You may hear from him.
3. Additionally, I've asked Ty to check if a revised master plan is required. If so, I believe, the Trex
Center owners will file that application.
4. The plans have been signed.

Thank you for the recent submission of the above -referenced site plan. I have completed a review of the plan
and would like you to address a few issues in a revision. I have enclosed a red -lined copy of the site plan to
clarify the concerns of staff. Please note the comments I have made below.
Review Comments
1. Engineer's Signature. Please remember to sign the engineer's seal on all pages of the final site plan.
2. Fire Code Improvements. Please provide the location of all improvements necessary to meet the fire
code requirements, this includes fire hydrants, required bollards, and fire lanes.
3. Road Information. Please label Exeter Drive and provide the speed limit.
4. Entrance Conflict. On the site plan, you show two proposed entrances. The zoning ordinance, Section
165-29 A (4), requires a minimum spacing of 200 feet between entrances along a primary and arterial
highway with a speed limit over 35 miles per hour. Therefore, the second entrance (western entrance)
along Route 522 is not permitted by the Zoning Ordinance. Please omit this entrance from the site
plan.
5. Add Future Road. The subject project depends on the entrance to the future road that is partly shown
on the site plan. Please include the portion of the road & entrance necessary to access the bank. In
other words, the entrance to the future road and a small portion of it will need to be constructed with
the bank.
6. Master Development Plan Update. Please submit a revision to the Master Development Plan, showing
the future road in its entirety, along with all other features. John Lewis was the engineer who prepared
the original Master Development Plan.

7. Loading Spaces/Areas. Please provide the location of all loading spaces and/or areas. Drive-thru
lanes are not generally considered as loading spaces, so omit them from your calculations. One
loading space is required for this type and size of development.
8. Perimeter Landscaping Calculations. Please adjust your calculations for the parking lot perimeter and
landscaping requirements. I have measured the perimeter to be 480 feet, which would require 12 trees
for the perimeter landscaping. Including the interior and perimeter landscaping requirements, 14 trees
are required.
9. Width of Drive -In Lanes. Drive-in lanes are required by our zoning ordinance to be 12 feet un width.
At no point are the four drive-in lanes on the site plan 12 feet. Please make the appropriate
adjustments to be in compliance with the ordinance.
10. Maximum Heiglrt. Please change the maximum height on the site plan to 35 feet for both signs and
structures. 35 feet is the maximum height required in the B2 Zoning District.
1 l . Curb Specifications. Please omit the 4" curb from the "Miscellaneous Details" page of the site plan.
The Zoning Ordinance requires a 6" curb.
After you have revised the site plan, please resubmit one copy so that I may verify the information on the plan.
I will then need all approved review agency comments and five copies of the final site plan for approval.
