application. The Department of Planning & Development will review the application to ensure that it is
complete prior to accepting it. If any portion of the application is not complete, it will be returned to the
applicant(s).

THIS DEED OF DEDICATION, EASEMENT AND VACATION (the "Deed") is made
this 13 day of , 2004, by and among CENTEX HOMES, a Nevada General
Partnership (hereinafter referred to as "Owner"); the BOARD OF SUPERVISORS OF
FREDERICK COUNTY, VIRGINIA, a body corporate and politic (hereinafter referred to as
"County"); and the FREDERICK COUNTY SANITATION AUTHORITY, a body corporate

WITNESSETH

u, WHEREAS, the Owner is the owner and proprietor of certain real property (the
"Property") as shown on plat dated May 17, 2004, entitled "Dedication and Various Easements

for Wakeland Manor Community Center," and prepared by BC Consultants of Fairfax, Virginia,
certified land surveyors (the "Plat") which Plat is attached hereto; and
WHEREAS, the Property is situate in Frederick County, Virginia, Owner having acquired

the Property by deed recorded in Instrument Number 030029073, among the land records of
Frederick County, Virginia; and

WHEREAS, it is the desire and intent of Owner to grant and convey unto the County and
unto the Authority the easements in the locations as shown on the Plat and as hereinafter provided.
STREET DEDICATION
NOW THEREFORE, that in consideration of the premises and the sum of One Dollar
($1.00) cash in hand paid, receipt of which is hereby acknowledged, Owner does hereby dedicate to
the County 0.05867 acres for public street purposes as so designated on the Plat. This dedication is
made in accordance with the statutes made and provided therefore.
COUNTY EASEMENTS
THIS DEED FURTHER WITNESSETH that in consideration of the premises and the sum
of One Dollar ($1.00), cash in hand paid, receipt of which is hereby acknowledged, Owner does
hereby grant and convey unto the County, its successors and assigns, the easements as hereafter set
forth in the respective locations shown on the Plat as follows:
A. Emergency InIress and Egress Easement. An easement for ingress and egress,
for construction and maintenance of utilities, for County and other emergency vehicles, and for the
purpose of performing any governmental functions which the County may fi-nd necessary or
desirable to perform, including but not limited to police and fire protection, over and across all
private streets, common driveways, public and private access easements, and ingress and egress
easements, as shown on the Plat.
B. Sight Distance Easement. A sight distance easement, as more particularly
bounded and described on the Plat, for the purpose of preventing obstructions to vehicular sight in
conformance with Virginia Department of Transportation ("VDOT") standards. Owner, its

successors and assigns, shall not place or permit on the Property fences, shrubbery, structures, or
other facilities or vegetation ("improvements") within the bounds of said easement unless such
improvements shall not obstruct vehicular sight from any direction. A VDOT review will be
required for any plantings or improvements within said easement. The right to enter and remove
any obstructions for the purpose of maintaining clear sight distance within such easement is hereby
granted to VDOT."
The foregoing easements are subject to the following conditions where applicable:
1. All sewers, manholes, inlet strictures, and appurtenant facilities which are
installed in the easements shall be and remain the property of the County, its successors and
assigns.
2. The County and its agents shall have full and free use of said easements for
the purposes named, and shall have all rights and privileges reasonably necessary to the exercise of
the easements including the right of access to and from the easements and right to use adjoining
land where necessary; provided, however, that this right to use adjoining land shall be exercised
only during periods of actual construction or maintenance, and further, this right shall not be
construed to allow the County to erect any building or structure of a permanent nature on such
adjoining land.
3. The County shall have the right to trim, cut, and remove trees, shrubbery,
fences, structures, or other obstructions or facilities in or near the easements being conveyed,
deemed by it to interfere with the proper and efficient construction, operation, and maintenance of
said easements; provided, however, that the County, at its own expense, shall restore, as nearly as

possible, the premises to their original condition. Such restoration shall include the backfilling of
trenches, the replacement of fences and shrubbery, the reseeding or resodding of lawns or pasture
areas, and the replacement of structures and other facilities located without the easements, but shall
not include the replacement of structures, trees, or other facilities located within the easements.
4. Owner reserves the right to construct and maintain roadways over said
easements to the extent not prohibited or restricted by ordinance and to make any use of the
easements herein granted which may not be inconsistent with the rights herein conveyed or
interfere with the use of said easements by the County for the purposes named; provided, however,
that Owner shall not erect any building or other structure, excepting a fence, on the easements
without obtaining the prior written approval of the County.
F.C.S.A. EASEMENTS
THIS DEED FURTHER WITNESSETH that in consideration of the premises and the sum
of One Dollar ($1.00), cash in hand paid, receipt of which is hereby acknowledged, Owner does
hereby grant and convey unto the Authority, its successors and assigns, the easements as hereafter
set forth in the respective locations as shown on the Plat, as follows:
Waterline Easements. Waterline easements for the purpose of constructing, operating,
maintaining, adding to, altering or replacing present or future water mains, including fire hydrants,
valves, meters, building service connections, and other appurtenant facilities for the transmission
and distribution of water through, upon, and across the property of Owner, said easements being
more particularly bounded and described on the Plat.
The foregoing easements to the Authority are subject to the following conditions:

All water mains, sewer lines, and appurtenant facilities which are installed in
the easements shall be and remain the property of the Authority, its successors and assigns.

4. Owner reserves the right to construct and maintain roadways over said

PRIVATE STREET INGRESS/EGRESS EASEMENTS
THIS DEED FURTHER WITNESSETH that in consideration of the sum of One Dollar
($1.00), cash in hand paid, receipt of which is hereby acknowledged, Owner does hereby create and
establish an easement for ingress and egress and for the construction and maintenance of utilities in
the location as shown on the Plat, designated thereon as "C/L 22' Ingress/Egress Esmt. (See Note
6)" for the use and benefit of the lot served thereby.
AUTHORITY VACATION OF EASEMENT
THIS DEED FURTHER WITNESSETH that in consideration of the premises and the sum
of One Dollar ($1.00), cash in hand paid, receipt of which is hereby acknowledged, the Authority
does hereby QUITCLAIM, VACATE AND RELEASE, WITHOUT WARRANTY, unto the
Owner, its successors and assigns, those portions of the Water Main Easement previously created
by instrument recorded among the land records of Frederick County, Virginia in Instrument
#030026748, as more particularly shown and depicted on the Plat as "Portions of Ex. 20' Water
Main Esmt. Hereby Vacated".

MISCELLANEOUS
Headings used in this Deed are for convenience purposes only and are not intended to affect
the express terms herein set forth.
This Deed is made in accordance with the statutes made and provided in such cases; with
the approval of the proper authorities of Frederick County, Virginia, as shown by the signatures
affixed to the Plat, and is with the free consent and in accordance with the desire of Owner, the
owner and proprietor of the land depicted on the Plat.
The undersigned warrants that this Deed is made and executed pursuant to authority
properly granted by the partnership agreement of the Owner.

A VDOT review has been completed on the final plat dated August 23, 2004 for the referenced project. The
plat appears to reflect the information shown on the approved project plans and is therefore approved by this
letter.
The application for subdivision of this property appears to have a measurable impact on Route 756, Macedonia
Church Road, the VDOT facility which would provide access to the property. This section of street is currently
not in the State's Secondary Road System. All entrance design and drainage features must meet State
requirements if the street is to be eligible for acceptance. A complete set of construction plans will be required
for review.
We are returning five (5) signed copies of the plat (Sheet 1 of 5) to your office, one copy is being retained for
our work file. Please provide one copy of the plat of dedication fully signed and recorded at the
appropriate County Clerk's Office prior to the issuance of any land use permit from VDOT.

The Frederick County Department of Planning and Development administratively approved the
above -referenced site plan on April 15, 2004. Approval is granted for the construction of a
conununity center facility in the Wakeland Manor Subdivision. This facility shall consist of a
pool, tot pool, asphalt sports courts, a 1,640 square foot meeting room building, and an 1,804
square foot locker room building. This facility shall be constructed within Phase 4 of the
development. All requirements of the Frederick County Zoning Ordinance have been adequately
addressed in the site plan, including approvals from all relevant review agencies.
I am providing you with five (5) copies of the approved site plan. Please forward these copies to
the appropriate representative(s). Furthermore, advise the owner(s) that a copy should be kept
for future reference, and an approved copy must be kept on the construction site throughout the
development process. Once site development is complete, the owner(s) should contact this office
to schedule an on -site inspection. Do not hesitate to contact me should you have any questions

This letter details staff's comments regarding the above -referenced project. All of these comments,
-as listed below, must be appropriately addressed prior to administrative approval. It is also
important to note that the site plan can not be approved until the revised master development plan
is approved and a complete application is submitted.
Preliminary Review Comments:
1) Complete Application. Please submit a complete application for formal submission of this
site plan. A complete application includes a site plan, signed application, special limited
power of attorney, and application fee. The application fee for this project is $1,000.00 plus
$100.00 per acre. With 2.15 acres the total fee will be $1,215.00. A copy of the special
limited power of attorney form is attached so you can complete this form upon formal
submission.
2) Agency Comments. Approved agency comments from the following agencies must be
submitted to planning staff prior to administrative approval: the Frederick County Fire
Marshal, the Frederick County Dept. of Building Inspections, the Frederick County Dept.
of Public Works, the Frederick County Sanitation Authority, the Frederick County Health
Department, the Frederick County Dept. of Parks and Recreation, and the Virginia Dept. of
Transportation (VDOT).
3) Phasing. Please clarify when the proposed community center will be constructed. The
proposed plan shows that the development will be constructed as part of Phase 2 of the
Wakeland Manor project. However, the preliminary master development plan submitted to
staff shows that the project is part of Phase 4.

4) Curb & Gutter. Please provide curb & gutter (CG-6) for all areas of the parking lot. This
includes all sides of proposed landscaped islands, which are shown without curb & gutter on
the preliminary site plan.
5) Metal Fence. Please illustrate/label on the site plan the location of the proposed metal fence,
as detailed on page 11 of 11. Will the fence around the pool, as shown, be this metal fence?
6) Access to Dumpster. Please accurately illustrate the means of access to the proposed
dumpster site. The plan appears to show curb & gutter in front of the dumpster on the
preliminary site plan.
7) Signs. Please limit the size of the future sign to no greater than 50 square feet.
8) Handicap Access. Please ensure that appropriate grading is provided from the proposed
handicap parking space to the facility (2% grade or less).
9) Maintenance. Please provide a narrative explaining who will be responsible for maintaining
this pool and grounds.
10) Setback from Parking Area. Staff requests that you provide a greater setback from the
parking area for the 1,804 square foot building. Typically, structures in the RP zoning
district are setback at least 20 feet from parking and travel aisle areas.
11) Plant Schedule. The planting schedule needs to be modified to reflect the requirements of
the Zoning Ordinance. First of all, trees required for parking lot landscaping should be the
only trees labeled as shade trees. Ornamental trees should be all the other trees and slu-ubs
provided. These trees may be used to meet the landscaping requirements for the entire
Wakeland Manor Subdivision if the ornamental landscaping option is chosen. If the street
tree option is chosen for Wakeland Manor you may want to revise the landscaping plan to
provide acceptable street trees so they could be applied for required landscaping. Only the
Willow Oak, Redbud, Magnolia and Crabapple trees are acceptable shade trees. Therefore,
10 additional acceptable shade trees need to be provided to meet the ordinance requirements.
Staff should also note that Crapemyrtle, Scotch Pine and Austrian Pine trees are not
acceptable trees for any type of landscaping. This means that unless these tree species are
changed, they may not be applied to meet other landscaping requirements. As far as the
shrubs go, Sweetboxes and Cherry Laurels can be planted as additional slu-ubs, but are not
listed as acceptable trees for required landscaping purposes. Staff would be glad to meet
with you to assist you in the preparation of these changes if you so desire.

approval. Also please provide three (3) sets of approved construction plans with signed seal for
VDOT distribution.
Please make a change to the pavement section to show the following materials: 8" sub -base VDOT
Standard Type I 21-B Aggregate, BM-25.0 Base Asphalt and SM-12.5A surface asphalt.
If any work is performed within the State right-of-way, a land use permit will need to be applied for from
this office.
A copy of any/all recorded plats of dedication for drainage easements or additional right-of-way required
for implementation of this proposed project should be provided to VDOT prior to issuance of any land
use permits. Dedication should be made to the Commonwealth of Virginia.
