The Frederick County Department of Planning and Development administratively approved site plan
9.02-04, for Shenandoah Mobile Court, on February 24, 2004. The site plan is approved for 17 mobile
homes on the above -referenced property. The Frederick County Planning Commission approved the
expansion of the existing private street system for this site plan on February 18, 2004. In accordance
with the approved site plan, the following site improvements are required with this development: street
tree landscaping, asphalt parking as shown, a tot lot with a four foot wide gravel trail for access, a road
efficiency buffer, and construction of a 20' wide private street with three foot gravel shoulders.
I am providing you with several copies of the approved site plan. Please forward these copies to the
appropriate representative(s). Furthermore, be advised that a copy should be kept for future reference,
and an approved copy must be kept on the construction site throughout the development process. Once

The Planning Commission is scheduled to review the site plan for Shenandoah Mobile Court on
February 18, 2004. Site plans are typically handled administratively by staff, however, the Zoning
Ordinance requires that the Planning Commission approve the expansion of private streets in mobile
home parks'. This project may also have significant interest to the Planning Commission because
of its previous involvement with the planning process of the new collector road and new middle
school located off of Front Royal Pike.
At this point in time, preliminary approval has been recommended by each agency other than
Planning, Public Works and GIS. The site plan comment letter from Public Works and the
applicant's response to Planning Staffs preliminary review comments are attached for your
information, as is the site plan application, MDP waiver approval letter, and a copy of the site plan.
The proposed private streets will need to be named and approved by Department of GIS prior to final
approval.
Following the Planning Commission's review of the site plan, and decision regarding the applicant's
request to expand the existing private road system, planning staff will coordinate with the applicant
what issues need to be addressed for final administrative approval. Please note that the Zoning
Ordinance does not require the Board of Supervisors to review this site plan.
The applicant is seeking approval front the Planning Commission to expand the existing private
street system to accommodate 17 new mobile homes.

Dear Mark:
Upon review of the subject site plan, we offer the following comments:
1) Provide all of the specified erosion and sediment control details on the plan.
Indicate inlet and outlet protection, reinforced silt fence, etc. Specify seeding
schedules in accordance with VESCH Standard 3.31 and 3.32.
2) It will be necessary to ensure that no units will be impacted by the post -developed
runoff from the proposed culverts. Grading will be required on the lots for units 5
and 6, 8 and 9, and 11, 12, and 13 to ensure that the structures will not be
impacted by a 100-year storm event.
Once theses comments have been addressed, submit two (2) copies of the site plan for
further review.

Dear Mr. Camp:
We have revised the Subdivision Design Plan based on the comments received and dated December 22,
2003 from the Frederick County Department of Planning and Development and offer the following
responses to those comments:
Comments from Frederick County Department of Planning; and Development
Comment 1: Master Development Plant. A master development phut is required for the subdivision or
development of property within the MlI-I Zoning district. Staff has re'vieived the preliminary documents
previously provided and it appears that there is a potential for a iwaiver of the master development plait
requirement. the conditions for qualifying for a waiver to the master development plan process are
specified in Section 1 G 5-1.34 of the Frederick County /,oning Ordinance. If it is your intent to pursite such a
Ivaiver, please submit a letter requesting a Ivaiver ,with the officially submitted site plait. The letter should
effectively describe why the proposed development qualifies for this waiver. Ultimately, administrative
approval of a master plait Ivaiver will be contingent on inee'ling all ordinance conditions and consistency
with the rezoning application.
Response: We have included a letter of Waiver Request for the Comprelicnsivc Development as suggested
by you (attached).
Comment 2: Expansion of Private Street. 77te expansion of the private steel in an cwisting mobile home
park may only occur with the approval by the planning Commission. Please be advised thal the site plait

Response: WC have provided the typical road and pavement details and their design have exceeded the
requirements set by Frederick County. Since the proposed street to the cul-de-sac is an extension from the
existing street (Uirst Street), we will use First Street accordingly. We have removed the future expansion
road.
Comment .3: Rl. 522 Entrance. Please show the M. 522 entrance to be removed as earl of thus .rite phut.
Response: This entrance has been shown on sheet 2 of 9. For your information, please understand this
work is being performed with the school site plan.

Dear Ian:
I am in receipt of your letter, received on January 15, 2004, which requests a waiver to the requirement
for a master development plan for the development of seventeen (17) mobile homes on the above -
referenced property. This is the same property which was rezoned (with proffers) from the RA (Rural
Areas) Zoning District to the MH1 (Mobile Home Community) District by the Board of Supervisors
on October 8, 2003.
Section 165-134 of the Frederick County Zoning Ordinance gives the Director of Plamiing and
Development the ability to waive the requirement for a master development plan under certain
conditions. The proposed development meets these conditions. It does not contain any new lots; is
not an integral portion of a future development; does not propose any new pubic streets; and is
harmonious with proffered General Development Plan, Subdivision Ordinance and Zoning Ordinance.
Therefore, your request for a waiver to the master development plan requirement is appropriate in this
situation. Please be advised that this waiver does not eliminate any applicable development and design
requirements of the Frederick County Subdivision and Zoning Ordinances. Prior to the development
of this property, a site plan must be reviewed and approved by Frederick County. It should also be
noted that the site plan for this project shall be reviewed by the Frederick County Planning
Commission.

COMMENTS: The Frederick County Department of GIS has reviewed the requested. road names
for use in the Shenandoah Mobile Court, and has made the following determinations:
1. Main Street: has been DENIED for use in the Frederick County Road Naming System.
This road name is currently attached to Route 11 South where it goes through the Towns of Stephens
City and Middletown. Therefore Main Street conflicts with road names already in the system.
2. Since this is an adjustment to an existing Shenandoah Mobile Home Park, the current
address of 1405 Front Royal Pike is to be applied to all trailers within this park, i.e. 1405 Front
Royal Pike, Lot 47, or 1405 Front Royal Pike, Trailer 47. Frederick County does not have
established street names and separate addressing within this Mobile Home Park.
In the best interest of the citizens in this mobile home park, it is this Departments
recommendation that the streets be named with road names that do not duplicate and conflict with
narnes in the current system, and that individual trailers be given individual addresses assigned from
new street names. The GIS Department would be happy to work with the owner and/or developer
in getting these residences into the official system.

Staff received a site plan application on January 5, 2004, with a letter requesting an administrative
waiver of a master development plan. For the latter, staff is unable to approve this waiver of a
master development plan because the condition found under Section 165-134 A (3), of the Frederick
County Zoning Ordinance, is not adhered to. The presence of the future road extension on the
southern portion of the property is integral for future development or subdivision. Therefore, as long
as this road is planned, a master development plan is required. Staff is returning the application for
a site plan until the requirement for a master development plan is satisfied.

The purpose of this letter is to request consideration of a waiver of the Master
Development Plan (MDP) for the relocation of mobile home units from the existing
Shenandoah Mobile Home Court to a 7.09-acre area portion of Tax Map 76-((A))-1 that
was rezoned to MH-1, Mobile Home Community District by the Board of Supervisors on
October 8, 2003. A Generalized Development Plan (GDP) was used as an exhibit during
the rezoning process to demonstrate the proposed land use plan for this acreage. The
GDP demonstrated that the 7.09-acre area would be developed in a manner that is
harmonious with surrounding properties and land uses and that future development or
subdivision of the 7.09-acre area would not occur. Furthermore, a detailed Site
Development Plan has been prepared for the 7.09-acre portion of Tax Map 76-((A))-1,
which will be presented to the Planning Commission to ensure conformance with the
proffered GDP; therefore, a waiver of the MDP would not substantially affect the purpose
and intent of the MH-1 District or Article XVIII of the Zoning Ordinance. We
respectfully request your approval of this waiver request as provided for in Section 165-
134 Waivers of the Frederick County Zoning Ordinance.

We have revised the Subdivision Design Plan based on the comments received and dated December 22, 2003 from
the Frederick County Department of Planning and Development and offer the following responses to those
comments:
Comments from Frederick County Department of Planning and Development
Continent 1: Master Development Plan. A master development plan is required for the subdivision or development
of property within the MH--1 Zoning district. Staff has reviewed the preliminary documents previously provided and
it appears that there is a potential for a waiver of the master development plan requirements. The conditions for
qual f,ing for a waiver to the master development plan process are specified in Section 165-134 of the Frederick
County Zoning Ordinances. If it is your intent top pursue such a waiver, please submit a letter requesting a waiver
with the officially submitted site plan. The letter should effectively describe wiry the proposed development qualifies
submitted site plan. The letter should effectively describe, Ultimately, administrative approval of a master plan
waiver will be contingent on meeting all ordinance conditions and consistency with the rezoning application.
Response: Attached we have included a letter of Waiver Request for the Comprehensive Development as suggested
by you.
Continent 2: Eipansion of Private Streets. The expansion of the private street in an existing mobile home park may
only occur with the approval by the planning Commission. Please be advised that the site plan will be scheduled for
review by the Planning Commission upon its formal submission so this issue can be reviewed. Private streets shall
meet or exceed the design standards specified in Section 165-81 C. (2). Please provide the sheet design standards
on the site plan., including typical road and pavement details.
Response: We have provided the typical road and pavement details and their design have exceeded the requirements
set by Frederick County.
Comment 3: Rt. 522 Entrance. Please show the Rt. 522 enhance to be removed as part of this site plan.
Response: This entrance has been shown on sheet 2 of 9. For your information, please understand this work is being
performed with the school site plan.
Comment 4: Cul-de-sac Length. Please provide the length of the proposed cul-de-sac on the site plan. The
maximum length of the cul-de-sac in the MH 1 zoning district is 1,000 feet.
Response: The distance is less than 1000 feet and therefore Stub Street is not needed.

Comment 5: Landscaping. Please provide a landscaping plan detailing the location, species, and size of all
required/proposed plants. This includes either ornamental or street tree landscaping, phis landscaping required for
the road efficiency buffer and for any parking lots.
Response: We could not find any codes that suggest that landscaping is required for mobile home parks and
subdivisions.
Comment 6: Road Efficiency Buffer Along Future Major Collector Road. Please provide the required road
ejfciency buffer (inactive and active portions) along the future collector road to the south of the proposed location
and type.
Response: We have shown the inactive and active portions of the road efficiency buffers on our site plan. The
school site will be installing the berm and planting.
Conunuent 7: Recreational Units. Please provide at least one recreational unit for this development. Please show its
proposed location and type.
Response: A tot lot has been provided on unit 1 lot and its location is shown on sheet 2 of 9.
Comment 8: Signage. Please show the location of all proposed signs. This includes any location signs, directional
signs, entrance signs, and traff c safety signs. A stop sign should be provided an entrance to the fuuture collector.
Response: We have provided two stop signs for the proposed street and they are shown on site plan.
Comment 9: Setbacks. Please more detailed setback information. The following information needs to be stated on
the site plan: 1) no mobile home shall be place within twenty (20) feet of another, 2) the minimunn lot size shall be
4,000 square feet for each dwelling unit, 3) all dwelling units shall be located a mininnmu of twenty (20) feet from
any right-of-way and at least ten (ten) feet from parking lots, common areas, and sidewalks, and 4) all uses shall be
satisfy at least fifty (50) feet from the perimeter bounday.
Response: This statement has been added on our site plan.
Comment 10: Lot Dimensions. Please show lot dimensions for all proposed mobile hone lot areas. Regardless if
individual lot will actually be subdivided, each residential building lot must satisfy dimensional requirements.
Response: We have shown all dimensions and each lot area is more than 4000 square foot.
Comment 11: Common Space Requirements. Please provide information regarding the size of common areas. The
zoning ordinance requires that mobile home parks have at least 4, 000 square feet of common areas. Or 15% of the
total gross area. Also, show the location of all common areas.
Response: We have provided common areas of more than fifteen percent of the total acreage in the backyard lots
Conurent 12: Parking Calculations. Please provide parking calculations for all required spaces. Please also show
and label all spaces. Two (2) off-street parking spaces are required for each dwelling unit. 1f parking lot is
proposed, it Hurst meet all requirements for a parking lot, found in the Zoning Ordinance.
Response: We have provided two (2) paved parking spaces per mobile home unit.
Comment 13: Outdoor Trash Receptacles: Please show the locations of all proposed outdoor trash receptacles,
such as dumpsters or conunnuuity garbage can storage areas.
Response: Trash is individually collected twice a week. There is no community dumpster.

The Winchester Regional Airport Authority offers the following comments regarding the
proposed site plan for Shenandoah Mobile Court.
This site is located within the Airport's Part 77 surfaces therefore property owners may
ise from aircraft entering into or departing the flight pattern and as
the airport continues to expand services and operation, noise associated with such expansion
will likely increase.
Even though potential buyers may be aware of the airport's existence, they should be
forewarned about aircraft noise and fly -over nuisance from aircraft through a covenant in their
property deed, therefore we respectfully request the developer include such language to protect
current and future operations of the airport.
The Winchester Regional Airport has a direct and principal economic impact on our community
and is continually working towards expanding operations. To be successful in our ventures, we
need citizen support, which causes us concern regarding potential complaints about aircraft
noise.

Upon review of the subject site plan, we offer the following comments:
1) Provide all of the specified erosion and sediment control details on the plan.
Indicate inlet and outlet protection, reinforced silt fence, etc. Specify seeding
schedules in accordance with VESCH Standard 3.31 and 3.32.
2) It will be necessary to ensure that no units will be impacted by the post -developed
runoff from the proposed culverts. Grading will be required on the lots for units 5
and 6, 8 and 9, and 11, 12, and 13 to ensure that the structures will not be
impacted by a 100-year storm event.
Once theses comments have been addressed, submit two (2) copies of the site plan for
further review.

Re: Preliminary Review Comments for Shenandoah Mobile Court
Dear Mark:
The purpose of this letter is to provide you with review comments for the preliminary Shenandoah
Mobile Court site plan. This site plan proposes the development of the seven acres adjacent to the
existing Shenandoah Mobile Court as a mobile home park. As you are aware, the Board of
Supervisors approved the rezoning of this property to the MH1 zoning district on October 8, 2003.
The rezoning application included a proffer that the subject mobile home community shall not
exceed the maximum density of 20 units for the entire seven acres. Furthermore, the rezoning was
intended to allow for the relocation of mobile home units that would be displaced as part of the
construction of a new collector road. The development of the subject parcel must be consistent with
these conditions. In addition, each of the following comments must be satisfactorily addressed
before any development or placement of mobile homes on the subject site. Staff's review comments
are as follows:
1) Master Development Plan. A master development plan is required for the subdivision or
development of property within the MH 1 zoning district. Staff has reviewed the preliminary
documents previously provided and it appears that there is a potential for a waiver of the
master development plan requirement. The conditions for qualifying for a waiver to the
master development plan process are specified in Section 165-134 of the Frederick County
Zoning Ordinance. If it is your intent to pursue such a waiver, please submit a letter
requesting a waiver with the officially submitted site plan. The letter should effectively
describe why the proposed development qualifies for this waiver. Ultimately, administrative
approval of a master development plan waiver will be contingent on meeting all ordinance
conditions and consistency with the rezoning application.
2) Expansion of Private Streets. The expansion of the private streets in an existing mobile
home park may only occur with approval by the Planning Commission. Please be advised
that the site plan will be scheduled for review by the Planning Commission upon its formal

submission so this issue can be reviewed. Private streets shall meet or exceed the design
standards specified in Section 165-81 C. (2). Please provide the street design standards on
the site plan, including typical road and pavement details.
3) Rt. 522 Entrance. Please show the Rt. 522 entrance to be removed as part of this site plan.
4) Cul-de-sac Length. Please provide the length of the proposed cul-de-sac on the site plan.
The maximum length for a cul-de-sac in the MH1 zoning district is 1,000 feet.
5) Landscaping. Please provide a landscaping plan detailing the location, species, and size of
all required/proposed plants. This includes either ornamental or street tree landscaping, plus
landscaping required for the road efficiency buffer and for any parking lots.
6) Road Efficiency Buffer Along Future Major Collector Road. Please provide the required
road efficiency buffer (inactive and active portions) along the fixture collector road to the
south of the proposed development.
7) Recreational Units. Please provide at least one recreational unit for this development.
Please show its proposed location and type.
8) Signage. Please show the location of all proposed signs. This includes any location signs,
directional signs, entrance signs, and traffic safety signs. A stop sign should be provided at
the entrance to the future collector road.
9) Setbacks. Please provide more detailed setback information. The following infonnation
needs to be stated on the site plan: 1) no mobile home shall be placed within twenty (20) feet
of another, 2) the minimum lot size shall be 4,000 square feet for each dwelling unit, 3) all
dwelling units shall be located a minimum of twenty (20) feet from any right-of-way and at
least ten (10) feet from parking lots, common areas, and sidewalks, and 4) all uses shall be
setback at least fifty (50) feet from the perimeter boundary.
10) Lot Dimensions. Please show lot dimensions for all proposed mobile home lot areas.
Regardless if individual lots will actually be subdivided, each residential building lot must
satisfy dimensional requirements.
11) Common Space Requirements. Please provide information regarding the size of common
areas. The zoning ordinance requires that mobile home parks have at least 4,000 square feet
of common area or 15% of the total gross area. Also, show the location of all common areas.

12) Parking Calculations. Please provide parking calculations for all required parking spaces.
Please also show and label all spaces. Two (2) off-street parking spaces are required for each
dwelling unit. If a parking lot is proposed, it must meet all requirements for a parking lot,
found in the Zoning Ordinance.
13) Outdoor Trash Receptacles. Please show the location of all proposed outdoor trash
receptacles, such as dumpsters or community garbage can storage areas.
14) Outdoor Storage. Please provide a statement to the effect that there will be no outdoor
storage on the property.
15) Mailboxes. Please show the location of all proposed community mailboxes.
16) Stub Street. Please specify the intended use and relationship to adjoining parcels of the
proposed stub street.
17) Underground Utilities. Please provide a statement to the effect that all utility lines (ie.
electric, ivater, sewer, cable, gas, telephone) shall be located underground.
Please ensure that each of these review comments are adequately addressed prior to the submission
of the site plan. Staff reserves the right to comment further on the site plan upon submission. The
site plan application shall include a completed and signed application form, completed and signed
special power of attorney form (see attachment), application fee [$1,000.00 plus $50.00 per unit],
and all agency review comments. Agency review comments are required from the Fire Marshal,
Building Inspections, Public Works, Sanitation Authority, Parks & Recreation, Health Department,
School Board, and VDOT. This application is denied until the above issues are adequately
addressed.

Thank you for your letter elated December 9, 2003. We are aware that the site plan has not been approved
for the Shenandoah Mobile Court and therefore, building permits for occupancy arc not available to us. In
an effort to clearly indicate what we are trying to achieve to facilitate the quickest possible relocation of
trailers for construction of the new school road, we were attempting to place two new trailer units and have
them setup for transitional units in the future. At this time, these units are waiting to be delivered by
Wampler Homes. 'These units are not going to be occupied until the Spring of 2004 and we are not desiring
an occupancy permit for them. Therefore, we would appreciate it if you could research your Ordinance to
determine if we would be allowed to install them at this time and not have them occupied. We do not aced
utility services such as water, sewer, all(] electric. Our desire is just to place the units on their foundations.
Thank you for any assistance you may be able to give us through the flexibility of the Planning
Department. If there is not the capability to allow us to expedite the process, we fully understand and

On November 17, 2003 two building permits were applied for at the Frederick County Department of
Building and Inspections for new mobile homes at Shenandoah Mobile Courts. The lots for these new
mobile homes were designated as lots 58 and 59 and are proposed to be located in the area recently rezoned
by the Frederick County Board of Supervisors (rezoning #09-03). According to our records a Master
Development Plan and a Site Plan have not been approved by this department for this portion of the
Shenandoah Mobile Courts site.
In accordance with Section §165-133 of the Frederick County Zoning Ordinance, a Master Development
Plan(MDP) is required prior to any development in the MII1 Zoning District. Once a MDP has been
approved by this department, a Site Development Plan is required in accordance with section § 165-144(9)
of the Frederick County Zoning Ordinance. Building permits for this new section of Shenandoah Mobile
Courts will not be given zoning approval until a MDP and a site plan are approved by our department.

The Winchester Regional Airport Authority offers the following comments regarding the
proposed site plan for Shenandoah Mobile Court.
This site is located within the Airport's Part 77 surfaces therefore property owners may
is-6 from aircraft entering into or departing the flight pattern and as
the airport continues to expand services and operation, noise associated with such expansion
will likely increase.
Even though potential buyers may be aware of the airport's existence, they should be
forewarned about aircraft noise and fly -over nuisance from aircraft through a covenant in their
property deed, therefore we respectfully request the developer include such language to protect
current and future operations of the airport.
The Winchester Regional Airport has a direct and principal economic impact on our community
and is continually working towards expanding operations. To be successful in our ventures, we
need citizen support, which causes us concern regarding potential complaints about aircraft
noise.

The purpose of this letter is to request consideration of a waiver of the Master
Development Plan (MDP) for the relocation Of mobile home units from the existing
Shenandoah Mobile Home Court to a 7.09-acre area portion of Tax Map 76-((A))-1 that
was rezoned to MI-I-1, Mobile Home Community District by the Board of Supervisors On
October 8, 2003. A Generalized Development Plan (GDP) was used as an exhibit during
the rezoning process to demonstrate the proposed land use plan for this acreage. The
GDP demonstrated that the 7.09-acre area would be developed in a manner that is
harmoniOLIS with SLIrrounding properties and land Uses and that fLItLll-e development or
subdivision of the 7.09-acre area would not occur. Furthermore, a detailed Site
Development Plan has been prepared for the 7.09-acre portion of Tax Map 76-((A))-1,
which will be presented to the Planning Commission to ensure conformance with the
proffered GDP; therefore, a waiver Of the MDP would not substantially affect the purpose
and intent of the MI-I-1 District or Article XVIII of the Zoning Ordinance. We
respectfully request your approval of this waiver rcgLlcst aS provided for in Section 165-
134 Waivers of the Frederick County Zoning Ordinance.
