The checklist below indicates all the information that needs to be submitted as part of the site plan
application. All required information must be submitted priorto the final approval of any site plan. The
Department of Planning and Development will review the application to ensure that it is complete. If
any portion is not included or complete, the site plan application will not be accepted and returned to
the applicant(s).

Dear Evan:
The Frederick County Department of Planning and Development administratively approved the above -
referenced plan on September 24, 2002. The plan is a revision of the original site plan, which was approved
on November 30, 2001. Changes to the plan reflect a waiver granted by the Planning Commission on
September 4, 2002 and eliminates the requirement for a screen along the southern property line of Lot 33-A-93,
which is used as a church, until the property is developed as a B3 use. This portion of the screen is identified
on the landscape plan, Sheet 5 of 5 of the site plan.
I am providing you with three copies of the approved site plan. Please forward these to the appropriate
representative and advise the owner that a copy should be kept for future reference. An approved copy must
be kept on the construction site throughout the development process. Once site development is complete, the
owner must contact this office to schedule an on -site inspection.

area.

Please find attached five (5) copies of the Tim Johnson Site Plan that has been revised to
eliminate the raised island. Please note that this area has been modified to relocate the curb and
gutter, stripe the area where the island was previously located, and to relocate the parking lot tree
behind the sidewalk. Please also note that we have provided an additional tree near the concrete
dumpster pad area. All applicable sheets have been modified to reflect these revisions.

The Frederick County Department of Planning and Development administratively approved the above -referenced
plan on November 30, 2001. The site plan meets all requirements for development in the B3 Zoning District.
Furthermore, all proffered conditions have been adequately satisfied for site plan approval. Below is a list of the
primary improvements of this development:
• Construction of a 4,800-square-foot auto repair shop with one service bay.
• Four regular parking spaces and one handicap accessible space. The parking lot includes such
improvements as striping, a handicap ramp, sidewalks, curb and gutter, and landscaping.
• Installation of a six-foot board on board opaque fence along the entire southern property line.
• Planting of a ten -foot wide landscaping screen along the entire southern property line.
• Improvements to the existing entrance as required by the Virginia Department of Transportation.
• Paving of the driveway to the auto body shop without curb and gutter.

Comment 5: Parking Space Area. The Ordinance requires that each space be at least 180 square feet ill
area. 1 he spaces shown are only 162 square Pet. Please increase the area of each parklng space so there
are at least 180 square feet.
Response;: We have modified the construction document to reflect the required parking dimensions
Comment G: Driveway and Church Parking. Please show the dimensions of the driveway better along the
ripper left hand side, next to the Clrra•ch parking area. No parking should occya• in the driveway. To ensure
this, please provide a statement our the site plan to that effect. Staff recommends that you also provide
either a "No Parking" sign or "No Parking Zone " striping.
Response: No parking signs have been added to the plans.
Comment 7: Loading Space and Calculations. Please show the location and dimensions of all loading
spaces and add loading space calculations to the site plan. All loading areas should be asphalted.
Response: We have added loading space tabulations to the cover sheet, and have added file location of the
loading space to the site plan.
Comment 8: Signs. Please provide the location, dimensions, and setbacks of all proposes/ or existing
signage.
Response: No signage is proposed at this time. We have added a note on signage to the cover sheet.
Comment 9: Outdoor Storage. Please show the location of all areas that will be designated as outdoor
storage. It should be noted that all outdoor storage is required to be fudly screened from all adjoining

A VDOT review has been completed on the preliminary plan dated October 2, 2001 for
the referenced project. Our comments follow and are shown in red on the plan sheets.
Sheet 2 of 5
1. Drainage calculations should be provided to include (HW/D) at 15 culvert at
Structure 13. Our concern is the 12" PVC and 30"x19" RCEP discharging
combined drainage flows into the 15" culvert near VDOT roadway.
2. The culvert end treatment at Structure 10 should be Standard EW-11.
3. The culvert end treatment at Structure 12 should be beveled.
4. The proposed MH-1 should be located out of the paved entrance. Also the MH-1
should be identified on plan sheet.
5. The proposed curb and gutter should be ended at the 12' offset point from
existing pavement.
6. The AADT 3900 (Year 2000 VDOT) should be used as basis for calculating
construction of site year volume. The 3900 should be projected at 4% annual
increase compounded to year of site plan completion. That volume should be
used to calculate pavement structure for shaded area of entrance.

7. Available sight distance at the entrance should be shown. The nearest VDOT
road intersection and the posted speed should be part of plan information.

8. Standard VDOT detail item to be used on project should be shown. Curb &
Gutter standard based on posted speed is 45 or over CG-7. If 0 to 44 CG-6, MH-
1? CG-11, pipe and end treatment EW-11, ES-1 if used.
9. A half typical section should be shown to include pavement structure to be used
in shaded pavement area.
All incidental notes shown in red on plan sheets and Entrance Permit Plan Check List
should be considered on revised plans. Please provide on set of revised plans to this
office for VDOT review.

An existing building on parcel 93 is connected to an existing old sewage disposal system
which cannot be guaranteed to function properly. There appears to be no area on the
property suitable for repair of this system. The system was approved for use under the
following conditions:
1. The owner is to replace the inlet and outlet tees in the septic tank, the distribution box
lid, and repair the distribution box to allow equal flow to all drain field ditches. A
construction permit issued by this office is required prior to such construction.
2. All vehicular traffic and parking is to be restricted from the drain field area.
3. Proposed water use is to be limited to 300 gallons per day. Water use for church use
is calculated based on ten (10) gallons per day per person with a kitchen on the
premises and five (5) gallons per day per person without a kitchen. This is based on a
peak loading rate.
4. No conunercial wastewater is to be discharged into the sewage disposal system.
An auto body paint shop is proposed to be constructed on parcel 92 to be served by a
proposed experimental sewage disposal system (reference permit # 34852, expiration
date 04-31-02). This system was permitted to support water use from four employees.

Dear Scott:
Thank you for your recent submission of the above -referenced site plan. Unfortunately, staff is unable to
administratively approve the document at this time. There are several issues with the site plan that must be addressed
to meet the requirements of the Frederick County Zoning Ordinance. I am providing you with this letter to detail what
needs to be changed on the site plan in. order to be considered for approval. To visually assist you, I am providing an
edited copy of the site plan with this letter. The comments noted below correlate with the edited marks on the enclosed
site plan.
Review Comments:
1. Proffered Conditions. Please show all of the proffered conditions on the site plan
2. Additional Proffer Statements. Please provide two additional statements underthe project information section
(Page 1) of the site plan regarding the associated proffered conditions. First, provide a statement to the effect
that $500.00 will be paid to the Frederick County Treasurer prior to the issuance of any building permit. This
money is intended for fire and rescue services. Second, provide a statement to the effect that the Frederick
County Recycling Coordinator will review and approve the subject business's recycling program prior to the
issuance of a final occupancy permit. Please also inform the owner that he may contact Gloria Puffinburger
at (540) 665-5643.
3. Landscaping Calculations. Please correct your landscaping calculations. Staff measures the perimeter ofthe
parking area at 137 feet. Thus, four (4) deciduous trees are required to satisfy the perimeter landscaping
requirement. Your interior landscaping calculations are correct. A total of five (5) trees are required for both
the perimeter and interior landscaping requirements. Please show all required and proposed trees on the
landscapuig plan. It should be noted that the interior and perimeter trees currently shown on Page 2 and Page
5 are less than what is required. The plans are also inconsistent because Page 2 shows four perimeter and
interior trees and Page 5 shows two perimeter and interior trees.
4. Driveway Surface Material. Please provide an asphalt pavement for the driveway. Also, curb and gutter
should be extended from the entrance to where the driveway becomes 24 feet.

5. Parking Space Area. The Ordinance requires that each space be at least 180 square feet in area. The spaces
shown are only 162 square feet. Please increase the area of each parking space so there are at least 180 square
feet.
6. Driveway and Church Parking. Please show the dimensions of the driveway better along the upper left hand
side, next to the Church parking area. No parking should occur in the driveway. To ensure this, please provide
a statement on the site plan to that effect. Staff recommends that you also provide either a "No Parking" sign
or "No Parking Zone" striping.
7. Loading Space and Calculations. Please show the location and dimensions of all loading spaces and add
loading space calculations to the site plan. All loading areas should be asphalted.
8. Signs. Please provide the location, dimensions, and setbacks of all proposed or existing signage.
9. Outdoor Storage. Please show the location of all areas that will be designated as outdoor storage. It should
be noted that all outdoor storage is required to be fully screened from all adjoining property lines and roads.
If no outdoor storage is proposed, provide a statement to that effect on the site plan.
10. Fire Code Improvements. Please show all improvements that will be installed for the purpose of complying
with the Fire Code.
11. Label Uses. Please label the proposed use for each building contained in the site plan.
12. Utilities. Please show and label all utility connections, easements, and dedications. Also, provide a statement
that all future utilities shall be installed underground.
13. Well. Please label and show the location of the well.
After you have revised the site plan, please resubmit one copy so that I may verify the information contained on the
plan. I will then need all approved review agency comment sheets and five copies of the final site plan for approval.
Comment sheets are required from the following agencies: Frederick County Building Inspections Department,
Frederick County Engineer (Public i3'orks), Frederick County Tire Marshal, lfredericic County Sanitation Authority
(if proposed provider), Frederick County Health Department, and Virginia Department of Transportation.

Pursuant to Section 15.2 - 2296 Et Seq., of the Code of Virginia, 1950, as amended, and the
provisions of the Frederick County Zoning Ordinance with respect to conditional zoning, the
undersigned applicant hereby proffers that in the event the Board of Supervisors of Frederick
County, Virginia shall approve this rezoning application for the rezoning of approximately 1.89 acres
from the Rural Area (RA) Zoning District to the Industrial Transition (I33) Zoning District,
development of the subject property shall be done in conformity with the terms and conditions set
forth herein, except to the extent that such terms and conditions may be subsequently amended or
revised by the applicant and such be approved by the Frederick County Board of Supervisors hi
accordance with said code and zoning ordinance. In the event that such rezoning is not granted, then
these proffers shall be deemed withdrawn and of no effect whatsoever. These proffers shall be
binding upon the applicant and their legal successors, heirs, or assigns. All previous rezoning
proffers for the subject property are hereby superseded.
The subject property is more particularly described as all of the land conveyed to Timothy W.
Johnson by deed from John E. Bowers and Patricia R. Bowers dated August 19, 1999 of record in
the Frederick County Court Clerk's Office in Deed Book 945 at Page 522. The subject property is
further described by survey, attached to said deed, prepared by W. Stuart Dunn and dated June 6,
1996 and is purported to contain 1.89 acres. The exhibit and conditions proffered are as follows:

will pay to the Treasurer of Frederick County, Virginia, at the time the initial building pernnit is
issued for said property, the sum of five hundred dollars ($500.00) for fire and rescue services.
